1979.11.27_TC_Minutes_WorkshopTOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Workshop Meeting November 2.7, 1979 9.30 A M Mayor Horton called the Workshop Meeting to order at 9:30 A.M. Those in attendance were: Mayor Horton, Vice Mayor Mumford and Commissioners Bauer, Genovese and Storm. Also in attendance were: Elaine W. Roberts, Town Manager; Thomas E. Sliney, Town Attorney; and Jane E. Barker, Town Clerk. There were several people in the audience. Mayor Horton called for comments or questions from the audience and there were none. 79.76 S. A. Healy Company • Mayor Horton stated that this item was withdrawn at the request ~ of the Healy Company. 79.70 Proposed Ordinance No. 374 Amending Chapter 29-10 entitled "Water Use Rates and Charges" of the Code of Ordinances. First Reading November 6, 1979. Mayor Horton stated that he felt all the Commissioners were familiar with this Proposed Ordinance and it would come up for a vote at the Regular Meeting on December 4, 1979. Mayor Horton then informed the Commission that the original WET Group Members had met with the expanded WET Group Members about ten days ago and the interest shown was grafifying. 79.77 Proposed Ordinance No. 375 Amending Chapter 29 entitled "Water System" of the Code of Ordinances. First Reading November 6, 1979. This Proposed Ordinance raises the water connection fee to $400.00 a dwelling unit. This Ordinance will have a final reading and possible adoption at the Regular Meeting on December 4, 1979, 79.71 Proposed Lease of Well Field by Boca Raton Mayor Horton gave a brief history of what had been requested by Minutes Highland Beach Town Commission • Workshop Meeting November 27, 1979 Page 2 of 6 the Town of Highland Beach regarding access to Spanish River Park. Discussion took place with Mrs. Roberts stating that the lease would be forthcoming from Boca Raton shortly which could then be studied by the Commission. It was the general consensus to wait until this lease was received by the Town before taking. any further action. 79.72 Status of Bel Lido Bridge Work Mrs. Roberts brought the Commission up to date on this matter by informing them of all the contacts she had made.. She re- ported that she had received information from Strock Engineers which she had not had a chance to study as yet and would not make a recommendation until she did. 79.73 Drexel Management Development Mayor Horton told of correspondence received regarding this matter and Mr. Sliney informed the Commission that he would • like to hold off on this until after the Hearing on the .~~ Motion To Dismiss which is set for Wednesday, November 28, 19'1x9 _ ''= Mr. Deuschle, who represents Drexel Management, stated that he had appeared today with the idea that the Town wanted to effect a settlement and he felt that this matter should not be delayed any longer. Mr. Sliney then proceeded to discuss the Van Lennep case. The Court date has been set for January and even though both sides have requested a continuance, the Judge stated he would not grant one. Mr. Sliney felt that the Judge was not familiar with this case, having been recently transferred to it, and that the Commission should make some motion that he be permitted to go back to the Court and seek this continuance in view of the fact that the property is in the process of being sold. The consensus of the Commission was that Mr. Sliney return to the Court to obtain this continuance. 79.78 County Sanitation Proposed New Contract Mrs. Roberts stated that she had received a copy of a new Contract with County Sanitation and there were some additional J Minutes Highland Beach Town Commission • Workshop Meeting November 27, 1979 Page 3 of 6 changes to be made. Mr. Gaudette, from County Sanitation, stated that these changes would be made and he would have the revised contract back in Town Hall by Thursday of this week. The Commission can then approve it at the Regular Meeting on Tuesday, December 4, 1979. Discussion ensued regarding rates, the disposal fee, the method of calculating cubic yards, and the increase in the apartment rate to $2.00 per month instead of $1.00. 79.79 Request from Mr. Bridges regarding Lot 71E Mr. Digby Bridges, of Baker, Amm; addressed the Commission. He is feet in length for Lot 71E. Discussion then took place regarding the wall which Mr. Bridges will be installing on this property. It is not a seawall, however, inasmuch as it is not going across the coastal con- struction line. Mrs. Roberts explained that Mr. Bridges will have to submit a sketch of the wall and all of the specs to the Building Official, who will then present it to the Town Com- mission for their approval. Mayor Horton then stated that the Commission would wait until they heard from the Planning Commission regarding the date for their Public Hearing - and then the Town Commission would be able to set the date for their Public Hearing. 79.80 Sewer Charges - Memo to Town Commission from Town Manager - 11 14 79 Mayor Horton explained the above memo which mentioned that there are buildings in Town, such as recreational buildings, model apartments and guard houses, which are not paying sewer charges, yet they are using the system. Mrs. Roberts said Delray Beach has not yet completed the rate schedule and she does not anticipate Minutes Highland Beach Town Commission • Workshop Meeting November 27, 1979 Page 4 of 6 any change until possibly in the Spring. Mrs. Roberts stated that she favored the system which Boynton Beach is using - where they charge if a sewer drain line extends from a structure. Inasmuch as there are temporary structures, she felt that some allowance should be made to cover this. Commissioner Bauer felt that $3.00 should be charged for every type of toilet unit. It was felt that no action should be taken at this time, however, the matter should have some thought given to it. 79.81 Palm Beach County Municipal League Meeting - Reservations 12 7 79 In discussing this briefly, it seemed as if only a few of the Commissioners would be able to attend. Mayor Horton felt that the Town should be represented and Mrs. Roberts indicated that reservations did not have to be in until November 30th so they still had some time to decide. • 79.82 University of Florida Population Estimate Mrs. Roberts announced that the new population figure given by the University of Florida (dated April 1, 1979) was 2,701. As of July 1, 1978 the figure was 2,643. 79.83 Change of Meeting Dates for December and January (Christmas and New Year's are on a Tuesday.) It was the consensus of the Commission that the Workshop Meeting should be held on Wednesday, December 26, 1979 and the Regular Meeting on Wednesday, January 2, 1980. Town Manager's Reports Mrs. Roberts reported that she was a little disappointed in the number of people who went through the Florida Power & Light Energy Van on Friday, November 23rd, however, it was possibly due to the fact that it was the Thanksgiving weekend. Mr. Sliney told the Commission that a petition had been filed with the Court to give Judge Harper jurisdiction over the seized • boat belonging to the Town. Once this jurisdiction has been ob- tained, it is possible that Judge Harper can allow the Town to Minutes Highland Beach Town Commission Workshop Meeting November 27, 1979 sell the boat, thus recovering the storage charges. Page 5 of 6 Mrs. Roberts informed the Commission of two meetings - one at 7:30 P.M. Tuesday, November 27 (tonight) in Palm Beach Town Hall regarding rules and procedures for coastal construction and excavation - the other one is a Community Block Grant Development Advisory Board Meeting on November 29 in Delray Beach at 7:30 P.M. The Town Manager further reported that she had received a pro- posal from Harvel and Deland for maintenance on a storm drain that was installed quite awhile ago. Harvel and Deland would like to replace the old piping with PVC pipe at a cost of $800.00. This is located on Intracoastal Drive and has collapsed twice in the past. Harvel and Deland recommended that PVC pipe be used. Mrs. Roberts requested approval of the Commission at the Special Meeting to have this work done. Mrs. Roberts also stated that she had a proposal for work on new catch basins on Highland Beach Drive which will be taken care of by the four developers involved. Mayor Horton then told of Boca Hi's offer to donate four water saver awards to be given in conjunction with the expanded WET Group. These will be given to the hi-rise that shows the greatest percentage drop in water during the first four months of next year as compared with the same four months last year. There will also be a grand prize which will be given to the building which will show the best decrease for a total of all four months. Mrs. Roberts said that she hoped the temporary Post Office conditions would not inconvenience anyone. Mayor Horton then asked about the Emergency Ordinance No. 373 and on what date it should be extended; Mr. Sliney stated he would like to engage Mr. Callaway as an expert witness for the Van Lennep case and would like the approval of the Commission for this at the Special Meeting to follow. Mayor Horton then stated that the appointment of a member of the Commission might possibly take place at the Regular Meeting on • Tuesday, December 4, 1979, and asked that the Commission give some thought to this matter. Minutes Highland Beach Town Commission • Workshop Meeting November 27, 1979 Page 6 of 6 Commissioner Bauer then questioned the status of the contract with Del-Trail Fire District and Mrs. Roberts said that she would have some information for him before he left today. She also said that work has been started on the renovating of the fire station. Vice Mayor Mumford then asked why it was necessary that so many people come in the case of an emergency. She said that two police cars, the fire truck, and the rescue van plus nine men arrive at the scene. Mayor Horton suggested that Chief Jones be consulted on this. Mr. M. H. W. Dent, a Town resident, then addressed the Commission regarding the low bid received for the municipal complex; the seawall on Lot 71 and the sewer charge; in addition to the assess- ment valuation.
