1979.10.30_TC_Minutes_Workshop1 ,~ • TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Workshop Meeting October 30, 1979 9:55 A.M. Mayor Horton called the Workshop Meeting to order at 9:55 A.M. Those in attendance were: Mayor Horton, Vice Mayor Mumford and Commissioners Bauer, Genovese and Storm. Also in attendance were: Elaine W. Roberts, Town Manager; Thomas E. Sliney, Town Attorney and Jane E. Barker, Town Clerk. Mayor Horton called on former Mayor Gilday to discuss the Vial of Life Program, which the Highland Beach Civic League will be introducing to the Town of Highland Beach. After Mr. Gilday spoke, Mayor Horton ex- pressed the Town's thanks to the Civic League for this effort. Mr. Dent, a Town resident, referred back to the Special Meeting and asked who Mr. Callaway was. He then spoke of Government in the Sunshine. • 79.59# Air Conditioning Fees Mr. Hamzik, Building Official, explained in detail how the Air Conditioning Fees were established and that they are within reason for the number of inspections needed (4 each dwelling unit). Mayor Horton then stated that another letter would be written to Hill York, Inc., explaining that the fees in the Town of Highland Beach are just, after analyzing our costs. 79.68 Expiration of Board Members' Terms Mrs. Roberts informed the Town Commission regarding the Board Members' terms that were expiring in November of this year. Inas- much as this was a Workshop Meeting, Mayor Horton asked Mrs. Roberts to bring this matter up for definite action at the Regular Meeting to be held on November 6th. 79.56 Discussion re: Proposed Ordinance No. 363 - Water Conservation - First Reading - August 7, 1979 Mayor Horton called attention to a new Proposed Ordinance No. 374 which concerns water usage rates. He explained that Proposed Ordinance No. 363 pertains to the responsibility of the Commission in time of water shortages. I Minutes Highland Beach Town Commission Workshop Meeting October 30, 1979 Page 2 of 5 Mrs. Roberts explained the several changes in Proposed Ordinance No. 363 for the benefit of the Commission. This can be brought up for Final Reading and possible adoption at the Regular Meeting on November 6, 1979. Concerning Proposed Ordinance a First Reading could be held discussion concerning this at Tuesday, November 27, 1979. 79.70 Discussion re: No. 374, Mayor Horton on Tuesday, November the Workshop Meeting stated that 6th, with to be held on _~a) Proposed Ordinance No. 372 - Amending Chapter 19, entitled "Plumbing" - First Reading - October 16, 1979 Discussion took place regarding water-saving devices for new construction. • Mrs. Roberts then spoke of Proposed Ordinance No. 370 - Limiting the appointed terms of Board Members - and Proposed Ordinance No. 371 - Deleting Chapter 21Z entitled "Sewage Interim Treatment Plant". These two ordinances had a First Reading on October 2, 1979. Final Reading and possible adoption can be held at the Regular Meeting on November 6, 1979. 79.71 Proposed Lease of Well Field by Boca Raton Discussion took place regarding the leasing of the western well field by Boca Raton. Mrs. Roberts said that she would be meeting with Mayor Koch, of Gulfstream, on Wednesday, October 31st. He has agreed to assist the Town with an appraisal of the value of the 8z acre parcel, and possibly by the time of the Regular Meeting next week, he will have an answer. Commissioner Genovese discussed this subject further, mentioning the use of Spanish River Park by the residents of Highland Beach. Mr. Sliney was requested to look into the matter of access to Spanish River Park by Town residents. Commissioner Bauer talked about the cooperation received from Boca Raton in our attempts to have Appleby Street paved from U. S. 1 to the Water Treatment Plant. • 79.72 Status of Bel Lido Bridge Work I Minutes Highland Beach Town Commission • Workshop Meeting October 30, 1979 Page 3 of 5 Mrs. Roberts explained what had been accomplished since receiving the engineering report from Botkin. She has talked to Geary Church, City Engineer in Delray Beach; weights of various trucks have been gathered; the Department of Transportation has been contacted; and just as soon as she hears further from Mr. Church, she will get back to the Commission. 79.73 Drexel Management Presentation regarding Development Mr. Brian C. Deuschle, of Spear, Deuschle & Curran, Attorneys at Law, addressed the Commission, stating that he represented Drexel Management Company, and he gave a brief historical picture of the relationship between the Town and Drexel Management. He stated that they are seeking a settlement or resolution of the matter in the same manner as what was achieved by Mr. Urbanek. Thinking along those lines, plans for a proposed development of this property were prepared and presented to the Planning Com- mission. Mr. Mark Weiner of Peabody and Childs, Architects, then displayed these plans. Mr. Deuschle explained the three different sites for the Commission. The Commission requested a chronology of all the events leading up to this by the next meeting so that it could be discussed in detail. Mr. Deuschle stated that they would be happy to submit this information for consideration. 79-74 Van Lennep Presentation regarding Development Mr. Shally Fine, representing Van Lennep, introduced himself. He stated that he understood he had been scheduled on the agenda, he presumed, as a result of discussions between himself and Mr. Sliney, regarding the possibilities of settling the pending law suit between Mary Van Lennep and. the Town. After much discussion, it was the consensus of the Commission that since this area was zoned for single family it should be maintained as such and Townhouses as proposed would not fit into this area. Mr. Fine then stated that it would have to be a matter for the courts to decide. I Minutes Highland Beach Town Commission Workshop Meeting • October 30, 1979 Page 4 o f 5 79.75 Discussion regarding correspondence to be sent to Legislative Delegation Mrs. Roberts stated that she needed advice as to what to send to the Legislative Delegation before the Municipal League made their presentation to the Delegation. She would like to comment about the Town's financial disclosure - whether or not, municipalities ~nith under 10,000 population and under a $1,000,000 budget could be exempt from filing records required by the new Financial Re- sponsibility Act. She stated that Senator Childers spoke about foreign interests buying precious farm land in the state and leaving it uncultivated.. Senator Childers will be presenting a bill in the Legislature that foreign interests can not buy over a certain percentage of land. Mayor Horton asked Mrs. Roberts if a Resolution should be passed regarding the Financial Responsibility records. Mrs. Roberts re- • plied in the affirmative and she was directed to draw up such a Resolution. He called for other expressions regarding the farm land and most of the Commissioners felt that the farm land bill should not be commented on. Mrs. Roberts then asked the Commission their feelings on a 5/ sales tax. After discussion, it was the consensus of the Commission that the sales tax be left unchanged. Mrs. Roberts then stated that Damon Smith, U. S. Senator Lawton Chiles' assistant, will be in Town Hall on Friday, November 2 from 11:45 A.M. to 12:45 P.M. She spoke of a notification from the Treasure Coast Regional Planning Council regarding a request from the Area Planning Board for HUD Comprehensive Planning Assistance for certain municipalities. Comments should be received by November 5th. She then asked for the Commission's opinion about requiring sub- contractors bids for the work at the Fire Station, or could Richard Maerz, Superintendent, be allowed to hire peiple that he has worked with. Discussion took place and it was the consensus • that further information should be obtained before answering this question. I a Minutes Highland Beach Town Commission • Workshop Meeting October 30, 1979 Page 5 of 5 Mayor Horton then read for the record a letter from Mr. Tom Delaney of Boca Hi regarding the proposed settlement of the Parker-Boca Hi boundary dispute. Much discussion took place with Mayor Horton re- questing Mr. Sliney to draw up a letter to Boca Hi stating that this transfer of property would not affect their RPUD. Mayor Horton stated. that he would get a letter from Parker stating Parker's concurrence with Boca Hi. Comments from the floor were made by Mr. Dent regarding Mr. Shally Fine, Mr. Callaway, the Bel Lido bridge and trading off of water with Delray Beach and Boca Raton. Mr. Sliney reported about a proposed agreement with Del-Trail Fire District, that would include deeding the Rescue Van to them. He said that if Del-Trail does not provide the services as agreed, the Van should be returned to the Town. Mayor Horton reported on a meeting he had with Mr. Norman Gregory, • Board of County Commissioners, regarding the Del-Trail Fire District. Mayor Horton thought there might be a possibility of the Town having their own Public Safety Department at some time in the future.
