1979.03.06_TC_Minutes_Special~ r TOWN OF HIGHLAND BEACH, FLO~tIDA • Minutes of Meeting of Town Commission Public Hearing March 6, 1979 1.30 P M Mayor Horton called the Public Hearing, as advertised in the Boca Raton News on February 18, 1979, to order at 1:30 P.M. In attendance were: Mayor Horton, Vice Mayor Mumford, Commissioners Bauer and Genovese. Commissioner Storm was absent. Also in attendance were: Mrs. Elaine W. Roberts, Town Manager, Thomas E. Sliney, Town Attorney, Police Chief Kenneth Jones, and Jane E. Barker, Town Clerk. Many residents were in the audience. The purpose of this Public Hearing was for consideration of Proposed Ordinance No. 347 - An Ordinance of the Town of Highland Beach, Florida amending Ordinance No. 228 as regards the Braemer Isle Section of the Boca Hi RPUD. .Mayor Horton then read for the record a memo from Joseph Boscove, Chairman of the Planning Commission, Local Planning Agency, addressed to the Mayor and members of the Town Commission. • Ordinance No. 347 was then read in its entirety by the Town Clerk. Mayor Horton announced that inasmuch as this was a Public Hearing the Commission would hear from the Petitioner first and then comments would be invited. Mr. Thomas Delaney addressed the Commission and residents, explaining the Boca Hi RPUD using charts showing the original RPUD and the pro- posed changes. There were several questions and comments from the audience. Mr. Twitty, of Schwab and Twitty Architects, then addressed the group and explained the changes for the benefit of every one. Much discussion took place among the Commissioners, the Town residents, Mrs. Roberts and Mr. Delaney. Some of the residents who spoke were: Mr. Dent, Mr. Losee, Mr. Shifman, Mrs. Louise Johnson, Mr. Gilday, the Garrisons, Dr. Sonking and Mr. Kemper. Mayor Horton asked if there were any more comments from the floor. Being none, Commissioner Bauer stated that over the years, serious • changes have been made in the Boca Hi RPUD. Commissioner Bauer feels that this is a major change, along with the additional units in the tower building. Mr. Delaney then replied to Commissioner Bauer's statements. Vice Mayor Mumford and Commissioner Genovese then gave their views on the matter in great detail. Mayor Horton then explained for the benefit of all that originally Boca Hi, when they applied for their RPUD, came into the matter with a lesser density than the law allowed. Mayor Horton, after Mr. Sliney explained legal points, stated that the Town Commission had three alternatives; one; deny the application which means that the original building would be built, second; if the Commission goes along with the recommendation of the Planning Com- mission, the new building could then be built; or possibly a compromise could be reached. • Commissioner Genovese made the MOTION that the petition be denied. Vice Mayor Mumford asked what the compromise would be? Commissioner Bauer SECONDED the MOTION that the petition be denied if no alterna- tives can be reached. Discussion took place with Mayor Horton stating that he would like to see this Public Hearing recessed and in the interim, see if something could be worked out. Commissioner Genovese then withdrew his MOTION, with Commissioner Bauer withdrawing his seconding, stating he would like the benefit of Commissioner Storm's thoughts on the matter. After further dissertation, a MOTION was made by Commissioner Genovese that Commissioner Bauer be appointed to meet with the members of the Boca Hi staff and Mr. Twitty, with this meeting being recessed until 1:30 P. M. on Tuesday, March 13, 1979. Vice Mayor Mumford seconded this MOTION. Mrs. Roberts ascertained that this meeting need not be advertised again.
