MINUTES OF TOWN COMMISSION MEETING
REGULAR MEETING
Tuesday, March 1, 2016 1:30 PM
Mayor Bernard Featherman called the Regular Meeting to order in the Town Commission Chambers at
1:30 PM.
CALL TO ORDER:
Roll Call: Members present: Mayor Bernard Featherman; Vice Mayor William Weitz, Ph.D;
Commissioner Carl Feldman; Commissioner Louis P. Stern; and Commissioner Rhoda Zelniker. Also
present: Town Attorney Glen Torcivia; Town Manager Beverly Brown; Town Clerk Valerie Oakes; Police
Chief Craig Hartmann; Finance Director Cale Curtis; Public Works Director Edward J. Soper; Library
Director Lois Albertson and members of the public.
Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence.
Civility Pledge: The Civility Pledge was recited by the Town Clerk.
1. ADDITIONS,DELETIONS OR ACCEPTANCE OF AGENDA:
Mayor Featherman called for any additions or deletions to the agenda.
Item 7B)—Town Manager Brown added the placement of a crosswalk by 45 Ocean Condominium.
Item 7C)—Vice Mayor Weitz added the possibility of having shelters and benches at various locations
in the Town for the school children while waiting for their buses.
Item 7D) — Commissioner Zelniker added a discussion on a policy for Town employees who wish to
run for office.
Hearing no further additions or deletions, the agenda was accepted as amended.
2. PUBLIC COMMENTS AND REOUESTS:
Tim Burnich, 4505 S. Ocean Blvd. — On Wednesday, February 24ffi at approximately noon, a concrete
projectile flew from the south side of 3200 S. Ocean Blvd., now under construction, into the balcony
glass door of apartment 704 at Villa Costa Condominium, 3210 S. Ocean Blvd. breaking the glass
door and leaving the concrete projectile in the apartment. It was luck that no one was injured. The
developer is going to repair the damage. As the manager of Villa Costa, I am concerned for the
residents who live on the north side of 3210 S. Ocean Blvd., and can this happen again. As the Chair
of the Code Enforcement Board, I would like to know what steps the Building Department is taking to
ensure the safety of the residents of Villa Costa, and that this does not happen again. I believe OSHA

should be notified if they have not been already. I request that the Town Commission address this
serious matter.
Phil Weinstein, 4504 S. Ocean Blvd. — I attended a meeting to approve a boatlift on our canal. I was
disappointed with the end result of that meeting. The Town requires a mailing which people received,
some yes and some no. I was told that perhaps this Commission could change the code to disallow
such a structure from being constructed. In my community there is one boatlift that is tucked into the
corner. My concern is that, if this is permitted, we are going to turn our beautiful town into a marina
with a dry dock lift where boats are risen out of the water. I believe an ordinance can be passed that
would stopped these boatlifts from going forward. We do not want our area to become a commercial
marina which obstructs views, is unsightly and takes away from our serenity.
Steve Artusie, 1109 Russell Drive — I am a Board member of the Highland House, and represent the
six homeowners on the waterway directly across from the proposed lift that Mr. Weinstein referred to.
We are in agreement with Mr. Weinstein's request to have the Commission adopt an ordinance
prohibiting these types of structures, and prohibiting this particular structure from being constructed.
Vice Mayor Weitz — If an individual does not favor the outcome of the Board's decision, they could
appeal that decision through the courts. This Commission has no authority to alter or adjust this
decision since it is a Quasi-judicial Board. The condominium boards, depending on where you live,
have prevailing control over the type of structures that are allowed. Commissioner Feldman — Some
condominium by-laws prohibit these types of structures. If you are concerned, perhaps you can bring
it to the attention of your Condominium Association to prohibit boatlifts, and this would supersede the
law. Commissioner Zelniker — (Read Code 30-68.4 and 30-68.7 regarding boatlifts). The Planning
Board has the final decision making authority over the granting of an approval for dolphins, free
standing pilings, boatlifts and moorings. Appeals of the decision are to be filed in the Fifteen Circuit
Court of Palm Beach County within 30 days of the final decision. There are many residents who have
voiced their concerns, not only about the boatlifts, but also the many townhomes and mansions that are
being constructed in Highland Beach. I am requesting that we put this matter on an agenda, and
perhaps we can adjust the criteria on some of these issues and some residents could come to the
meeting. Vice Mayor Weitz — This is a point of order. We have already commented that we are not
the prevailing authority in these matters. We should not be commenting, directing or advising any
residents as to their actions, and Commissioner Zelniker should not be discussing this at this time.
Commissioner Stern — Having been Chairman of the Planning Board for six years, we had this issue
many, many times. It always came down to one thing; it is a boating community and no one in this
town is guaranteed a view. The code states that a canal must be 80 feet wide. This canal is 156 feet
wide, and in this case there is no navigation problems, view problems or turning around problems.

description of her background, responsibilities and achievements since joining the Property
Appraiser's Office in 1988.

2015 (attached as Exhibit"A").

Town Manager Brown—Mr. Weinstein and Mr. Artusie indicated that not everyone was notified. We
have signed green cards that they received their notice. Also, we have one from Mr. Walters who
claimed he did not receive a notice. Town Clerk Oakes—Today the Commission will be approving an
ordinance for posting signs on the property when there is a public hearing. We also posted these signs
at the property, so there were at least three types of notifications.

Comm. Zelniker — I am opposed to this ordinance because I feel builders should not have
exceptions, and they should live within the codes.
Comm. Feldman—I agree with Comm. Zelniker.
Comm. Stern—I support this ordinance.
Vice Mayor Weitz — I also support this ordinance. Anyone should have the ability to ask for a
variance. It is improper to have an absolute concept that we prevent anyone from applying.
There is no guarantee that their variance would be granted. This could probably be more
challengeable in a more statutory way. We have an excellent Board of Adjustment and Appeals
as well as an excellent legal system to back that up.
Public Comments:
Tim Burnich, 4505 S. Ocean Blvd. —I agree with Comm. Zelniker and Comm. Feldman.
Commission Discussion:
Comm. Zelniker — Is it illegal not to give someone a chance to have an exception? Town
Attorney Torcivia—You always have that choice. It is unusual, but you could.
Vice Mayor Weitz — There already is an ordinance that permits certain exceptions. I am not for
big buildings and developments, but I am for due process. The idea that you would say you can't
apply for a variance, even if it may get rejected, I think is absolutist and you would be open to
significant challenges.

MOTION: Commissioner Feldman moved to accept the Consent Agenda. Motion was seconded by
Commissioner Stern, which passed unanimously.
7. NEW BUSINESS:
A) Commission to Revoke the Revised Inter-Local Agreement with Delray Beach for Fire
Services
Town Attorney Torcivia — At the last meeting, Commissioner Feldman pointed out that the
agreement this Commission approved on December 18, 2015 is technically still alive. It was
signed and forwarded to Delray Beach. Since then, Delray has taken some action that has been
somewhat upsetting. We also did some research as to the amount of time they are transporting, an
average of better than once a day, someone out of Highland Beach using Highland Beach
equipment and personnel to Delray Beach. My letter to Delray Beach rescinds and revokes that
previous approval. This letter will be delivered prior to their meeting this evening, so they will
know you are not interested in going forward on the agreement approved in December.
Commission Discussion:
Comm. Stern — Our Town Attorney has written an excellent letter to the Delray Beach Town
Manager, Mr. Cooper, indicating our intention to rescind this agreement.
Comm. Feldman — We had to have a letter to revoke. (Read a February 25th newspaper article
stating that according to city records, the Highland Beach Fire Station responded to 35 Delray
Beach service calls. We only had five, which means we were paying for more service out of the
town then in the town.
Vice Mayor Weitz— I totally endorse this letter and applaud the fine work the Town Attorney has
done in supporting the town.
Comm. Zelniker—I also agree that we need to move on.
Mayor Featherman — I would also like to commend our legal department on the work they have
done on this, and the direction we have taken.

Town Attorney Torcivia — I appreciate all the kind words, but I must share them with Town
Manager Brown and Fin. Dir. Curtis because they have been very involved with all the
negotiations.
MOTION: Vice Mayor Weitz moved to endorse Town Attorney Torcivia's letter as a
Commission, and forward it immediately to Delray Beach prior to their meeting so they
understand our position. Motion was seconded by Commissioner Zelniker, which passed
unanimously.
B) Discussion regarding Crosswalks on AlA by 45 Ocean Condominium
Town Manager Brown—I received a letter requesting a crosswalk in the vicinity of the 45 Ocean
Condominium due to the heavy pedestrian traffic crossing at that location. I would like
authorization to submit this letter to Florida Department of Transportation (FDOT) requesting an
additional crosswalk.
Commission Discussion:
Comm. Stern—I have contacted the FDOT in the past to have a crosswalk placed in that vicinity,
and was turned down. I think we should try again.
Vice Mayor Weitz — The traffic flow during the season has gotten so heavy. We want to ensure
pedestrian safety, and I have no problem supporting this request.
Comm. Feldman—One of the regulations you must have before you apply for a crosswalk is there
needs to be a handicap access ramp from the sidewalk to the street on both sides of A IA. It could
be costly to the residents if they want to pursue this.
Comm. Zelniker — It is important that we protect our residents, and we should definitely pursue
this.
Mayor Featherman — I suggest the Town Manager investigate what is needed and what the
regulations are for the DOT. Town Manager Brown — I will contact the DOT to see what the
specifications are for a crosswalk and notify 45 Ocean. They can determine if they want to spend
the money to meet the minimum qualifications to get the crosswalk.
C) Discussion on Placing Shelters and Benches for School Children Waiting for Bus
Vice Mayor Weitz — We are becoming more aware of the amount of children moving into
Highland Beach. Many of them have bus pickups at certain locations in town, but have no
benches or shelters in case of inclement weather. I am not certain whether this is a town or state
consideration, but the concept is a good one for the safety and comfort of the children.
Town Manager Brown — I requested a list of bus stops from Police Chief Hartmann, and will
follow up with the Commission.

D) Discussion on Policy Regarding an Employee Wishing to Run for Office
Comm. Zelniker — Our Town Attorney gave us some ideas as to what other municipalities do in
this situation. There should be a discussion on how we want to proceed with this.
Comm. Feldman — There should be some rules and regulations. I would like to see if a town
employee wishes to run for office, their position with the Town be terminated.
Vice Mayor Weitz — There should be a policy in place, and I would leave that up to the Town
Attorney to guide us and see what could be done legally.
Town Manager Brown — We are one of the few municipalities that does not do a background
check on a candidate, and I would like to add this in.
Discussion ensued as to whether an employee wishing to run for office should resign or take a
leave of absence during the campaign.
Consensus was to have the Town Attorney draft a policy regarding an employee resigning to run
for office, and to include requirement of candidate background check, which will be presented at
the next meeting.
8. MISCELLANEOUS ITEMS—LEFT OVER:
None.
9. REPORTS—TOWN COMMISSION:
A) Commissioner Zelniker — Now that we said no to Ordinance No. 16-003 O regarding
exceptions, could we legally change the ordinance we now have to "no exceptions". Vice Mayor
Weitz—That was a height variance. We already have an ordinance on the books that have height
exceptions, even more than what we are trying to control. We have now reverted back to the
original ordinance. Comm. Zelniker—I am asking for an ordinance that would say no exceptions.
You must follow our codes. Comm. Stern — I am not sure why we are walking away from this
ordinance. There are two height exceptions allowed, and this would prevent asking for any more
exceptions. I don't agree that there should be no exceptions. There are all kinds of exceptions on
our books.
B) Commissioner Feldman — There was a fire at the condominium next to the Delray Sands Hotel.
Traffic was tied up for over an hour. I called the Palm Beach Late Line and was frustrated with
how the call was handled. Eventually I received a call from a Highland Beach Police Officer who
informed me that there was a fire and traffic should be moving shortly. My wife was unable to
get to our condominium, so I informed her that she should park at the Delray Sands Hotel and
walk home. Unfortunately, my wife along with 25 other residents, many of them elderly, were
told they could not walk, the street was closed and they could not get back home. This is totally
unacceptable. When there is a situation on AlA, we have Code Red, and the residents should be

notified that the street is on lockdown. We definitely need a way to be able to contact the officers
on patrol in Highland Beach when a situation comes up. This was a Sunday and there was no
way of contacting anyone.
Comm. Feldman— Regarding the damage done to a resident's home at 3210 S. Ocean Blvd. by a
cement projectile coming from 3200 S. Ocean Blvd. When something like this happens, the
Building Inspector should go directly to the site, close down the site and call OSHA. This was a
very serious matter.
C) Commissioner Stern — Last Wednesday, Town Manager Brown and myself went to the League
of Cities Luncheon. There was a presentation on the one percent (1%) that would take our sales
tax from six percent (6%) to seven percent (7%). If this goes through, the Town of Highland
Beach could be entitled to some monies for which we made an application to take care of some
items such as the walk path, fire engine, etc. in the town. For your information, a House Bill was
passed in Tallahassee that allows disabled veterans to park free of charge at the Florida airports.
It would also give additional funds so they could be retrained for other jobs.
D) Vice Mayor Weitz — I would encourage everyone to exercise their right to vote. With reference
to Comm. Feldman's statement, it seems to me that we are constantly hearing about construction
problems after the fact. We have no preventive outreach to check, monitor, pay site visits and
check on construction sites to see what is going on in terms of OSHA. There is so much
construction on AIA, and someone needs to be out there at all times monitoring these sites. Once
the Spanish River to I-95 is complete, there will be an excess flow of traffic. Spanish River Road
is one of our major ways of moving onto the barrier island and entering Highland Beach.

construction sites at all times. I have been contacted by many people regarding the light on AIA
and Linton Blvd. and the heavy traffic backup this causes because of the amount of people
making a left hand turn onto Linton Blvd. Something needs to be done about the timing of the
light.

11. REPORTS—TOWN MANAGER BEVERLY BROWN:
Regarding the light on AIA and Linton Blvd., Police Chief Hartmann and I called FDOT and Delray.
They claim that when the light turns, some of the drivers don't immediately move causing a backup.
It is the amount of visitors that we have here and we have to live with it. We have contacted them
numerous times, and don't know what else we could do about this situation.
The bridge over I-95 at Spanish River Blvd. is under construction, and will eventually be a four lane
road with a breakdown lane. So it will be six lanes going over I-95. They are also building a major
condo development in that area. The traffic will be horrendous over the next few years.

Carl Gehman, 1123 Highland Beach Drive. —I agree about the height of the buildings. Thank you for
the great job you are doing.
Edward Neidich, 4740 S. Ocean Blvd. — I have some concerns regarding the situation at 3200 S.
Ocean Blvd. A Building Inspector needs to get there first before a builder has a chance to remedy
anything, because any potential investigation could be compromised. It is dangerous and we need to
prevent this from happening.

motion to adjourn the Regular Meeting at 3:07 PM.
