MINUTES: REGULAR MEETING OF THE TOWN COMMISSION - March 7, 1972
The regular meeting of the Town Commission was called to order by Mayor
Horton on Tuesday, March 7, 1972 at 7:00 P.M. All Commissioners were
present.. The minutes of the regular meeting of February 1, 1972 were
read and approved after the corrections of the Tax Committee Report and
the date of November 18, 1972 changed to November 18, 1971 in reference
to a denied motion by Judge Knott regarding the Town, the Civic League
and August Urbanek suits.
Mayor Horton introduced Mr. John Klinck of Russell & Axon, to explain
aspects of the revised report updating the Brockway, Owen & Anderson
water expansion report of 1970. The Mayor notified those in attendance
of a workshop meeting on March 21 and a. special meeting on March 28 for
further discussion and action toward a bond issue on the May 2nd election.
Discussion followed.
The minutes of the workshop meetings of February 18, 1972 and February 28,
1972 were approved as read.
The concensus was to sell copies of the new Code of Ordinances at $25.00
in a loose leaf binder and $15.00 without a binder. Commissioner Jurisch
moved to approve this, Vice Mayor Vedder 2nd and the vote was unanimous.
Mayor Horton read a notice of the Palm Beach County Municipal League meeting
in West Palm Beach on Friday, March 10, 1972 at 1:30 P.M. Anyone wishing
to�may attend with Mrs. Roberts.
The Mayor read a letter received from the newly formed Highland Beach Isles
Property Owners' Association asking questions concerning zoning, sewer
assessment costs and completion date of same. Mayor Horton answered the
questions and discussion followed.
Mayor Horton read a notice received from the Palm Beach County Health
Planning Council about a seminar on March 10,/ 1972 in the West Palm Beach
Ramada Inn concerning solid w�r disposal. J
The Mayor announced notice of a public meeting concerning improvements for
flood control and water control measures received from the Department of
Corps of Army Engineers on March 15, 1972 in the City Hall, Deerfied Beach.
Mayor Horton read a letter received from Mr. Robert Farley, a new resident,
recommending a bicycle path in Town for walking, jogging and bicycling.
Also received was a petition supporting this, signed by approximately 200
residents. Commissioner Jurisch explained that costs have been gathered
but that work is not planned until the sewer construction is completed.
Discussion followed.
The Mayor read a notice received from the State of Florida, Department of
Pollution Control, of a meeting in West Palm Beach on March 20, 1972 to
consider the Palm Beach County regional sewerage plan. All notices are
posted on the bulletin board.
Mayor Horton read a letter received from Mrs. Howard Slagle concerning
front setbacks from AlA and building on the ridge in the single family
dwelling zone, further protesting adoption of the thirty foot setback
and recommending one of eighteen to twenty feet. The letter will be
referred to the Planning Board.

Mayor Horton read a letter received from Mr. August Urbanek, requesting
removal of excess soil from several parcels on the Ocean side to lots
which he owns on the west side of A1A, for the purpose of compaction.
Discussion followed. Commissioner Jurisch moved approval with a request
for ground cover and Commissioner Joy seconded. Vice Mayor Vedder
suggested to contact the Town Attorney regarding ground cover, so the
Town is protected. The motion was to include approval by the Town
Attorney. Commissioner Jurisch and Commissioner Joy agreed. The vote
was unanimous.
Mayor Horton read a letter received from Mr. Rudolph Brey regarding
protection of our beaches, after he read an article in the Sun Sentinel
which stated the danger of the sand transfer plant at the Boynton Inlet.
The Mayor explained that both Mr. Harlow Burnside and Mr. Milton Beekman
were appointed to represent the Town at meetings in regard to beach
erosion and beach preservation currently held in Delray Beach and will
keep the Town informed.
In regard to the suits in which the Town is involved, Mayor Horton informed
us that one date is set for April 26 and the other one has no date set
as yet.
Regarding the property South of Town Hall, an appraiser was hired who came
up with a figure somewhat higher than the County Assessor. Several offers
have been made to the owners, Mayor Horton reported and the efforts have
been unsuccessful. He stated that the Town Attorney was directed to
�- draw up the necessary papers toward the proper action.
Mayor Horton read communication received from the Palm Beach County
Municipal League proposing rejects of Article V, which would abolish
municipal courts.
TAX COMMITTEE No additional tax money received from the County.
Commissioner Joy added that we received a check in the
amount of $638.27 for the additional 2� cigarette tax, based on the corrected
census population figure for the months of October, November and December 1971.
FINANCE COMMITTEE Commissioner Hackman commented on the February financial
statement and added that it will be posted on the
bulletin board.
PUBLIC WORKS & WATER Commissioner Jurisch reported the water plant is
being air - conditioned. The new well field tests
are being delayed because the Health Department is moving to new facilities.
Mr. Jurisch further reported he told Mr. Klinck to move the sewer line
across the Bel Lido bridge to a safer location and to include expansion
joints in the pipe before it will be approved.
HEALTH & ZONING No report.
POLICE COMMITTEE Mr. Frank Walton reported receiving about 150 applications
for the Police Chief and that the committee has met to
eliminate some toward selection of the most qualified man.

PLANNING BOARD Mr. Kemery reported the members met with two architects,
a week ago, to gain opinions and suggestions. The Mayor
and Mrs. Roberts also attended the meeting. Additional meetings are
planned for the near future.
i Resolution No. 187 requesting the State Department of Transportation to
expidite construction of the proposed 12th Street Bridge in Delray, was
moved for approval by Vice Mayor Vedder and seconded by Commissioner Joy.
Discussion followed and the vote was unanimous.
Resolution No. 188 declaring the necessity for the acquisition of property
South of the present Town Hall, was read. Commissioner Jurisch moved it
be adopted, Vice Mayor Vedder seconded and the vote was unanimous.
Ordinance No. 185 restricting the use of water in extreme drought conditions,
had a second reading. Discussion followed. Commissioner Jurisch moved it
be adopted, Vice Mayor Vedder seconded and the vote was unanimous.
A proposed Ordinance, providing for a Charter amendment election, had the
first reading. Discussion followed.
Mrs. Roberts read a letter received from the Department of Transportation,
which stated the road repairs would be made, the Highland "s" Beach signs
corrected, and a study made regarding double lines in the 3100 and 3200
blocks of South Ocean Blvd.
Mr. Frank Pond recommended a Health Officer be considered, to have power
to act, and sit on a Zoning Board and attend meetings -on ecological problems.
Discussion was held on the Bel Lido sewer construction progress and related
problems.
The bills and accounts were approved for payment.
