Public Hearing
Recessed from May 15, 1979
May 18, 1979 1:30 P.M.
Mayor Horton called the Recessed Public Hearing to order at 1:30 P.M.
He stated that this was the reconvening of a Public Hearing which
was recessed on Tuesday, May 15, 1979 until this afternoon. This
Public Hearing was called for the consideration of a request for a
Special Exception under Section 9 of Chapter 30 of the Code of Ordin-
ances made by Rigby C. Bridges for the Park Tower Development Group
for Highland Beach Town Lots #92, 93 and 94 east.
In attendance were: Mayor Horton, Vice Mayor Mumford, Commissioners
Bauer, Genovese and Storm. Also in attendance were: Mrs. Elaine W.
Roberts, Town Manager, Town Attorney Thomas E. Sliney, Police Chief
Kenneth Jones and Mrs. Jane E. Barker, Town Clerk.
The representatives from Park Tower Development were also present;
• namely, Mr. Charles Danto, Mr. Rigby Bridges and Mr. Ray Case, as
well as several interested Townspeople.
Mayor Horton read for the record a letter of recommendation from
Vice Chairman of the Planning Commission, Mr. Nicholas Johnson, which
was addressed to the Mayor and Town Commission. Mayor Horton then
stated the rules for conducting a Public Hearing for the benefit of all.
Mr. Charles Blankenship, a member of the Planning Commission, addressed
the Town Commission regarding the parking, setbacks and height of this
project. He hoped that the Town Commission would approve it as it
would be an asset to Highland Beach.
Commissioner Genovese talked about the reduction in height which is
now 118.05 feet above the crown of the road. At this time, Mr. Fran
Hamzik stated that revised plans had been received and explained the
changes for the benefit of all. They have reduced the height of the
building by one floor and lowered the garage slab to 7.5 feet above
mean sea level or 8.05 feet above the crown of the road.
Other remarks were made by Mr. M. H. W. Dent regarding the height;
Mr. Eypel about the seawall, the natural outcropping and the removal
of the pool; Mrs. Roberts questioned the height above the crown of
• the road.

Mr. Danto then spoke about the revisions affecting the parking and
recreational facilities. Statements were then made by Commissioner
Storm concerning the compromising on our ordinances, the parking lot
being under the building and the fact that the building was a good
looking one, however, he could not go along with their request for a
Special Exception.
Vice Mayor Mumford agreed with Commissioner Storm, stating that she
would like to see the two top floors removed in order to conform to
the Code.
Commissioner Genovese stated that the concept of this building was
excellent - he would be in favor of the Special Exception - and
Commissioner Bauer agreed that the concept was good and he would like
to see a compromise.
After much more discussion among the Commissioners and Attorney Sliney,
a MOTION was made by Commissioner Genovese and seconded by Commissioner
• Bauer to approve the petition as it has been amended and reported by
Mr. Hamzik today that the height would be 118.05 feet above the crown
of AlA. In polling the Commission, the vote was:
Commissioner Genovese -Aye
Vice Mayor Mumford - Nay
Mayor Horton - Nay
Commissioner Storm - Nay
Commissioner Bauer - Aye
The MOTION failed because of a three to two vote in the negative.
Following this, the Mayor felt that a MOTION should be made showing the
disposition of this request. Vice Mayor Mumford made a MOTION which
was seconded by Commissioner Genovese that we deny the petition as sub-
mitted with the acknowledgment of the fact that we are in effect denying
the Town of something which might be an attraction, but at the same time,
our ordinances should be enforced. In polling the Commission, the vote, was
unanimous in favor of this MOTION.
After additional conversation, Commissioner Genovese moved and seconded
by Commissioner Bauer that we reconsider the MOTION that the petition be
denied. By voice vote, the reconsideration was approved unanimously.
• An AMENDMENT was then offered by Commissioner Genovese and seconded by
Vice Mayor Mumford that this matter be kept open for thirty days for

further consultation. Polling the Commission resulted in a unanimous
vote in favor of the above.
Mayor Horton stated .that we now have for consideration the MOTION as
originally made and that has now been AMENDED that the petition be
denied with the proviso that further consultation or amendment may be
considered within thirty days from this date. The Town Clerk polled
the Commission and the vote was unanimous in favor of the above.
A five-minute recess was held.
Meeting reconvened at 2:40 P.M. Mr. Danto requested specific direction
about coming back to this Commission within the thirty days. Further
discussion took place for a long period of time, after which Mayor Horton
granted Mr. Danto a ten-minute recess to confer with his colleagues.
Upon reconvening and further discussion, a MOTION was made by Commissioner
Bauer and seconded by Commissioner Genovese that the petition be approved
as it now stands which includes a building not to exceed 114.05 feet in
height with the basic.configuration as set forth in plans submitted to
Mr. Hamzik today. In polling the Commission the vote was as follows:
Commissioner Bauer - Aye
Commissioner Storm - Nay
Mayor Horton - Aye
Vice Mayor Mumford - Nay
Commissioner Genovese - Aye
MOTION carried.
