2015.05.05_TC_Minutes_Regular TOWN OF HIGHLAND BEACH MINUTES OF TOWN COMMISSION MEETING REGULAR MEETING Tuesday, May 5, 2015 1:30 PM Mayor Bernard Featherman called the Regular Meeting to order in the Town Commission Chambers at 1:30 PM. CALL TO ORDER: Roll Call: Members present: Mayor Bernard Featherman; Vice Mayor William Weitz, Ph.D; Commissioner Louis P. Stern; Commissioner Carl Feldman and Commissioner Rhoda Zelniker. Also present: Town Attorney Glen Torcivia; Town Manager Beverly Brown; Administrative Assistant Rosalie DeMartino; Finance Director Cale Curtis; Public Works Director Edward J. Soper; Police Chief Craig Hartmann; Library Systems Analyst Jerry Williams and members of the public. Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence. Civility Pledge: The Civility Pledge was recited by the Administrative Assistant. 1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA: Mayor Featherman called for any additions or deletions to the agenda. Commissioner Zelniker — I would like to discuss the Friends of the Library's financial commitment to the Library enclosure. This item is to be placed under 7(A). Town Attorney Torcivia — Item 6 (C) Adoption of the Purchasing Policy needs to be changed from an effective date of May 5, 2015 to an effective date of June 2, 2015. By consensus, the agenda was accepted as amended. 2. PUBLIC COMMENTS AND REOUESTS: George Kelvin, 4740 S. Ocean Blvd — The brochure given out by State Representative Bill Hager is a very valuable piece of literature. It should be included in our next newsletter. With regard to the proposed Library project, you could never go wrong asking the public what they think about an upcoming project. A letter should be sent to the residents explaining the Library project, the cost and funding and asking for their input. It should also include details, pictures and a place where the Town Commission Regular Meeting Minutes Tuesday, May 5, 2015 Page 2 of 14 residents could vote "for" or "against" the project as well as comments. This should all be taken into consideration when the Commission votes on this project. Jim Jiovanazzo, 3700 S. Ocean Blvd — Everyone is aware of the tragic accident that took place here in Highland Beach with two bicyclists and an automobile. The bike path is not the true distance that a bike path should have. Highland Beach has no control over this since AIA is under the jurisdiction of the Department of Transportation. Perhaps something can be added to the side of the road to help prevent cars from going too close to the bike path. 3. PRESENTATIONS: • Post Legislative Session By: State Representative Bill Hager State Representative Bill Hager — I served seven years on the Boca Raton City Council and would like to thank you for your excellent service to the Town of Highland Beach. I represent House District 89 that runs from Boca Raton to Singer Island. This is an an update on the bills that have been passed through the Legislature as follows: • Sober Home Bill — This calls for registration, licensing of those who administer the homes and they are subject to the usual zoning. There is also a background screening and fingerprinting for those who invest in these homes. The challenge with Sober Homes is that the federal government has declared drug addiction as a disability. The Fair Housing Act and the American Disability Act preclude any discrimination based on a disability. • Hotel stays for military personnel 17 years and older — Hotels required a person to be 25 years of age and older to register. The law now requires hotels to show respect for those military personnel 17 years of age and older who can provide military identification. • Budgets — We have decreased taxes two- thirds of a billion dollars. We continue to bring money home in terms of beach restoration. • Education — We put in place a provision that says no more than five (5 %) percent of student's time can be taken up with testing. From a tax standpoint, Florida has the fifth lowest overall taxation in the United States. We have no income tax or state tax. From an economy standpoint, this State is booming and we have the second highest job growth in the nation. Mayor Featherman — What items were cut from taxes? Rep. Hager — Some of the items cut were taxes on your cell phone bill and vehicle registration fees. I will be happy to provide you with the other tax cuts if you would like. Vice Mayor Weitz — As a mental health professional, I know the Sober Homes have been a problem and they are. There are too many people moving in and out of these homes; moving from one to another. I was not aware that addiction is classified as a disability. Is this the same definition as a disabled person on social security disability who cannot work? Rep. Hager — The courts have Town Commission Regular Meeting Minutes Tuesday, May 5, 2015 Page 3 of 14 construed that addiction is a disability requiring respect for and applications of the law in terms of housing and etc. Vice Mayor Weitz — With respect to the casino issues and Indian gaming, why can't we make a deal with the Indians? Rep. Hager — Under the right circumstances, I would favor gambling. We need to be confident as to the location. The neighborhood has to be agreeable to it, and we have to know if we have the police and fire power to oversee gambling. We also have to be confident that we can appropriately regulate it. Commissioner Zelniker — There was a bill in the Legislator regarding eliminating plastic bags in the State of Florida, and I understand it never came to be voted on. California and other states have done this. Rep. Hager — There was a bill introduced to ban or control plastic bags. It was assigned to a committee and it died there. If this comes forward again I will do everything I can on this issue. Comm. Zelniker — Florida was one of the three states that did not vote for the Equal Rights Amendment and, to this day, there is still no Equal Rights Amendment in the Constitution of the United States. Are we ever going to support women? Rep. Hager — I believe and support equality and fairness for all Americans. I cannot answer your question since it is not an issue before any of the committees that I am on, but I will do everything in my power to support this. Commissioner Stern — Thank you so much for your support on the Sober Homes. You had the whole Senate fighting you all the way and appreciate the fact that you got it passed. Did we finally do a budget that is balanced this year? Rep. Hager — We will reconvene sometime within the next 30 days. There are some issues that are being negotiated. The budget is in very good shape. Commissioner Feldman — Are all the cities in Florida zoned for Sober Homes? Rep. Hager — You cannot have a special zoning for Sober Homes, but you can apply all your zoning tools, obligations and responsibilities to Sober Homes. Comm. Feldman — Are Sober Homes a profitable organization? Rep. Hager — Most of these homes are for profit and there is quite a bit of money to be made. Rep. Ham explained the qualifications for being accepted into these homes. George Kelvin, 4740 S. Ocean Blvd — Does this law apply to condominiums and apartment homes? Rep. Hager — Yes it does. Myles Schlam, 3600 S. Ocean Blvd — Who regulates these homes? Rep. Hager — The Department of Children & Family Services regulate these homes. Public Works Director Soper — The publically owned portion of the water lines will be replaced. If there are pipes that lead up to your meter on the Town's side they will be replaced. Anything from the meter beyond is private and will not be replaced. The owners can replace them if they care to. Carl Gehman — If they put the pipes into the driveway, will they replace the driveway or do we? PWD Soper — Anything we touch and disturb will be replaced and restored. By consensus, the Consent Agenda was accepted as presented. 7. NEW BUSINESS: A) Discussion of Friends of the Library financial commitment to the Library enclosure project. Comm. Zelniker — Upon investigating previous information about this project, I want to bring to light some facts about the Library enclosure so we can move forward and make the proper decisions. Our beautiful Library was built in March of 2006. Our Library Director, Mari Suarez was here at the time of the construction. The following are the facts presented by Comm. Zelniker: o May 9, 2013 — Memo from Kathleeen Weiser, former Town Manager to Mari Suarez, Library Director re: justification for the enclosing of the Highland Beach Library. The last paragraph read: As part of this project, The Friends of the Library would like to become involved and are proposing a special "naming rights" campaign with an individual contribution of $35,000 per terrace. If successful, this campaign could potentially raise $70,000.00 towards the final cost. o May 28, 2013, Minutes — Vice Mayor Brown asked if at a $150,000 cost, are we looking at matching funds? Dorothy Kellington, Co- President of the Friends of The Library responded by saying that all the plans we have put together are just that. The Friends are prepared to make a substantial donation to this project. o May 28, 2013, Minutes — Part of the Commission's discussion included funding: $150,000: Allocations from the General Fund Unrestricted Fund Balance; Donations via "Naming Rights Campaign ". Town Commission Regular Meeting Minutes Tuesday, May 5, 2015 Page 9 of 14 o June 24, 2014, minutes — Town Manager Weiser stated that the Friends of the Library will be raising money to fund half of this. They are planning on doing a specific fund raising task for this item. However, the Commission will have to budget this entire amount should they not be able to come close to half of it, and if you want to go forward with this project. Comm. Feldman asked if they would be obligated to give us this money. Town Manager Weiser stated that it was the Commission's call as a policy make to say that you will move forward if they raise a certain amount. o November 4, 2014, minutes, — It was agreed that the Town would provide $75,000 and the Friends of the Library would also provide $75,000. We doubled our effort and put $1 50,000 in our current budget for this project. Commissioners voted to do this. o This was only a Capital Improvement Plan that was approved. The project was never voted on by the previous Commission. It was discussed, worked through but never voted on. In this rove p sion for the Capital Improvement Budget, it puts in the fact that we are going to put in $150,000 for the enclosing of the two terraces. There was a stipulation written that said "Friends of the Library have proposed a funding concept that would raise money from individuals and/or groups in return for name recognition on the enclosed terraces. Initial estimates of their "Naming Rights Campaign" indicate the potential to raise 50% of the project costs. Supplement funding for this project could be made available from an allocation of the General Fund's Unrestricted Fund Balance." o February 24, 2015, minutes — Statement made by Marge Lanthier, Co- President of the Friends of the Library asking for the definition of due - diligence. Town Attorney Torcivia responded that due - diligence is the responsibility of both sides. There was a great deal of discussion by our Commissioners, but never voted on. I am hearing rumors that the Friends of the Library don't have the funds for this project at all. I have never been notified in writing of anything. The Library belongs to our town. We never asked the Friends of the Library for any donations. People pay taxes, and I am not sure if we need something done to our Library that the Friends of the Library should be involved. I feel there is something not right about this project. Commission discussion: Comm. Stern — I had the feeling that we did vote on it as a project. The question is do they need this enclosure or do they not. Maybe we should table this project for one year and find out if they need it, and whether they can pay the monies they promised us. We need to get the facts. It does not make any sense to me to hold these people who have spent the money for the bids, and the time the staff has put into it, to go any further. Vice Mayor Weitz — We are told that the six year old Library building needs to be modified and there is an outpouring from the public that this needs to be done. We are also told that the modification needs to be done to handle the overflow of crowds that attend certain programming. We come to find out that we have the capability of streaming live programming directly into the Town Commission Regular Meeting Minutes Tuesday, May 5, 2015 Page 10 of 14 homes of all the residents of Highland Beach. The Friends of the Library can no longer pay for any part of this project, and also cannot pay for any furniture, etc. for these enclosed rooms. The taxpayers will then be responsible for not only the project but the furnishings as well. I have received many calls from residents asking me why we are doing this project, changing the Florida room, and why didn't we know about it. We can either table this project or end it. I don't see the data that says we need it, nor the financing in place that says we have the financing. If there is a need and financing, bring it back and I will consider it. Comm. Feldman — There is a meeting this afternoon with the Town Attorney, Town Manager and myself and we are going to bring up some of these questions. I would like to propose that we have a Library Advisory Board who could be fielding all this information and then bring it back to the Commission. Mayor Featherman — I strongly support the Library but feel we need additional information before we make a decision. MOTION: Vice Mayor Weitz moved to table the Library renovation project for one year to give individuals proper time to provide any necessary information, relevant information and details that may justify this project. Also, that we curtail any further contracting efforts with bidders at this time and suspend that process immediately. Motion was seconded by Commissioner Zelniker. Commission Discussion: Comm. Zelniker — The Library belongs to the town, the taxpayers. Should the Friends of the Library be contributing money to this project? Town Attorney Torcivia — The Town owns the Library and is responsible for maintaining the Library. The Friends of the Library can have a fundraiser and donate to the Town Library. You have never had an agreement with the Friends of the Library saying what they would provide because you are providing the meeting space; they are providing programming. There is no obligation for them to donate the money, or you accept it. Comm. Zelniker — People are donating money to the Library and I don't think they feel this money should be going into construction. It should be going to programming and buying more books. Comm. Feldman — Last year the Friends of the Library spent almost $5,000 on capital improvements to the Library. They should not have been using the money for that. This has to be defined, and is one of the things we will be talking about at this meeting. Instead of holding up this project, I would like to wait until next week to see what some of these answers are. Comm. Stern — If we do table this, I would like to instruct the staff to send the nicest possible letters to those who did the bidding because they have spent a great deal of money. Town Attorney Torcivia asked for a second motion rejecting all bids. You can send that letter thanking them, but we are rejecting all bids. MOTION: Commissioner Stern moved to reject all bids and send a letter to those who did the bidding thanking them and telling them that we are rejecting all bids. Motion was seconded by Vice Mayor Weitz Commission Discussion: Comm. Zelniker — I am not rejecting these bids because of the motion that was just made. It was my understanding, when listening to the audio, that the Selection Committee was not happy with any of the bids. Based on this, I would have rejected the bids anyway. Comm. Feldman — The discussion was not that they were not complying with the bidding. I think it was not clear just what they were bidding on. If this goes out again, they must make the bids clear as to what they want. MISCELLANEOUS — ITEMS LEFT OVER: A) Discussion on Design/Build Contract. Town Manager Brown — There is no need for discussion since the motion made rejected all bids. 9. REPORTS — TOWN COMMISSION: A) Commissioner Zelniker — I would like to thank George Kelvin for his remarks. Perhaps we could do a written survey or letter to the residents for their input. I am not against this project; just the way it was handled. In response to Jim Jiovanazzo's comments, we take what he said regarding the bike lanes very seriously. Unfortunately, when a car goes out of control there is Town Commission Regular Meeting Minutes Tuesday, May 5, 2015 Page 12 of 14 nothing that can be done to prevent such a tragedy. Hopefully we can find a solution to the bike lane issue to keep our community safe. B) Commissioner Feldman — The bike lane issue is a very difficult situation. At the time of that accident, AIA was closed for some time. I know we have a Code Red. Whenever they are going to close the road, or anything major happens in the town, this Code Red alert should be used to keep our residents informed of what is happening in our town. C) Commissioner Stern — I would like to read some statistics regarding accidents in Palm Beach County. The five year accident statistic is pretty steady. Regarding bicycles, out of 15,000 reported accidents, there were 380 bicycle injuries. Comm. Stern went on to read other statistics such as pedestrian and automobiles for both Palm Beach County and nationwide. I agree that bicycles are dangerous; but according to the statistics, pedestrian fatalities and injuries are even more dangerous. It is very sad that this tragic accident happened and in Highland Beach. D) Vice Mayor William Weitz — I also want to send my condolences to the family. This Commission will do whatever it can to protect the safety of the residents of this town and those who pass through it. I also would like to thank my fellow Commissioners for the discussion on the Library project being done in a reasonable, professional and democratic way. I would like to pay tribute to a former colleague of mine, Dr. Len Haber who has passed away. He was a role model in my life. He was a Commissioner for a few years and then ran for, and became, Mayor of Miami Beach. Dr. Haber was a good friend of my Father's and then became a good friend of mine. E) Mayor Bernard Fearherman — I want to thank my fellow Commissioners for fighting so hard for our residents. I would also like to say that I support the Library. They are a tremendous asset to our community and we want to do the right thing. Regarding the bicycle situation, I researched this and found that they have the same rights as automobiles. Hopefully we can find a solution to this problem. 10. REPORTS — TOWN ATTORNEY GLEN TORCIVIA: Town Attorney Torcivia had no report. 11. REPORTS — TOWN MANAGER BEVERLY BROWN: FDOT notified us that they will be removing the tree at the end of the driveway. The next door residents are challenging this so I asked the gentleman from FDOT to come back. The problem is the visibility leaving our parking lot. Tomorrow starts our budget season for Town employees. If any of the Commissioners have any special project they want included, please see me so we can investigate the financial part of it. This afternoon, I am meeting with Town Attorney Torcivia, Commissioner Feldman and the Friends of the Library. We are considering removing part of the island in the parking lot at the north side of the building to make a few more parking spots. We are in the process of getting estimates for this. Ocean Blvd — This was basically a Library meeting and I would like to know why the Librarian was not here today. Town Manager Brown — The money was involved with the Friends of the Library and they were here last week. The person we are meeting with could not get here before 3:30 PM. Nick Macro plis, 3215 S. Ocean Blvd — I was here at the time of the bicycle accident. I could not get to my home because they had AIA closed and the Police Officer would not let me through. Why would they close a main highway down for over three hours? There should be some way to get through. George Kelvin, 4740 S. Ocean Blvd — I think we should investigate putting down a noise strip that would alert the motorists to slow down, or avoid a bicyclist going into the road, or a car crossing into the bike path. Myles Schlam, 3600 S. Ocean Blvd — I am now aware of who the Friends of the Library are and that Library is owned by the Town. Peter Rodis, 3224 S. Ocean Blvd — In terms of the Library, I participate in the film program of the Library. The Librarian told me that the Town provides funds for the Library and the programs are provided by the Friends of the Library. Lynn Rodis, 3224 S. Ocean Blvd — Very often I see two bicyclists riding side by side and I feel they shouldn't be doing that. Mayor Featherman — They can ride two abreast. Carl Gehman, 1123 Highland Beach Dr . — People should be more aware of their surroundings when they are on the road. There should be more police presence. What are the police hours? Town Manager Brown — They are here every day, 24 hours a day. Lt. Eric Lundberg, Highland Beach Police Dept. — We have two officers on at any given time, mandatory. Sometimes we may have three. There are a total of 17 officers. Comm. Stern — Our Lt. Lundberg has instituted the program with bicycles along with other towns, and has done a great job. Lt. Lundberg — The South Florida Safe Roads Task Force has developed over the years, and every agency from Hillsboro to Palm Beach participate. We have events throughout the year to reinforce what is necessary in the rules and regulations for vehicles, bicycles and pedestrians. Our goal is for everyone to share the road. Edward Neidich, 4740 S. Ocean Blvd — The hours of the Library Director are 6:00 AM until 2:00 PM. Those hours are on the parking space by the Library reserved for the Librarian. Why does the Librarian work from 6:00 AM to 2:00 PM when the Library is opened from 10:00 AM until 8:00 PM most nights? I would like to know if those hours are approved by the Town Commission.
