Recessed from March 6, 1979

Mayor Horton called the Recessed Regular Meeting of the Town Commission
to order at 2:35 P.M. Those in attendance were: Mayor Horton, Vice
Mayor Mumford, Commissioners Bauer, Genovese and Storm.
Also in attendance were: Mrs. Elaine W. Roberts, Town Manager, Mr.
Thomas E. Sliney, Town Attorney, Police Chief Kenneth Jones and Mrs.
Jane E. Barker, Town Clerk.
Public Rectuests and Comments
None.
Reports - Town Commission
• (a) Mayor Louis Y. Horton - Mayor Horton reported that he had
received a call from a Mrs. Bailey,
representing the Cystic Fibrosis Foundation. This Foundation is
trying to promote a fund-raising drive within the Town and Mayor
Horton explained that the Commission normally only approves one
general fund-raising campaign a year. The consensus of the
Commission was to continue as they have in the past and deny
this request.
(b) Vice Mayor Ruth E. Mumford - No report.
(c) Commissioner Harry Bauer - Commissioner Bauer reported that
he had written letters of com-
mendation to the Town personnel and also had purchased some
surplus champagne to give to them, which was his way of saying
"Thanks" for the excellent job they did on Sunday, February 25,
1979 - the day of the 30th Birthday Party.
(d) Commissioner Peter J. Genovese - No report.
(e) Commissioner Harold C. Storm - No report.

(c) Housing Board of Adjustment Appeals ~- Will be meeting
tomorrow morning.
(d) Planning Commission - This Board will be meeting tomorrow
night - March 14, 1979.
Reports - Representatives Re:
(a) Metropolitan Ping. Organization & Transportation (Don Wilson)
Mrs. Roberts reported that Mr. Wilson had been unable to attend
this meeting, however, he did leave his report which she read
for the record.
(b) South County Committee (Morton E. Gilday)
• Mr. Gilday reported that the By-laws of this Committee were just
about complete and he believes that once the new Corporation is
set up, the Committee will probably cease to be an official
organization of the City of Boca Raton, and will be striking
out on their own.
(c) South Florida Water Mgt. District (Frank Carberry)
No report.
Reports - Town Attorney
Mr. Sliney informed the Commission that he had prepared two
ordinances; one being a nuisance ordinance which could have a
first reading today. The other one was Chapter 27 entitled
"Traffic and Motor Vehicles" on which he had made some drastic
changes. He stated that the Town Commission might wish to
look these changes over, prior to having a second reading.
Reports - Town Manager
Mrs. Roberts reported that the Palm Beach County Municipal
League met last Friday in Royal Palm Beach. One of the matters

discussed concerned municipalities being permitted to have
violations of Town Ordinances heard by a Board, rather than
having to go to Court. Other matters discussed were a Self-
Insurance Pool, the County Library System, and the Environ-
mental Control Rule No. 2. Mrs. Roberts stated that on
February 23rd several members of the Municipal League Executive
Board made a presentation to the Legislative Delegation in
North Palm Beach; her portion concerned strong opposition to
any legislation tending to eliminate smaller municipalities
and setting up some sort of a "Hearing" for adjudicating
municipal ordinances.
Mrs. Roberts said that the Treasure Coast Regional Council
Meeting will be held on Thursday, March 15, in Stuart; that
she has been attending the "208" Meetings, there will be an
Annual Governor's Highway Safety Conference in Orlando on
Thursday and Friday, March 29 and 30, 1979, and a Beach
Seminar in Gainesville on April 5th and 6th.
• Mrs. Roberts then reported on a letter received from the
attorney for Mr. Hoffmann, requesting a hearing regarding the
extension of their RPUD. Mrs. Roberts replied to Mr. Slinkman
that the Town Commission would probably include this on the
agenda for the Workshop Meeting on March 27, in order to take
a vote on April 3rd at the Regular Meeting.
Regarding the boat, Mrs. Roberts stated that the hearing should
have been held last Friday, however, it has been continued until
next June. Mrs. Roberts informed the Commission that she is
working with Mr. Bartolone regarding the storage charges.
Correspondence received concerned new flood insurance infor-
mation setting up different zones for the Town which could
possibly give the residents a further reduction in their flood
insurance; a letter from the Palm Beach Soil and Water Con-
servation District regarding the availability of soil evalu-
ations for the Town; information concerning the ECR Rule No. 11;
and an A-95 review from the Area Planning Board, which the
Commission is required to comment on.
Mrs. Roberts then gave the names of those who sent letters of
• regret re: the Birthday Party; said that Bill Koch would come
down and talk to the Commission regarding the Bethesda Hospital

District; reported that on February 7 and 8, 1979 when the
Property Appraiser's representatives were here, they helped
about 90 people with their Homestead Exemption, and that she
had received minutes from Norman Gregory, who is our County
Commissioner, regarding the F.I.N.D. parcel within the
Hoffmann RPUD. The County Commission will release this parcel
back to the Town providing that the area is not disturbed.
The Town Manager then informed the Commission that Irving
Feinstein, one of the Post Office clerks, had suffered a heart
attack last Thursday and Gertrude Vendeland, Secretary of the
Housing Board of Adjustment and Appeals, was in the Boca Raton
Hospital.
Mayor Horton brought up the subject of an easement on the
F.I.N.D. parcel and stated that this should be discussed with
the Hoffmann people. Mrs. Rob erts informed the Commission
that the house on this property has never been hooked into the
sewage system. This will be further discussed at the Workshop
• Meeting on March 27th.
Mrs. Roberts then reported on the following:
Building Department
A Certificate of Occupancy has been issued on a four-plex on
Highland Beach Drive, and seventeen building permits-were
issued. Three sub-contractor permits have been issued for -~r
the Townhouses of Highland Beach and a building permit wi~I
be issued shortly. Mrs. Roberts reported that Mr. Hamzik had~`~'`
attended the 27th Annual Building Officials Conference in
Orlando on February 26, 27 and 28, 1979.
Finance Department
Mrs. Roberts informed the Commission that $283,239.65 has been
collected in tax money out of $319,628.00 budgeted; from the
Road and Bridge Fund - $19,711.58 out of $28,000.00 budgeted;
and Court revenue has amounted to $599.29 for January and
February. She stated that she had received a memo from the
Finance Director recommending that the anti-recession money
• ($324.00) be appropriated to the General Fund for additional
clerical work needed for the utility accounts.

Mrs. Roberts stated that she has additional information on the
lethal yellow program which will be discussed at the Workshop
Meeting on March 27th. Vice Mayor Mumford reported receiving
complaints about the dirty rooms at the Holiday Inn in Town.
Maintenance Department
Michael has devised a routine cleaning schedule for the storm
drains in the sub-divisions.
Police Department
Mrs. Roberts stated that all the Commissioners had received
their monthly activity report for February - with nothing
unusual noted. She announced that there is a proposal to
establish a Regional Citizens Crime Commission - the Chief
attended the meeting on February 28, 1979 in Ft. Lauderdale,
She read for the record a commendatory letter for Officer Maher,
the C.D.C. meetings have been attended, and there is a possi-
bility that the "911" emergency number will become a reality.
Mrs. Roberts mentioned that Officer Kasten is most grateful
for the kindness of the residents of Highland Beach. She also
mentioned an article she saw in the Boca News over the weekend,
concerning a "Vial of Life". More about this will be published
soon in the Bulletin.

Mrs. Roberts reported that the Town Clerk and Helen Carpenter
have been extremely busy with the upcoming election in May.
Public Utilities and Works
The water consumption was up a bit for the month of February,
Mrs. Roberts .said. Raw water for January was 22,420,000 and
for February - 23,698,000. The last of the water conservation
booklets have been distributed; the automatic lime feed was
put into operation at the water treatment plant on February 7th;
and last week, Mrs. Roberts said, she received the permit from
the South Florida Water Management District giving the higher

water allocation of 1.3 million gallons a day, along with a list
of twenty-five requirements that have to be followed. Mrs.
Roberts then stated that Ross, Saarinen, Bolton & Wilder had
submitted a status report last week, recommending that the Town
buy a turbidimeter. With everything included, this would cost
about $1,050.
MOTION by Commissioner Bauer/Commissioner Genovese that the turbidimeter
be purchased at the above price.
Mayor Horton stated that this turbidimeter is essential regarding
the Palm Beach County Health Department's rerating of our filters
and will record our water quality in order to meet their standards.
All Commissioners voted Aye in favor of this Motion.
Mrs. Roberts then announced that Jesse Arney had painted the
repump station next door.
• The monthly sewage system report for February from Carl Howard
has been received. Mrs. Roberts also stated that she has had
correspondence with Mr. Eldon Mariott regarding the anticipated
revision of our pre-treated sanitary sewage contract with Delray
Beach. Mrs. Roberts then announced that the new Regional Waste-
water Plant start-up will be delayed until June.
Mrs. Roberts said that the McCoy drain is 75/ completed.
Commissioner Bauer said that it looks very good. Earl Harvel
has been retained to do the water meter installations.
Mrs. Roberts then mentioned the paper pick-up salvage that has
been initiated in Town, beginning today - Tuesday. After the
contract is signed, the Town will receive a percentage of the
tonnage. Out of the one hundred zoning booklets ordered, fifty-
three have been sold to date, said Mrs. Roberts.
Resolution No. 369 - Discussion took place regarding this Resolution
concerning the "208 Plan". Mrs. Roberts ex-
plained that the Town has already been taking part in this Plan for
the past several years. This Resolution provides that the process
is a continuing one and needs the Town's support.

MOTION by Mayor Horton and seconded by Vice Mayor Mumford that
Resolution No. 369 be adopted, as read at a previous meeting. All
Commissioners voted Aye in favor of adopting this Resolution.
Resolution No. 370 - Mrs. Roberts asked the Commission if they
had received their substitute pages - 3, 4
and 5 from Bond Counsel? Mrs. Barker was asked to read this
Resolution for the record, but it was discovered that neither
the Commission, Town Manager nor Town Clerk had revised page 1;
therefore, Mr. Sliney read Resolution No. 370.
After the reading of this Resolution, discussion took place
and it was determined that both the Resolution and Notice of
Bond Referendum had to be advertised in a newspaper of general
circulation during the fifth and third weeks prior to the Election.
MOTION by Commissioner Genovese/Commissioner Bauer that Resolution
No. 370, as read by the Town Attorney, be adopted. In polling the
Commission, the vote was in favor of adoption.
• Proposed Ordinance(s)
Mayor Horton stated that Mr. Sliney has a new Proposed Ordinance
No. 346 which will be discussed at the next Workshop Meeting.
Mrs. Roberts questioned whether it should be re-advertised.
It was Mr. Sliney's opinion that this was not necessary. This
will be discussed further on March 27, 1979.
Proposed Ordinances Nos. 348, 349 and 350 have already had a
First Reading at the Regular Meeting on March 6, 1979, Mrs. Roberts
announced.
Proposed Ordinance No. 351 - An Ordinance of the Town of Highland
Beach, Florida enacting the Town Nuisance Ordinance, providing a
penalty clause, repealing clause, saving clause, codification,
and effective date - was read by title only by the Town Clerk.
Mayor Horton announced that this will be discussed at the next
Workshop Meeting on March 27, 1979.
Highland Beach Utilities Company
Since the new Regional Wastewater Treatment Plant will not be in
operation until June, Mayor Horton requested that this item be put

on the agenda for the March Workshop Meeting.
Proposals Regarding Police Department
Mayor Horton stated that the Commission had received a memo
from him regarding the proposed salary schedules for the Police
Department, stating that he felt the police were working under
pleasurable conditions and could see no need for the adjustment.
However, in talking with various people around Town, they wanted
to make certain that the police force was well satisfied to be
here. Mayor Horton worked further on the proposals, which
upgraded the positions.
Commissioner Storm questioned the percentage of this increase.
Mayor Horton explained that this would amount to approximately
a 5% increase and would be a "one-time-shot". Commissioner
Bauer stated that he felt the policeman would be very happy
to get this. Commissioner Genovese also stated that he thought
the police would be grateful and their morale would be much
• better.
MOTION by Commissioner Bauer and seconded by Commissioner Genovese
that the proposal as set forth in Mayor Norton's memo of March 1,
1979 be adopted as a pay scale for the police department, effective
April 1, 1979. In polling the Commission, all Commissioners voted Aye.
Bid from Earl Harvel - Fire Hydrants across from Regency Highlands
Mrs. Roberts explained that she had given the Commission a pro-
posal from Earl Harvel, which, after deducting the insurance,
amounts to $1,615., for relocation of the hydrant. A bid from
Lyons Construction was in the amount of $2,100.
MOTION by Commissioner Storm/Commissioner Bauer that Earl Harvel be
authorized to relocate the hydrant across from Regency Highlands for
for the sum of $1,615.00. By voice vote, the Motion was approved.
Bond Issue
Commissioner Storm, who has been working on this bond issue,
recommended that the proposal of Southeastern Municipal Bonds,
Inc. to amt as the Town's Fiscal Agent in the forthcoming bond
issue, be accepted.

MOTION was seconded by Commissioner Bauer. The Town Clerk polled
the Commission and the favorable vote was unanimous.
Mr. Sliney then read the letter of February 14, 1979 from
Bond Counsel, Richardson, Watson, Slade, McCarthy & Kelly,
P.A.,,for the record.
MOTION by Commissioner Bauer/Commissioner Storm that the proposal
from Bond Counsel in a letter dated February 14, 1979 as read by
Attorney Sliney, with the correction as to the amount involved,
be approved. In polling the Commission, the vote was unanimous
in favor of approving this proposal.
Old Business - None
New Business
Mr. Dent, a Town resident, questioned what was on Proposition
2 on the bond issue beside the library and was informed that
• it was a municipal building. This bond issue should not
exceed 2 mills, Mrs. Roberts stated. Mr. Dent then talked
about the amendments to Chapter 27, the easement on the F.I.N.D.
property, the turbidimeter, and the "208 Plan".
