Minutes of Meeting of Town Commission
Workshop Meeting
March 27, 1979 9.30 A M
The Regular Workshop Meeting of the Town Commission was called to
order by the Mayor at 9:30 A.M. Those in attendance were: Mayor
Horton, Vice Mayor Mumford, Commissioners Bauer, Genovese and Storm.
Also in attendance were: Mrs. Elaine W. Roberts, Town Manager, Mr.
Thomas E. Sliney, Town Attorney, Police Chief Kenneth Jones and
Mrs. Jane E. Barker, Town Clerk.
Mr. John Roberts, Ross, Saarinen, Bolton & Wilder, was also in the
audience, as well as several Townspeople.
Mayor Horton called for any comments from the audience and
former Mayor Gilday offered several comments regarding the
rescue van we have stored in the fire station.
• Mr. ~im Zester, President of the Board of Directors of Seagate
of Highland, stated that there have been a lot of complaints
regarding the sand on the lot to the south of Seagate which is
blowing onto the owners' cars and also into their apartments.
He was promised some remedial action.
Mr. Earl Totz, a Town resident, then spoke regarding the permit
from the D.E.R. for Town lots 93 and 94. He is looking for
favorable comments from the Town in regard to this. Mr. Totz
also explained the reason for the sand on the property south of
Seagate, at Commissioner Genovese's request. Vice Mayor Mumford
also stated that she is getting complaints from Seagate residents.
Mr. Dent spoke re: Lots 93 and 94.
Mayor Horton then asked Commissioner Bauer to respond re: the
rescue van. Commissioner Bauer explained that he is trying to
get paramedics around the clock for the Town and he and Mrs.
Roberts have been looking into many plans, including Del Trail
and Atlantic Palm Beach. Emergency Medical Technicians stationed
in the fire station are not licensed to provide treatment as are
paramedics. Commissioner Bauer then said that we are aware of
• the problems the Del Trail Fire District is experiencing and we

have been investigating this matter also. Commissioner Bauer
mentioned another reason why the ambulance is not operational
at this time and that the Bond Issue Part 2, calling for the
enlargement of living quarters at the fire station for the
additional men needed, speaks to this.
At this point, Mayor Horton answered a question raised at the
last Regular Meeting regarding the Bond Issue. He said another
letter has just been received from Southeastern Municipal Bond,
Inc. stating that, assuming an interest rate of 6-3/4/, the
interest payment for fiscal year 1979-80 would be $89,450.00.
If the tax base as of January 1, 1979 is $100,000,000. this
would mean a millage rate of .8945 - if the tax base is
$110,000,000. the millage would be .8132.
Mayor Horton then discussed the high water consumption. The
Town Hall Staff has been contacting the high users of water,
asking that they please cut down on their water usage. There
is an article in the current Bulletin, concerning water con-
• servation, which will be mailed this coming Thursday.
Commissioner Genovese suggested putting notices in the ele-
vators of all the condominiums. Mayor Horton stated that they
have been in touch with the Water Resources Center in Pompano
regarding stickers to be placed on mirrors in the bathrooms
of the motel rooms, asking for conservation of water.
Mayor Horton then acknowledged John Roberts from the Engineers'
firm who addressed the Commission. Mr. Roberts answered
questions concerning the engineering report submitted last
February regarding the Water Treatment Plant Expansion. He
spoke about the turbidimeter which the Town Commission agreed
to purchase and which is necessary in order to meet the Palm
Beach County Health Department's requirements.
Mayor Horton asked questions regarding the construction costs,
a 10/ escalation factor to mid 1980, the completion date of
November 1, 1980 and others. Commissioner Bauer asked about
the spiractor and about the life time of one. Mr. Roberts
explained that it should be good for fifteen or twenty years.
Further discussion took place regarding the Engineers report,
including the number of personnel needed for the plant when it
• is completed.

Mayor Horton asked Attorney Sliney if he had read the letter
from Mr. Delaney regarding the cost figures and if discussion
should be held with the Highland Beach Utilities Company directly.
Any proposed ordinance, ..amending the Sewer Franchise, could
have a first reading in April with final adoption at the May
Regular Meeting.
78.43 Proposed Ordinance No. 346 - amending Chapter 27 of the
Code of Ordinances entitled
"Traffic and Motor Vehicles", will be discussed later in the
meeting.
79.11 Proposed Ordinances 348 - "Sewers" and 349 - "Water" -
These Ordinances had a First Reading at the last Regular Meeting
and will come up for a vote at the April 3rd Meeting.
• 79.18 Proposed Ordinance No. 350 - amending Chapter 7 entitled
"Buildings"
Mrs. Roberts stated that there has been a change in this Ordinance,
amending the fee schedule. The schedule is being increased in
order to provide for required inspections in the Energy Code.
Mayor Horton stated that this Ordinance would be voted on at the
Regular Meeting on April 3, 1979.
78.43 Proposed Ordinance No. 346 - (Shown Above).
Mayor Horton questioned Paragraph 4 - Section 27-4 - regarding
the parking of recreational vehicles. It seemed to be the con-
sensus that recreational vehicles could be parked at motels or
hotels in Town for three days and after that, the vehicles could
be parked behind Town Hall. Further discussion took place.
This ordinance will come up for a vote at the Regular Meeting on
April 3rd.
79.18 Proposed Ordinance No. 351 - Enacting the Town Nuisance
Ordinance.
• This Ordinance had a first reading on March 13, 1979 and will
come up for vote at the Regular Meeting on April 3, 1979.

79.19 Proposed Ordinance No. 352 - Amending Chapter 25, entitled
"Subdivisions".
This Ordinance will have a first reading at the Regular Meeting
on April 3, 1979.
79.20 Requested Extension for Hoffmann RPUD
Mayor Horton stated that a letter had been received from Mr.
Slinkman, Attorney for Mr. Hoffmann, requesting another extension
for their RPUD which expires on April 4, 1979. This matter will
come up for a vote at the Regular Meeting of the Town Commission
on April 3, 1979.
Commissioner Genovese questioned how many extensions had been
granted to Mr. Hoffmann. Mrs. Roberts replied that she thought
this would be the fifth extension.
Mr. Hoffmann then addressed the Commission, stating that his
• Attorney, Mr. Slinkman, had been present but had to leave to go
to Court. Mr. Mike Egan, Attorney from Tallahassee, then brought
the Commission up to date on what has been taking place, re:
petitions to the involved agencies. Mr. Hoffmann has been trying
to obtain permits from the Army Corps of Engineers and the DER.
He explained that there have been personnel changes in the DER
which seems to necessitate starting over with each new group.
Mr. Hoffmann stated that they have changed their plans, for
more luxurious type of apartments, are reducing their density
and new site plans are being drawn up.
Mrs. Roberts informed the Commission that the monthly status
reports that were requested have been coming in regularly.
After much more discussion among the Commissioners, Mr. Hoffmann
and Mr. Egan, Commissioner Genovese stated that he would be in
favor of granting this extension. Mayor Horton, speaking for
himself, agreed with Commissioner Genovese. The consensus of
the Commission was that the extension would be granted, which
action would be taken at the Regular Meeting on April 3, 1979.

Before Mr. Hoffmann and Mr. Egan left, Mayor Horton spoke to
the matter of the cottage on Mr. Hoffmann's property not being
connected to the sewer system. Mr. Hoffmann stated he was not
aware of this, but he would have the resident call regarding this.
Mayor Horton then talked about the F.I.N.D. parcel which is
located within the Hoffmann property boundaries. Mr. Hoffmann
left the meeting at 11:35 A.M.
78.84 Lethal Yellow Program - Recommendations
Mrs. Roberts spoke of articles in recent newspapers which
recommended the continuance of injecting the trees with terra-
mycin. If this program were stopped now, there is a possibility
that the Town would lose all of their trees. Mrs. Roberts'
recommendation is the injections be continued and also to purchase
malayan palms to under plant. These trees can be purchased from
Brandon Nursery in West Palm Beach at $12.00 a tree. The trees
are about 4' tall. This will be discussed further at the Regular
• Meeting next week.
79.21 Discussion regarding Urbanek Lots 93 & 94 - Request to DER
Mr. Earl Totz, representative for Mr. Urbanek, requested that
the Town write to the DER regarding the revised request (from
that of a few years ago) to construct only a seawall on these
lots.
This was discussed and the consensus was that the Town had no
objections. A letter will be written to the DER advising them
of this and stating that the Town will abide by the DER's decision.
79.22 Paper Salvage Contract
This matter will be handled at the Regular Meeting on April 3, 1979.
79.23 Amendments to Job Descriptions and other personnel matters.
Mrs. Roberts had given the Commission a memo dated March 19, 1979
regarding the above. Mayor Horton stated that this matter was
probably overdue and will be placed on the Agenda for the Regular
• Meeting on April 3rd.

79.24 Bids

(a) Mrs. Roberts stated that she had received two bids for
cleaning the ground water storage tank - one for $2,932.00
from Webb General Contracting and the other from Earl Harvel in
the amount of $1,850.00, and recommended the low bid be accepted.
(b) The Police Station has need of attic insulation and roof
vent fans in order to get more economic use of the air con-
ditioner. Mr. Stano, our air conditioning resident consultant,
recommended that insulation be put in about six inches thick.
One bid received by Mrs. Roberts was in the amount of $550.00,
the next one was in the amount of $388.00, and the third one
was in the amount of $370.80, which is a much thicker insulation
(64"). Mrs. Roberts is awarding the low bidder the job.
Regarding the roof vent fans, Mrs. Roberts received bids from
Robertson Roofing - $175.00; Modern Roofing - $150.00 and Lindsley
• Lumber $87.88. This is the bid Mrs. Roberts will select.
Mrs. Roberts stated that Sewer Lift Station No. 2 requires some
work and she has received two bids - one from 2 & M Services for
$1,350.00 and another one from R. J. Sullivan from Coral Springs
in the amount of $900.00. Commission approval is required for
this work, so the issue will be placed on the Agenda for the
Regular Meeting April 3rd.
Reports - Town Manager
Mrs. Roberts stated that she had received a copy of an ordinance
from Delray concerning charitable solicitations, which the
Commission might wish to include in the Town's Code.
Mrs. Roberts and Commissioner Bauer have been working on the
"Vial of Life" program. Mr. Earl Totz, a Town resident, informed
the Town Manager and Commission that his son and daughter-in-law
are working with the Boca Jaycees on this project and he might
be able to get some literature and some sample vials for Mrs.
Roberts.

Mrs. Roberts reported that the new police car arrived on March
16th and has been fully equipped. She is also requesting bids
for painting the elevated water tower.
