1993.09.28_TC_Minutes_Workshop~. ., TOWN OF HIGHLAND BEACH, FLORIDA U Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, Se tember 28, 1993 1:30 p.m. Mayor Arlin Voress called the Regular Meeting of the Town Commis- sion of the Town of Highland Beach, Florida, to order at 1:30 p.m. in the Commission Chambers at Town Hall. Others present were Vice Mayor Bill Paul, Commissioners Arthur Eypel, John F. Rand, and David Augenstein. Also in attendance were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, Building Official Lee Leffingwell, Delray City Manager David Harden, Delray Fire Chief Kerry Koen and Staff, President of Boca Raton Junior League Ms. Barbara Hill, Developer James Drago, Montgomery Watson Engineers Clay Blanton and Mark Nelson, and members of the general public. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The Agenda, amended by including a presentation by the Boca Raton Junior League and the introduction of Delray Beach Fire Chief Kerry Koen and Staff, received unanimous acceptance as amended. 93.1 PUBLIC COMMENTS AND REQUESTS Mr. Reg Wagner of 1111 A Russell Drive, representing six members of the Highland Beach Association, noting the Comino Cove complex on South Ocean Boulevard between Bel Air Drive and Highland Beach Drive filed plans for new dockage with the DERM and DEP indicating stern-to dockage in the canal, stated his association requested their Attorney, Charles Butler III, to bring the Commission up to date on the status of this matter. If the Camino Cove request receives approval for the new dockage, Attorney Butler stated it would adversely affect his clients' complex. The Attorney, noting an Administrative Hearing is set for December 08, 1993, with the DEP submitting an "Intent to Issue", questioned if the Town would require a variance concerning this matter. Building Official Lee Leffingwell advised the Commission she met with Camino Cove representatives and had given them copies of the applicable Town Code. Noting it will be necessary to follow pro- cedures, the Building Official stated she does not have much data to go by as Camino Cove has not approached the Town at this point. Town Commission Workshop Meeting Minutes September 28, 1993 • Page 2 of 7 Town Attorney Sliney stated the Town would require any approvals from all agencies having jurisdiction over the water before it would consider Camino Cove's application. The Town Attorney sug- gested Attorney Butler submit a letter on behalf of his clients saying 'based on your understanding of the plans, you have the following objections'; the Town will review the letter and see where the problems are. Mr. Richard O'Keefe of 1110 Bel Air Drive stated if the Town were to turn down Camino Cove's request, it would be a benefit to the canal. Mr. Jose Echeverria of Russell Drive gave a status report on the Town's Turtle Program noting there were 492 nests with 476 false crawls this year. Mr. Echeverria noted the volunteers worked two days cleaning up the Town beach; they filled 46 garbage bags and .estimated the weight to be 1,605 lbs. Mr. Echeverria extended thanks to Ted Hanna and his staff for doing a fine job emptying the trash receptacles in place on the beach. Boca Raton Junior League, Ms. Barbara Hill, President Ms. Barbara W. Hill, President of the Boca Raton Junior League, made a presentation to the Town Commission regarding a fund rais- ing event, a Designer Showhouse proposed for the new home built by Developer James Drago at 4217 South Ocean Boulevard, to commence on February il, through February 17, 1994. With permission from Fr. Chepanis, St. Lucy's Church parking lot will be used for valet parking with the Town Hall Complex utilized for overflow parking. Introduction of Delray Fire Chief Kerry Koen Mayor Voress, noting the Delray Beach Fire Department will soon provide fire/rescue services to our Town, called on Town Manager Mariano to introduce the Delray Beach Staff in attendance today. Town Manager Mariano advised the Town contracted with the City of Delray Beach for fire/rescue services and necessary changes in communications have been completed to effect the transition on Thursday, September 30, 1993, at 4:00 p.m., at which time our phone lines will go to Delray Beach rather than Palm Beach County. Delray City Manager David Harden, upon introduction by the Town Manager, stated it was a pleasure to work with the Town in putting together the contract and preparing to provide the services. The City Manager introduced Delray Fire Chief Kerry Koen. Town Commission Workshop Meeting Minutes September 28, 1993 • Page 3 of 7 Delray Chief Kerry Koen, noting he is happy to participate in the positive relationship, stated the City looks at this as a part- nership rather than the neighbor relationship; it's a business relationship that makes sense for both parties. Noting he looks forward to working on a day to day basis with the Town, Chief Koen introduced his Staff: Assistant Chiefs Mike Wickerson and John Tomaszewski, Division Chief Mike Cato, Lt. Larry Garitto, Division Chiefs Alan Traywick and Joe Koppel, Battalion Chief Mike Hendricks, and Chief of Maintenance Roy Conoff. Noting Delray is proud of its staff, Chief Koen advised the new rescue unit provid- ed by the Town is parked in front of Town Hall. Mayor Voress recessed the Workshop Meeting at 2:30 p.m. to allow all in attendance to inspect the new Delray Beach/Highland Beach Rescue vehicle. The Mayor reconvened the Workshop Meeting at 2:30 p.m. noting the next Agenda item to be addressed is the Montgomery Watson Reports. MONTGOMERY WATSON REPORTS Montgomery Watson Engineers Clay Blanton and Mark Nelson gave a status report with regard to the Intracoastal Waterway Crossing • Pipeline indicating the design has been completed, permits have been received and are valid for approximately five years, and the Town is now in a position to proceed with the project should it opt to do so. Noting the normal life span of a Ductile Iron Pipeline is 50 years, our Engineers advised the Town's Ductile Iron Pipeline, in use for the last 20 years, is in good shape and should remain so for a number of years. Should this line sustain damage, repairing it would cost approximately $10,000. plus the cost of materials while the estimated cost for an additional (new) line would run between $230,000 - $320,000. When Commissioner Rand questioned the $150,000. that had been ap- propriated for this project, the Town Manager advised a portion of that money has been used for the engineering studies and the permitting fees. It was the consensus to move this matter to the October 05, 1993, Regular Meeting Agenda for further discussion and possible consideration. 93.2 BOARDS AND COMMITTEES Mayor Voress noted there are no vacancies on any Advisory Boards or Committees nor was any correspondence received from same. Town Commission Workshop Meeting Minutes September 28, 1993 • Page 4 of 7 AD HOC COMMITTEE FOR THE ADVICE AND PROTECTION PROGRAM Mayor Voress, noting the Ad Hoc Committee for the Advice and Pro- tection Program Chairman Ward and Associates are present today to share information with the Commission, advised he will call on the Town Attorney for guidance following Chairman Ward's presentation. Chairman Ward advised the Commission of the progress made by the Ad Hoc Committee thus far and noted they are concerned about get- ting publicity for the Advice and Protection Program; without the publicity, they feel they will not know if there is a need for said program which involves advice regarding legal and financial matters. Attorney Sliney, noting the Town could incur liability if it were to sponsor an organization that gives legal and financial advice, stated the way for an Advice and Protection Program to function would be as a non-profit group (without any Town connection) where volunteer members would do the work. Town Manager Mariano noted the Town must first decide what it is and if it wants to be involved in these issues. The Town can educate the public via Channel 12 and the Newsletter with regard • to services available; however, the Town should not sponsor any Social Service Programs. It was the consensus to move this issue to the Regular Meeting Agenda for further discussion. 93.3 PROPOSED ORDINANCES AND RESOLUTIONS 1. It was the consensus to move this matter to the Regular Meeting Agenda for consideration. 93.8 Discussion re Adelphia Cable During brief discussion regarding Adelphia Cable Service, Mayor Voress noted this matter will be carried on the Agenda for the next few Workshop Meetings. MISCELLANEOUS - ITEMS LEFT OVER Status of Building Development in Town Members received and reviewed the Status of Building Development in Town, a report submitted by the Building Department. Minutes for approval at October 1993 Regular Meeting Four sets of Town Commission Meeting Minutes were reviewed and moved to the Regular Meeting Agenda for possible approval. REPORTS - TOWN COMMISSION • Vice Mayor Bill Paul Vice Mayor Bill Paul, under his report, stated Thursday, Septem- ber 30, 1993, at 4:00 p.m. (when the Town switches to Delray Beach Fire/Rescue Service) will be very exciting for all people. Commissioner Arthur Eypel Commissioner Arthur Eypel, under his report, extended thanks to the Palm Beach County Fire/Rescue for the many years they provided this important service to our Town; and now, we look forward to Delray Beach providing this service to our residents. The Commissioner reported he, along with Ms. Jane Rayner and the Mayor, will attend the Palm Beach Countywide Beaches and Shores Meeting on October 18, 1993, at which Mr. Kirby Green of the Florida DNR will address the Council. Commissioner Eypel noted the Community Appearance Board will be meeting on Thursday, September 30, 1993, to review the Town's sign ordinance. Commissioner John F. Rand • Commissioner John F. Mayor Arlin Voress Mayor Arlin Voress extended condolences to the Vice Mayor on the recent loss of his Mother. The Mayor invited all residents to see the new Rescue Vehicle; he announced the Town will begin using the Atlantic Ambulance Service as of October O1, 1993. REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney had no report. REPORTS - TOWN MANAGER Town Manager Mariano reported the 'Transfers of funds' are a matter of year-end bookkeeping. It was the consensus to place consideration of said transfers on the Regular Meeting Consent Agenda. • The Town Manager noted by changing our Fire/Rescue Service to Delray Beach, the Town was able to reduce the milage rate to 3.3 for the 1993/94 fiscal year. The Town Manager reported the Town is changing the source of Health Insurance Coverage for its Employees by contracting with Travelers Insurance at an annual saving of $30,000. Mayor Voress advised the Palm Beach County Municipal League is requesting the Communities support the efforts of Palm Beach County to work on cleaning up the Lake Worth Lagoon; a Resolution regarding this matter will be prepared for consideration at the Regular Meeting on October 05, 1993.
