1979.04.24_TC_Minutes_Workshop• TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Workshop Meeting April 24, 1979 9 30 A M Mayor Horton called the Workshop Meeting to order at 9:30 A.M. Those in attendance were: Mayor Horton, Vice Mayor Mumford and Commissioners Bauer, Genovese and Storm. Also in attendance were: Mrs. Elaine W. Roberts, Town Manager, Police Chief Kenneth Jones and Mrs. Jane E. Barker, Town Clerk. There were several people in the audience. Mayor Horton called for any comments regarding the agenda. There were none. 78.28 Highland Beach Utilities Company - Proposed Sewer Franchise Amendment • Mayor Horton stated that no answer had been received from Counsel regarding a suggestion submitted to him, however, Mayor Horton, Mr. Sliney and Mrs. Roberts will be meeting within the next day or two and this matter will be submitted at the next Regular Meeting. Mayor Horton then stated that the next Regular Meeting will be held on Tuesday, May 1, 1979, which is Election Day. The meeting will convene at 7:30 P.M. and, inasmuch as the Town Commission serves as the Election Canvassing Board, a recess will be called when the Clerk of Elections informs the Commission that the votes have been counted. After serving as the Canvassing Board, the Town Commission will then go back into regular session. 79.19 Proposed Ordinance No. 352, amending Chapter 25 of the Code of Ordinances, entitled "Subdivisions". Mayor Horton asked if there were any questions concerning this Proposed Ordinance. Being none, he stated that this matter would come up for a vote next week at the Regular Meeting. Minutes Highland Beach • Town Commission Workshop Meeting April 24, 1979 Page 2 of 5 79.25 Proposed Ordinance No. 353, amending Chapter 7 of the Code of Ordinances, entitled "Buildings" in order to adopt amendments to the Standard Building Code, 1976 and in order to amend the Building Permit Fee Schedule and Plan Check Fee Schedule. Mrs. Roberts stated that Mr. Hamzik, Building Official, has requested that the item to incorporate the 1977 Amendments to the Standard Building Code, 1976 Edition be stricken at this time. The Proposed Ordinance would deal only with the increase in the fees to take care of the additional inspections due to the Energy Code adoption. This proposed ordinance will come up for a final reading and possible adoption at the Regular Meeting on May 1, 1979. 79.22 Paper Salvage Contract • Mrs. Roberts stated she had given the Commission some notes that she had made concerning the Paper Salvage Contract. She reviewed these notes with the idea that this could be finalized and typed in time for the Regular Meeting on May 1, 1979. Further discussion took place concerning this contract, including the subject of Workmen's Compensation, which Mrs. Roberts said she would take up with the Town's insurance carrier. She then said she would call the Attorney, read the revised contract to him and then have it retyped. 79.26 Testing of Municipal Election Tabulating Equipment - April 30, 1979 - 10:00 A.M. The Election Tabulating Equipment will be deli Hall on Friday, April 27, 1979 and the testing will be held at 10:00 A.M. Monday, April 30th. Board may designate one member of the Board to test and Commissioner Bauer was so designated. Storm stated that he would also try to attend. 79.27 Six Months' Financial Statement ~ered to the Town of this equipment The Canvassing be present at the Commissioner • The Town Commission received their copies of the six months' Minutes Highland Beach Town Commission • Workshop Meeting April 24, 1979 Page 3 of 5 financial statement, had not had time to look it over yet but would study and submit any questions they might have to Mrs. Roberts. Any questions would be answered at the Regular Meeting on. May 1, 1979. Mayor Horton then announced that a Public Hearing will be held on Tuesday, May 15, 1979 at 9:30 A.M. for consideration of a special exception under Section 9, Chapter 30 of the Code of Ordinances. The Planning Commission will also be holding a Public Hearing on this same matter on Wednesday, May 9, 1979 at 7:30 P.M. Mayor Horton stated that any one who could attend the Planning Commission Public Hearing might pick up some back- ground information. 79.28 Water Consumption and Conservation Mrs. Roberts informed the Commission that the water conservation program has worked very well; a great deal of cooperation was • received from the people in Town and the fact that a lot of people have left for the North has helped the situation. She further stated that neighboring communities have also been having water problems and she has kept all newspaper articles concerning all these Towns. She stated that Delray Beach is rationing water again and allowing sprinkling twice a week. Mayor Horton said that the next issue of the Bulletin would contain a statement that Highland Beach was one of the few communities around that avoided a strict rationing program this year because of the cooperation of the people in Town. Mayor Horton suggested that the Commissioners talk to their constituents stressing the fact that next winter will be equally as bad unless the rainfall pattern changes. It will not be until November 1, 1980 when relief can be expected. Plans re water conservation and/or rationing for next year are already being worked on by Mrs. Roberts and the Mayor. Reports - Town Manager Mrs. Roberts informed the Commission that the turbidimeter at • the water treatment plant was installed last Thursday, April 19, Minutes Highland Beach Town Commission • Workshop Meeting April 24, 1979 Page 4 of 5 1979. With the new lime feed in operation, Mayor Horton sand the Town is not exceeding Palm Beach County Health Department requirement for percentage of turbidity. Mrs. Roberts then announced that Officer Jack Wambach was one of the first patrol officers to attend a Defensive Driving Course put on by the County. He is taking this course today, (April 24), tomorrow and Thursday. The other police officers will also take this course. Mrs. Roberts brought up the matter of Chapter 24 in the Code of Ordinances, concerning the disturbing of any street. The Code reads that if a developer ruins the road in any way while building, it must be repaired prior to the issuance of a Certificate of Occupancy. This has happened on Russell Drive in Town and, unfortunately, the man who did this has sold the property and the new owner does not feel that he should be responsible. He has, however, offered a token amount to have the street repaired. More discussion took place and the consensus of the Commission was to uphold the Ordinance and make the individual repair the street. Commissioner Bauer stated that he would like to have the Building Official check the bike path south of Bel Lido Drive, as it has some bad patches in it. Vice Mayor Mumford stated that the developers are constantly disturbing the bike path and should be made to repair it. A Performance Bond for developers covering any kind of damage whatsoever was discussed - such as the Town now has for the ruination of trees. Mrs. Roberts was asked to draw up an ordinance covering this situation and it will be discussed at the next workshop Meeting. Vice Mayor Mumford asked about the house on Mr. Hoffmann's property and was informed by the Town Manager that a letter had been sent to Attorney Slinkman, giving the tenants sixty days to connect to the sewer system or the house would be torn • down. The sixty days will be up June 3rd. Minutes Highland Beach Town Commission • Workshop Meeting April 24, 1979 Page 5 of 5 Commissioner Bauer said that the Town of Ocean Ridge has dropped their palm tree inoculation program. Mayor Horton asked Mrs. Roberts how many of the fifty malayan palm trees that the Town has purchased have been sold to date. Mrs. Roberts stated that about a dozen trees have been sold. Mr. Dent, a Town resident, stated that the Town of Manalapan has not lost any trees to lethal yellowing. He then questioned the State requirements for turbidity and Mayor Horton informed him that the State requires five units while the Palm Beach County Health Department is now one unit. The upcoming Election was discussed including the rules of conduct on Election Day. Mayor Horton stated that he had already discussed this with the other two incumbents and they all agreed that they would come in to vote and leave immediately thereafter. The fire hydrant in front of Regency Highlands has been replaced, . Mayor Horton stated. Mr. Dent then talked about the bad accident that took place in Bel Lido.
