In reaching its decision and order, the Board has found/has not found in the case of the
above numbered Petition that:
1. Special conditions and circumstances exist which are peculiar to the land, structure
or building involved, and which are not applicable to other lands, structures or buildings
in the same district.
2. The special conditions and circumstances do not result from the action of the
applicant.
3. Granting the variance requested will not confer on the applicant any special privilege
that is denied by the ordinance to other lands, structures or buildings in the same district.
4. Literal interpretation of the provisions of this ordinance would deprive the applicant
of rights commonly enjoyed by other properties in the same district under the terms of the
ordinance, and would work unnecessary and undue hardship on the applicant.
5. The reasons set forth in the applicant's petition justify the granting of the variance,
and the variance granted is the minimum reasonable variance that will make possible the
reasonable use of land, structure or building.
6. Granting of the variance will be in harmony with the general purpose and intent of the
ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the
public welfare.
Chapter 30, Zoning Code/Article III; Sec. 30-40(h): A variance, when implemented in
accordance with the approval granted by the Board of Adjustment and Appeals, shall run
with the land in perpetuity. Unless a lesser time is approved by the Board of Adjustment
and Appeals, a variance that is not implemented shall expire eighteen (18) months
following approval. Extensions of variance approvals shall not be granted by the Board
of Adjustment and Appeals.

Recommendation:
The application/petition with supporting documents show a lot width of 100 linear feet The applicant
is requesting a variance from Code Section 30-68 (g) (2) (b) (1) on application. This code section is
incorrect, and applies to boat basins (harbor). Highland Beach Code of Ordinance Section 30-68 (g)
(6) (d) (1) states—Marine facilities shall comply with side yard setbacks in Single-Family zoning
districts: Twenty-five (25) feet. Applicants request is to reduce dock setbacks to fifteen (15) feet from
side property line.

Install a replacement dock/deck with 15 foot side yard setbacks,reducing the side yard from 25 feet to 15 feet for the new dock/deck
4. For a variance to be favorably considered,the Board must find that the following four requirements have
been met. After each paragraph, state fully your reasons justifying the granting of this variance.
(a) That special conditions and circumstances exist which are peculiar to the land, structure, or building

involved and which are not applicable to other lands, structures or buildings in Errie distit;
The existing wooden dock is 5 feet from the western edge of the seawall and 50 feet wide. It will be replaced with a monolithic
pour of concrete to form the more secure and sae_n_ew__d_oc_R7deck replacing the old wooden dock tot the same western ocation.
We are requesting to reduce the side yard setbacks to the north and south by 10 feet from the current 25 feet to 15 feet.Giving the
homeowner greater access to oc a oat at t e south or north end of the dock. I his will allow for avoidance of potential oat
collisions and maintain the symmetry and serenity of the lake.
(b) That the special conditions and circumstances do not result from the actions of the applicant;
The special conditions and circumstances do not result from the applicants actions.In order to avoid potential boating collisions
access tot the north and south side of the dock is necessary to be flexible with the neighbors on the location of their own vessels
and movement thereof.
(c) That granting the variance requested will not confer on the applicant any special privilege that is denied
by this ordinance to other lands,buildings or structures in the same district;
In conducting a search of records of this board we found a previous approval for the home next door at 4320 Tranquility Dr.
(9/21/10). The applicant,Mr.Ferguson,was granted a variance to reduce the side yard setback to the north end of his dock/deck
to 10 feet.We are only asking for the granting of the variance to reduce the side yard setbacks for the dock/deck to 15 feet to the
north and the south. We are not asking for a variance to increase the western width of the dock but to merely replace it with a
safer and more secure concrete dock/deck at the same width distance from the western edge of the seawall. The granting of this
variance will not confer any special privilege upon the applicant.
(d) That literal interpretation of the provisions of this ordinance would deprive the applicant of the rights
commonly enjoyed by other properties in the same district under the terms of this ordinance and would
work unnecessary and undue hardship on the applicant.
In conducting a search of records of this board we found a previous approval for the home next door at 4320 Tranquility Dr.
(9/21/10). The applicant,Mr.Ferguson,was granted a variance to reduce the side yard setback to the north end of his dock/deck
to 10 feet.We are only asking for the granting of the variance to reduce the side yard setbacks for the dock/deck to 15 feet to the
north and the south. It would cause an undue hardship upon the applicant and the neighbors by enhancing the potential for
navigational collisions. The ability to move the boat from north to south can avoid such collisions.
