WORKSHOP MEETING
Tuesday, July 26, 2016 1:30 PM
Mayor Bernard Featherman called the Workshop Meeting to order in the Town Commission
Chambers at 1:30 PM.
CALL TO ORDER:
Roll Call: Members present: Mayor Bernard Featherman; Vice Mayor William Weitz, Ph.D;
Commissioner Carl Feldman; Commissioner Louis P. Stern; and Commissioner Rhoda
Zelniker. Also present: Town Attorney Glen Torcivia; Town Manager Beverly Brown; Town
Clerk Valerie Oakes; Finance Director Cale Curtis; Public Works Director Ed Soper; Library
Director Lois Albertson; Building Official Michael Desorcy and members of the public.
Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence.
Civility Pledge: The Civility Pledge was recited by the Town Clerk.
1. ADDITIONS,DELETIONS OR ACCEPTANCE OF AGENDA:
Mayor Featherman called for any additions or deletions to the agenda.
Item 6C — Vice Mayor Weitz added a discussion regarding cost analysis data on the
insurance stipends.
Item 6D—Vice Mayor Weitz added a discussion regarding the Zika virus.
Item 6E—Commissioner Feldman added a discussion on the draft incentive memo.
Hearing no further additions or deletions,the agenda was accepted as amended.
2. PUBLIC COMMENTS AND REOUESTS:
Tim Burnich, 4505 S. Ocean Blvd. — Governments are formed both local, state and federal
to provide certain services for residents for non-profit. I am concerned about a corporation
handling our Building Department because they are a company that is for profit. I am also
concerned as Chairman of the Code Enforcement Board that we have not had any cases

submitted to us in almost two years. One of the reasons that we don't see anything brought
before the Code Enforcement Board is that it is time consuming for the Building Inspector
and the Code Enforcement Officer, and it is not profitable. My other issue is that I don't
believe in privatizing government functions for any reason. With regard to the Town
Manager's memo of July 11 t', I am well aware of the responsibilities and how the code
enforcement works. The Building Inspector or the Code Enforcement Officer issues a
citation if they spot a code violation. If the violation isn't corrected, it is to be sent forward
to the Code Enforcement Board and that doesn't seem to happen. It seems that the Building
Official or the Code Enforcement Officer negotiates with the people, and they supposedly
solve the problem all by themselves. We have corporate employees making subjective
decisions that should be made by the seven members of the Code Enforcement Board that
are taxpaying people in this town. I hope that you would consider taking the Building
Inspector and Code Enforcement Inspector out of a private company and bring it back into
the employment of the Town.
Josh McAlees, developer for 3621 S. Ocean Blvd. —There is an agenda item that pertains to
a change to the temporary fence signing code. Regarding our fence for the construction on
the property, we are trying to be good neighbors. We mirrored what the 3200 project did as
far as a printed windscreen on the front of the site. We also spent additional money to put
up brand new shiny silver construction fencing. I understand that the printed windscreen
was a bit much since we do have a large amount of frontage on this property. We did have a
good amount of phone calls regarding the type of homes that were being constructed. I was
hoping that we could come to some type of compromise and consideration that would allow
a certain amount of linear footage to have a printed picture on the windscreen.
Peggy Gossett Seidman, 4312 Intracoastal Dr. — I understand at the last meeting it was
brought up that I had a memo stating that Town Officials instructed me not to talk to the
Commission. I want to clarify that this was brought up because we had so many code
violations on our street, and I was getting calls from people, and I expressed a desire to a
few Town Officials that it was too much. They told me to send it to them, and they would
take care of it. There was no intention of impeding any kind of communication. Back in
1999 the former Building Official, Bob Dawson, shut down a job based on a report from
Police Officer Mitch Reiger due to many code violations. This is the type of response the
residents would like to see. The problems on our street and the code violations do not stop.
Mayor Featherman—I wish we had more people like you reporting these problems. We are
not getting the service that we should get for our residents to protect them. Our attorney
told us that we have no power to initiate enforcement proceedings. We can change things
by having the Code Enforcement Officer issue a citation with a copy going to our Code
Enforcement Board. Mrs. Seidman— I have told the Code Enforcement Officer that I have
picked up the nails and pieces of metal in our street because I can't wait for him to come. I
don't want anyone getting hurt. There needs to be a type of code that would have
immediate response and these people should be fined. Mayor Featherman — I agree that a
citation should be issued immediately and given to the Chairman of the Code Enforcement
Board. If they don't comply within the five days, they should be fined. Mrs. Seidman — It
would be helpful if you could have evening meetings to discuss this so the working people
could attend.

Vice Mayor Weitz — This item is on the agenda, and there is no need to discuss this during
public comments.
Commissioner Feldman — I have prepared a report for you, which is a list of all the
inspections, and you will see a lot of work has been done. I personally go through Bel Lido
a few times a day as well as the Police Department, Code Enforcement Officer and the
Town Manager. Mrs. Seidman — I understand everyone is trying to do their best. There
should not be a five-day period to correct a problem; especially when there are nails in the
road. They should be fined immediately.

Town Clerk Oakes — Received Form 8B from Commissioner Stern who abstained
from voting and disclosed that it inured to the special gain or loss of his wife, Carol
Stern, as she was appointed as a member of the Beaches & Shores Advisory Board
(form attached hereto as `Exhibit A').

Town Manager Brown—This ordinance is scheduled for a second reading and adoption
on August 2nd. The proposed ordinance was developed by FEMA and we are required
to enact it to coordinate for our floodplain management regulations with the Florida
Building Code.

FENCES" TO PROVIDE THAT ALL FENCING OF CONSTRUCTION SITES
MUST BE GREEN OR BLACK IN COLOR WITH NO ARTWORK OR
SIGNAGE AFFIXED TO THE FENCE; PROVIDING FOR CODIFICATION;

Town Manager Brown — Per the request of the Town Commission, this ordinance is
presented to you to eliminate artwork on the fencing and to provide that it is only black
or green.
Commission Discussion:
Comm. Feldman — I agree with the changes. In response to Mr. McAlees request, if a
developer wants to sell his property, there are other means to do so. It is called
advertising in the newspaper. This was brought forth because of 3200 South Ocean
Blvd.. My answer to that is two wrongs don't make a right. This can't continue
because there is a great deal of development going on, especially in Bel Lido, and there
would be advertising everywhere.
Comm. Stern — The windscreen at 3200 South Ocean Blvd. was incorrect. It did not
help their sales, which were very slow.
Vice Mayor Weitz — There has always been some type of architectural drawing on
display. I can understand a developer making an investment in this town wanting to
entice a potential buyer by showing the type of architect that is being built. However, I
can see the need for this Town to maintain some sense of purity. I am concerned about
how many times an issue comes up and this Commission is constantly revising
ordinances. We should be looking at having people review the general issues in the
Town, review them and make recommendations to us and going from there.
Comm. Zelniker—Our ordinances are not being enforced the way we would like. I also
agree that the best way to advertise the property at 3621 S. Ocean Blvd. is on the web.
Mayor Featherman —I also agree that we need to adhere to our codes. A copy of code
violations should be sent to our Code Enforcement Board for their review. We need to
take a firm hand and make corrections immediately.

Town Manager Brown — I provided the Commission with the facts and figures and
what the Town code says and what the state law says on the procedure of code
enforcement. We have to follow those procedures.
Comm. Stern— The code enforcement assistant has presented us with a printout. Over
the last three months there were over 50 violations, all of which were closed within a
timely manner of five days. You can't ask for more than that.
Comm. Feldman—Each contractor is given a packet of what is expected of them when
they get their permits.
Consensus was to place Ordinance No. 16-010 O on the August 2nd agenda for a first
reading.
6. NEW BUSINESS:
A) Commission to Authorize the Town Manager to Execute the Task Order
Described Herein by Issuing a Purchasing Requisition to Globaltech, Inc. in
Accordance with Town Purchasing Policies
Town Manager Brown—The SCADA(Supervisory Control & Data Acquisition) is the
computer system that monitors, controls, acquires and processes data at the Water
Treatment Plant. The existing system is over 12 years old and in need of an upgrade
to ensure its reliability, future compatibility and to retain the capability of keeping the
facility operational. It is recommended that because of their familiarity, experience
and knowledge of the Town's Water Treatment Facility that Globaltech, Inc. be
allowed to utilize their designated subcontractor, Control Systems Designs, Inc. to
accomplish this critical upgrade. This task order would be issued in accordance with
the Agreement for Professional Services between the Town and Globaltech, Inc. which
was executed on April 5, 2016. $70,000 has been allocated for this project. The
amount of this task order#1 is $31,896.
Comm. Feldman — Will this system work with the new calcification equipment and
what does it do? Public Works Director Soper — When they hook up this new
equipment, you will need a more powerful and faster computer system to run this
equipment. We want to do this before, so there will be no issues. The existing system
is obsolete. We consider this a critical upgrade. Training on the new system for both
the water plant operators, who would have primary responsibility, and public works
personnel will be provided by Globaltech through their subcontractor. Comm.
Feldman — What would the total cost of the package be including training, computers,
hardware and software, etc.? PWD Soper—We appropriated $70,000 in the budget. I
believe it will come $10,000 under budget.

B) Discussion on Electric Vehicle Charging Station (EV)
Town Manager Brown — I did extensive research on this. Even though Boca Raton
and Delray Beach have these systems, they are owned by the town. In Delray Beach, a
resident is picking up the bill. The key considerations are as follows: 1) visibility and
the lighting; 2) proximity to the power source; 3) parking and space size; 4) weather
and climate; 5) ADA accessible; 6)maintenance problem and 7) fee structure.
Commission Discussion:
Vice Mayor Weitz —None of our town vehicles are electric. I am guessing that there
are very few vehicles in this town that would utilize this service. Given the kinds of
things that would be required to do including liability issues, I am not sure that the
Town needs to pursue this at this time.
Comm. Zelniker — I believe in being prepared for the future, and Highland Beach
should be part of the future. There are companies that come in that set the chargers up
and take the liability.
Comm. Feldman — I feel that an electric charging station paid for by the Town is
subsidizing an individual. Homeowners and condominiums can put in their own
charging station if they feel that strongly about it.
Comm. Stem—This is something we should consider in the future, but I don't feel it is
something we need to do at this time.
Vice Mayor Weitz—I also believe that it should be considered in the future, but not at
this time.
C) Discussion on Zika Virus
Vice Mayor Weitz—It was my understanding that the Zika Virus was contracted from
another country and brought back into this country. I have also learned that there have
been some cases of people contracting this in our State. The Federal government is
providing significant amounts of monies to the State of Florida to try to prevent the
spread of this disease. My request is that we speak up directly as a community in a
barrier island with lots of moisture and water in the area. I want to make a significant
and direct request, appropriately through letter and directly to the State, from this
Commission and the Town Manager, to ensure what their plans are in dealing with this
issue, and we want Highland Beach to get its fair share.
Comm. Zelniker — I had a conversation with our Town Manager who looked into this
issue for me. I believe the County said that each municipality was responsible for
their own spraying. Town Manager Brown — I contacted the County and they said

they would come down, and if we had a problem they would spray for us and pay for
the spraying, not us. Comm. Zelniker — We could also look into the environmental
agencies to see what we could do to prevent this problem.
Comm. Stern — I read a headline that indicated Congress did nothing to solve this
problem. I also read that Zika is no longer an epidemic. If the County is willing to
spray if we have a problem, I think that is as far as we can go with it.
Comm. Feldman—There is very little we can do but if they are willing to spray that is
a good thing.
D) Discussion on Deferred Compensation
Vice Mayor Weitz — I received a cost analysis for the stipend for individuals with
respect to the insurance program from Finance Director Curtis. Is the Police
Department included in this analysis? Fin. Dir. Curtis— The employees listed include
union and non-union members. The ones listed are employees that have received a
stipend or have employee only coverage. Anyone that has dependents are not
included. Vice Mayor Weitz — There are 21 employees on this list. In the years
between 2012 and 2016, only one-third of the individuals receiving stipends would
even qualify as individuals that would have the family members to potentially switch
to the Town's health insurance policy. Two thirds of these employees are receiving a
benefit that have no qualification for individuals who fall within that framework. This
insurance stipend has nothing to do with healthcare. I have never seen this item voted
on by any Town Commission, and it is an unauthorized expenditure that has been
included in this health benefit sheet. This is not a health benefit. It is a payroll
supplement, and it goes into a retirement fund so the employee doesn't pay taxes. We
are paying anywhere from $2,000 to $5,000 a year as a payroll supplement. This is
wrong. This program was implemented years ago when health cost were low. This is
an item that has to be independently considered and authorized, and we vote up or
down on how we want to implement it.
Comm. Feldman — We are having a meeting on personnel rules and regulations and
this topic should be discussed at that time and also at a budget meeting.
Comm. Stern — Do we know if this was authorized by a former Commission years
ago? Town Manager Brown— It is part of the personnel rules and regulations. It was
put in by a former Commission. I will have to investigate it further and present it at
the next meeting.
E) Discussion on Draft Incentive Memo
Comm. Feldman — Before we can go any further with this, we should ask a
representative from the Town Commission to serve on the productive board as there

will be more discussions between the Finance Director and the Town Manager. I
would like to propose Vice Mayor Weitz to serve on that board representing the
Commission since he does have so much input on employee relations, etc. Vice
Mayor Weitz accepted.
F) Review of Code Enforcement Officer—SAFEbuilt Florida, LLC
Town Manager Brown—At the Commission's request, SAFEbuilt provided the Town
with a part-time Code Enforcement Officer. His hours vary from week-to-week, so
that he is making inspections in the evening, after construction hours and on
Saturdays. With his irregular timed inspections, the contractors can never become
complacent. He has monitored areas and sites of concerns that the Commission and
residents have felt were not adequately being addressed. During his inspections he has
also found work being done without a permit and it was stopped immediately. I
shared the code enforcement tracking program that we use with the Commission
which shows the date, address, the violation, code section, follow up date, date closed
and what has been transpired.
Commission Discussion:
Comm. Feldman — Was the report done by the SAFEbuilt employee? Town Manager
Brown — Yes. On the days that he is not here, Carol Holland does the follow-up for
him. Comm. Feldman—I would like to receive a report from her on the days that she
does code enforcement.
Comm. Zelniker— I broke down the number of violations on each street listed on the
code enforcement tracking report. According to the memo given to us by the Town
Manager, if there is a repeat violation, the Code Enforcement Officer shall notify the
Code Enforcement Board and request a hearing. This should be brought to the Code
Enforcement Board, and they should be issued a fine. There are no fines in this town.
We definitely need to do something with the code enforcement.
Town Attorney Torcivia— Until the Code Enforcement Board finds the person guilty,
it is not a violation yet, it is an accusation. Mayor Featherman — I still feel the Code
Enforcement Board should be notified immediately when there is a violation.
G) Commission to Authorize the Mayor to Sign the Professional Services Agreement
between the Town of Highland Beach and SAFEbuilt Florida,LLC for one year
Town Manager Brown — Since 2008, the Town has engaged with an outside firm to
provide professional services for building official and inspection services. This
ongoing agreement was originally with Independent Inspectors, Ltd., but last year the
business was acquired by SAFEbuilt, Florida LLC. At that time, the Town determined
that they would like to continue this type of service and signed a one-year agreement

that included three one year options. This agreement also includes a thirty (30) day
termination notice on the part of either party with or without cause. The one-year term
expires at the beginning of August.
Commission Discussion:
Comm. Feldman — We are getting great work out of the Building Official, Mike
Desorcy. I don't feel we could do any better hiring on our own, and I don't see the
benefit in doing so. The problems we are having are with code enforcement.
Comm. Stern—There was a period of time when we had an in-house Building Official
and a Code Enforcement Officer. I was not in favor of outsourcing our Building
Official,but I was proven wrong. This outside service has absolutely covered our base
on many occasions. If the Building Official is out for any reason, the company
supplies us with someone the same day. Looking over the cost analysis, it is to our
advantage that we stay with an outside source. I feel that in addition to this Building
Official, we could use a full time Code Enforcement Officer from this company and
not a part-time one that comes in three days a week. I am looking out for our
residents. If this is not a possibility, perhaps we can hire our own full-time code
enforcement person who would report to the Town Manager or the Police Department.
Vice Mayor Weitz—I never understand why we have an entire town of employees and
one person outsourced. I don't agree with this cost analysis. We have many projects
going on in this town. I think it is dangerous to say that we are going to make this
decision because we can project that the amount of money they are going to make is
going to get lower. When you don't have control over personnel, you are not able to
enforce certain things. Is there a certain certification needed to be hired for the code
enforcement position and do our people have that? Comm. Feldman — Yes they do.
Vice Mayor Weitz—Why is it then that there has not been a fine issued within the last
year and one-half especially when there is so much construction going on? We have a
problem and bringing in a full-time code enforcement inspector is a good idea.
Comm. Zelniker— We have had between 65 and 75 emails from residents in Bel Lido
asking for code enforcement to take care of certain issues occurring on these
construction sites. They should not have to contact us for code enforcement. There is
something wrong when there are this many emails being sent to the Town
Commission. I went to Bel Lido and saw the dumpster that one of the residents was
complaining about. It has been there for months. I am not in favor of signing any
contracts at this time. I feel we need more time to review this contract since it was just
given to us. We have to come up with an answer.
Vice Mayor Weitz —We need to look into automating our Building Department to cut
down on physical labor, issuing permits, scheduling and paperwork. This is cost
savings for our Town.

Comm. Feldman — I know of nobody that was held up on a project because they
couldn't get a permit. Our permits and inspections are given within a reasonable
amount of time. There is no way we can improve that. This agenda item, which we
are voting on today, is for the SAFEbuilt contract for the Building Inspector and not
the code enforcement inspector. It makes no sense to computerize a department for a
small town like Highland Beach.
Comm. Stern— We do get our permits and follow-ups very quickly. If we do not sign
this contract today, you will put this whole town in jeopardy. This is not the first time
we have seen this contract. We have had the same identical wording over the last two
years. If we do not sign this contract, then all building in this town will stop until we
hire the necessary people to take over. There is a 30-day option clause that we must
adhere to.
Town Manager Brown — Regarding the dumpster Comm. Zelniker was referring to in
Bel Lido, those residents have an active permit and as long as they have an open active
permit, we cannot make them take the dumpster away. A statement was made that
there are no fines issued. When the Building Official goes out and finds that there is
no permit, the fee is doubled when they do come in to apply for that permit. There are
penalties in the Building Department. It is just the Code Enforcement Board that have
not met. There are permit applications online that can be filled out and submitted
electronically. There would be a cost of$6,000 per month if we were to put all the
applications on the internet. It is taking three to four months to obtain a permit in
Boca Raton and Delray Beach. We have a Building Official for five days a week plus
a code enforcement inspector three days a week. We have a 30-day opt, so if you are
still not satisfied we can give them a 30-day notice. It is not going to be easy to find
someone who is as qualified as Mike Desorcy. I know there have been problems in
Bel Lido, but there have been so many non-related construction complaints also.

B) Commissioner Carl Feldman — I have been an advocate of being able to reach our
Police Department 24/7, after 4:30 PM and on Saturdays and Sundays. I met with
Chief Hartmann who agrees, and we have been informed that they can. There is an
after hour's number for the Police Department. You can call that number and request a

10. REPORTS—TOWN MANAGER BEVERLY BROWN:
• Update on the Strategic Plan:
The Strategic Plan is on the agenda for the Commission to review and make
modifications. Consensus was to discuss this item further at the next workshop meeting.
• Other Updates:
o The carpeting at the Library will be installed starting next Monday.
o As the Commission voted in favor of the Infrastructure Sales Tax Referendum, we
will need to create a citizen oversight committee. If the referendum passes, each
municipality will be required to have a citizen oversight committee, which shall
review the municipality's expenditure of the surtax proceeds. The Commission has
the option to use the County's oversight committee.
o Last week one of our rescue vehicles parked on the street because they did not have
the code to the gate to get into one of the condominiums. They have some codes but
not all of the codes to the gated communities in the town. Police Chief Hartmann,

the Fire Chief and I had a meeting and decided it would be a good idea to have a
Knox Box on the gate. There was an incident on AIA and the police were not
notified. We will have a meeting with the County, and the next time a rescue vehicle
is sent out the police will also be sent out. If the Police Department also wants a
Knox Box,they will have to have a separate one from the Fire Department because it
is a law that you can't have the same key. I will be sending a letter to all the multi-
family units to see if they would consider putting in the Knox Box.
11. PUBLIC COMMENTS AND REQUESTS RELATED TO AGENDA ITEMS
DISCUSSED AT MEETING ONLY:
Carl Gehman, 1123 Highland Beach Drive — I would like to commend Carol Holland on
code enforcement. Also, Mike Desorcy because he does a great job. Carl Gehman asked
about State and Town ordinances and which take preference. Town Attorney Torcivia
explained the process.
George Kelvin—4740 S. Ocean Blvd. —When a Building Inspector comes to a site and sees
imminent danger, he can shut down the site immediately. What about potential danger.
Town Attorney Torcivia — He has to make that judgement call. George Kelvin — I believe
that shutting down the site would be more meaningful then giving out fines to these builders
as a punishment for violating the code.
Peggy Gossett Seidman, 4312 Intracoastal Drive showed a bag of debris picked up on her
street. If we have a problem with a neighbor, we speak with that person. If it is a problem
with a builder, we come to you.
