Minutes of Meeting of Town Commission
SPECIAL MEETING
Tuesday, January 12, 1993 9:30 a.m.
Mayor Joseph A. Boulay called the Special Meeting of the Town Com-
mission of the Town of Highland Beach, Florida, to order in the
Commission Chambers at Town Hall at 9:30 a.m. Others present were
Vice Mayor Bill Paul, Commissioners Arlin Voress, Arthur Eypel,
and John F. Rand.
Also in attendance were Town Attorney Thomas E. Sliney, Town
Manager Mary Ann Mariano, and Town Clerk Anne M. Kowals.
Mayor Boulay noted the purpose of the Special Meeting is to give
first reading to a proposed ordinance regarding a referendum for
the March 09, 1993, Municipal Election relating to term limitation
for elected officials.
The Mayor further noted there were no Charter Review Board Members
nor members of the general public in attendance.
Town Attorney Thomas Sliney explained he submitted two separate
draft ordinances (one reflecting the Town Manager's suggestion
with the other representing his proposal) in order to differenti-
ate the two real changes which are:
1. limiting the Commissioners to three (3) succesive terms
2. provide that term limitation for all elected officials
shall not include any appointments
In noting he prefers the Town Manager's suggestion of combining,
in one section, the existing limitations on Mayor and Vice Mayor
together with the proposed new change of three (3) successive
terms as Commissioner and include the limitation shall not affect
any appointments, the Town Attorney advised the Commission has the
option of selecting the draft ordinance they consider most
appropriate.
During discussion, the Town Attorney stated he would like the
Minutes to reflect that, should the referendum fail, the intent
would be that Section 1.06 (3) remains unchanged whereby the Mayor
and Vice Mayor are limited to three successive terms.

When it was questioned whether the draft ordinance reflecting the
Town Manager's suggestion would be clearer if a Section 5 was
added to indicate that "upon the unsuccessful referendum, the
existing charter requirements under Section 1.06 (3) remain in
place", the Town Attorney advised, if the electorate defeats the
referendum, he will draft another ordinance to clarify the Town
Commission's intent (he will add the intent which is the Mayor and
Vice Mayor are limited to three (3) terms whether the referendum
passes or not).
Following brief discussion, it was the consensus to give first
reading to the draft ordinance reflecting the Town Manager's
suggestion. The Town Clerk read the title of the ordinance.
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
PROPOSING AMENDMENT TO SECTION 1.06 (3) OF ARTICLE I OF THE
TOWN CHARTER ENTITLED "GENERAL PROVISIONS" PROVIDING THAT NO
PERSON MAY SERVE MORE THAN THREE (3) SUCCESSIVE TERMS AS
MAYOR, VICE MAYOR OR COMMISSIONER AND PROVIDING THAT THE
AFORESAID TERM LIMITATIONS REGARDING THE OFFICES OF MAYOR,
VICE MAYOR, AND COMMISSIONER SHALL NOT INCLUDE ANY APPOINT-
MENTS MADE BY THE GOVERNING BODY TO FILL UNEXPIRED TERMS;
PROVIDING FOR EFFECTIVE DATE OF PROPOSED AMENDMENT UPON
SUCCESSFUL REFERENDUM; PROVIDING FOR CODIFICATION OF
AMENDMENT.
There being no further business to come before the Commission at
this time, upon proper MOTION, Mayor Boulay adjourned the Special
Meeting at 10:00 a.m.
