Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesday, July 27, 1993 1:30 p.m.
Mayor Arlin Voress called the Workshop Meeting of the Town Commis-
sion of the Town of Highland Beach, Florida, to order at 1:30 p.m.
in the Commission Chambers at Town Hall. Others present were Vice
Mayor Bill Paul, Commissioners Arthur Eypel, John F. Rand, and
David Augenstein.
Also in attendance were Town Attorney Thomas E. Sliney, Town Clerk
Anne M. Kowals, CMC, and members of the General Public. It was
noted Town Manager Mariano was absent.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
The Agenda, upon Mayor Voress' recommendation to amend same by
moving Items No. 4 and No. 5 under 93.3 (Proposed Ordinances and
Resolutions) to the August 3, 1993, Regular Meeting, was accepted
as amended.
93.1 PUBLIC COMMENTS AND REQUESTS
No individual addressed the Town Commission at this time.
93.2 BOARDS AND COMMITTEES
Mayor Voress noted the vacancy on the Planning Board was due to
the passing of Vice Chairman Arthur R. Keller on July 14, 1993.
Commissioner Rand, noting the Town follows a process in appointing
Members to the Advisory Boards, stated Talent Bank Applications
are listed according to date of submittal with consideration being
given to said date and qualifications; no one is being prevented
from serving on any Town Boards and Committees.
No correspondence was received from any Town Boards and
Committees .
93.3 PROPOSED ORDINANCES AND RESOLUTIONS
1. AN ORDINANCE AMENDING SECTION 3.05 OF THE CHARTER OF THE
TOWN OF HIGHLAND BEACH, FLORIDA, ENTITLED "SALARIES OF
COMMISSIONERS AND MAYORS RESTRICTED".
The proposed ordinance, given first reading on 07/06/93 and
published on 07/16/93, was read by title only. Following discus-
sion, this matter was moved to the August Regular Meeting Agenda.

2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
AMENDING SECTION 6.5 (b) OF SECTION 6.5 ENTITLED "NON-
CONFORMING STRUCTURES" OF CHAPTER 30 ENTITLED "ZONING" OF
THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH
REGARDING REGULATIONS APPLICABLE TO THE RECONSTRUCTION OF
A STRUCTURE DESTROYED OR DAMAGED BY A CATASTROPHIC EVENT.
The proposed ordinance, read by title only, received first reading
on 07/06/93 and was published on 07/16/93. It was the consensus
to move this matter to the August Regular Meeting Agenda for
further discussion and possible approval.
3. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
AMENDING CHAPTER 2 ENTITLED "ADMINISTRATION" SECTION 2-76
(a) REGARDING THE COMMUNITY APPEARANCE BOARD; CHAPTER 20
ENTITLED "PLANNING AND DEVELOPMENT" SECTION 20-26 (a)
REGARDING THE PLANNING BOARD AND SECTION 20-46 REGARDING
THE BOARD OF ADJUSTMENT, OF THE CODE OF ORDINANCES OF THE
TOWN OF HIGHLAND BEACH, FLORIDA, REGARDING REGULATION OF
MEMBER ABSENCES OF THE AFORESAID BOARDS.
Following discussion of the proposed ordinance, it was moved to
the August Regular Meeting Agenda for first reading.
At this time, Mayor Voress commented with regard to the Countywide
Intergovernmental Coordination Agreement which is being coordina-
ted by, among others, the Palm Beach County Municipal League. The
Mayor advised this Interlocal Agreement will be a coordinating
group between the Cities, Towns, County, South Florida Water
Management District, and individual Districts. Mayor Voress
further advised we will be required to approve two Resolutions
that must be signed by the Town; and, an annual fee of $500. is
applicable for participation in this program. The Mayor noted the
Commission will receive further briefing on this matter at the
August 3, 1993, Regular Meeting.
Mayor Voress informed his associates the Commission will be re-
quested to approve an Interlocal Agreement with North Palm Beach
County Water Control District for water quality. Said District
will submit, on behalf of the Town of Highland Beach, the required
5 year monitoring program for water quality and the necessary
reports associated with this activity. This District has been,
and is, the mechanism by which the Town will receive its storm
water NPDES permit.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
• Members received and reviewed the "Status of Building Development
in Town", a report submitted by the Building Department.

Minutes for approval at August 1993 Regular Meeting
It was the consensus to move two sets of Town Commission Meeting
Minutes to the August Regular Meeting Agenda for possible
approval.
REPORTS - TOWN COMMISSION
Vice Mayor Bill Paul
Vice Mayor Bill Paul, under his report, extended condolences to
the families of Police Sgt. Frank Mencik and Town Manager Mariano
on the recent loss of their loved ones.
The Vice Mayor advised the bike path signs were received and
installed, at eye level, in designated areas.
Commissioner Arthur Eypel
Commissioner Arthur Eypel expressed condolences to the Town
Manager and her family on the loss of her step-father, Pasquale
Focarile, as well as the family of Police Sgt. Frank Mencik.
• The Commissioner recommended that, if a new building to house the
Police Department is to be erected, it be done in honor of Sgt.
Frank Mencik who dedicated his life to police work.
Commissioner Eypel reported attending the July 12, 1993, Palm
Beach Countywide Beaches and Shores Council Meeting at which time
a motion to invite a DNR representative to the Council's August
Meeting to answer the concerns raised by the Council Members with
regard to the DNR's proposed changes relating to seawalls and
bulkheads was proposed and approved. It was noted by Mayor Voress
that the DNR is involved in the Coastal Construction Control Line
issue.
Commissioner John F. Rand
Commissioner John F. Rand had no report at this time.
Commissioner David Augenstein
Commissioner David Augenstein expressed his appreciation to Vice
Mayor Paul for the installation of the safety signs in a more
visible position on the bike path.
Commissioner Augenstein, noting the Code Enforcement Board issued
an ORDER requiring Mrs. Lucia Milani install flashing barriers by
• 07/26/93 and an earth berm by 08/02/93 at the front of Lots 9 and
10 West, advised both requirements were complied with by 07/26/93.

Commissioner Augenstein commented with regard to the improvement
of the landscaping at Regency Highland and the progress at Boca
Highland where railings at the Braemer Isle Condominium are being
replaced.
Mayor Arlin Voress
Mayor Arlin Voress echoed the comments of his associates with
regard to condolences to the families of Police Sgt. Frank Mencik
and Town Manager Mariano.
The Mayor regretably announced the passing of Planning Board Vice
Chairman Arthur Keller on July 14, 1993, who gave freely of his
time and talents and will be missed by all.
Mayor Voress, noting Mr. Eliot Woronoff is here on a trial basis
to videotape today's proceedings, introduced Mr. Woronoff who
submitted a proposal to videotape our Town Commission Meetings at
a cost of $100.00 per session. This matter will receive consider-
ation at the August Regular Meeting.
The Mayor advised he will be meeting with Attorney Mac Conahan,
• Town Manager Mariano, and Finance Director Michael Seaman to
discuss information regarding the scheduling of a Special Meeting
(advertised Public Hearing) in mid-August regarding the cable
rules and our relationship (franchise renewal) with Adelphia
Cable.
Mayor Voress noted the Finance Director attended a two-day seminar
regarding the new cable t.v. rules which are more in favor of the
cable companies than subscribers. In order to preserve our rights
regarding the cable franchise in Town, it is important that we
have the Special Meeting (advertised Public Hearing) which Town
residents are encouraged to attend and provide their in-put.
The Mayor, noting Ted Hanna (Supervisor of Maintenance) has been
out of work due to "hepatitis" and a foot injury, stated the Main-
tenance Department is operating one man short.
Vice Mayor Paul noted many illegal real estate signs were removed
from properties in Town by the Building Official/Code Enforcement
Officer.
REPORTS - TOWN ATTORNEY
Town Attorney Thomas E. Sliney, alluding to the Mayor's comments
regarding the Adelphia Cable franchise, advised the new cable
legislation contains a complicated set of rules; the public hear-
. ing will allow residents to present their feelings regarding the
cable system. The cable company has the responsibility to correct
whatever deficiencies are identified.

Drexel Investments
Town Attorney Sliney advised he forwarded additional paper work to
Brian Deuschle, Attorney representing Drexel Investments, regard-
ing the Drexel Settlement; said paper work will be submitted to
the Town Manager for execution by the Mayor and Town Manager.
REPORTS - TOWN MANAGER
The Town Manager was not available at this meeting.
ADJOURNMENT
There being no further business to come before the Town Commission
at this time, upon proper MOTION, Mayor Voress adjourned the
Workshop Meeting at 2:05 p.m.
