Chair Stem called the Regular Meeting to order at 9:30 AM in the Commission
Chambers. RoIl call was taken by Interim Deputy Town Clerk Rosalie DeMartino
followed by the Pledge ofAllegiance.

Chair Stern caled for a motion to accept the agenda as presentd.
MOTION: Member Clark moved to accept the agenda as presentd. Vice Cbair

Deputv Town Clerk Rosalie DeMantino swore-in all those who would testifr for
each item.

Staf s Presentation:
Michael Desorcv. Buildine Official - Mark Hamister is the owner of this property
and Stephen Little is the Architect/Engineer. The paperwork tbat was submitted to
the Building Department was reviewed for zoning code compliance, and I found no
issues. The proposed addition meets the setback requirements as well as the
building height re
Boerd's Questions:
Member Sventstruo - Is there no need for any variance with regard to this
application? B.O. Desorcv - There are no outstanding issues, and no need to take
this application to a different board.
Chair Stem asked if there were arry comments from the public.
Public Comments:
Debbie Muller. 2435 S. Ocean Blvd. - We have some landscaping issues with this
application as well as the safety and wellbeing of our Koi pond, which is next to the
side of the *all where the addition is going. I have had these fish for a very long
time, and they are very valuable to me. Mr. Hamister has caused some problems in
the past with his landscaping and construction, and he has not been cooperative
with my request to fix any of the damage he caused to my property. I want to go
on record that Mr. Hamister would be responsible for any damages to my property

or the Koi fish. B.O. Desorcy has informed me that he is following all the rules, but
I would like this Board to consider how it will affect us.
Member Svenstruo - You indicate how it will affect yorl but have you seen
anything in the plans that would affect you? Mrs. Muller - I have not seen the
plans, but I do know ttrey are building this addition next to our wall, which is my
concern.
Vice Chair Mendelson - Your statement tlat you wish to put on record is not with
the Planning Board. We have no authority ifhe destroys anything on your property.
This is a legal matter that should be put on record with your attorney and his
attomey tbat you will take legal action if he damages any of your property. Mrs.
Muller - If it should come to that I will prcduce these minutes to show my
objection to this addition. Let it be [a6eg1 rhat I have come to this Board and I
want what I said to be put on record.
Beverly Knieht Oce€n Estate Prop€rties - I have two listings tbat are on both sides
of this pmject. My concerns are the same as Mrs. Muller's concens. In the past I
have noted that construction trucks are always parked on the properties next to my
listing property, ruin the grass and make a great deal of mud. I then have to locate
the constuction workers to have them move these trucks. If this should happeA
Effigr than baving to do this myse[ who would I call? I believe the Town is
responsible for policing these construction sites. B.O. Desorcy - The contractor is
responsible, and the property owner is ultimately responsible. Chapter 12 of the
Zoning Ordinance addresses pa*ing, dumpsters, fencing and other construction
issues. Mr. tlamister has a very large piece of property, so I don't know if parking
will even be an issue. Vice Chair Mendelson - If there are cde violations of those
code sections, would it be a code enforcement issue? B.O. Desorcv - If it impacted
AlAu it would be controlled by the Police Department and also code enforcement.
Beverlv Kniqht - Is there a non-€mergency number for the Police Deparbnent if I
need to call them? Member Svenstrup - There is a non-emergency number you can
call during business hours.

Buildins Official Michael Desorcv - Mr. Roger Brown is owner/applicant of
subject property located at 4314 Tranquility Dr. The construction documents and
the plans submitted to the Building Department were reviewed for compliance with
the zoning code, and we formd that the proposed construction complies with all the
requirements of the zoning code in Chapter 30. Setbacks and building height
requirements have been me! and there are no outstanding issues with this property.
The contractor is Cudmore Construction.
Board Questions:
Member Svenstrup - Are there any issues with the docks? B.O. Desorcy - Those
issues have already been addressed by a different Board. Mr. Brown came before
the Board of Adjustnent for a variance to do something other than what the code
requirc4 and it was denied. There are no issues with the dock at this time.
Chair Stem - The house that was on the lot has already been dernolished. B.O.
Desorcy - That is correct. It is an empty lot.
Chair Stem asked if the public had any comments. None were received.

submitted to the Building Deparfnent for code compliarce, and no outstanding
issues exist. All the setback requirements and the building height requirements
have been met.
Applicant's Presentation:
Ralph Choeff. Princioal of Choeff. Lew. Fischmann Architects - We specialize in
tropical modern axchitectue and would like to introduce this type of architecture to
Highland Beach. Mr. Choeff described the home and the type of materials being
used. A rendering of the home was placed before the board members for their
viewing.
Board Questions:
Chair Stem - Are you tearing down the existing home on this property? Mr. Choeff
- Yes.
Mernber Svenstrup - Since the back of the home is all glass windows and doors,
will there be any exterior patios or axeas on the second and third floor where they
will open. Mr. Choeff - There are rear balconies on the second floor. The third
floor is a roofterrace, which will only have windows for a clear view of the ocean.

- The construction is post tension.
