In reaching its decision and order, the Board has found/has not found in the case of the
above numbered Petition that:
1. Special conditions and circumstances exist which are peculiar to the land, structure
or building involved, and which are not applicable to other lands, structures or buildings
in the same district.
2. The special conditions and circumstances do not result from the action of the
applicant.
3. Granting the variance requested will not confer on the applicant any special privilege
that is denied by the ordinance to other lands, structures or buildings in the same district.
4. Literal interpretation of the provisions of this ordinance would deprive the applicant
of rights commonly enjoyed by other properties in the same district under the terms of the
ordinance, and would work unnecessary and undue hardship on the applicant.
5. The reasons set forth in the applicant's petition justify the granting of the variance,
and the variance granted is the minimum reasonable variance that will make possible the
reasonable use of land, structure or building.
6. Granting of the variance will be in harmony with the general purpose and intent of the
ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the
public welfare.
Chapter 30, Zoning Code/Article 111; Sec. 30-40(h): A variance, when implemented in
accordance with the approval granted by the Board of Adjustment and Appeals, shall run
with the land in perpetuity. Unless a lesser time is approved by the Board of Adjustment
and Appeals, a variance that is not implemented shall expire eighteen (18) months
following approval. Extensions of variance approvals shall not be granted by the Board
of Adjustment and Appeals.

VARIANCE REQUEST — NEEDS ANALYSIS f MANIFESTO
Town of Highland Beach
Project: Residence for Mr. & Mrs. Girgis
Location: 4121 South Ocean Drive, Highland Beach, Florida
We are hereby requesting a Variance to the Site Wall height regulation to increase the allowable
height to ten feet. We have a manifest injustice because of a noise source in the neighboring
property which we intent to shield ourselves from its noise, analysis as follows:
Our neighbor to the south, has a large stand-by power generator 3.5 feet from our property
line, and about 5 feet from the front property line. The noise it produces on a weekly basis
is excessive and disruptive to our front yard.
2. The model generator is a Generac 150kw model (as best as we could determine on field
inspection from outside our wall) Generac publishes noise production at 23 feet of
distance to be 66db for weekly exercise and 79db at full run. However this is at 23 feet
away, this unit is 3 feet away, so we have to achieve a conversion factor to determine the
actual sound level at our property line.
To calculate the decibels, the formula used is
Decible Distance (dB) =20 X log(d, _d2) Which yields 17.692 additional decibels than the
reading at 23'. Therefore, at exercise mode the unit produces 66+17.692 = 83.692 db. And at
full run mode 79+ 17.692 = 96.692 db
4, Town of Highland Beach Code Section 18-10, item 6 states: Exhaust discharge. The
discharge into the open air of the exhaust of any steam engine, stationary internal combustion
engine motor or vehicle, except through a muffler or other device which will effectively prevent
loud or explosive noises therefrom. This section declares this type of noise as declared to be
loud, disturbing and unnecessary noises in violation of section_`
5. OSHA Standards (Occupational Safety and Health Act) provide standard values that apply
to our case: discomfort level is above 80 decibels, automobile at 60 feet is 70 db, and
residential area at night at 40 db.
6. The Florida Department of Transportation (FDOT), which is responsible for AIA, states that
exterior impact criteria for single family residences is 66 db(A), any higher than that
qualifies for noise abatement barrier.
The above data demonstrates that the existing generator produces sound levels way
higher than those deemed acceptable by OSHA and FDOT. Therefore we do have a
manifest injustice found in our property by installations of our neighbor, And to
provide for safe and comfortable enjoyment of our front yard, we propose to abate the
noise, as follows:

SPECIFICATIONS OF OUR PROPOSED ABATEMENT:
HEIGHT REQUIRED TO BLOCK NOISE:
The existing generator is 3 feet south of our south property line. Its height is 4'-7", however the
exhaust ports are higher than that. In order to block the noise from our side, we propose
building our wall about 4' higher than the exhaust ports, for an approximate 45 degree vertical
angle of abatement. (see building elevation)
BARRIER PROPOSED:
We propose a concrete block wall, covered in float finish stucco, to match the existing site
walls of our property, to maintain the aesthetic design uniform.

17-6.1.1 Noise Reduction Factor The feasibility of providing noise abatement is focused on the ability of the noise
barrier to provide a reduction of at least 5 dB(A)to the impacted receptors.The more reduction you can achieve,the
better the barrier,as long as the cost,visual impact,etc.of the barrier are not unreasonable. If a minimum of 5 dB(A)
reduction cannot be achieved at a particular receptor,that receptor is not considered benefited.The number of
impacted receptors required to achieve a 5 dB(A)reduction or greater in order for a noise barrier to be considered
feasible will be two(2)or greater.
17-6.4 Traffic Noise Abatement Techniques The most common type of traffic noise abatement measure is the
construction of a noise barrier. As noted in 23 CFR 772.13(c)(1),the FHWA requires that,at a minimum,the FDOT
shall consider noise abatement in the form of a noise barrier.Therefore,all impacted receptors will require analysis for
traffic noise reduction using a noise barrier.FHWA considers traffic management,alteration of horizontal and vertical
alignments,acquisition of real property to create a buffer zone,and noise insulation of Activity Category D land use to
also be acceptable noise abatement measures.
