Dubendorff I Piarmon, onith Totterdale & Hertwig. Gomm Harmon took the oath of office as uommissioner as set forth in Town Code, page 16, section 3 and thus became a ful3Ly quali- fied member of the Town Commission- viinutes of the preceding meeting were read and approved on motion of (;Om 6mith seconded by Comm. Dubendorff and approved by affirmative votes of al five commissioners present. On motion of Comm. Dubendorff I seconded by Comm* Harmon and passed by affirmative votes of all five commissioners present, Gor missioners Dubendorff and Smith were designated to fill expiring director-ships of the Palm Beach County Restources Developement Board for one and t years respectively. - Referring to letter dated August 9, 1951 from Attorney Byrd, in which he withdrew as Town Attorney, the U 'lommission at the meeting on Sep- tember 4th had instructed Gomm* Hertwig, to call on Lur. Byrd and ask him to reconsider the matter. Comm* Hertwig reported that complying with these instructions he had talked with Mr. Byrd who stated his willingness to continue as Tolm 'Attorney provided the Commissioners could give assurance that Town affairs would be conducted with less friction and personal exchanges among the Commission members* COMM* Hertwig submitted a letter intended to be sent to !�.Lr Byrd to cover situation. the s uomm. Smith moved that the letter, dated 9A be approved and that the Clerk be directed to formard same to mr. Byrd. :he motion was seconded by Comm. Harmon and passed by the affirmative votes of all five oommissioners present. Mayor zotterdale advised that the project relating to the submerged lands vras being reduced to v,,rriting and would be submitted for Attor- ney Byrd's approval in the near future. Mayor Totterdale advised that at this time the previously considered glades buggy could be purchased for �`00 There Iras discussion about the question of permitting driveways to be located directly over shutoff valves in the mater main as recently happened on two jobs of i. Frank Bader and the consensus such occurrences should be avoided. Comm. These ordinances ��ere pass- ed on first reading on August 7, 1951 and have been posted on the bulletin board since that time. The clerk read the Building Code Ordinance, the title of vIlaich follows. After full reading of the ordinance and a general discussion of it, Comm. Dubendorff moved that the Building Code Ordinance, dust redd, be passed and adopted without amendment. Comm. Smith seconded the motion and it passed by affirmative votes of Comm. Dubendorff„ Harmon, Smith, Totterdale & Hertvrig, thus becoming Ordinance X10$0 ` The clerk read the Electrical Code Ordinance, title of which follows. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, IN THE COUNTY OF PALM BEACH & STATE OF FLORIDA ADOPT 114G AN ELECTRICAL CODE OF THE TOWN OF HIGHLAND BEACH- PROVIDING FOR THE ISSU- ANCE OF PE13MITS &-. COLLECTION OF FEkS FOR THE INSTALLATION OF ELECTRICAL laIRING, FIXTURES AND APPLIANCES• PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND PROVIDING THAT XLL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THERE TKITH ARE REPEALED, AND PROVIDING 11HEN THIS ORDINANCE SHALL TAKE EFFECT. After reading of the ordinance in full and discussion of its pr ©visions, Comm.. Smith moved that the Electrical code Ordinance, just read, be passed and adopted without amendment. The motion w a s seconded by Comm. Dubendorff and passed by affirmative votes of Comm Dubendorff, Harmon., Smith, Totterdale & Hert thus be- coming Ordinance ;109. Comm. Dubendorff advised the Commission that personal interests required his full timez and presented his written resignation to take effect immediately. There ira.s some discussion and requests that he change his mind in the matter but he insisted that he could not spare the necessary time. In compliance with his wishes, Corm. Harmon moved that Comm. Dubendorff t s resignation be accepted and that the Commission extend to him a vote of thanks for the service he rendered to the Torn while a member of the Uommission, Comm. Smith seconded the motion and it was passed by affirmative votes of all five commissioners present. On motion of Uomm. Smith, seconded by Comm.
