Granting of the variance will be in harmony with the general purpose and intent of the ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. This is true for Variance 02(pool setback)in question:The subject property is a waterfront lot,which allows for a 5'-0"setback for pool deck.While the deck is allowed to encroach close to the rear property line,the pool(water's edge)has a 10'-0"setback requirement.This creates a hardship on the applicant as it significantly reduces the habitable pool size at the rear yard. (b) That the special conditions and circumstances do not result from the actions of the applicant, This is true for Variance 01(cabana setback)in question:The addition of the cabana structure to the already approved Planning Board design is an addition out of necessity.The applicant has recently been diagnosed with skin cancer,and the addition of the covered area is critical to the functionality of the property and safety of the applicant. This is true for Variance 02(pool setback)in question:The need for a pool setback variance is a result of the technicality of the code.Since the subject property is a waterfront lot,the required pool deck setback is only 5'-0".However,the pool(water's edge)setback remains at 10'-0"which creates an undesirable condition.As noted,this is resultant of the code,and not the applicant's decision. (c) That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands,buildings,or structures in the some district; This is true for Variance 01(cabana setback)in question:The proposed cabana is designed to have the least encroachment possible.Therefore,the small reduction from 20'-0"setback requirement to 7'-0" requirement will not confer a noticeable special privilege upon the applicant.Additionally,no view corridors for adjacent neighbors will be affected.
