2015.07.14_TC_Minutes_Special TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING SPECIAL MEETING Tuesday July 14 2015 9:30 AM Mayor Bernard Featherman called the Regular Meeting to order in the Town Commission Chambers at 9:30 AM. CALL TO ORDER: Roll Call: Members present: Mayor Bernard Featherman; Vice Mayor William Weitz, Ph.D; Commissioner Carl Feldman; Commissioner Louis P. Stern; and Commissioner Rhoda Zelniker. Also present: Town Attorney Glen Torcivia; Town Manager Beverly Brown; Town Clerk Valerie Oakes; Finance Director Cale Curtis; Public Works Director Edward J. Soper; Building Official Michael Desorcy, Code Enforcement Officer Carol Holland; Interim Library Director Suzi Hayes; Police Accreditation Manager Eric Aronowitz and members of the public. Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence. Civility Pledge: The Civility Pledge was recited by the Town Clerk. 1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA: Mayor Featherman called for any additions or deletions to the agenda. Vice Mayor Weitz requested that a discussion be put on the agenda regarding under new business as item 6E "Generic Personnel Issues" when an employee, in agreement with the Town, fails to abide by the terms of the agreement. By consensus, the agenda was accepted as amended. 2. PUBLIC COMMENTS AND REQUESTS: Mike Stein, 3912 S. Ocean Blvd — I sent a memo to the Commission on the matter I believe Vice Mayor Weitz wishes to discuss. I would like to request removing that item from the agenda. The memo I sent was in good faith to convince the Commission to pursue an alternate path. I understand the Commission did not look favorably upon it and did not agree with me. I thank Vice Mayor Weitz for taking the time to respond to me. I respectfully suggest, for the interest of all parties, that the item not be brought up and we get on with our business. Ocean Blvd — I am very concerned and aggrieved because Jerry Williams is a friend of mine and feel he was treated very inappropriately. I am not disputing the fact that the Town Manager has the right to ask any employee to resign. In the Town of Highland Beach, I believe we should treat all our employees with a kind of humanity. I have not spoken to Jerry Williams since his resignation, but I did speak to him prior to his resigning. He has served this community for ten years with honor and integrity. I would like to know if the Inspector General came last Thursday and if he found Jerry Williams susceptible to any issues. I don't believe so, but I have been told that I don't understand the full story. I am concerned that his reputation may be tarnished. As a town, we have an obligation to make sure that all of our employees are treated fairly. I do have a loyalty to Jerry; but quite frankly, all of you are my friends and I have the same loyalty to you. If I found that anyone of you were being talked about inappropriately, I would stand the same defense. 3. PRESENTATIONS: • Proposed Operating Budget for FY 2015 -2016 By: Cale Curtis, Finance Director I The following is a synopsis of the presentation (Proposed Operating Budget attached as Exhibit "A"). The Town's Taxable Value: In Fiscal Year 2016, our estimated taxable value is $2,076,387,102 which is a 7.19% increase from 2015. At this rate we will surpass the 2007 high in the next two years. Understanding Your Tax Bill: The tax bill contains are multiple taxing jurisdictions, which includes Highland Beach. The largest tax jurisdiction is public schools; Highland Beach is about 24% of the tax bill. Unassigned Fund Balance: The Unassigned Fund Balance is the Town Commission's reserve funds that are not allocated for any particular purpose. In 2014, we ended the year a little over $3.5 million. The current fiscal year, 2015, we are estimated to fall about $3.3 million. For 2016, it is proposed to go up based on the current tax rate we have proposed in this budget. The budget has a surplus of $692,000 and if we do not spend that money and the Town Commission adopts that rate, the Unassigned Fund Balance will go up by that amount. The water system fund which currently holds the $3.5 million from the proceeds of our land sale, the Unassigned Fund Balance is $4.7 million and the Unassigned Fund Balance in the sewer fund is $1.7 million. The town is in a very good position with regard to their reserve funds. Town Tax Rate: Our high point was in 2013. The total tax rate was 4.8673 and is a combined tax rate. It has an operating tax rate of 3.95 and a debt service tax rate that is determined by the annual principle and interest payments due on voter approved debt. For the 2016, we are recommending a 3.95 operating rate, which is the same rate as 2015, 2014, and 2013. Combined with the debt service tax rate, the rate is 4.954, which is about a 1% decrease over the prior year. General Fund Proposed Budget Highlights: The total revenues are $11,551,450 which is an increase of $48,000 year- over -year. The Reserve appropriation is down $530,000. Last year we Town Commission Special Meeting Minutes Tuesday, July 14, 2015 Page 3 of It had to put a plug number from our Unassigned Fund Balance to balance our budget and that number was $530,000. Based on the current new revenues and the estimated expenditures, we will not have to take any money from our reserves. Total expenses balance with our total revenues. State law requires us to have a balanced budget - revenues equal our expenditures. (General Fund Expenditures: Personnel Expenses, Operating Expenses, Capital Expenses and all other General Fund Expenses are explained in the attached Exhibit "A ".) Water System Proposed Budget On the revenue side, we are estimating about a $50,000 increase in charges for service. The $5,000,000 shown is the proceeds from the State Revolving Loan Fund which are the funds planned to help finance our major capital improvement projects or the water main replacement and the calcite system delivery replacement. We have a rate study planned to make sure our rates are in line with our expenses and capital improvement needs. The total revenue and expenses balance at $9,106,220. Sewer System Proposed Budget The revenues are flat rate fees applied to residents. They are a carbon copy every year. The expenditures fluctuate very minor based on the capital needs and any changes that the City of Delray Beach puts into their rate structure that are passed onto the town. We currently pay the City of Delray Beach to process our sewage. The budget balances at $1,192,000. 5 -Year Capital Improvement Plan The 2015 -2016 section will be the basis for our capital budget for the year. There will be funds allocated to each one of these projects. There is a correction in the 2017 -2018 section. The replacement for the Public Works pickup truck should read $30,000 and not $300,000. The major project in 2016 -2017 is the streetscape construction. We are not sure of the number. We are hiring a consultant to come in and give us a feasibility analysis, a study and some options for the Commission to consider and make their decision as to what they would want. Millage Rate Scenario Our estimated taxable assessed value of Highland Beach for 2015 is $2,076,387,102. We are proposing to stay at the tax rate of 3.95 %. First Public Hearing on the Tax Rate and Budget The Town Commission is required to hold two Public Hearings in order to adopt a millage rate and a budget. The first hearing is where the Commission will discuss and adopt a tentative millage rate and budget. This will take place on Thursday, September 10, 2015 at 5:01 PM. The second and final Public Hearing will be held on Thursday, September 24, 2015 at 5 :01 PM. Setting the Tentative Maximum Millage Rate The purpose of this meeting today is to set the tentative maximum millage rate. This rate can always be lowered at future meetings but cannot be raised without notifying each taxpayer individually. Staff is recommending the tax rate of 3.95 be adopted which will cover the Town's General Fund expenditures and provides a surplus of approximately $692,000 as we work through the budget. Commission Discussion: Vice Mayor Weitz — I would like to thank our Finance Director Cale Curtis, Town Manager Beverly Brown and the staff for doing an excellent job. There are some things in this budget that I Town Commission Special Meeting Minutes Tuesday, July 14, 2015 Page 4 of 11 am not happy with. There are commitments financially for things we do not have. I am looking at the license plate recognition, streetscape construction and the Library enclosure situation. I am not saying the funds are not there; just don't commit to it. The Library enclosure is going back to the drawing board, the license plate recognition is being held up by state law, and the streetscape project needs to be reviewed by this Commission. I am not happy with the personnel costs and the two percent/two percent increase. The federal government gives a COLA (Cost of Living Adjustment) which is based on criteria, and there is no reason to establish our own COLA. I understand that this is an adjustment for this town, but rarely has any business in America given five percent (5 %) automatic increases to their employees during times of both feast and famine. I do not want to see the elimination of educational incentives. I still would like to pay for individuals who want to upgrade their skills and abilities in job related areas from accredited universities. What we got rid of is the automatic $4,000 a year amount of increase to salaries based on having a degree that was required to have the job in the first place. I like the 3.95 rate but in my consideration, I would be looking to drop it. When times are tough, we have to be fair to the public. We have a good building program in the town, a nice surplus and overlay in the budget. We do have to figure out a way to handle the water operating expenses. We cannot borrow from reserve Rinds to meet obligations on usage, and I am glad we have a rate study coming up. Commissioner Zelniker — I also would like to thank Fin. Dir. Curtis and Town Manager Brown. I agree that we should keep the rate at 3.95 to start and feel there is an opportunity to lower it. Do you know how many families live in condos and how many in single family homes? Fin. Dir Curtis — There are approximately 3,500 condominiums and 500 single family homes. It is unit wise and not people wise. Comm. Zelniker — I know the Commission would want to do the best for the community. We have some brilliant minds on the Financial Advisory Board, and I am awaiting their analysis on the budget. Comm. Feldman — There were two items in the budget for 2014 (Library enclosure project and the police license plate recognition cameras) and the monies were not spent. Does that money go back into the General Fund? Fin. Dir. Curtis — That is correct. We still have to budget for the full amount to support it. It would either be new revenues or an allocation of unassigned reserves. Comm. Feldman — What about IT support? Fin. Dir. Curtis — The budgeted amount is $35,000 for the outside source. Comm. Feldman — If we have to purchase our own fire truck, will we still stay within the 3.95? Fin. Dir. Curtis — We will still stay within the 3.95. We would probably take funds from our Unassigned Fund Balance to pay for it. Comm. Stern — Thank you for doing such a fine job. In reviewing the proposed budget, I don't feel we will have any increase for our residents. I will hold my comments until the Financial Advisory Board has the opportunity to make their recommendations. I believe we should approve the 3.95 today. Mayor Featherman — I feel we should stay with the 3.95 today and try to come in with a lower figure for our residents. Town Manager Brown — As the Town Commission works its way through this budget, we should be in a position to lower the tax rate when it comes to the final adoption in September. The tentative maximum millage rate should be considered the upper limit on this year's tax rate. Our recommendation to the Commission is to remain at the current rate of 3.95 as the tentative maximum millage rate. MOTION: Commissioner Stern moved to adopt a Tentative Maximum Millage Rate of 3.95. Motion was seconded by Vice Mayor Weitz. NEW BUSINESS: A) Setting the Tentative Maximum Millage Rate — Fiscal Year 2015 -2016. Town Clerk Oakes stated that this item has already been discussed and action was taken under item #3 — Presentations. B) Setting a Time and Date for the Budget Workshops. Town Manager Brown — The Commission can have as many workshops as necessary. The Financial Advisory Board is scheduled to review the budget on July 22 which allows you to receive their input prior to any scheduled workshops. In addition, Fin. Dir. Curtis and I will meet with each Commissioner separately to review the breakdown of each department's request. We are recommending the first budget workshop take place on August 4 th immediately following the regular monthly meeting. If a second workshop is needed, it will be on August 25 immediately following the workshop meeting. If the Commission requires more information, there will be no problem scheduling additional meetings. MOTION: Commissioner Stern moved to accept the two budget workshop meetings in August. Motion was seconded by Vice Mayor Weitz, which passed unanimously. C) Setting a Time and Date for Two (2) Public Hearings to Adopt a Millage Rate and Budget. Town Manager Brown — The first Public Hearing we are recommending is on Thursday, September 10 at 5:01 PM and the second one on Thursday, September 24 at 5:01 PM. These specific hearings are under a specific time limit set by state statute. Town Commission Special Meeting Minutes Tuesday, July 14, 2015 Page 6 of 11 MOTION: Commissioner Zelniker moved to accept the Public Hearing dates of September 10, 2015 at 5:01 PM and September 24, 2015 at 5:01 PM. Motion was seconded by Commissioner Stern which passed unanimously. D) Commission to Declare the Town's 1994 Sutphen Aerial Ladder Truck Surplus and Authorize the Truck to be offered for Sale at a Public Auction. Comm. Feldman — I am not in favor of a public auction. I think we should look for sale in other areas before a public auction because you could end up with nothing. The engine is 20 years old and does have some value. Town Manager Brown — One of the problems we have is that we have to remove it from the City of Delray Beach's Fire and Rescue. It was supposed to be removed last week but we haven't found a location yet. Comm. Feldman — Perhaps one of the car dealerships on Federal Highway would want to store it for us as a visual. Town Manager Brown — Fin. Dir. Curtis and I looked at a number of places such as Government Deals, and Tampa Bay Machinery in Tampa who has an auction once a month and sell quite a few fire trucks between $15,000 and $25,000. Vice Mayor Weitz — When you do a public auction are you able to specify a reserve, so if it doesn't reach a certain point you don't have to sell it? Town Manager Brown — That is correct. Vice Mayor Weitz — We could set a minimum as to what we feel it is worth. Mayor Featherman — Do we still have a problem with the engine and does the truck run? Town Manager Brown — The truck did not pass the safety test that the City of Delray Beach Fire Department requires for all their vehicles. In the past five years it has been out of service 43% of the time. It would cost approximately $32,000 to repair it. Comm. Zelniker — If we cannot get any money for it, can we donate it to some organization and use it as a tax write -off? Fin. Dir. Curtis — There would be no tax benefit to the Town because we do not pay income tax. I have checked an online auction that deals specifically with fire equipment, but they do not want any equipment that is listed in any condition less than good. I understand this fire truck is in poor condition. I am working with Tampa Machinery and he may be able to help us with an online auction. Based on my knowledge of this truck, it is in poor condition and we are not going to see much value other than scrap value. Comm. Stern — Rather than waste any more time on what amount we could get for this truck, our biggest concern as a Commission is to figure out how we can get rid of the pumper truck that is doing us no good. We need to put our effort into getting our fire and emergency situation set up. We should take the Town Manager's suggestion and move it as quickly as possible out of Delray Beach, and get what we can for it. Mayor Featherman — I would suggest we get an appraisal on this truck before we sell it. Comm. Feldman — How are we doing with the other avenues for a fire truck and fire coverage? Town Manager Brown — We have a request into another city, the county and have an idea for a new fire district. We are weighing all our options. We have met with Delray Beach to review their contract and to lease a vehicle for us, but they are also negotiating with the county. We still Town Commission Special Meeting Minutes Tuesday, July 14, 2015 Page 7 of 11 have a contract with the City of Delray Beach into 2017. Comm. Feldman — If Delray Beach goes with the county then we will have to go with the county if we don't make any decisions before that. Town Manager Brown — We have to negotiate with the county directly because our contract is with Delray Beach. Town Attorney Torcivia — We have been talking to other coastal cities about working cooperatively. We talked to the City of Delray Beach and the City of Boca Raton. Town Manager Brown and I are scheduled to talk to Palm Beach County (PBC). One problem with the PBC system is that they are pegged to a tax rate of 3.4 or 3.5 mils. That is our entire ad valorem budget. When we meet with PBC, we will discuss possible alternatives rather than paying 3.5 mils or $6 million. If the City of Delray Beach contracted with PBC, their taxable value is different than our taxable values. I spoke with the PBC Fire Chief who explained that if there is a contract between the Town and the City of Delray Beach, then PBC will honor such contract. However, if the Town contracts with PBC, we will see if there is a different way. Town Manager Brown — We have to give the City of Delray Beach a one year notice if we are not going to continue with our contract. Vice Mayor Weitz — If you purchase a fire truck for $1 million, it will have to go for a referendum. It is my understanding that the last time there was a referendum it was turned down. Comm. Feldman — The difference between now and then is we don't have a piece of equipment. Without that we cannot protect our residents, it is a matter of public health and safety emergency; therefore, we would not have to have a referendum. MOTION: Commissioner Zelniker moved to declare the Town's 1994 Sutphen Aerial Ladder truck surplus and authorize the truck to be offered for sale at a public auction. E) Discussion regarding generic personnel issues. Vice Mayor Weitz — It is the sole purview of the Town Manager in terms of supervising, monitoring hire and termination issues. This has nothing to do with the Commission. When there are issues with a particular employee and a determination is made that the employee and the Town would enter into an agreement (whether it be financial terms, length of tenure and benefits) it is all incorporated within that agreement. However, if part of that agreement is a mutual confidentiality, in terms of not releasing any information to the public, and there is a situation where we learn clear, definitive and approvable that the employee has not lived up to their agreement of confidentiality, and in fact, has violated the terms of the agreement, I want to ask our Town Attorney as to what obligations and options the Town would have with respect to that initial agreement. Town Commission Special Meeting Minutes Tuesday, July 14, 2015 Page 8 of 11 Town Attorney Torcivia — As in any agreement, there are always two sides to an obligation. If there is ever a breach of an agreement, then the other side would say, "Since you are in breach of the agreement, we are not going to do what we agreed to do ". With an employment agreement, if the employee agrees to do certain things and they don't, they are in breach of that agreement and you don't have to pay them. It could also work the other way if the employer does not live up to their part of the agreement. Comm. Feldman — My comments are related to emails. Emails could be quite damaging. I have emails from a resident and from a Commissioner. I don't believe a Commissioner can enter into any conversation with a resident if it is going to be brought before us for a vote or any other reason. We have one of the finest Town Managers in the county with a great deal of knowledge in government. If a resident has a situation that he or she wants to discuss, the resident should go directly to the Town Manager and she could give that resident the background that is allowed to be given. The Commissioners cannot do this. With what is being discussed today, I would like to have some type of agreement that the residents go to the Town Manager for information or advisement. Referring back to Mike Stein's comments stating that we were not in agreement with him, my answer to him was that I could not comment on this because of what we are doing here today. Mayor Featherman — I take exception to Commissioner Feldman's statement. I think a resident should be able to send it to any one of our Commissioners. It doesn't mean that Commissioner will talk to another Commissioner on that specific subject, but can talk himself from his own opinion. Our residents should be able to say whatever it is they want to say to any specific Commissioner or Manager. Comm. Feldman — When a Commissioner emails back to that resident, is it a public record and can it be used against the town? Town Attorney Torcivia — It is a public record. Anytime you are creating a public record you should be careful because anyone in the public can see that record. There should not be communication among the Commissioners because that would be in violation of the Sunshine Law. Comm. Zelniker — Emails are the new technology. One of the emails mentioned an employee that worked here. We have to be very careful when we send an email. I was also surprised that Peter Rodis, when he made his comments, mentioned something that I had just been made aware of. Some things that are done for the benefit of people, because we do care about our employees, are done in confidentiality. Sometimes there are reasons why things are done that people might not know or understand. I can assure you that every Commissioner here cares about everybody who works for us. As a resident, we don't always have all the information, and if that information comes out, it could be more damaging to the person that you are trying to protect. Mayor Featherman — If there is something you want to say, either phone or put it in writing; not an email. Town Attorney Torcivia — Whether it is verbally, in writing or an email, communication is not to be shared amongst the Commission. I have confidence that you would not, but any resident could inadvertently do that; especially with emails. If you are going to send an email, and I agree it is better that you don't, put on it "PLEASE DO NOT REPLY TO ALL ". Town Commission Special Meeting Minutes Tuesday, July 14, 2015 Page 9 of 11 5. PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT MEETING: Peter Rodis, 3224 S. Ocean Blvd — My question is how do we avoid defaming an employee by saying I can't discuss it because it is privileged information. Yet, when the person who is being discussed (in this case Jerry Williams) is a babe in the woods. He has worked here for ten years and has gotten an excellent review every one of these ten years. Now all of a sudden he is told he needs to be terminated, and if he doesn't get terminated immediately, he will not get severance pay. That to me is not humane. It is not appropriate to take someone who has been loyal, hardworking and who is not political, tell him we don't want you here anymore, and give him no reason. We had a former Town Manager who we all felt certain things about, but she signed a contract that was inappropriate because it had no ending. All I am saying is that it is inappropriate to discuss why something happened and defame somebody by doing it. I would like to hear from the Council. I did call Town Manager Brown. I did talk to her and she said I can't discuss it because it is a confidential matter. I understand that, but what I don't understand is that there is a young man with two young children who is confused. Why am I terminated? Obviously there is more than that. Is it coincidental that the day after he was terminated or resigned that the Inspector General came? Town Attorney Torcivia — I don't represent you, but you are dangerously close to defaming that individual yourself. I ask you to think about what you are saying. I am advising the Commission not to respond. If they made those kinds of comments, he would have a lawsuit against the Commission. Your comments, you are talking about allegations about the man that no one here has brought up publically. You are publically saying things about a gentleman that, if I was your lawyer, I would advise you not to say. Peter Rodis — I apologize. What I would like is to have some discussion as to how we can protect all of the Commissioners if they get defamed, and how do we protect an individual employee if potentially he gets defamed. Mike Stein, 3912 S. Ocean Blvd — Vice Mayor Weitz I am really sorry that you did not withdraw this agenda item. This is exactly what I was trying to avoid. I would also like to add that the suggestion that the agreement was violated, Jerry Williams complained to me weeks before the termination and the agreement... Town Attorney Torcivia — Mr. Stein, why are we talking about an individual personally in a public meeting. If you want to talk to the Commissioners or the Town Manager individually you can, but you are both talking about a gentleman's personal life in public. I can't stop either one of you, but you are making statements that, if I were that person, I would not want to hear said publically. You are both well- intentioned but you are saying things in public. Let the gentleman abide by the agreement that he made. Mike Stein — The point that I am simply trying to make is that when this individual leaves immediately, yet you knew he was fearing for his job, you ask why you left and he says he had no choice. As far as I am concerned, he did not violate the agreement. However, everything that proceeded beyond that was completely obvious and explanatory. He presented no detail beyond what had been said prior to the agreement. My main question is why the agreement. It is the suggestion that we want to protect the employee. If the Commission wants to protect the employee, the Commission does not need a non - disclosure agreement to recuse itself and not to disclose anything about the employee. The Commission does need an agreement if it wants to preclude the individual from discussing the matter. My problem is that I think the agreement was for the benefit of the Commission and not for the individual. I really wish this matter would have gone away, and I apologize for bringing it up. It was a suggestion that this individual was a friend of mine. He is not a friend of mine, but I have worked with him for ten years and he is bright. I have two Town Commission Special Meeting Minutes Tuesday, July 14, 2015 Page 10 of 11 comments on this meeting. The first is that you have taken the IT function away from the Library. It is now going to be the same under the new arrangement with the consulting company and I think it compromises the Library. I know that one of your campaign issues was how wonderful our Library is. It is not going to be as wonderful with the change. I know you have saved some money, but I think it is money poorly spent. I believe Jerry could have done more in that function. The other thing is the enclosures for the Library terraces. All I can say is that you will not have a problem with parking at the Library pretty soon. Thank you Commissioners. I do feel very close to all of you. I am disappointed in some of your actions, but that is only one voice. Al Craft, 3215 S. Ocean Blvd — I see no problem with a citizen emailing a Commissioner. Your email addresses are in the bulletin. If you don't want us to email you, then you should not have your email address available. If the Commissioner receives an email and reply to it, I see no problem with the Sunshine Law as long as it doesn't go to the other Commissioners. Regarding the fire truck issues, I know there are many options, but if we buy one I believe there should be a referendum. The reason you would need one is because you sold the one we have. It is better to spend $30,000 to fix it than $1 million for a new one. My other question is regarding the budget and the money that was not spent. Is it going back into the operating budget? Fin. Dir. Curtis — It will go back into the Town's General Fund Unassigned Fund Balance. In next year's budget, if the Commission wants to re- appropriate funds for that project, we re- budget it and apply those funds. New taxes, or new revenues could be applied towards that expense. Mr. Craft had a question regarding reserves. Fin. Dir. Curtis explained the reserve fund. Comm. Zelniker — Are there copies of the budget for the residents so they could be prepared when they come to the budget meetings? Town Manager Brown — There are copies in the Town Clerk's Office. Town Clerk Oakes — It is also available online if anyone would like to download it from home. 6.
