Regular Meeting
April 3, 1979 1.30 P M
Mayor Horton called the Regular Meeting to order at 1x30 P.M. Those in
attendance were: Mayor Horton, Vice Mayor Mumford, Commissioners Bauer,
Genovese and Storm. Also in attendance were: Mrs. Elaine W. Roberts,
Town Manager, Mr. Thomas E. Sliney, Town Attorney, Police Chief Kenneth
Jones and Mrs. Jane E. Barker, Town Clerk.
There were several Town residents in the audience.

MOTION by Commissioner Genovese and seconded by Vice Mayor Mumford that
the minutes be approved as written. By voice vote, the MOTION was
adopted unanimously.
Public Requests and Comments
Former Mayor Gilday, as President of the Highland Beach Civic
League, announced that the Civic League in cooperation with the
Heart Association will be holding a C.P.R. Course (Cardin Pulmonary
Resuscitation) in the Town Hall on Wednesday, April 11, 1979 at
7:30 P.M. Lt. Tillson of the Boca Raton Fire Department will be
giving this course.
Mr. Dent, a Town resident, brought up several items; the Hoffmann
RPUD extension, the water plant expansion and different ways of
conserving water.

letter received from Mr. Gilday resigning as a delegate from the
South County Committee, due to his election as President of the
Highland Beach Civic League.
Mayor Horton then announced that there is a Votomatic machine
in the Commission Chambers for any one who wishes to vote an
absentee ballott.

signing of this Proclamation. He stated he would sign it.
• (b) Vice Mayor Ruth E. Mumford - Vice Mayor Mumford reported
that she and Mr. Mumford had
attended the Open House of the Electronic Switching Systems for
Southern Bell on March 20, 1979, culminating with a reception
at the Hamlet in Delray Beach, and she stated that the Open House
was most interesting and very worthwhile.
She then brought up the subject of the third story penthouse
apartment in Bel Lido. She has been receiving complaints about
this and it was her understanding that there would be no buildings
such as this in that area. It was the consensus of the Commission
that a memo be directed to the Planning Commission to look into
this matter.
Another issue that Vice Mayor Mumford brought up was the Recre-
ational Leases in the Town of Highland Beach. She stated that
she did not mind paying for swimming pools, shuffleboard courts
or dock space, but that she did object to paying the taxes on
the developer's property, his utility bills and the insurance
on his property. Mrs. Roberts stated that letters should be
written to Congressmen about this subject, because of pending
legislation.

Commissioner Bauer suggested that a petition be drawn up and
signed by the condominium owners and present this to Senator
Chiles'aide when he visits Town Hall on April 27th.
(c) Commissioner Harry Bauer - Commissioner Bauer stated that
he had met last week with a
retired hospital administrator, who was quite impressed with
the progress that has been made so far, after looking over
Commissioner Bauer's entire file. Commissioner Bauer also
stated that through Mrs. Roberts' efforts, samples of the
"Vial of Life" have been received. He commended Mr. Gilday
on having the C.P.R. course presented here in the Town Hall
and said that he is looking into the idea of leasing certain
types of equipment - when he has more information, he will
report back to the Commission.
(d) Commissioner Peter J. Genovese - Commissioner Genovese
stated that the Police
Department is quite happy about the increases received in
• their base salaries. He then mentioned the increase in crimes
in the Town.
(e) Commissioner Harold C. Storm - No report.
Reports of Boards and Agencies of the Town
(a) Board of Adjustment - Mr. Brotzman, Vice Chairman, announced
that a meeting had been scheduled for
March 5, 1979 but it was cancelled and the matter was turned over,
therefore, no meeting was necessary.
(b) Community Appearance Board - A special Meeting will be held
April 10, 1979.
(c) Housing Board of Adjustment and Appeals - Mrs. Roberts said
that this Board
will be meeting next Wednesday morning (April 11th) at 10:15 A.M.
(d) Planning Commission - A Special Meeting is being held tonight
(April 3rd) on the Danto case to set
their date for a Public Hearing. Their Regular Meeting will be
• held on April 18, 1979.

South Florida Water Mgt. District - Mrs. Roberts stated that Mr.
Carberry had been in to see
her and informed her that he had two people from two different
condominiums visit the Water Resources Center with him and he
highly recommends that everybody do this if they want to learn
about water conservation devices.
• Reports - Town Attorney - Mr. Sliney had a few questions con-
cerning the Paper Salvage Contract
and after discussion it was decided to table this matter.
Mr. Sliney enumerated some ordinance changes for the Commission:
Ordinance No. 346 - "Traffic and Motor Vehicles", Ordinance
No. 350 - "Florida Model Energy Code" - Mr. Sliney stated that
he has separated this Ordinance so that it just deals with the
energy code only. Previously, it had included the amendments
to the Building Code and also included the new building fees.
Mr. Sliney delivered a new ordinance today which covers the
amendments and the new fee schedule.
It was decided that the Commission would then go to Item 10 on
the Agenda, which is Proposed Ordinances.
Proposed Ordinance No. 346 - Amending Chapter 27 of the Code of
Ordinances entitled "Traffic and
Motor Vehicles" - Second Reading. This Ordinance was read in
full by the Town Attorney, Mr. Sliney.
MOTION by Commissioner Genovese/Commissioner Bauer that this Ordinance
be adopted as read by the Town Attorney.

Mayor Horton then inquired regarding cars like El Caminos and
a five-minute recess was called to look into this matter. It
was decided that E1 Camino type vehicles be exempted - intent
of Town Commission.
Mayor Horton then asked if the maker of the MOTION and the
seconder agreed with the slight changes made in the Ordinance
and they did.
In polling the Commission, the vote was unanimous in favor of adoption.
Proposed Ordinance No. 348 - Amending Chapter 22 of the Code of
Ordinances entitled "Sewers" - Second
Reading. This Ordinance was read in full by the Town Attorney.
MOTION by Vice Mayor Mumford and seconded by Commissioner Storm that
the Motion be adopted. The Town Clerk polled the Commission and the
vote was unanimous.
• Proposed Ordinance No. 349 - Amending Chapter 29 of the Code of
Ordinances entitled "Water System" -
Second Reading. This Ordinance was read in full by the Town
Attorney.
MOTION by Commissioner Bauer/Vice Mayor Mumford that Ordinance No. 349
be adopted as read. In polling the Commission, the vote was unanimous.
Proposed Ordinance No. 350 - Mr. Sliney announced that this is
the Ordinance that has been revised
to apply only to the adoption of the Energy Code. He then read
Ordinance No. 350 - Adopting the State of Florida Model Energy
Efficiency Building Code.
MOTION by Commissioner Storm/Vice Mayor Mumford that Ordinance No. 350
with the new version be adopted as read. In polling the Commission,
the vote was unanimous in favor of adopting Ordinance No. 350.
Proposed Ordinance No. 351 - Enacting the Town Nuisance Ordinance,
providing a penalty clause, repealing
clause, saving clause, codification and effective date. Mr. Sliney
read this ordinance in full.

Commissioner Genovese complimented Attorney Sliney on proposing
such a well-rounded ordinance, which Commissioner Genovese feels
will accomplish its purpose.
MOTION by Commissioner Genovese and seconded by Vice Mayor Mumford that
Ordinance No. 351 be adopted as read.
Mrs. Roberts asked Mr. Sliney's advice as to whether this Ordinance
could be added to the Code of Ordinances under Chapter 17, which
is presently marked "Reserved".
In polling the Commission, the vote was unanimous in favor of adopting
Ordinance No. 351.
Proposed Ordinance No. 352 - Amending Chapter 25 of the Code of
Ordinances entitled "Subdivisions".
This Ordinance was read by title only by the Town Attorney.
Proposed Ordinance No. 353 - Amending Chapter 7 of the Code of
• Ordinances entitled "Buildings".
Read by title only.
Mayor Horton advised that these two ordinances would come up for
discussion at the next Workshop Meeting, with possible adoption
at the next Regular Meeting.
Mrs. Roberts stated that there was a Franchise Ordinance for
consideration, however, since this is not in complete form,
it will be placed on the Workshop Agenda for April 24, 1979.
Reports - Town Manager
Mrs. Roberts reported on meetings - Palm Beach County Municipal
League will be meeting on Thursday, April 12th in Lantana; the
Treasure Coast Regional Planning Council same day in Stuart.
Mrs. Roberts stated she has given the Commission request from the
Area Planning Board for their comments regarding the Unified
Planning Work Program for fiscal year 1979-80. This mostly con-
cerns transportation and is a request for federal funding. The
Commissioners had no objections to this.

Mrs. Roberts then commented on her review of the Boca Raton
Comprehensive Plan; stated she had received preliminary popu-
lation figures from the Bureau of Census; she has written to
the Department of Environmental Regulation concerning the water
plant problems; and stated that a representative from Senator
Chiles' office will be in Town Hall on April 27th from 10:00
to 11:00 A.M.
Mrs. Roberts has posted the Hot Line for the Legislators on the
Bulletin Board and she has written to the Florida League of
Cities inquiring about any ordinances known to them regarding
new construction plumbing fixtures.
Mrs. Roberts reported that Irv Feinstein's condition is much
improved; Maggie Arnieri is presently working all day in the
Post Office; a man is coming in May to work when Maggie leaves
to have her baby; Ray Thernell is working full time as inspector
in the Building Department; Mr. William Carlton, from the Bureau
of Beaches and Shores, had a heart attack and is in the Talla-
• hassee:Memorial Hospital and several residents have received
specific assistance re: critical issues, by the Town Manager
recently.
A man from Town, who wishes to remain anonymous, would like to
see an ordinance passed requiring dog owners to dispose of their
dog's waste along the bike path or face a $100.00 fine.
Mrs. Roberts then reported on the following:
Building Department - Thirty-eight permits were issued last month
for a total of $20,000. Gross valuation
for new construction so far this fiscal year is $5,092,240. No
Certificates of Occupancy were issued during the month. The
Building Official attended an energy seminar at FAU on the 22nd
of March. Mr. Thernell will attend the next one. The buildings
on the property next door have been demolished.
Finance Department - Everything is going along fine in this
department, Mrs. Roberts stated.
Health Department - The Town Manager said it was through Mr. Earl

samples of the "Vial of Life". She also stated that Mr. Totz's
son and daughter-in-law are willing to give a presentation on
this. There will be a CPR Course held in Town Hall on Wednesday,
April 11, 1979 which has been arranged for by the Highland Beach
Civic League.
Maintenance Department - There is still the problem of getting
a young man to help Michael Coppola
with the maintenance work. However, it is hoped that this matter
will correct itself shortly.
Police Department - According to the Police Report for the month
of March, there have been several larcenies
in Town with robberies continuing at the Holiday Inn. Mrs.
Roberts said that there is a general increase in crime in south-
east Florida, and, as a result of this, one of the Highland Beach
Police Officers will be walking a foot patrol around the various
condominiums in Town during the evening hours.
• Mrs. Roberts stated that the Town was not notified of the last
meeting of the Crime Commission, however, she and the Chief will
keep up with the matter. Mrs. Roberts would like to have someone
from Town represent them on this Commission.
The C.D.C. had a special meeting on the 21st of March and the
regular meeting was held this morning. The new police car has
been in operation since the 20th of March.
Mrs. Roberts read a letter from the Police Chief and Patrolmen
thanking the Mayor and the Commission for the readjustment in
their salary schedule. Another letter of thanks that Mrs. Roberts
read was from Patrolman Kasten.
Mrs. Roberts stated that the Police Chief had attended a seminar
for arson education at the Palm .Beach Junior College and will be
attending one more session on April 9th.
Town Clerk - Mrs. Roberts reported that Helen Carpenter had been
sworn in as Deputy Town Clerk and that department
is busy working on the Election.

Public Utilities and Works - The water consumption for March was
high and as a result, severe conser-
vation steps were taken. After the meters were read, high users
were contacted and asked to conserve water. Notices have been
placed in the elevators of the condominiums, requesting residents
to be careful regarding the washing of cars, their laundry,
sprinkling systems and showers.
The turbidimeter has arrived and will be installed shortly.
Bids are being taken for the elevated tower paint work.
Mrs. Roberts stated that Carl Howard's monthly report was on
the clipboard. Sixty-four zoning booklets out of the one
hundred ordered have been sold.
Requested Extension of the Hoffmann RPUD.
Mayor Horton stated that this matter had been discussed at the
Workshop Meeting and the consensus was to approve this for
• another six months. Commissioner Genovese inquired as to the
house on this property being connected to the sewer.
MOTION by Commissioner Genovese that the extension be granted for six
months provided that the house be connected to the sewer system or
abandoned within sixty days. Commissioner Bauer seconded the MOTION
with the proviso that this be the last extension to be granted.
Mayor Horton requested Mrs. Roberts to bring this matter to the
Commission's attention two months before the extension expires
so that if legal action has to be taken, there would be suffic-
ient time.
In polling the Commission, the vote was unanimous in favor of granting
this extension.
Paper Salvage Contract
This matter was discussed earlier in the meeting and will be
tabled until the Workshop Meeting on April 24, 1979.
Amendments to Job Descriptions and other personnel matters.
• Mrs. Roberts requested that the Town Commission give approval

to her revision of the Municipal Maintenance Supervisor's
(Grade 4) job description and also that of the Maintenance Man.
Commissioner Bauer stated that he felt this was long overdue
and recommended serious consideration be given to this.
MOTION by Commissioner Bauer/Commissioner Storm that the job descrip-
tion of the Municipal Maintenance Supervisor as stated in Mrs. Roberts'
memo of March 19 and the attachment be approved.
Vice Mayor Mumford mentioned the untidy condition of the property
just north of the fire station.
The MOTION before the Commission was passed unanimously by a voice vote.
Lethal Yellow Program
Mrs. Roberts recommended to the Commission the purchase of ten
more cases of terramycin at $654.00 and fifty malayan palm trees
• at $600.00 (for resale to Town residents at cost).
MOTION by Commissioner Storm/Commissioner Genovese that Mrs. Roberts'
recommendation be accepted. All Commissioners voted Aye.
Bids
(a) Mrs. Roberts stated that she had two bids for cleaning the
ground storage tank - one from Earl Harvel in the amount of
$1,850. and one from Webb Contracting in the amount of $2,932.
She is recommending that the low bid of $1,850. be approved.
MOTION by Commissioner Storm/Vice Mayor Mumford that the expenditure of
$1,850. be approved for the cleaning of the ground storage tank. By
voice vote, the MOTION was approved unanimously.
(b) Mrs. Roberts said that two bids had been received for Sewer
Lift Station No. 2 - one from Mr. Sullivan for $900.00 and
one from I & M Services for $1,350. She recommended the
bid from Mr. Sullivan in the amount of $900.00 be accepted.
MOTION by Commissioner Genovese/Commissioner Bauer that the bid of
• $900.00 (for the work at Sewer Lift Station No. 2) be approved. All
members of the Commission voted Aye.

Commissioner Storm stated that he is quite concerned about the
storage bills at the Marina for the confiscated boat. Attorney
Sliney informed the Commission that Mr. Bartolone is working on
this case and is not getting much cooperation from the State
Attorney's office.
Discussion took place. Mrs. Roberts brought up the subject of
moving the boat into Town, however, the insurance has to be
checked into first. Several Townspeople have offered the use of
their docks. It was the general consensus of the Commission that
they will just have to bear with this case, with the possibility
of moving the boat into Town and thus saving the storage charges;
and with the hope that the case will be settled soon.
MOTION by Commissioner Genovese/Commissioner Bauer that the meeting
be ADJOURNED. Time - 3:50 P.M.
