REGULAR MEETING

Mayor Bernard Featherman called the Regular Meeting to order in the Town Commission Chambers at
1:30 PM.
CALL TO ORDER:
Roll Call: Members present: Mayor Bernard Featherman; Vice Mavor William Weitz, Ph.D;
Commissioner Carl Feldman; Commissioner Louis P. Stern; and Commissioner Rhoda Zelniker. Also
present: Town Attorney Glen Torcivia; Town Manager Beverly Brown; Town Clerk Valerie Oakes; Police
Chief Craig Hartmann; Finance Director Cale Curtis; Public Works Director Edward J. Soper; Building
Official Michael Desorcy, Library Director Lois Albertson and members of the public.
Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence.
Civility Pledge: The Civility Pledge was recited by the Town Clerk.
1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA:
Mayor Featherman called for any additions or deletions to the agenda.
Commissioner Zelniker requested adding the following items:
Item 7A—Discussion on political signs;
Item 7B —Discussion of policy and procedure for our Town employees running for office;
Item 7C—Discussion regarding the placement of past Mayors photographs on the Commission
Chambers walls;
Item 7D—Discussion regarding the Board's Luncheon; and
Item 7E— Discussion on the Utilitv Revenue Efficiency &-Rate Study.
Hearing no further additions or deletions, the agenda was accepted as amended.

2. PUBLIC COMMENTS AND REOUESTS:
Elyse Riesa, Boca Cove Lane — I received an invitation to the annual Board's Recognition Luncheon.
The past luncheons included spouses, and I would like to understand why spouses were not invited this
year. It was always a nice gesture to have the spouses attend these luncheons and see what everyone
does. Was this a decision made by the Commission, and was it a budgetary issue since I was told
there was not enough money in the budget? If it was a budget issue, I would like to know why the
Commissioner's spouses and Town employees are invited to attend all the training sessions and
conferences. Their expenses are paid for by the Town, and that is money being spent out of our
pockets. If you are so concerned about the budget, you should make a resolution to eliminate spouses
from attending these conferences if you are going to eliminate spouses from attending the luncheon. I
would like to know how this decision was made, and was it a majority decision.
Commissioner Feldman — At the last budget meeting, I suggested spouses not be included on future
trips to these meetings and that we don't pay for the meals. I also suggested that not all the
Commissioners attend every one of these meetings. I do not believe it will be in the budget for next
year. Also, the statement made that there was not enough money in the budget is incorrect. We do
have the money in the budget. Our Board members are given a stipend of S25 per meeting, even
though some are not concerned about the money. We not only eliminated spouses this year from the
luncheon but also alcohol. Other places were looked into to hold this luncheon that would possibly
lower the cost. We want to recognize those that volunteer to serve on the various Boards, and a
decision was made that we could have this luncheon at the Delray Sands Resort if we limit the amount
of people attending this luncheon.
Peter Rodis, 3224 S. Ocean Blvd. — I am happy and proud to announce that my film "What Happened
Miss Simone" is nominated for an academy award. The Library is showing the film on February 18th
at 5:00 PM and am inviting you to attend. The Academy Awards are being shown on February 28th
and there will be a party at Seagate Clubhouse starting at 7:00 PM to watch the awards. I am inviting
you to join me on that day.

A) ORDINANCE NO. 16-0010— 1st READING/PUBLIC HEARING
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA AMENDING
THE TOWN CODE. OF ORDINANCES BY AMENDING CHAPTER 12,
"CONSTRUCTION FENCES" TO MODIFY THE REQUIREMENTS REGARDING
FENCING OF CONSTRUCTION SITES; PROVIDING FOR CODIFICATION;
PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE,.
Town Clerk Oakes read Ordinance 16-0010 into the record.
Town Manager Brown — This ordinance has been amended since the last meeting. Based on the
Commission comments, the changes made are as follows:
o All activities, all material, storage facilities, dumpsters, portable toilets, etc. must be located
within the boundaries of the temporary construction fence.
The site must be completely enclosed, on all sides, by the construction fence.
The language allowing the building official the discretion to waive the requirement for a
temporary construction fence during demolition has been removed, thus a temporary
construction fence is required at all times.
Commission Discussion:
Commissioner Zelniker - Is there a resolution that states the responsibilities of street cleaning at
the construction sites and the repair of our s A ales being destroyed by construction trucks? Town
Attorney Torcivia - If someone damages your property, you can ask them to fir your property_ .
There is a general cleanliness law on a construction site that they must clean up.

Building Official Desorcy - Regarding the swale issue, they are to be maintained by the property
owner or the assignees of the property and not necessarily the contractors. The swales have not
been damaged primarily by the construction companies but bv_ other vehicles such as FedEx,
FP&L subcontractors working on the trees, UPS, etc. There is a provision in the ordinance
regarding construction sites being kept clean and the streets being swept twice a day. If there is a
problem with the swales, and they are not being maintained, it is a code enforcement issue.
Comm. Zelniker - I would like to see a provision put in the ordinance that the streets be hosed
down, and not just swept.
Vice Mayor Weitz - You cannot micromanage every detailed procedure that construction or
FP&L utilizes. If there is a problem identified, it needs to be presented to the Code Enforcement
Officer. B.O. Desorcy-The weather has a great deal to do with the swales. They can be repaired
one day and, if we have a good amount of rain, they will be in bad shape again.
Comm. Stern - I agree with Vice Mayor Weitz. We cannot micromanage everything in this
Town. The Building Official and the Building Department are doing a fine job.
Comm. Feldman - All the changes have been made as requested, and I am pleased with the new
ordinance.

C) ORDINANCE NO. 16-003 O— 1st READING/PUBLIC HEARING

ARTICLE IV, "ZONING DISTRICTS," OF CHAPTER 30, "ZONING CODE," OF THE
TOWN CODE OF ORDINANCES BY AMENDING SECTION 30-68, "SUPPLEMENTAL
DISTRICT REGULATIONS," SUBSECTION• (U), "FINISH FLOOR ELEVATION,
BUILDING HEIGHT, AND EXCEPTIONS TO BUILDING HEIGHT", SUB-SECTION
(4), "EXCEPTIONS TO BUILDING HEIGHT TO CLARIFY BUILDING HEIGHT
EXCEPTIONS; PROVIDING FOR CODIFICATION, FOR CONFLICTS, FOR

Town Manager Brown—Based on the Commission comments, we clarified that in the event there
is no parapet wall, the height of any equipment or antenna shall not exceed four feet in height.
Commission Discussion:
Commissioner Zelniker — There should be no exceptions. When an architect prepares his plans,
he should know our Town codes and they should be followed.
Vice Mayor Weitz — The Town codes should be followed. If an exception is asked for, there
should be a good reason and presented before the Board of Adjustment and Appeals. I am not in
support of this ordinance the way it is written. If you are going to mandate these exceptions as
permissible, then why have a Zoning Board.
Comm. Stern — This ordinance was to clear up an already existing ordinance that allowed the two
exceptions. Do we not want to allow two exceptions at any time, or do we want to amend what
we already have on the books?
Discussion ensued as to the existing ordinance and the exceptions allowed, and the items listed in
the ordinance that are considered exceptions. Only two exceptions are allowed, and can be any
two of those items listed.
B.O. Desorcy described the new design of architectural structures being constructed at this time
and the reason why the supporting equipment is being placed on the roof. There is a list of things
that could be put on the roof. The first two are free and if they want additional items, they have to
prove a hardship. There is another exception in the code that allows an observation deck on the
roof, and that may have to be looked into because that would be an exception.
Comm. Zelniker — We are losing the charm of Highland Beach. Every unit that is being
constructed, whether it be townhomes or individual homes, are extremely large and
overpowering. The quality of our lives living here in Highland Beach is being affected.

MOTION: Commissioner Zelniker moved to deny Ordinance 16-003 O and prepare a revised
ordinance specifying that there be no exceptions to our building heights.
Motion died due to lack of a second.
Vice Mavor Weitz had a concern that the code read "two exceptions per dwelling unit" and would
like to have it changed to "two exceptions per building". The elevators would be an exception for
one elevator per unit. Consensus was to change the wording as presented by Vice Mayor Weitz.
MOTION: Commissioner Stern moved to accept Ordinance 16-003 O with the new wording.

STORAGE UNITS", TO PROVIDE FOR REGULATIONS GOVERNING PORTABLE
STORAGE UNITS; PROVIDING FOR CODIFICATION, FOR CONFLICTS, FOR
SEVERABILITY, AND FOR AN EFFECTIVE DATE.

Commission Discussion:
Comm. Feldman — If it is a condominium with 100 units, and they are doing more construction
such as replacing windows and needed a place to store them, are they still limited to only one
portable unit? B.O. Desorcv — That would be up to the Commission to decide how many Pods
would be allowed on a piece of property.
Comm. Stern — My interpretation of a Pod is temporary and stipulated as to how many times a
year you can do it. I do not see a Pod being used for construction. I don't see where you can
limit a high rise or an apartment building to just one Pod at one time because two people could
not move out at the same time. We need to come up with a comfortable number for these
instances.
Town Manager Brown —We talked about doing it progressive and setting unit limits according to
the size of the building.

G) RESOLUTION 16-001 R
A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, DECLARING
EXPENDITURES OF TOWN FUNDS FOR FOOD/REFRESHMENTS FOR CERTAIN
EVENTS/OCCASSIONS — AS VALID PUBLIC PURPOSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
Town Clerk Oakes read Resolution No. 16-001 R into the record.
Town Attornev Torcivia stated the following additions and corrections to Resolution 16-001 R:
o Exhibit A—Gift Cards is to be removed.
c Under Section 2 — The following words were added: "provided the monies have been
previously budgeted".
Commission Discussion:
Commissioner Feldman — The League of Cities, City Manager's Association and City Clerk's
Association should be a budget item and not approved as carte blanch.
Vice Mayor Weitz —I agree with Comm. Feldman's statement. There was an investigation by the
Inspector General's Office (IGO) regarding the use of gift cards and monies for what the
complainant said was for unauthorized or illegal purposes. The IG did not find any specific or
criminal finding in that area. (Read from the Inspector General's Office letter dated October 16,
2015 for future guidance when considering if an expenditure of City funds meet public purpose).
It was my understanding that that the Commission had discussed cutting back on the League of
Cities Conference for spouses and staff attending these functions. This Commission is acting in
accordance with the IG's recommendation to look at how monies are being spent, and to not
spend monies on areas that have no benefit to the public. I am not in favor of giving birthday and
holiday gift cards to the staff and will not support this resolution. We need to be more in line with
the recommendations from the IG's Office.
Comm. Zelniker — I feel the items listed should not be in a Resolution. They should be discussed
individually by the Commission and voted on. Highland Beach is a small town, and hosting
organizations such as League of Cities should be done co-hosting with other small towns.
Comm. Stern — We did a great job this year reducing the taxes. I believe in morale with the
employees and, if a S25 gift certificate makes an employee happy, I don't see why we cannot
afford that. I don't like blanket policies either, but I think we should discuss these items and
accept a few of them that makes sense ,vithout costing a lot of dollars. Regarding the Board
Appreciation Luncheon, I am not sure if we ever took a formal vote to include spouses. There
were some Commissioners who wanted to reduce the cost of the luncheon. The Town Manager
did just that. We should rethink the Board Luncheon and invite the spouses.

Vice Mayor Weitz — I am in favor of morale, but birthday and holiday gift cards are not a legal
issue since they do not benefit the residents of this Town. We do budget particular items on a
yearly basis, but I do not want to see a resolution that lists items in sequence where we are now
mandating that those are permissible, when in many of them, I would not support as items that
meet the Inspector General's guidelines.
Comm. Feldman — Most of the items listed on Exhibit "A' were items put in the budget. It is at
the discretion of the Town Manager as to what she wants to do. If these are items we don't want,
it should be addressed during the budget hearings and not during the year. Are we in any
violation if we approve this or if we don't approve this?
Town Attorney Torcivia —The IG sent a letter with a recommendation that they send to all cities.
It is a recommendation and not a requirement, so we are not in violation. As a best practice, their
recommendation is that you adopt this type of a resolution where you find in a public meeting that
certain things are for a public purpose, such as Light up the Holidays.
Vice Mayor Weitz — Budgets are not commitments, but that the money is available. After this, if
the Town Manager spends money on birthday or holiday gift cards, she is in violation of the
Florida State Law. It is very clear that money spent for tax dollars have to be for the benefit of
the public. The items have no public benefit except I would agree for morale. I don't agree that
the fact that the money is in the budget, the Town Manager has authorization to spend it.
Town Attorney Torcivia—This resolution gives the IG the paper proof that this Commission, as a
public body, found that these items are public purposes. Town Attorney reviewed the items listed
and took into consideration the comments from the Commission. He will draft a new resolution,
and bring it back to the Commission for approval at the next meeting.
Town Manager Brown stated that the item "gifts for retirements" were for elected officials when
they leave office, and not for employees.
Further discussion ensued regarding the IG's recommendation and whether certain items are legal
or illegal. Town Attorney Torcivia stated that of all the cities they represent, virtually all of them
adopt policies such as this one. They have all received the IG's recommendation and some have
included employees, and some have not. It is a discretionary decision. The IG's position is, if
your elected body says it is okay, then it is okay.
MOTION: Commissioner Vice Mavor Weitz moved to table Resolution No. 16-001 R. Motion
was seconded by Commissioner Zelniker, which passed unanimously.

MOTION: Commissioner Stern moved to accept the Consent Agenda. Motion was seconded
by Vice Mayor Weitz which passed unanimously.
7. NEW BUSINESS:
A) Discussion on Employee-Resident.Running for Office
Comm. Zelniker — We need a standard policy and procedure for any person living in Highland
Beach, working for the Town, and is interested in running for Town office. They should be
required to resign, since it could be a conflict of interest.
Town Attorney Torcivia — There is a statewide Resign to Run Law. I will look into this and
report back at the next meeting whether that law is the exclusive, or whether towns are allowed to
supplement that law.
B) Discussion on Political Signs
Comm. Zelniker—At the last meeting, a resident had a question regarding political signs, the time
and the placement. Is there any ruling regarding this issue? Town Attorney Torcivia—There is a
sign code, and there is no limit for political signs as to the amount of time they can go up before
an election.
C) Discussion on the Placement of Former Mayor's Photographs
Comm. Zelniker — The pictures of the past Mayors were hanging in the Commission Chambers
before the renovations took place. Town Xlanager Brown — I am having them re-photographed so
they are all of the same median. There will be new names plates with their names and the date
they were Mayor and will be the same size, color and same picture frames.
Vice Mayor Weitz — I would like to see the Town Hall decorated appropriately. The Town
Manager could make an appropriate recommendation to this Commission. Town Manager Brown
— I was hoping to purchase some of the paintings in the Library that were done by some of the
residents, but they were on the expensive side. In the display case in the hallway, we have placed
some of the artwork done by the Children's Program in the Library. I have asked them to send
something once a month for us to display in this case.
D) Discussion on the Board Luncheon
Comm. Zelniker — I would like to know how the decision was made to not include spouses for
this luncheon. Town Manager Brown—At the budget hearing, the initial thought was to eliminate
the stipend the Board members receive and to change the Board's Luncheon to the Library to try
and reduce the cost by fifty percent (50%). We looked into several options such as catering the
luncheon at the Library and reducing the cost with Delray Sands, which is what,,e decided to do.
Comm. Zelniker — This is something that should have been discussed and voted on by the
Commission. I personally feel the spouses should have been invited since it has always been that
way.

Discussion ensued regarding the Board luncheon and the Commission's decision to cut back on
the expense of the luncheon, such as eliminating spouses being invited. Based on comments from
some residents and their disappointment in this decision, consensus was to invite the spouses to
the luncheon.
MOTION: Commissioner Zelniker moved to invite the spouses and significant others to attend
the Board Luncheon and not provide alcohol. Motion was seconded by Commissioner Stern.

E) Discussion Regarding the Utility Revenue Efficiency Rate Study
Comm. Zelniker — At the last meeting I asked Fin. Dir. Curtis if we had a shortfall, and he
indicated that we did not. Fin. Dir. Curtis —We do budget for a shortfall. It is a line item in the
budget called "the appropriation from reserve". Comm. Zelniker read from the proposed water
fund budget. The survey that was done showed an increase of 2.40%. Is this enough to cover our
shortfall? Fin. Dir. Curtis — It is not enough to completely cover the shortfall, and it was made
part of the presentation. Because we have sufficient reserves in the Utility Funds, we wouldn't go
ahead and completely close that revenue gap with a rate increase. Rather, we would increase the
rate slightly and use some of our existing reserves to close that gap as we move forward. We are
projecting a shortfall for the next five years. We will be bringing this back to the Commission in

8. MISCELLANEOUS ITEMS —LEFT OVER:
A) Discussion on Proposed Highland Beach Veteran's Flag
Comm. Feldman asked George Kelvin if he would give the Town the rights to reproduce this.
George Kelvin, 4740 S. Ocean Blvd. —Town Manager Brown has the release. I don't believe we
need to have another flag pole. It would be my recommendation that we fly this flag underneath
the American Flag that already exists. I would also recommend that we have a small committee
in conjunction with the Town Manager, and decide how and what direction we want to go in.
Comm. Feldman recommended that a committee be formed headed by George Kelvin.
George Kelvin — The cost for doing this is very nominal. A flag and two banners would cost
under S800 or 5900. Town Manager Brown — If we reproduce the flag, we would want to do it in
a quality that could be placed outside. Comm. Feldman — Perhaps we could have the different
condominiums partake in this since the cost will go done with multiple units. George Kelvin —

We could place an article in the Highlander or send letters to the different condominiums and
homeowners suggesting the cost would be nominal. Comm. Zelniker suggested this be made into
a plaque to be placed on the Commission Chamber's wall honoring all veterans.

Today is Ground Hog's Day and he saw his shadow; we will have six more weeks of northern visitors.

Carl Gehman, 1123 Highland Beach Dr. - Regarding the Board Luncheon, the spouses should be
invited and I am glad to see you agreed on this. Thank you for doing such a great job for the residents
of Highland Beach.
Tim Burnich, 4505 S. Ocean Blvd. read a section of Chapter 12.2(e) of the Code of Ordinances that
states all construction sites should be swept clean twice a day, at least one of which shall be at the
conclusion of the work day. He continued to read from Chapter 12.8(b) ingress and egress; 12.8(c)
disruption of traffic for a period of five minutes or longer must be approved in advance be the
Highland Police Department, and a police officer must be on site. He would like to see this enforced.
Elvse Riesa, Boca Cove Lane - I brought up the luncheon, not because it means so much to me
personally, but it is a question of resident morale versus employee morale. I heard different accounts
as to why spouses were not being invited. You need to find a wavy to communicate to residents so we
could understand why you are doing what you are doing.
Peggy Gossett Seidman, 4312 Intracoastal Dr. - Thank you for the ordinances passed today in support
of the cleaning of construction sites. I would like to point out that in Bel Lido we have lawns being

run over quite frequently by construction trucks. Town Manager Brown indicated to me that because
Bel Lido is not heavily trafficked, when construction equipment is being moved a flag man is not
necessary. We would appreciate it if you would consider having the same codes in Bel Lido as on
you have on AIA.

motion to adjourn the Regular Meeting at 4:00 PM.
MOTION: Commissioner Stern moved to adjourn the meeting at 4:00 PM. Motion was seconded by
Commissioner Zelniker, which passed unanimously.
