u A special meeting was called at the request of Mayor Horton, and Commissioners
Beekman and Vedder on March 17, 1971 at 4 :00 P. M. for the purpose of dis-
c cussing an application for a building permit submitted by Messers Gundlach
and Urbanek. All Commissioners were present except Comm. Beekman, who was
out of Town. Also present was attorney Poulton, as well as several property
owners, attorneys and a court reporter.
Mayor Horton read correspondence dated March 2, March 5, and March 8, 1971
requesting the application for building permits for 22 buildings.
Discussion followed. Comm. Jurisch moved to defer action until after the
workshop meeting and the public hearing. There was no second. The decision
was to let both sides be heard at the workshop meeting and the public hearing
before action is contemplated. *(on the proposed zoning amendment Ordinance)
The meeting was recessed at 6 :00 P. M. until Saturday, March 20th at 9 :00 A.M.
On Saturday there was no quorum present so the meeting was postponed until
Wed. March 23rd at 4:00 P. M. The meeting was resumed with all Commissioners
present. Also in attendance was Town attorney Poulton as well as several
property owners, attorneys and a court reporter.
Discussion continued on the application for building permits submitted by
Messers Gundlach and Urbanek. The concensus was to wait until after the
public hearing on Thursday for the Commission approval. Comm. Jurisch moved
to postpone this meeting until Friday, March 26th at 4:00 P. M.
When the meeting resumed on Friday all Commissioners were present as well
as Town attorney Poulton. Also in attendance were Messers Gundlach, Urbanek,
attorney Faust and several townspeople.
Regarding the request for 22 building permits as submitted by William Gund-
lach, their attorney, Mr. David Faust, submitted a compromise request. and
is- asking that only 11 permits covering 980 dwelling units, be issued for
the present. These buildings comply with the zoning in process as far as
density is concerned but they are suggesting that the new zoning be revised
to provide service roads to be constructed that run parallel to AlA and that
where these roads are provided that the parking be reduced to 12 spaces per
dwelling unit. Mr. Faust further understands that the plans are subject
to review by the various inspectors to determine that all requirements of
the building, plumbing, electrical and fire codes are complied with. The
zoning committee will review the plans for the 11 buildings in question, to
see that they conform to zoning Ordinances # 132 and # 150. The applications
for the remaining 11 buildings would be withdrawn at the present time, but
when they are resubmitted, they would agree with the proposed zoning amendment.
Vice Mayor Vedder moved to enter into this agreement as stated by Mr. Faust
at the recommendation of Town attorney Mr. Poulton. Comm. Jurisch seconded
and it was unanimously voted.
