TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission -• SPECIAL MEETING/CANVASSING BOARD Wednesday, March 10, 1993 1:00 p.m. The Special Meeting/Canvassing Board of the Town Commission of the Town of Highland Beach, Florida, was called to order at 1:00 p.m. in the Commission Chambers at Town Hall by Mayor Joseph A. Boulay. Others in attendance were Vice Mayor Bill Paul, Commissioners Arlin Voress, Arthur Eypel, and John F. Rand. Also present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Marianp, Town Clerk Anne M. Kowals, and members of the general public. Town Clerk Anne M. Kowals read Resolution No. 625 (a copy of which is attached to and made a Bart of these minutes) declaring the election to have been held on the 09th day of March, 1993 for the Mayor unnecessary since the qualifying candidate is unopposed. MOTION by COMMISSIONER RAND/VICE MAYOR PAUL to adopt the Resolu- tion as read received unanimous approval. Town Clerk Anne M. Kowals administered the "Oath of Office" to Mayor Arlin Voress. • At the request of Mayor Voress, the Town Clerk read the results of the Commission race: Arthur Eypel 816 votes David Augenstein 688 votes Michael Hill 636 votes Records indicate Highland Beach has a total of 3,075 registered voters; 1,229 ballots were cast which represents a 39.97 percent voter turnout. VICE MAYOR PAUL/COMMISSIONER RAND MOVED to accept the certifica- tion of the election. The MOTION passed without objection. The "Oath of Office" was administered to Commissioner Arthur Eypel by the Town Clerk who then administered the "Oath of Office" to Commissioner David Augenstein. At this point, the Town Clerk read the results of the referendum question pertaining to term limitation for elected officials: "Yes" votes 953 "No" votes 103 ~~ i ti Town Commission Special Meeting/Canvassing Board Minutes March 10, 1993 Page 2 of 4 Certification of the referendum vote was accepted upon unanimous approval of MOTION proposed by VICE MAYOR PAUL/COMMISSIONER EYPEL. A certified copy of the election results, submitted by the Palm Beach County Supervisor of Elections Office, is attached to and made a part of these minutes. Mayor Voress, noting all three elected officials being sworn in this date would like to make brief statements, at this time, called on Commissioner David Augenstein. Commissioner Augenstein, noting it is customary to pay tribute to those who assisted him in getting to this point, extended his heartfelt thanks to all for their support which helped him through the entire campaign. Commissioner Augenstein, noting he came to Highland Beach 11 years ago without any thoughts of running for public office, stated this is a great country where an individual like he can strive and work and eventually sit on a dais like this Town Commission. Commissioner Augenstein concluded his statement with "God bless us all--God bless America!" Commissioner Arthur Eypel, noting he would like to thank some of the people responsible for his re-election, advised he would like to start with his fellow Commissioners, Arlin Voress, Bill Paul, • and John Rand who not only gave their moral support but endorsed his candidacy; they had faith in him and what he believes in. Commissioner Eypel extended thanks to his campaign manager Gerald Marshall and Mr. Marshall's lovely wife Mary, as well as his friends and supporters in Highland Beach, too many to mention; without their help and support, none of this would be possible. The Commissioner thanked all Editorial Boards of the Palm Beach County Newspapers who endorsed his candidacy. Commissioner Eypel thanked his wife Nancy who was by his side, with her undying faith and trust, throughout the campaign. The Commissioner acknowledged someone he owes a great deal to, the wife of a former mayor, his mother, Mrs. Morgan. With that in mind, Commissioner Eypel promised he will, with all his heart, dispense the responsibilities the voters have given him to the best of his ability. Commissioner Eypel thanked one and all for their support. Mayor Arlin Voress, recognized his wife, sister and her husband, the many friends and neighbors in the audience today. The Mayor thanked all who urged him to run for Mayor and those who provided strong advice and support during his two year term as a Commis- sioner. Mayor Voress stated he will do his best to live up to the responsibilities of the office. Mayor Voress noted several important issues: the Broadview Litiga- tion that is before the 11th Circuit Court of Appeals (a response from the Court is anticipated by the end of the year); the DNR's request for funds to up-date the model used to determine the CCCL should receive Legislative approval within three weeks (model development will take 1 to 1-1/2 years and the Town will be actively involved in this DNR matter); an alternate Fire/Rescue Service, equal to or better than presently received from Palm • Beach County, at a reduced cost should be identified shortly; The Drexel dispute should be settled in the near future; and, the emergency generators for use during power outages will be in place in May. The Mayor stated he looks forward to continue working with all Town employees, with Town Manager Mariano who does an outstanding job for our Town, with Tom Sliney who has served as the Town's Attorney since the 70's; and, working with and being part of the Town Commission. Mayor Voress noted the Focus Group has been very helpful in improving citizen involvement. Mayor Voress thanked each and everyone for their support and confidence. At this time, Mary McCarty, Chairman of the Palm Beach County Board of County Commissioners, noting she came to congratulate Mayor Voress, Commissioner Eypel, and Commissioner Augenstein on their victories, stated Highland Beach needs to be commended for its stamina. WHEREAS, the Florida State Statute, Chapter 101.151(6) states: "Except for justices of the Supreme Court and judges of District Courts of Appeal, the names of unopposed candi- dates shall not appear on the general election ballot. Each unopposed candidate shall be deemed to have voted for himself."; and WHEREAS, the election was to have been held in the Town of Highland Beach on March 09, 1993 for the Mayor is now unnecessary since the qualifying candidate is unopposed and shall be deemed to have voted for himself. NOW, THEREFORE, it is hereby declared that under the laws of the State of Florida, and the Codes of the Town of Highland • Beach, ARLIN G. VORESS is hereby elected to the office of the Mayor.
