A workshop meeting of the Town Commission was called to ayor H rton on
Wednesday, May 27, 1970 at 7:30 P. M. All Commissioners were present ex-
cept Comm. Beekman, who was out of Town. Several Town citizens were also
in attendance.
Mayor Horton reported receiving a letter from a resident of Penthouse
Highlands regarding the piles of wood behind the Monterey House Model.
The office manager wrote to Mr. Young, requesting this to be cleaned up.
A follow up letter will be written within the next few days if Mr. Young
does not reply. The fire inspector has been asked to inspect for a
possible fire hazard.
Mayor Horton reported on a note received from a Town resident asking to
have the TV in the fire house repaired, so they don't have to use one
of the fireman's private set4 The Mayor authorized this to be repaired.
Mayor Horton read a letter from Mr. John Klinck of Russell & Axon,
stating that firm's terms for a proposal to be hired as consultants to
the Town , to perform services that they are now doing for free. Their
fee would apply only to sepcific assignments authorized by the Commission.
Duscission followed, with opinions of the Commissioners. A resolution
will be prepared for the next Town meeting.
Vice Mayor Vedder reported that the property north of Penthouse Towers,
owned by Spinnaker Inc., was being cleared last Saturday without permits
having been obtained. The bulldozer and truck work was stopped that same
day. Comm. Vedder read a letter received from Mr. Anderson requesting a
permit to clear the south 50' of this property for a temporary road to be
used in construction of Penthouse Towers. The Vice Mayor had a copy of
a telegram of permission from Spinnaker Inc. The zoning committee met
on this matter and decided that they must stay clear 120' of the Easterly
Survey line, put in a temporary road to be policed at all times so no one
has entrance to the beach,* all liabilities assigned by Penthouse Towers
and Biltmore Realty & Development Corp. This road is to be removed along
with all debris east and west of the properties and only clean fill will
be allowed to be put in there. The ridge is to be restored to its natural
height and is to be landscaped with sea grapes or palmetto trees or both,
of density approximately 25 square feet. All work is to be done and the
property restored by August 1, 1970 and a $ 20,000 bond is to be furnished
to the Town, to see that this work is properly done. A representative of
Penthouse Towers, who was in attendance was informed of this decision.
Comm. Jurisch moved to proceed as to the report, Vice Mayor Vedder seconded,
and it unanimously passed. A permit will be issued when the $ 20,000 bond
is received.
Mayor Horton read a.letter of resignation from the A. & S. Utility Manage-
ment Inc., the Town's Water Plant operators. Comm. Jurisch stated that
they are resigning, not because of unhappiness, but because it requires
more time to operate our water plant than they are able to devote. They
stated that they will remain on duty until new operators have been secured.

`./ utilities operators, which could include meter installations, and future
operation of the sewer system. Comm. Jurisch suggested we may need a
public works superintendant and he was informed that he may authorize ex-
penditures for advertising to obtain this. Comm. Jurisch stated that he
will initiate a new program ofl duties for this with guidance from Messers
Bertash, Burnside and. Joy, and Brockway, Owen and Anderson will give tech-
nical help. Further discussion followed.
Mayor Horton stated that there was a surplus of approximately $ 22,000 from
the water plant construction. He asked the Town attorney to get an opinion
as to how this money should be used. Information was also obtained from
Mr. Eubanks, the Town's CPA. Mr. Timothy Poulton, the attorney, stated in
a letter that because money for this construction had been borrowed from the
General Fund, it will be returned to the General Fund. At present it is
invested in Government securities.
Mayor Horton read a letter from Southern Bell regarding an application to
construct and maintain 42 feet of pipe along AlA. It will be posted on the
bulletin board.
The Mayor read a letter received from Nr. Brey of Penthouse Highlands re-
garding the abnormally high water bill for that building. He has made a
survey of past water consumption and bills and has requested information
from Harvel & DeLand, who installed their meter and the Nepttune Meter Co.
Mr. Brey explained there will be a delay in paying the present bill.
The Mayor read correspondence received from the Palm Beach County Board of
Health signed by Mr. Reed for Mr. Lukin regarding the approved use of temp-
orary septic tanks in Bel Lido until the sewer system is in operation, in
that sub - division; to correct a misconception as to the number of homes
allowed in Bel Lido.
Comm. Jurisch stated that he received the basic plans and preliminary
prints for the expansion of the well field, from Brockway, Owen and Anderson.
He recommended making out the preliminary applications for going under Rt. 1,
Dixie highway, and the railroad, to avoid a long delay. The estimated cost
is approximately $ 80,000. Since our reserve surplus is about $ 60,000, the
Mayor added that this work may have to be done before we can collect any
water connecting fees to help pay the cost.
There was discussion on the proposed Air Conditioning Ordinance and several
changes recommended by the Commissioners. Action will be taken when the
changes are made.
Vice Mayor Vedder reported a letter has been sent to the Royal Highlander
requesting removal of the model and the utility but off that property
because the building permit has expired.

Comm. Jurisch stated that a proposed water Ordinance is being prepared and
will be presented when ready.
