CODE ENFORCEMENT BOARD
REGULAR MEETING
Wednesday, January 21, 2015 9:30 AM
Members Present: Chair Paul Resnick; Vice Chair Tim Burnich; Board Member Don
Gill; Board Member David Stem and Board Member Robert Ford. Members Absent:
Board Member Jack Halpern (excused) and Board Member Michael Kravit (excused).
Also Attending: Acting Town Manager Beverly Brown, Commissioner Rhoda Zelniker;
Administrative Assistant Rosalie DeMartino and a member of the general public.
CALL TO ORDER:
Chair Resnick called the Regular Meeting to order at 9:30 a.m. Roll call was taken by
the Administrative Assistant followed by the Pledge of Allegiance.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA:
Chair Resnick called for any additions, deletions or acceptance of the agenda, hearing
none, the agenda was accepted as presented.
PUBLIC COMMENTS AND REQUESTS:

• 2014 Code Enforcement Update

The board members were given a code enforcement recap for the calendar year of 2014
(attached as Exhibit "A "). Code Enforcement Officer Carol Holland stated that all the
issues brought forth in 2014 have been resolved. Most times they were settled by a
telephone call rather than having to go out and physically issue any kind of warning.
Vice Chair Burnich thanked Officer Holland for such a detailed report and suggested that
such a report could be given to the Board on a quarterly basis, if they should go to
quarterly meetings, so they would know what is occurring. Member Stern — Regarding
the Delray Sands Hotel, I noticed that on Sundays they have been parking cars on the
swale. Is this allowed? C.E.O. Holland — I will check into this.
Chair Resnick — The parking situations on both sides of A 1 A are not aesthetically
pleasing. Cars are parked everywhere and there are signs in the road for valet parking.
The Police Dept. needs to control the cars being parked on the grass. I also noticed a lot
of "junk" on the property. As a private citizen, if you see something that is not code
f compliant, contact the Police Department.
Member Ford requested a copy of the Code of Ordinances. Chair Resnick stated that all
codes appropriate to this Board were given to each member when appointed. Member
Ford — Do you follow the National Electric Code? Building Official Mike Desorcy — We
follow the NEC (National Electric Code) 2008. We will be adopting the NEC 2011
shortly. To answer the questions regarding the parking at Delray Sands, the right -of -way
is DOT jurisdiction. I will contact David Moore, representative for DOT, to find out
what the parking situation should be in the right -of -way. If there are cars parked there for
special occasions, they should have a permit or DOT approval. I am not aware of the
parking on the weekends since we are not here but it is the responsibility of the Police
Dept. to take care of that. I am not aware of any "junk" on the property. Renovations are
over so any debris on the property should have been removed.
Chair Resnick — I was referring to signs strewn about such as valet parking. B.O.
Desorcy — I discussed this with the Town Attorney and the signs and cones are allowed
on their property by the ordinance. Member Stern — The safety has increased
tremendously since putting up those signs. Also, it would be a great help to us if we
could receive your report a few days before our scheduled meeting.

• Review and Approve the 2015 Meeting Schedule

As Needed Per Code of Ordinances Section 2 -101
Chair Resnick reviewed the 2015 meeting schedule and called for a motion to approve
the schedule.
MOTION: Member Stern moved to approve the 2015 meeting schedule to meet on the
3 rd Wednesday of the month at 9:30 a.m. as needed. Vice Chair Burnich seconded the
motion, which passed unanimously.
ELECTION OF OFFICERS:
A. Chair
Chair Resnick called for a nomination for the Office of Chair. Member Stern nominated
Paul Resnick as Chair of the Board. Paul Resnick declined the nomination. Member
Stern nominated Tim Burnich as Chair of the Board. There being no further nominations,
Chair Resnick called for a motion to elect Tim Burnich as Chair.
MOTION: Member Stern moved to elect Tim Burnich as Chair. Member Gill
seconded the motion.

B. Vice Chair

Chair Resnick called for a motion to elect Don Gill as Vice Chair.
MOTION: Vice Chair Burnich moved to elect Don Gill as Vice Chair. Member Stern
seconded the motion.

Code Enforcement Recap for 2014
January 2014
1. Removed Real Estate sign- called realtor to pick up sign from office- complied
2. Verified 2 contractor registrations.- all ok
3. Called owners of property south of Toscana to cut vegetation back and cut grass- complied
4. Went to check beach out with Public Works employee
S. Attended Beaches and Shores meeting with Mike Desorcy
6. Spoke to 2 contractors who were building housed on the east side of A1A to clean up the beach
behind the houses. They both complied. Another resident called to thank me for the cleanup.
7. Called Seagate Construction to fix screening on fence and cut grass on inside of fence. Complied
8. Pulled Real Estate sign on Russell Dr. for incorrect colors. Read him the ordinance. It was
resolved.
9. Boat parked illegally on So Ocean. Gave resident until Monday to move it. They complied.
10. South Ocean Blvd- informed resident that he needed to remove reflectors from the grass by
street. He was very mad because his grass was getting ruined from big trucks ripping up the
grass. He yelled at me and slammed the door in my face. I went back a few days later and spoke
to the Property Manager, and he took the reflectors down.
11. Went on 10 patrols
February 2014
1. Garbage on vacant property south of Toscana. Called property manager and all was corrected
2. Went out on beach patrol.
3. Spoke with 2 more contractors to clean up behind new construction. They complied
4. Called realtor to remove rider on sign. She complied
5. A Commissioner's election signs were removed from A1A and never to be found.
6. Another red rider was placed on a real estate sign. Called realtor and she took it off.
7. Complaint about reflectors on A1A. Gave the contractors and homeowners until March 3 rd to
remove. All reflectors were removed by the specified date.
8. Moved 3 election signs to tree line that were right on the grass line on A1A.
9. Realtor came in to complain about an illegal fence that was put up on her listing property
without her permission. Went with her through the property to look at it. Spoke with
homeowner's contractor who put the fence up. He was trying to alleviate people from walking
on his property to get to the beach. He removed the fence.
10. Pulled real estate sign that did not comply with our sign ordinance. Called Realtor and gave him
a copy of ordinance. He came in and picked up sign.
11. Spoke with property manager about poles that were place in the grass by A1A. He was
concerned because big trucks were ripping up the grass. I informed him that he could put up
soft landscaping. He was appreciative and he did plant soft landscaping. Looks very nice.
12. Code violation to resident on A1A condo that they were working without a permit. Stop work
order posted. Contractor came in and pulled permits.
13. Went on 11 patrols.
March 2014
1. Pulled colored Real Estate sign on Russell Drive. Called Realtor and told him about sign
ordinance. He came in and picked up his sign. Gave him a copy of the ordinance.
2. Did inspection on all properties that had reflectors on A1A and everyone complied.
3. Got a complaint about the roof door on the Wiltshire house. Called Manager and he
painted it right away.
4. Open house on Tranquility Drive. Had many signs along AlA with balloons attached.
Removed balloons and signs and went to the open house and let realtor know he could not
do that. He apologized and never happened again.
5. Pulled realtor sign that did not meet our code for signs. Called realtor and gave him coy of
ordinance. He also picked up his signs.
6. Complaint about 3200 SOB. The screening on the fence was coming down and the grass
needed to be cut. Called owners and they came and fixed the screening and cut the grass.
7. Called Manager at Delray Sands and informed him to remove signs that said "formally
known as Holiday Inn ". He complied right away.
8. Removed colored real estate signs. Called realtor to pick up and gave him copy of sign
ordinance.
9. Boat trailer on Bel Air. Spoke with homeowner and let them know they could not leave it
there. They moved it the next day.
10. Stopped work on Tranquility drive. Working without permit. Contractor came in and pulled
permit that afternoon.
11. Stopped work on Bel Air Drive, working without permit. Replacing tile flooring. Contractor
came in and pulled the permit.
12. Pulled real estate sign on Bel Air. Realtor came in and picked up sign. Gave her a copy of
sign ordinance.
13. Resident called and complained about his neighbor putting up a sign in his backyard and an
illegal fence. Went to property to check it out. Spoke with homeowner and he took down
the illegal fence, but left the sign up. It was not an illegal sign. But he did eventually remove
it.
14. Got complaint about a house on Tranquility Drive that it was in need of a roof replacement
and fixing up of his house and yard. Went over and spoke with the homeowner, who was
very nice. He replaced his roof and spruced up his yard.
15. Went on 10 patrols
April 2014
1. Had a complaint from bike rider that there was debris and dirt on bike bath in front of homes
under construction. Called each contractor and reminded them that they needed to keep the
bike bath clean. I also sent each contractor a certified letter reminding them what they needed
to do in front of their construction sight.
2. Had complaint about valet sign at Delray Sands. Called and left message that they needed to
remove them. They complied.
3. Received complaint about debris left on the roadside on Highland Beach Drive. Went and left
garbage schedule on the 3 doors.
4. Called realtor that he needed to take down for sale signs and riders because the house was sold
and they could not leave up the signs anymore. He complied
5. Called realtor to take down a rider on his real estate sign. He complied.
6. Boat trailer in driveway on Bel Lido. Spoke with owner and they removed it.
7. Caught landscapers leaving cuttings that they did from trees and bushes. Spoke with the
landscaping company and let him know that they needed to take it with them. He complied.
8. Went out on beach. Very windy and lots of seaweed.
9. Called realtor to remove for rent rider on real estate sign. Went back the next day and it was
still up, so I removed it. Called the realtor and he apologized and said he forgot. He came in and
picked it up.
10. Received complaint about grass on vacant property on Tranquility. The landscapers just mowed
straight down the middle and forgot about cutting the rest of it. Called owner and he
apologized and he had the landscapers come back and finish the job.
11. Contractor working without permit on Highland Beach Drive. I told them they needed to stop
work and get a permit. The installer started screaming at me in my face, and I got in my car and
called the Building Official. He came and shut down the job. The contractor came in later that
afternoon and apologized for the way his installer treated me.
12. Garbage cans out on non garbage day. Left garbage schedule in home owner's door. Garbage
can was removed.
13. Complaint about construction of house on Intracoastal Drive. Called contractor to clean up
construction site. He complied.
14. Went on 13 patrols
May 2014
1. Called realtor to remove real estate sign. Property was sold over 3 weeks ago. She removed
it immediately.
2. Received complaint that the gate at 3200 SOB was wide open. Called owner and it was
closed and locked.
3. Called owner of property just south of Toscana. Need grass to be cut and bushes trimmed
back. Owner complied. Landscapers did a great job.
4. Vacant land on Tranquility grass needs to be cut. Called owner and he will have landscapers
come to cut. He complied. Landscapers did a great job.
5. Called owners at 3200 SOB. North side of fence is falling over. He called and fixed the fence
a few days later.
6. Owner on Highland Beach Drive complained about palm trees that are hanging over her
fence. Went to neighbor's house and explained the issue. They resolved their issues.
7. Pulled realtor sign. Does not comply with sign ordinance. Called realtor and he picked up
sign and I gave him copy of sign ordinance.
8. Called realtor to take down sold by sign. He complies.
9. Complaint about debris on north side of parking lot of the Delray Sands on the Intracoastal
side. Called manager and he had it cleaned up right away.
10. Went on 11 patrols
June 2014
1. Several complaints on different days about nails and debris in street at new home construction
on Intracoastal Drive. Went to check it and it all seemed cleaned up.
2. Called owners at 3200 SOB to close gate. They complied.
3. Had complaint about new construction home on Intracoastal Drive. Called police to come with
me. Officer Wentz and I went to site and everything looked fine. Took pictures.
4. Called owners again at 3200 SOB that gate was open. He told me that he went there himself and
locked it. He said someone is cutting his locks off the gate. He put another lock on the gate right
away.
5. Attended meeting about new home site on Intracoastal Drive.
6. Had complaint about 3200 grass very high. Called owners and they had it cut right away.
7. Went out on beach patrol. All OK.
8. Complaint about dumpster removal on Intracoastal drive. Contractor cleaned up street.
9. Went on 10 patrols
July 2014
1. Had complaint about landscaping on private home on A1A. Property manager advised me that
they were doing an over hall on the old landscaping. They had to stop because there was an
altercation with a resident and one of the landscapers. All was resolved and the landscaping was
finished.
2. Had complaint about lights being too bright from a home on the ocean side for the sea turtles.
Went to the home and spoke with the homeowner and gave him a sea turtle brochure. He
apologized and said his children were playing with the lights and they did not realize it. He was
very nice and it never happened again.
3. Went on 10 patrols
Aueust 2014
1. Had complaint about scary spiders in the bushes at the property just south of Toscana. Called
the owners and they had a tree cutting outfit call me. They were going to do a major cut back
and he was glad I told him about the spiders. I think they were banana spiders which can grow
to be huge, but don't really bother people. They are NOT nice to look at!! They are scary!!
2. Called owners at 3200 SOB to fix screening on fence. He complied.
3. Had complaint about hedges growing too far on the sidewalk on the south side of Town. Called
HOA president and he had the bushes cut way back.
4. Pulled real estate sign. Called reactor to pick up sign and gave her copy of sign ordinance.
5. Complaint about landscaping cuttings being left on the side of the road. It was a Monday which
is when it gets picked up, and it did.
6. Went on beach patrol. All ok.
7. Went on 10 patrols
September 2014
1. Had complaint about a homemade real estate sign on A1A. Pulled sign and called owner to let
them know that there is a sign ordinance. He was not aware.
2. Called owners of property just south of Toscana that the grass needs to be cut, trees need to be
pruned. Owner complied.
3. Had a complaint that another homemade sign for that same property that I removed and spoke
with the owner, a real estate sale was going up on Friday nights and being taken down Sunday
night. I called him and told him that if it goes up again, he will be cited. I notified the Chief of
police of this issue. It never went up again to the best of my knowledge.
4. Called contractor to remove a construction sign on a house that was competed. He removed it
immediately.
5. Big tree fell down on vacant property that was blocking the bike path. I called the listing agent
and she had it removed right way.
6. Went out n beach patrol
7. Mailed code violation letter to home on A1A for not having gutters replaced. They complied.
8. Landscape cuttings being left by gardeners for the garbage man on Intracoastal Drive. Let
homeowners know that the gardeners need to take it with them. They came back and picked it
up.
9. Had complaint about new construction site on Intracoastal Drive about food and garbage being
left and not cleaned up. Called contractor and he said he does clean up the site every day.
Drove by and it was clean.
10. Went on 12 patrols
October 2014
1. Had homeowner call me to complain about new home construction on Intracoastal drive. She
said that someone had tampered with her wiring. FPL was doing work in the neighborhood and
it could have been them.
2. Pulled political signs on A1A. Brought to Town Hall.
3. Hoby Cat was parked in driveway on AlA. It was later removed.
4. Had a complaint about the road in front of the new construction on Intracoastal Drive. Called
contractor to remind him to sweep. He complied right away.
5. Pulled real estate signs. Called realtor and let them know they can pick up their signs in the
Building Dept, Gave them a copy of sign ordinance.
6. Boat trainer in someone's driveway on Intracoastal Drive. Notified them that they had to
remove it. They complied.
7. Mailed notice of code violations to owners of property just south of Toscana. Grass was over 12
inches high and there was trash in the bushes. Owners complied. Violation closed.
8. 7. Went on 11 patrols
November 2014
1. Contractor installing an air conditioner without a permit. Shut the job down. Came in and got
permit that day.
2. Attended a meeting with FDOT about contractors and workers parking in the right of way.
3. Received a complaint about a rusted out barbeque abandoned on the side of the road on
Highland Beach Drive. Called the Public Works dept and they went and disposed of it. I knocked
on the doors of the condo, but no one said it was theirs.
4. Complaint about landscapers cutting foliage and leaving it on the side of the road in Bel Lido.
Spoke with the landscapers, and they took it away.
5. Called several contractors to remind them to clean the street at least twice a day. They seem to
forget every once in a while.
6. Pulled 2 real estate signs. Called each realtor and told them of our sign ordinance. They came
and picked up their signs.
7. Boat trailer parked in driveway on Intracoastal Drive. Notified homeowner it had to be
removed.
8. Went on 12 patrols
December 2014
1. Received complaints about garbage being left out in front of Byrd Beach. Spoke to 2
homeowners and gave them the garbage pickup days. They said they would put it up by the
mailboxes to remind everyone of pick up days.
2. Boat and trailer on Intracoastal drive. No one home. Left ordinance in door. Went back later, it
was gone.
3. Pulled real estate sign from Bel Air. Called realtor and let them know of our sign ordinance,
came in and picked up sign.
4. Received complaint about a dirty roof on A1A. Called HOA president and let him know. He had
the roof painted and cleaned last year, but it is white, so gets dirty easily. He said he will have
the roof pressure cleaned as soon as possible.
