2016.04.26_TC_Minutes_Workshop TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING WORKSHOP MEETING Tuesday, April 26, 2016 1:30 PM Mavor Bernard Featherman called the Workshop Meeting to order in the Town Commission Chambers at 1:30 PM. CALL TO ORDER: Roll Call: Members present: Mayor Bernard Featherman; Vice Mayor William Weitz, Ph.D; Commissioner Carl Feldman; Commissioner Louis P. Stern; and Commissioner Rhoda Zelniker. Also present: Town Attorney Glen Torcivia; Town Manager Beverly Brown; Town Clerk Valerie Oakes; Police Chief Craig Hartmann; Finance Director Cale Curtis; Library Director Lois Albertson and members of the public. Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence. Civility Pledge: The Civility Pledge was recited by the Town Clerk. 1. ADDITIONS,DELETIONS OR ACCEPTANCE OF AGENDA: Mayor Featherman called for any additions or deletions to the agenda. Item 6D — Vice Mayor Weitz asked that the review of the Policies and Procedures Manual be deleted from the agenda and be placed on an agenda for a Special Workshop Meeting for the sole purpose of discussion on this subject. Item 6E—Commissioner Zelniker added a discussion regarding crosswalk lighting. Item 6F— Commissioner Zelniker added a discussion on code enforcement. Hearing no further additions or deletions, the agenda was accepted as amended. 2. PUBLIC COMMENTS AND REQUESTS: Peter Rodis, 3224 S. Ocean Blvd. — I would like to thank the Mayor for his comments in the Palm Beach Post. He is absolutely right. We are the most favorite town in the county. Also, is it possible to have an update on the Delray Beach fire contract`' Town Commission Workshop Meeting Minutes Tuesdav, April 26, 2016 Page 2 of 11 Harry Adwar, 4740 S. Ocean Blvd. — I would like to thank Public Works Director Ed Soper for helping to get the crosswalk light on AIA at Boca Highlands to work properly. Carl Gehman, 1123 Highland Beach Dr. —There is always flooding on Highland Beach Dr. and AIA every time it rains. Hopefully this situation can be corrected. Kevin Ormes, 4200 S. Ocean Blvd. — We have a tremendous flooding problem. I am aware that Public Works Director Soper will be addressing a study that has been recently_ completed. Our property is located on the lowest point of Highland Beach. Each year when we return to Highland Beach, we have to replace our shrubbery because it is completely destroyed. I would appreciate you looking into this matter. Ed Neidich 4740 S. Ocean Blvd. — Our very fine Highland Beach Police Department is under voluntary review by Accreditors from the State of Florida Department of Law Enforcement. The Accreditors look at approximately 260 separate criteria for determining whether a given Police Department gets this high award for Accreditation. I have written a letter in praise of the Highland Beach Police Department. Our Police Department is the best under the highly capable stewardship of Chief Craig Hartmann, his lieutenants and the wonderful men and women of our force. 3. PRESENTATIONS: A) AIA Drainage Study James Poole, P.E.,District Drainage Engineer—District 4 Town Manager Brown — Commissioner Zelniker asked for a drainage study. Public Works Director Soper contacted the FDOT and this is the final report. James Poole, P.E. introduced George Corrales of the Department of Transportation who was more closely involved with this study. George Corrales — The Wantman Group performed this analysis, which was based on a video provided to them by P.W.D. Soper. This video identified the locations where the flooding was occurring on the bike lanes, sidewalks, swales and areas across the roadway. They also did several fill inspections during and after several rain events. Mr. Corrales gave a presentation summarizing the study, attached as Exhibit "A". If the work was to be performed all at one time, the total cost for this project would be S199,424.45, which does not include any design fees that would be required for the intermediate and the ultimate solution. We know this is an issue for the Commission. What we are planning to do is a quick fix now where we work on the design that would take care of the intermediate and final design. Commission Discussion: Commissioner Zelniker — We do have a climate change and live between two barriers of water. Does this study take into consideration our climate change, because there is a reality to where we live? James Poole, P.E. —Anything that has an outfall to the Intracoastal is going to be impacted Town Commission Workshop Meeting minutes Tuesdav, April 26, 2016 Page 3 of 11 by climate change when the sea levels rise, and it will rise. The outfalls into the Intracoastal that were not brought up during this presentation would be directly impacted. Even the ground water is going to be affected. Comm. Zelniker — For your point of information, we do not have an official bike lane. We have a shoulder. Perhaps we need a five or ten-year plan to address this climate change issue, since the water level will continue to rise. Also, would French drains help? Mr. Poole—Yes, they would. Commissioner Feldman— Since this is a State road, will the cost be picked up by the State? Mr. Poole — That is our hope. We have a few funding strategies in mind, and we are hoping that the costs remain in that ballpark. Comm. Feldman—Is it correct that we are only one foot above sea level on AIA? Mr. Poole—It depends on where you are. Comm. Feldman—All these drainages that you are talking about, will it actually drain somewhere. Mr. Poole — It will be less effective when we are experiencing a king tide. We are hoping to address your typical summer afternoon thunderstorm. Comm. Feldman — At 3210 S. Ocean Blvd., we have a large sewer system in our driveway that goes down about five feet and goes right into the Intracoastal. We never have a drainage problem. Comm. Feldman referred to the new ordinance regarding new homeowners building on AIA. Town Manager Brown — When someone gets a permit for a driveway on AIA, they are required by Florida Department of Transportation (FDOT) to widen the shoulder. Mr. Corrales — This definitely will help the bikers. Comm. Feldman — We would like to pursue this, and start as soon as we can. Commissioner Stern—You have presented an excellent proposal. What percentage of success do you think it would be from the presentation you made today? Mr. Corrales — You would definitely see a change, and there should be at least 80 percent less water on the road. The sea level will continue to rise, and whatever measures we put in now will start to decline over the years. The long term solution is putting in pump stations to get rid of the water as they are doing in Miami. However, this is a very expensive undertaking. Comm. Stern — Regarding the outfalls, is it legal to continue to put water into the Intracoastal Waterway? Mr. Corrales — We would have to go through a permitting process with South Florida Water Management. They would most likely ask us to do certain water treatments before we can send the water out. It is possible, but not a guarantee. Comm. Stern — What exposure does the town people have in financial obligations to get this work done? Mr. Corrales — Any help you can give us is welcomed. Since all the work will be within the FDOT right-of-way, we do not ask for you to contribute any funds. Vice Mayor Weitz — There has been some discussion regarding long term plans to redesign the sidewalk with either asphalt, cement or pavers. It is important that we integrate this information so we do not sabotage their work a year or two later. Mavor Featherman — There is one area that has a great deal of flooding, and would it continue after we do the repairs? If it isn't successful, how much would it cost to do it again, or take a recovery on what you need to do? Mr. Corrales — If it doesn't work at this particular location, we will definitely come back and take a look at a deeper extensive analysis. Town Manajw Brown — What would be the next step to get this project on the books with FDOT? Mr. Poole — We are moving it forward, developing designs and identifying with our maintenance people to see which areas they can address the sod issues right away. There might be some irrigation in some areas that could potentially be impacted. Vice Mayor Weitz —We have a potential problem because of the homes being built on the ocean side of AlA. They are bigger, and they are sloping, which causes the water problems we are incurring. This should be the responsibility of the homeowner and architect. It is a code enforcement issue. B) Proclamation: Municipal Clerks Week Town Clerk Oakes read the Proclamation into the record attached as Exhibit`B" Consensus was to approve the Proclamation for Mayor Featherman's signature. 4. PROPOSED ORDINANCES AND RESOLUTIONS: A) ORDINANCE NO. 16-007 O—2nd READING on May 3, 2016 AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA AMENDING THE TOWN CODE OF ORDINANCES BY AMENDING CHAPTER 7, "ELECTIONS", ARTICLE I, "IN GENERAL" TO CREATE SECTION 7-4, "RESIGN-TO-RUN" TO PROVIDING FOR RESIGN TO RUN REGULATIONS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Town Clerk Oakes read Ordinance No. 16-007 O into the record. Consensus was to place Ordinance No. 16-007 on the May 3rd agenda for the 2nd reading. NEW BUSINESS: A) Consideration of Placing an Ad in the Florida League of Cities (FLD) Conference Issue of the Quality Cities Magazine Town Manager Brown — For a number of years the Town of Highland Beach has placed a congratulatory ad in the Conference Issue of the Florida League of Cities Quality Cities Magazine. We have received the FLC ad notice for this year's conference which will be held at the Diplomat Resort and Spa in Hollywood on August 14th thru August 20th. To purchase the same half-page ad as previous years, the ad will cost $400.00. Money has been identified in the budget to cover this expense. I would also like to note that Mayor Susan Haynie of Boca Raton will be installed as President of the Florida League of Cities at this conference. Comm. Feldman — I would like to have the picture of the five Commissioners that was taken at the Spring Fling Community Event placed in the ad. Consensus was to place this item on the Consent Agenda for May 3rd. B) Approval of the Proposed Recommended Change to ARTICLE XIII of the Personnel Rules and Regulations Town Manager Brown — The Town Commission approved reinstating the "Longevity Bonus" when they adopted the 2015-2016 Fiscal Budgets. Before staff can implement the policy, it requires approval by the Town Commission. This change in policy was presented to the Commission in November, but there was a question regarding at which years of service the longevity would be paid. Staff has incorporated the recommended changes and requests the following addition to the Personnel Rules and Regulations — ARTICLE XIII — PAYROLL INFORMATION. SECTION 10: LONGEVITY PAY. Longevity Pay will be based on the employee's base salary and paid out in a lump sum check as follows: 10th year of employment— 2%; 15th year of employment - 3%; 20th year of employment- 4%; 25`h year of employment and every 5th year thereafter- 5%. Consensus was to place this item on the Consent Agenda for May 3rd. C) Commission to Authorize Mayor Featherman to Attend the Florida League of Mayors 2016 Conference Town Manager Brown — Mayor Featherman has requested funding to attend the Florida League of Mayors 2016 Conference to be held in Orlando from May 5th thru May 7th. This conference was not included as part of the adopted 2015-2016 Budget. Estimated costs that would include registration, hotel, meals and mileage are S 1,150.00. Town Commission Workshop Meeting!Minutes Tuesdati, April 26, 2016 Page 6 of 11 Commission Discussion: Vice Mayor Weitz — We have had major cuts in the budget, and some of these areas had to do with attending conferences, workshops and other types of meetings. I am not supporting this particular expenditure because it wasn't budgeted. Comm. Feldman — The Mayor has attended this conference every year. If it wasn't in the budget, it should have been. I am in favor of the Mayor attending this conference, and ask that he give a report on what is accomplished at these conferences. Comm. Zelniker—I agree with Vice Mayor Weitz, and the reason being the topic. It is about the upcoming election, and I do not see how this is relevant to our town. Comm. Stern—I am not in favor of sending a representative at this time. We should save this for the upcoming Mayor. No action was taken. D) Review of the Policies and -owes Alanual E) Discussion on Sidewalk Crossings Comm. Zelniker asked Town Manager Brown to give her report on this subject. Town Manager Brown read into the record her report on Rapid Rectangular Flashing Beacons attached as Exhibit "C". Basically, the FDOT District IV Pedestrian/Bicycle Safety Specialist notified us that unless there is a compelling reason to replace the standardized signs presently used, FDOT will not allow the LED signage. Comm. Zelniker — This is a safety and wellbeing issue for the people who live in Highland Beach. If necessary, we have to get our Senators and Congress Representatives involved. This is an accident waiting to happen. This Commission has the best interest of the residents at heart, and the safety and wellbeing of our residents will continue to be the first priority of this Commission. This answer is unacceptable, and we have to pursue this, even if it means going to the Governor's office. Vice Mayor Weitz— I have to agree that safety is an issue. What we can control, we control, and what we don't control, we don't control. No matter what we do, no one can prevent a catastrophic accident, unfortunately. The FDOT is under the jurisdiction of the Governor. We have dealt with a situation similar to this with the Intracoastal. This Commission has come to the realization that it is a matter of law and political realities, and we cannot change that internally. Comm. Stern — I worked very hard for many years on the Intracoastal situation, and I got the same answer after 12 years of my effort. What concerns me more is, now that we have delved into this, they want to take away our paddles (rebounders). They keep getting knocked over, and Town Commission Workshop Meeting Minutes Tuesdav, April 26, 2016 Page 7 of 11 now they want to charge us $65.00 for every single paddle that gets knocked down. This is going to be an expense, since we lost at least 100 of them over the last three _years. There is only so much we can do as a Commission. The State is now moving these rebounders from the center to the side of the road where they are not as effective. Comm. Feldman—The burden for crossing AIA or any street is still the pedestrian's burden. Town Manager Brown — Education to our residents might be a good idea, too. I was going to ask Chief Hartmann to start a program and go to the condos to give some instruction to the residents about crossing at these crosswalks. F) Discussion on Code Enforcement Comm. Zelniker—After receiving calls from residents in Bel Lido, I drove to see for myself just what is happening on Tranquility Dr. There were dumpsters in front of job sites, and no fences. There are bulldozers on a lot where the house was demolished, and no fence. Are we getting a report every day from the part time Code Enforcer? Town Manager Brown— I do not get a daily report, but I do see him around town all day long. Unless you have a permit, you do not need to put up a fence. Comm. Zelniker—Then we need to have an ordinance to address this. Comm. Feldman — We have many ordinances. If everyone would comply with the ordinances we would be in fine shape. I drove past the empty lot, and it was flat. I don't think there is any ordinance that states you cannot leave a bulldozer sitting on a lot. We cannot make a Town ordinance for every little thing that comes along. Once a permit is given a fence must be placed on all four sides of the site. Comm. Stern— I noticed a job being done without a permit. I notified the new code enforcement person, Orlando Rodriquez, and the job was stopped within the half hour. I do know we have a third person doing what has to be done. Vice Mayor Weitz — SAFEbuilt has provided this town with a part time code enforcement person, and we have given them 90 days to remediate the issues we have been dealing with. If people of this Town are concerned about the functioning of this town, the operational functions of this town are monitored through the Town Manager and her staff, not the Commissioners. Mayor Featherman— I am in agreement with my fellow Commissioners. 7. MISCELLANEOUS —ITEMS LEFT OVER: A) Discussion on Commission's Recommendations for the following Job Descriptions: 0 Library Commission Discussion: Comm. Feldman — The Library job descriptions are complete and have been recently updated. We have a new Library Director who is doing an excellent job. The Library staff is working Town Commission Nv orkshop Meeting Minutes Tuesdav, April 26, 2016 Page 8 of 11 with the Friends of the Library in helping them with their programs. How does this work? Library Director Albertson —The Library staff works with the Friends of the Library on booking and running the events, scheduling, etc., which are primarily for the concerts. The Friends of the Library provide the financing. Comm. Feldman — Is there anything from the old budget that you would like to have in the new budget. Lib. Dir. Albertson — We do have the need for some computers to replace some of our patron computers, and I would like to consider this for the upcoming budget season. We also have a 3D printer that is partially assembled. Comm. Feldman— George Kelvin is interested in the 3D printer, and perhaps he could look at it with our IT people and get it working. Keep up the wonderful work you are doing with the Library. Comm. Stern — Accolades also to you for the wonderful job you are doing with the Library. Now that the job descriptions have been updated, I see no changes necessary. Vice Mayor Weitz — You and your staff are doing an excellent job with the Library. I have two recommendations that will carry through to all job descriptions. One is under the minimum qualifications which states "a comparable amount of training, education or experience may be substituted for the minimum qualifications". I do not support that and would like this statement removed. Certain positions require specific education requirements. The second is under Duties and Responsibilities which should include the phrase "and other duties as assigned". Town Manager Brown—This phrase is included under Position Summary. Comm. Zelniker—I see no problem with the updated job descriptions. However, I do agree with Vice Mayor Weitz that the sentence regarding comparable amount of training, etc. be removed from all job descriptions. B) Minutes: • March 29, 2016 —Special Meeting • March 29, 2016—Workshop Meeting • April 5, 2016 —Regular Meeting Consensus was to place this item on the Consent Agenda for May 3rd 8. REPORTS —TOWN COMMISSION: A) Commissioner Rhoda Zelniker — I would like to thank Town Clerk Oakes and all the staff members who helped put together the wonder "Spring Fling Community Event". It was very well received by the residents of Highland Beach. Town Commission Workshop Meeting Minutes Tuesdav, April 26, 2016 Page 9 of 11 B) Commissioner Stern — I would also like to thank the staff for putting together the wonderful community event. Thank you to the Town staff for the wonderful pictures in the hallway and the flag honoring our veterans. • Water Usage We are going into a water rate study. Our ordinances now place a eery stiff penalty on homeowners that have overage water usage, through no fault of their own, where a pipe is broken and nobody is aware. We have approved a system that could detect that, and I have found out that the system does not actually alert them soon enough to a broken pipe. These homeowners are being charged the maximum possible on our current rate study, so they are paying triple for the amount of water that is going through the pipe, which is an unfair charge. We are doing a water rate study and am hopeful that we will be able to look into the possibility that we do not give them a triple charge for the amount of water used; but that there could be a one-time forgiveness for a broken pipe that you did not know about in a period of time for one year or three years, or whatever we decide is feasible. I hope to get support on this. C) Commissioner Carl Feldman displayed the flag which was designed by George Kelvin honoring our veterans. Comm. Feldman — The Spring Fling was a great time, and I would like to thank Valerie, Beverly, Rosalie and staff for putting together such a wonderful event. Also, many thanks to Bill Moore and the Public Works Department for the wonderful job they did in preparing and organizing the parking lot. A special thanks to Vice Mayor Weitz for being my "bun man" and assisting me in cooking the hot dogs. With regards to the negotiations on the fire department, we are still working on this issue with the City of Delray Beach, Palm Beach County and the barrier islands, and hopefully we will have a decision within the next few weeks. Following up on Comm. Stern's report, I thought we had a system that would be able to identify any broken pipe or over usage very quickly. Public Works Director Soper — When I started two years ago, we had $55,000 budgeted for a system where the smart meters would read into the Cloud, and customers could go onto the Cloud and look at what they were using. There is an ongoing maintenance cost with that for approximately $12,000 a year. The Public Utilities Commission states that once it goes through the citizen's meter, they have to pay for it no matter what. I came up with a belt clip technology where you could do a drive by, download it, identify high usage, and then go back to see when it occurred and how much they actually used. Since this has been implemented, there has been so much more advanced technology. The bottom line is that it is still the customer's issue, and they would still have to go onto the Cloud, since I don't believe the town wants to be responsible for things that are happening on private property. No matter what technology we buy, there is always going to be a chance of it being faulty. I think the idea of having a forgiveness policy, or a reduction to a lower rate, would be excellent. Comm. Feldman — I also think this is a good idea. Would we need to have a new ordinance prepared? PWD Soper — We would have to change the existing ordinance, which would refer to the fee schedule we are now developing for the Commission's consideration. Town Attorney Torcivia — The fee schedule could be in a resolution and updated as often as it needs to be. Comm. Feldman — There was a water report in the Highlander, and most people, including myself, did not understand it. Could PWD Soper come to one of our meetings and explain this report? Town Town Commission Workshop Meeting Minutes Tuesdav, April 26, 2016 Page 10 of 11 Manager Brown — That is required yearly due to our license, but I will have PWD come to a meeting and explain the report. D) Vice Mayor Weitz —I want to thank Town Manager Brown for the display of our former Mayors placed on the wall in our Chambers. Also for the pictures of the earlier days of our Town. Many thanks to the staff for a wonderful Spring Fling Event. It was a job well done, and we hope to see many more people there next year. E) Mayor Bernard Featherman read into the record an email sent to him by Alan Teller regarding attendance at commission meetings attached as Exhibit "D". Mayor Featherman— I also received a letter from a resident complaining about the trash left on the beach by residents living across from his home. I spoke to Town Manager Brown who will be sending a letter advising them, if they do use the beach, to be sure to keep it clean. Last year we saved 5650,000 on our expenses in our Town, and hopefully this year we could save even more. We are always looking to see what we could save the town and still give them first class service. We have great residents, great Commissioners and our staff is the best. 9. REPORTS—TOWN ATTORNEY GLEN TORCIVIA: We are still continuing to pursue fire rescue solutions. 10. REPORTS—TOWN MANAGER BEVERLY BROWN: I would like to thank all of the staff for taking the time on a Saturday to work at the Spring Fling and our golf cart driver, Ed Soper. We rented a golf cart for that day. In the future, if the Library has any large programs, we could do the same thing and transport people back and forth from the parking lot at St Lucy's Church. If you look at the plaques on the wall, it tells you exactly when the Mayors were in office. When the Commissioners do receive complaints, I would like you to contact me so I can investigate it and report at the meeting. George Kelvin, I hope you are happy with the flag. It is beautiful. Brown Town Manager RE: Rapid Rectangular Flashing Beacons After resident John Boden shared his thoughts at last month's Commission Meeting in reference to pedestrian safety while using the crosswalks in Highland Beach, staff investigated various LED blinker signs and crosswalk systems that are presently available. We discovered that there are many different types of signs: LED enhancing signs, crosswalk lighting systems, reflective post panels, flashing blinker signs and the type used in Highland Beach crosswalk rebounders. Unfortunately, the staff time spent and our investigation was to no avail. PWD Soper received an email from the FDOT District IV Pedestrian/Bicycle Safety Specialist who noted us that unless there is a compelling reason to replace the standardized signs presently used (documented conflict or crash problems at crosswalks); FDOT will not allow the LED signage. Even though the signage is charged by solar panels, the panels charge a battery that technically provides the voltage necessary for these signs. If they were to be allowed, the signs would be installed on the FDOT right-of-way and create an unfunded maintenance expenditure for that department. On a side note, if the Town wants to continue having the crosswalk rebounders replaced, FDOT is going to require a "Maintenance Memorandum of Agreement (MMOA)" between FDOT and the Town requiring the Town to cover the cost of the replacement of the damaged crosswalk rebounders. I had the privilege of serving on the Highland Beach financial advisory board some years ago, and finished service as it's chairman. Your remarks regarding low attendance of your meetings by the citizens struck a familiar chord. This has been the complaint most mentioned by all who serve on public forums in town. I have come to the conclusion that low attendance means that the citizens mostly agree with the job being done by the commission and have confidence in the commissioners acting in the Town's best interests. I have had the experience of seeing strong reactions from our citizens when they disagree with actions, and have seen the town hall packed to overflowing on more than one subject. The "park" issue as well as traffic lights and 24 hour police boat patrols come to mind. There are many more examples. We citizens are out here and do have an interest in your activities.
