TOWN OF HIGHLAND BEACH
MINUTES OF TOWN COMMISSION MEETING
REGULAR MEETING
Tuesday, March 4, 2008 1.30 P M
Mayor Harold R. Hagelmann called the Regular Meeting to order in Commission Chambers at
1:30 P.M.
CALL TO ORDER:
Roll Call: Members present: Mayor Harold R. Hagelmann; Vice Mayor Joseph J. Asselta;
Commissioner Miriam S. Zwick; and Commissioner Doris M. Trinley. Also present: Town
Attorney Tom Sliney; Town Manager Dale S. Sugerman; Town Clerk Beverly M. Brown; and
members of the public. Commissioner Jim Newill, CPA was absent due to illness.
Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence in
honor of members of the military, both living and deceased.

2. PUBLIC COMMENTS AND REQUESTS
Joe Yucht -Boca Highlands
Last Thursday, the Cultural Board sponsored a program "Saving our Lives" presented by
Dr. Gordon of the University of Miami. There were 39 people present, including two
Commissioners and their wives. The program was on life saving techniques, and I was
disappointed that the Cultural Board did not see fit to video the program for future
distribution. On March 17th, there will be a bus trip to the university if we have enough
people interested in attending. After last week's meeting, I asked the Town Manager why
he had not scheduled a debate and he stated it was a conflict of interest. With the
upcoming election, it is a crime that we are not having a debate amongst the candidates.
Town Mana eg r Su e~rman -The Town's Code does not allow campaigning on town
property. In addition, my IMCA Code of Ethics prohibits me from sponsoring this type of
function.
Commissioner Zwick - In prior years, the League of Woman Voters has come forward and
requested authorization from the Town to hold a debate. Possibly there was no interest this

• Hart Selnick -Toscana
The Commission is seated because they have been elected by the residents of Highland
Beach, and the residents deserve respect when speaking. On the agenda today is a proposal
for a salary adjustment for the Town Manager, we are in a recession and there should be a
moratorium on raises.
Karm Hill -Seagate
In the past the Town has approached the League of Woman Voters to hold the debate, but
no one contacted us this year. Mayor Hagelmann inquired if they would still be interested
this year? Mrs. Hill stated she would check and get back to the Town Manager.
Beverly Knight - 4023 S. Ocean Blvd.
The Beaches and Shores Committee just returned from the state "Sea Turtle" training, and
we discovered we were the only community in the state that had a "hawksbill" nest hatch
throughout the entire state. In order to keep the homeowners in tune with what is going on
within the town, we are putting together an "Alliance of Homeowners Association."
Town Mana eg r Su erman -Would like to take a "Personal Privilege" and remind
homeowners and residents on the beach that the "Sea Turtle" Nesting Season began
March 1St and does end until October 1St. Any lights beach side, should be dimmed or
turned off from dusk to dawn. Have already received complaints that people are not
turning down or off their lights facing the water.

Previously have attended "Candidate's Night," but feel candidates schedule are full with
speaking engagements from now until the election.

4. BOARDS AND COMMITTEES
A) Board Correspondence
Town Manager Sugerman - At the March 12th Planning Meeting, the County is
expected to respond to the reports submitted by the town's professionals. In response
to a question about the Commission attending the Planning Workshop, Manager
Sugerman stated that there is nothing stopping the Commission from attending, but his
preference is that they did not. The final approval will be made by the Commission and
would like them all to hear the information at the same time.

5. PROPOSED ORDINANCES AND RESOLUTIONS
A) Resolution No. 08-002 R - Authorizing a Salary Adjustment for the Town Manager
Town Mana eg r Su erman - In Section 2 of the Employment Agreement that I have with
the Town, it says in part "on the basis of an annual salary/performance review of said
Employee, Town may award Employee a merit increase not to exceed seven (7%) of base
salary." Several weeks ago, I circulated to the members of the Board a memorandum
outlining the activities and accomplishments over the past year, along with a blank
evaluation sheet. The evaluations are attached and it is up to the Commission to determine
how much of an increase is appropriate.
Vice Mayor Asselta - At one point in time, we totaled the recommendations and then
• divided by 5. Commissioner Trinley -The merit increases are generally in the 4-5% range.
Feel we should total the recommendations and then divide it by 5. The increase would then
be 3.15%.
MOTION: Commissioner Zwick moved to approve Resolution No. 08-002R and grant
Town Manager Sugerman a 3.15% increase in base salary effective March 7, 2008;
seconded by Commissioner Trinley.
Motion carried by Unanimous Voice Vote.
6) NEW BUSINESS
A) Waiving the last sentence of Section 20-46 of the Code of Ordinances -Board of
Adjustment and Appeals which prohibits membership on the Board by an official or
employee of the Town.
MOTION: Commissioner Zwick moved to waive the last sentence of Section 20-46 of the
Code of Ordinances "No member of the Board shall be an official or employee of the
town. " as a one time waiver, for Theresa Colarullo until the end of this term; seconded by
Commissioner Trinley.
Commissioner Zwick -Have worked with Mrs. Colarullo for sxc years, she is a hard
• working citizen of the town and a part time employee of the library. The Commission
inadvertently over looked this prohibition when they appointed her. Commissioner Trinley

- This provision in the code was overlooked, and do not feel we should penalize her. It
• was poor judgment on out part.
Motion carried by Unanimous Voice Vote.
B} Authorizing the Purchase of Two Patrol Vehicles for the Police Department
Town Mana er Su erman -After the current budget year began, the Town Commission
authorized two additional patrol officers and the purchase of two additional patrol vehicles.
Each vehicle exceeds authority of the Town Manager as they are over $15,000.00,
therefore it would need Commission approval. Because of a clerical error, the Town has
already taken delivery of these4 vehicles, but the purchase will not be finalized until the
Town Commission grants its approval.

12) PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT

Emil. Firtell - Beachwalk East
Concur with the safety at the crosswalks. I can be stopped to allow a pedestrian to cross,
and traffic in the opposite direction keeps going, in addition to the bicyclists. You often
find the bicyclists riding in the traffic lane, and they do not budge when traffic gets delayed
behind them. They create a dangerous situation. Will citations also be issued to them?
Town Mana eg_r Su eg_rman -The Town Code does not address how bicyclists can ride, that
would be regulated by state law. They are allowed to ride 2 X 2, and are entitled to space
on the roadway as is any other vehicle. Police Officers can issue citations if they are not
following state law.
12. ADJOURNMENT
There being no further business to come before the Commission. Mayor Hagelmann
adjourned the Regular Meeting at 2:15 P.M. upon a MOTION by Commissioner Newill
seconded by Commissioner Zwick.
