1980.08.26_TC_Minutes_Workshop TOWN OF HIGHLAND BEACH, FLORIDA • Minutes of Meeting of Town Commission Workshop Meeting Auctust 26, 1980 9:30 A.M. Mayor Horton called the Workshop Meeting to order at 9:30 A.M. Those Commissioners present were: Mayor Louis Y. Horton, Vice Mayor Harold C. Storm and Commissioners Mary Louise G. Blosser and John J. Basso. Commissioner Genovese was absent. Also in attendance were: Elaine W. Roberts, Town Manager; Thomas E. Sliney, Town Attorney and Jane E. Barker, Town Clerk. Mayor Horton explained for Commissioner Basso's information just how the Commission-Manager type of government worked, stating that each Commissioner has one main area of interest, Mrs. Roberts informed Commissioner Basso that the Town Staff was here to help him as well as other Commissioners. Mr. Sliney said that he was available for any Commissioner to talk to. • 79.76 Status of S. A. Healy Co. Inasmuch as Representative Jim Watt had not arrived, the Commission proceeded with the first item on the agenda - the S. A. Healy Co. Mr. Sliney stated that he had given a Unity of Title to the Healy people based on what Commissioner Genovese had drawn up plus some additions of his own. This matter was discussed at great length. At this point in time, Representative Watt spoke to the Commission, saying how delighted he was to be here again. He talked about the various items he had on his "Watt-Line" Legislative Report 1980 Campaign Edition, all of which was most interesting. Mayor Horton asked some questions about the possibility of Public Safety Department certification and Vice Mayor Storm asked about the "Education" bill. The newly formed Code Enforcement Board was discussed as well. Representative • Watt left at 10:25 A.M. Minutes Highland Beach • Town Commission Workshop Meeting August 26, 1980 80.34 Proposed Ordinances Page 2 of 7 (a) Proposed Ordinance No. 382 - An ordinance of the Town of Highland Beach, Florida, to amend Chapter 2, Article V, Community Appearance Board, of the Code of Ordinances of the Town of Highland Beach, Florida. (b) Proposed Ordinance No. 387 - An ordinance of the Town Commission of the Town of Highland Beach, Florida, amending Chapter 25, entitled "Subdivisions" of the Code of Ordinances of the Town of Highland Beach, Florida. After some discussion, it was the consensus of the Commission to delete both of these ordinances completely. 80.40 Purchase of Sewage System • Mayor Horton stated that he would be meeting with Mr. Schanz of the Gulfstream Bank this afternoon regarding the bond issue for the purchase of the Sewage System. A Proposed ~~ Resolution from Bond Counsel will hopefully be received by this Friday (August 29th). Mrs. Roberts verified that the Resolution from Bond Counsel and the Unity of Title for Healy Co. would be shown on the agenda for the Regular Meeting on September 2, 1980. 80.42 Proposed Ordinances (a) Proposed Ordinance No. - An ordinance of the Town of Highland Beach, Florida, to amend Zoning Code, Chapter 30, Section 5.3(e) of the Code of Ordinances of the Town of Highland Beach, Florida; "Noncommercial Docks, Piers, Launching Facilities and Mooring Devices". Mayor Horton discussed the ideas submitted by Mr. M. H. W. Dent, a Town resident. Mr. Sliney suggested that this ordinance be tabled until the • September 30, 1980 Workshop Meeting. Minutes Highland Beach • Town Commission Workshop Meeting August 26, 1980 Page 3 of 7 (b) Proposed Ordinance No. - An ordinance of the Town of Highland Beach, Florida, amending the Town of Highland Beach Sewer Franchise Agreement providing for the retention of the sewer connection fees by the Town of Highland Beach pending revenue bonds to purchase the sewage system and court validation and sale of the revenue bonds. Mayor Horton stated that this ordinance would come up for final reading and possible adoption at the Regular Meeting on September 2, 1980. 80.43 Proposed Ordinances Mayor Horton stated that inasmuch as Mr. Tom Gullett was in the audience and waiting to talk about the Cable TV ordinance, Proposed Ordinance No. - Cable TV Franchise (Item (b) ) was brought up next. • Mrs. Roberts explained the intent of her memo re: Cable TV, which had been distributed to the Commission, along with a copy of a letter from Mr. Ray Blosser containing his thoughts on this matter. Mr. Gullett spoke re: Cable TV. Mayor Horton asked him about the 75' tower and how much land would be needed for the base and building. There was considerable discussion on the cable TV matter. (a) Proposed Ordinance No. - An ordinance of the Town of Highland Beach, Florida, amending. Ordinance No. 366 which appropriated funds for the Fiscal Year 1979-80 which began October 1, 1979 and will end September 30, 1980. Mayor Horton explained, for the benefit of the new Commissioner, that the State of Florida requires the Budget to be amended at the end of the fiscal year to take care of discrepancies from the Budget as originally adopted. Mrs. Roberts then explained the figures in detail on the Revenue • and Expenditures Amendments. (c) Proposed Ordinance No. amending the Zoning Code of of Highland Beach, Florida, adding New Sections 3.2 and Time-Share Estates and Time - An ordinance of the Town of Highland Beach, Florida, the Code of Ordinances of the Town Chapter 30, Section 5.2(a) and 13.33, regarding prohibition of -Share Units. This ordinance could have a first reading at the Regular Meeting on September 2nd. Discussion took place with Dick Raab regarding the height of his proposed fence (or wall). Mayor Horton asked if the fact. that their plans were submitted last December - and now an ordinance might be passed limiting the height of fences, walls and hedges - would this apply to them? • Dick Raab spoke re: his seawall and grade beam work. He stated that he would hate to have to wait or be held up on this until the Unity of Title is straightened out. Mayor Horton stated that the Unity of Title matter will come up for discussion next week and that this item had no connection to the "height limits" and "time-share estate". After further discussion on the proposed .new sections on "Time- share Estates", it was decided to have this ordinance come up for more discussion at the Workshop Meeting on September 30th. Mrs. Roberts stated that $110,000 from the General Fund Savings Account had been invested yesterday at 104°/ for 30 days. 80.44 Vacancies on Various Boards (a) Planning Commission - Mrs. Roberts stated that Mr. Edward Sullivan was recommended to be appointed as a Regular Member to this Board inasmuch as Mr. Orville Edlund had missed three meetings in a row and is automatically out. (b) Housing Board of Adj. & Appeals - Mr. Theodore Boepple has • been recommended as Alternate No. 2. Minutes Highland Beach Town Commission • Workshop Meeting August 26, 1980 Page 5 of 7 (c) Community Appearance Board - Mr. Dominick Conte has been invited to attend the Regular Meeting of this Board on August 28th. Town Manager Reports Mrs. Roberts stated that some of the newspaper machines at the youth end of Town had been moved because of many complaints received concerning the safety of people when the cars drive across the bike path. Also, residents of Bel Air Drive want to beautify the entrance to their street from AlA. The Massengill property matter came before the Code Enforcement Board last week and a citation was issued by Mrs. Roberts based on the Nuisance Ordinance. This citation was sent to their attorney in West Palm Beach; Mr. Sliney also wrote a letter to their attorney. Several residents of Boca Cove are very unhappy about this situation and came before the Code Enforcement Board last week to air their complaints and request assistance. Mrs. Roberts stated that the Capital Improvements Program, which had been given to the Town Commission, had been approved by the Planning Commission and they will be holding public hearings and will also be sending a letter of transmittal to the Town Commission. Copies of this Capital Improvements plan were also given to the Financial Advisory Board. Mrs. Roberts asked the Commission to study this plan and make recommendations. Mrs. Roberts reported that the Municipal Building plans had been approved by the Planning Commission last week and will come up for approval at the Community Appearance Board meeting August 28th. There is no landscape plan, Mrs. Roberts stated, but hopefully, they will let us delay that. Mayor Horton will be attending this meeting inasmuch as Mrs. Roberts will be out of Town. Mrs. Roberts stated that the Van Lennep property had been sold August 11th but did not know the name of the new owner. Mrs. Roberts stated that notification had been received that can be filled out for more Local Government Comprehensive Planning Act monies. The deadline is August 29th and Mrs. Roberts said n Minutes Highland Beach . Mayor Horton brought up the subject of the Town Hall sign in front and the possibility of removing it and replacing it with a new sign, which could be moved, if necessary, after the new building is constructed. Mrs. Roberts stated that the Community Appearance Board will review an application for a permanent sign, as well as the new building, at their meeting on August 28th. • Mayor Horton stated that the water rates will need to be increased due to the fact that we will need additional help when the water plant expansion is complete. An ordinance will be drawn up to raise the base rate from .414 to .464 per thousand gallons, and the next step amount would change from .504 to .604 per thousand gallons. This change would be effective September 29, 1980. Vice Mayor Storm said he read in the newspapers that the Delray-Boynton sewer system is going to have a sizeable increase in their rates, and asked how this would affect Highland Beach. Mrs. Roberts stated that she had been in touch with the prin- cipals in Delray Beach for months, trying to find out how the whole plant would affect Highland Beach. Correspondence had been put on the clipboard pertaining to this. Mayor Horton said the only thing we could do was to "sit tight". Mr. Dick Raab asked about the ordinance concerning his wall and gatehouse. There was some discussion on this and Mayor Horton stated that this will be discussed again at the Workshop Meeting on September 30th and the whole package could be under Special Exception.
