1979.03.13_TC_Minutes_Special• TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Recessed Public Hearing from March 6, 1979 March 13, 1979 1.30 P M Mayor Horton called the Recessed Public Hearing to order at 1:30 P.M. This Public Hearing was recessed from March 6th and had been adver- tised in the Boca News on February 18, 1979. In attendance were: Bauer, Genovese and Roberts, Town Manage Jones and Mrs. Jane Mr. Richard Rodgers Twitty, Architects, in the audience. Mayor Horton, Vice Mayor Mumford, Commissioners Storm. Also in attendance were: Mrs. Elaine W. ar, Thomas E. Sliney, Town Attorney, Chief Kenneth E. Barker, Town Clerk. Mr. Thomas Delaney and of Boca Hi, as well as Mr. Twitty of Schwab & were also present. There were a great many people Mayor Horton then turned the meeting over to Commissioner Bauer, who had been appointed at the Public Hearing on March 6th to meet with the Boca Hi people, to see if a compromise could be reached. Commissioner Bauer then gave his presentation, explaining that the negotiations with the developer were quite amiable. Many hours and days were spent working on this matter and Commissioner Bauer felt that every one would be pleased with the results. The Tower Building, he explained, will have sixteen stories instead of seventeen and the number of units will be reduced from two hundred and forty-one to two hundred and twenty-six. The Townhouses will be increased to twenty-six from eighteen. There will be no roof top tennis courts and no lighting on the garages. The garages will be reduced to twenty-nine feet instead of thirty-nine feet. The combined total number of units will be two hundred and fifty-two instead of the original two hundred and fifty-nine, for a reduction of seven units overall. There will be more space between Braemer Isle and Aberdeem Arms, the Tower being moved approximately one hundred feet. Page 2 of 3 Commissioner Genovese then thanked Commissioner Bauer, Messrs. Delaney, Rodgers and Twitty for the tremendous job they had done on this compromise. Mayor Horton called a recess for several minutes while the charts were taken down and the Commission resumed their seats on the dais. At 2:00 P.M. Mayor Horton reconvened the recessed hearing. Commis- sioner Bauer finalized his presentation by stating that he had received suggestions from citizens that all highrise buildings in the Boca Hi RPUD be kept at the same height of sixteen stories. Mayor Horton then called for comments from the audience and several residents spoke, including Mr. Allen Dillenberg, Mr. Schiffman, Mrs. Becker, Mr. Milani, Mrs. Harrison, and Mr. Gilday. • Mr. Rodgers of Boca Hi then thanked the Town Commission, and particu- larly Commissioner Bauer, for their kindness and consideration, stating that Boca Hi will bow to the will of the Commission. Commissioner Genovese then stated that he was very much in favor of the agreed changes and made a MOTION that the plan be approved as read. Vice Mayor Mumford seconded the MOTION. Mr. Sliney altered the wording somewhat and the MOTION read as follows: That the proposed ordinance amending the RPUD in regard to the Braemer Isle Development be approved, with the agreed changes in Modification No. 2 as set forth in Commissioner Bauer's memorandum of March 12, 1979, attached to Exhibit "B", with the supplemental plans submitted at this hearing, also attached to the Exhibit. Mayor Horton then read for the record the memorandum of March 12, 1979 from Commissioner Harry Bauer. He stated that a Motion had been made and seconded, and at this point, our choice was one of two. If the Motion before the Commission is approved, this will change the RPUD as stated. If the Motion is denied, it would mean that the RPUD orig- inal plans for Braemer Isle would be followed. The Town Clerk then polled the Commission and all members voted Aye in favor of approving these changes in the Boca Hi RPUD. Mayor Horton stated for the benefit of all that this event was an exercise in democratic government. Inasmuch as some residents of the Town raised questions concerning the Boca Hi proposal, a Commissioner was appointed to work with the developers. This has resulted in friendly meetings and both the Town and the residents have benefited from this compromise. Mayor Horton expressed the thanks of the Town residents to all concerned.
