Minutes of Meeting of Town Commission
Regular Meeting
May 1, 1979 7.30 P.M.
Mayor Horton called the Regular Meeting to order at 7:30 P.M. Those in
attendance were: Mayor Horton, Vice Mayor Mumford, Commissioners Bauer,
Genovese and Storm. Also in attendance were: Mrs. Elaine W. Roberts,
Town Manager, Mr. Thomas E. Sliney, Town Attorney, Police Chief Kenneth
Jones and Helen Carpenter, Deputy Town Clerk.
There were many residents in the audience.

by Commissioner Storm and seconded by Vice Mayor Mumford that
the minutes be approved as written. By voice vote, the minutes were
unanimously approved.

Reports - Town Commission
(a) Mayor Louis Y. Horton - Mayor Horton stated that he thought
this was an exceptionally smooth run
election. This was due in part to the team which has been working
on elections for some years - Ben Stephenson and his crew certainly
have done very well.

(e) Commissioner Harold C. Storm - Commissioner Storm said he
wished to announce that he
has been appointed as a member of the Implementation Advisory
Committee of the Palm Beach County Area Planning Board "208"
Program and he will attend his first meeting on May 11th.
Mrs. Roberts stated that confirmation will be needed by a vote
of the Town Commission.
MOTION by Vice Mayor Mumford and seconded by Commissioner Genovese
that Commissioner Harold C. Storm be the duly elected representative
from the Town of Highland Beach to the Implementation Advisory
Committee of the Palm Beach County Area Planning Board. By voice vote,
the MOTION passed unanimously.
Reports of Boards and Agencies of the Town
(a) Board of Adjustment - No report
• (b) Community Appearance Board - No report
(c) Housing Board of Adjustment and Appeals - No report
(d) Planning Commission - Chairman, Mr. Boscove, stated that
they are currently reviewing the
present zoning ordinance.
Mr. Johnson stated that there is a meeting scheduled for May 9th
at 7:00 P.M. re: Boca Hi presentation on changes in C and D
buildings, and at 7:30 P.M. there will be a public hearing re:
Lots 92, 93, 94 East.
At this time, Mayor Horton stated that this meeting was to proceed
with the regular order of business until such time as the Election
Committee was ready with the results. At that time, the Regular
Meeting would be recessed and the Town Commission would then sit
as a Municipal Election Canvassing Board to certify the results
of the election. The Regular Meeting would then be reconvened,
the newly elected Commissioners sworn in and then they would
proceed with the balance of the Agenda.

Metropolitan Planning Organization and Transportation - Mr. Don Wilson
- No report
South County Committee - No report (no representative at this time)
South Florida Water Mgt. District - Mr. Frank Carberry - No report
Reports - Town Attorney
Mr. Sliney reported that he will be meeting with the Attorney for
Drexel Properties, at their request, sometime in the latter part
of May and he will have more to report after that meeting.
Mayor Horton stated that there was a Public Hearing scheduled for
May 15th at 9:30 A.M. for discussion on the Danto Lots 92, 93 & 94
(Park Tower Development), and it was agreed to schedule a Special
Meeting the same day (May 15th) at 9:15 A.M., at which time there
will be a first reading of an amendment to the Sewer Franchise
• Ordinance.
In regard to the status of the confiscated boat, Mr. Sliney stated
that this matter is still mired in the court calendars, however,
a letter was written to State Attorney David Bludworth today.
Mayor Horton stated the Town Commission has been trying to get
some action from the State Attorney's office for some time as we
are paying daily storage charges on this boat.
Reports - Town Manacter
Mrs. Roberts reported on meetings she attended in April - The Palm
Beach County Municipal League and the Executive Board Meeting.
The next meeting of the Palm Beach County Municipal League will be
on Thursday, May 24th, at 1:30 P.M. in Palm Beach Gardens and one
of the main topics of the agenda will be what support other
communities want to give them in their problems with abolishing
their police department, and the impact of Judge Hewett's decision
re: related litigation.
The Treasure Coast Regional Planning Council's next meeting will
be the 10th of May at 9:30 A.M. in Stuart. We have received a
• draft of the Regional Energy Plan from the Treasure Coast Regional
Planning Council.

On Thursday, May 3, 1979, 7:00 P.M., there will be a Public
Hearing in the Delray Beach City Hall regarding the Wastewater
Treatment Plant which has been built, of which Highland Beach
is going to be a part. This Public Hearing is to discuss the
recommendations of the plan with the agencies and governmental
entities that they represent. Any comments for or against the
proposed program will be discussed at the Public Hearing.
The Palm Beach County Municipal League Members will meet on
May 3rd at 12:00 in Lake Worth to discuss the self-insurance
program. Mrs. Roberts plans to attend this meeting.
Correspondence received: Mrs. Roberts stated that we have
received a copy of the Del Trail Audit for 1977/78 which is
available for anyone who would like to see it. We have also
received booklets from the Department of Natural Resources,
put out by the State Department of Agriculture called "Coastal
Plants of Florida, a Key To Good Land Management". These books
have been distributed to the various Boards and Officials and
• one is available in the office.
Mrs. Roberts stated that she has written to the Florida Legis-
lators in regard to several items in the DATAGRAM: Double
Taxation Bill, Sales Tax on Public Works Materials, Unemployment
Compensation and Workmen's Compensation.
Mrs. Roberts stated that she has written to DER, keeping them
apprised of the status of what we are doing at the water plant;
received from the Area Planning Board a copy of the table of
contents of the "201 Facilities Plan" and received our annual
set of maps and aerial photographs from the Property Appraiser's
Office.
Mrs. Roberts' Annual Report has been distributed and is available
for anyone who would like to see it.
Building Department - Mrs. Roberts reported that they are very
busy and that they need another building
inspector as Roy Thernell could not stay with us. A temporary
C/O has been issued to Tra vieso triplex on Highland Beach Drive
and to the owners' apartment in the DeJoseph fourplex and final
• C/O's to the O'Keefe building on Bel Air Drive and to Lots 23 & 24,
Highland Beach Isles (Z-Con).

We have received $294,343.16 so far in general taxes out of a
total of $319,628. budgeted. In the Road & Bridge Fund we have
received $20,870.56 out of a total of $28,000. budgeted. The
court revenue through March is $889.00. A Bond Issue payment
was made today for the 1966 Bond Issue totaling $17,589.10, for
the water bonds and the Town Hall Bonds.
Health Department - No report
Maintenance Department - Jim Hirst was hired about the middle of
the month to help Michael. One of Jim's main jobs will be to
make sure the bicycle path is kept clean.
Police Department
The activity report for April will be available shortly.
• Mrs. Roberts stated that the Palm Beach County Municipal League
has developed a Crime Commission that is going to be active in
four counties - Dade, Monroe, Broward and Palm Beach. As soon
as more information regarding the makeup and the costs is available,
it will be distributed.
There was a C.D.C. meeting today in Delray City Hall, but because
Boynton did not attend, it was cancelled. Chief Jones attended
the Administrative Board Meeting last Friday in Boca Raton and
Mrs. Roberts attended the meeting today. The nett meeting will
be held the first Tuesday in June - the 5th.
Palm Beach County has established a defensive driver course for
police officers and Officer Wambach was our first man to attend
this last week on May 24, 25 and 26th.
Mrs. Roberts stated that Chief Jones reported that from January
1st to April 23, 1979, 28 vehicles used the rear Town Hall parking
lot with our permission. There were: 5 pickup trucks, 7 vans,
1 private automobile, 12 motor homes, a boat, trailer and a large
truck.

very busy all month with election work and that Helen Carpenter
has been appointed Deputy Town Clerk effective April 1, 1979.
Public Works and Utilities
The water consumption went down for the month of April by two
million gallons. The turbidimeter was installed on April 19th
and will be measuring the amount of turbidity in the water.
Reports sent to the Health Department will help us re the
filters rerating.
The bids on the elevated water tank are complete. The three
bids have been sent to the Engineers for their recommendation.
In re: Water Facilities, plans for the water treatment plant
are moving along fine. One bill has been received for approx-
imately°$12,000. for engineers work. Carl Howard's monthly
sewage system report, from March 26 through April 29, has been
received and is on the Clipboard.
• There was discussion in regard to repairs needed on equipment
at the sewage treatment plant. Russell & Axon, retained by the
Highland Beach Utilities Co., inspected the plant and made the
recommendations as to the repairs needed.
MOTION by Commissioner Genovese and seconded by Commissioner Storm to
authorize the expenditure, not to exceed $2,000. after having received
the required bids. By voice vote, MOTION carried unanimously.
Mrs. Roberts stated that out of the 100 Zoning Booklets which
were purchased, 77 have been sold and we are ordering more.
Highland Beach Utilities Co. - Proposed Sewer Franchise Amendment
This item will be the subject of the Special Meeting on May 15th
at 9:15 A.M.
Proposed Ordinance No. 352 - Amending Chapter 25 of the Code of
Ordinances entitled "Subdivisions"
This Ordinance was read in full by the Deputy Town Clerk.
Mr. Jospeh Boscove, Chairman of the Planning Commission, stated
• that some changes are being proposed in this Ordinance. Mayor
Horton then said this Ordinance will come up for further

discussion and possible vote at the Special Meeting on Tuesday,
May 15th.
Proposed Ordinance No. 353 - Amending Chapter 7 of the Code of
Ordinances, entitled "Buildings"
in order to amend the Building Permit Fee Schedule and Plan Check
Fee schedule. This Ordinance was read in full by the Deputy Town
Clerk. Mr. Sliney then explained the fee schedule attached to
the Ordinance.
MOTION by Commissioner Genovese and seconded by Commissioner Bauer
that Ordinance No. 353 be amended in accordance with the wording as
read and in accordance with the fee schedule attached, and adopted.
In polling the Commission, all voted in favor of the adoption.
Proposed Ordinance No. 354 - Amending Chapter 9 of the Code of
Ordinances, (Sec. 9-26) entitled
"Electrical Code". This Ordinance was read by title only by
the Deputy Town Clerk, and will come up for discussion at the
• next Workshop Meeting.
Paper Salvacie Contract
Mr. Sliney suggested some more changes to the Paper Salvage
Contract. After some discussion on this subject, Mayor Horton
stated that some action will be taken on this at the Special
Meeting on May 15th.
Six Months' Financial Statement
This statement was distributed just before the Workshop Meeting
of April 24th so that the Commissioners could review the statement
and bring up any questions they might have at this meeting.
Several questions were raised by the Commission which Mrs.. Roberts
answered.

Bills for Approval
• .Mrs. Roberts presented the bills for approval which totaled
$25,957.15.

MOTION by Commissioner Storm and seconded by Vice Mayor Mumford that
the bills be approved for payment. All Commissioners voted approval
of these bills.
Meeting RECESSED at 8:35 P.M. to await the election returns.
Mayor Horton called the recessed meeting to order at 9:00 P.M. and
stated that the Commission is now meeting as a Municipal Election
Canvassing Board.
Mr. Ben Stephenson, Clerk of the Election, read the results of the
election which were certified by all of the Election Inspectors and
Town Clerk, Bette Barker.

MOTION by Commissioner Storm/Vice Mayor Mumford to accept the results
of the election as announced by the Clerk of the Election. By voice
vote, motion unanimously passed.

Regular Meeting of the Commission was then reconvened and the newly
elected Officials were sworn in by the Town Clerk.
Mayor Horton thanked the Clerk of Elections as well as all those who
served today.
Each of the newly elected Officials spoke a few words.
Mr. Dent also addressed the Commission and Former Mayor Gilday spoke
on behalf of the Highland Beach Civic League.
