1973.01.16_TC_Minutes_Regular MINUTES: CONTINUATION OF THE REGULAR MEETING OF THE TOWN COMMISSION - January 16 19 The continuation of the regular meeting of the Town Commission was called to order by Mayor Horton on January 16, 1973 at 7:30 P.M. All Commissioners were present as well as the Town Administrator. Mayor Horton read a notice received from the Palm Beach County Legislative Delegation notifying of several meetings in the area. The closest one is in Boca on January 24, 1973 at 9:30 in the morning. Any one can suggest legislation that might benefit on a state -wide basis, such as dune preservation. There was discussion regarding the National Association of Home Builders who are making efforts to circumvent laws that combat density in Towns. One suggestion was to write a letter to the Florida League of Cities with a copy to the Palm Beach County Municipal League that would support the citizens and the towns in their effort to control their own destiny on density matters. Vice Mayor Dent moved this be approved and Commissioner Gilday seconded. The following voted Yes: Mayor Horton, Vice Mayor Dent, Commissioners Gilday, Joy and Mumford. Mayor Horton read a letter received from the Department of Pollution Control regarding a meeting on February 13, 1973 regarding requirements of public incinerators. I Mayor Horton reported receiving no official word yet regarding the hearing in Tallahassee on January 15th. The morning newspaper articles reported that Delray `Bch., was granted approval for their application of a temporary Operating Permit. However, they are going to issue no more building permits and so neither will Highland Beach. Official word is expected shortly. The Mayor further stated that Mr. Klinck of Russell & Axon received word from the President of the Highland Beach Utilities Company to proceed with engineering work toward construartion on completion of the sewer system. Mr. Urbanek wants to schedule a meeting for Tuesday, January 23rd, to discuss the Department of Pollution Control's official decision. A workshop meeting is scheduled for that night. LEGAL DEPARTMENT Commissioner Gilday reported on the selection of a Judge for the Municipal Court which will be activated and have its first session Monday, January 29, 1973 at 7:30 P.M. Mr. John D. Wessel, an attorney in Boca Raton, has been appointed as our first Municipal Judge. Commissioner Gilday read Resolution No. 216 activating the Municipal Court of the Town of Highland Beach and appointing a Judge. Commissioner Gilday moved for approval, Commissioner Joy seconded - the following voted Yes: Mayor Horton, Vice Mayor Dent, Commissioners Gilday, Joy and Mumford. Commissioner Gilday reported that Mr. Urbanek has filed a motion against the Town to tax costs and requiring the Town to post a supersedeas bond. Mr. Klein will represent the Town and the hearing is set for February 9th at 11:30 A.M. There has been nothing further on the VanLennep suit. Regarding the 3200 suit a brief has been filed WATER COMMITTEE: Commissioner Joy reported that his committee, the Town Administrator, and Engineer Joseph Wantman met on Saturday morning to gather e- stimated costs on water storage and transmission main under the Intracoastal Waterway. We will still have to gather more information on an elevated vs. a ground water storage tank and a final breakdown of costs. BUILDING DEPARTMENT Vice Mayor Dent reported CGC Corporation sent a letter of request to move their sales trailer from their west of AlA across to east of AlA on the Beach Terrace property, which they recently acquired. Also, they are requesting to paint two existing signs - one of which is a non - conforming size. They were given approval to move the sales trailer for a period of six months on this temporary location and they were granted a one year permit for a temporary sign - 4 x 8 feet. Vice Mayor Dent reported Mr. Urbanek's architect, Mr. Ed Seymour, met with Mr. Foster on Monday to try to determine the original number of acres and, as compared to the number of acres in the recently submitted surveys. Discussion followed. Further reporting on the Town Hall construction progress was that piles are now being driven and that a palm tree has been saved by relocating it temporarily. Commissioner Mumford reported on the newspaper article she saw which states the State might get land adjoining the Intracoastal Waterway back from private owners. The meeting adjourned at 9:30 P.M. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA ACTIVATING THE MUNICIPAL COURT OF THE TOWN OF HIGHLAND BEACH AND APPOINTING A JUDGE THEREOF. BE IT RESOLVED that pursuant to the authority of the charter of the Town of Highland Beach and ordinances pursuant thereto previously enacted, a Municipal Court in and for the Town of Highland Beach is hereby activated; as follows: Said Court shall be known and designated as Municipal Court of the Town of Highland Beach. The sessions of said Court shall be held at the Town Hall of the Town of Highland Beach or at such other place as may, from time to time, be designated by the Town Commission. A , —., is hereby appointed as Municipal Court Judge of the Town of Highland Beach to serve at the pleasure of the Town Commission and his compensation therefor shall be at the rate of $35.00 per hour. The Town Marshall or one of his deputies shall attend all sessions of said Court, acting as a Court Baliff. The Town Clerk of the Town of Highland Beach shall be the Clerk of the aforesaid Court and shall be compensated therefor at the rate of per session of Court attended by her, and she may designate a Deputy Clerk who shall exercise the functions of said Court Clerk and shall be compensated for all.
