TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission REGULAR MEETING Tuesday, November 02, 1993 1:30 p.m. Mayor Arlin Voress called the Regular Meeting of the Town Commis- sion of the Town of Highland Beach, Florida, to order at 1:30 p.m. in the Commission Chambers at Town Hall. Others present were Commissioners Arthur Eypel, John F. Rand, and David Augenstein. Vice Mayor Bill Paul was absent. Also in attendance were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, and members of the general public. Following roll call, the Pledge of Allegiance was given. ADOPTION OF AGENDA The Agenda, as submitted, received unanimous acceptance. APPROVAL OF MINUTES The following Minutes were submitted for approval: S September 14, 1993 September 28, 1993 October 05, 1993 October 05, 1993 - Public Hearing/Special Meeting - Workshop Meeting - Public Hearing - Regular Meeting A MOTION by COMMISSIONER AUGENSTEIN/COMMISSIONER RAND to approved the above Minutes as written received all favorable votes. PUBLIC COMMENTS AND REQUESTS Mr. John DeMarco, a Coronado resident, informed the Commission he submitted his Talent Bank Application to the Town Clerk's Depart- ment on Monday, November O1, 1993. It was noted, following Mr. DeMarco's attendance at a meeting of the Board of his choice, he will be invited to be interviewed by the Town Commission at a Workshop Meeting. Highland Beach resident, Dr. Ray Murphy, complimented the Town Commission for their efforts regarding the Florida Department of Natural Resource's proposal to relocate the Coastal Construction Control Line. REPORTS - TOWN COMMISSION Vice Mayor Bill Paul Absent - no report. Town Commission Regular Meeting Minutes November 02, 1993 Page 2 of 5 Commissioner Arthur Eypel Commissioner Arthur Eypel, alluding to his report at the October Workshop Meeting, advised he received data from the Palm Beach County Department of Environmental Management regarding Article 9: Environmental Standards, Coastal Protection. Said data includes a number of items that will require close scrutiny in the future (i.e. to prevent illumination from windows of beachfront homes during turtle nesting season, window treatments will be required.) Commissioner John F. Rand Commissioner John F. Rand, under his report, announced he is a volunteer member of the Medicare, Part B, Beneficiary Advisory Council, sponsored by Blue Cross Blue Shield of Florida; it is a statewide network of Councils who will, upon request, assist medicare recipients with questions regarding medicare benefits and claims payments. The Commissioner, commenting with regard to Talent Bank Applica- tions, stated it would be helpful if Town Staff would indicate, on the memo listing current applicants, the date an applicant was interviewed by the Town Commission. Noting the extreme sensitivity of the microphones in the Chambers, Commissioner Rand advised that, in viewing the October Workshop videotape, he became aware of the fact that even the rustling of papers/candy wrappers will 'drown out' an individual speaker. Commissioner Rand, citing an editorial in the October 29, 1993, issue of the Sun Sentinel regarding the term limitation of poli- ticians, advised he submitted a written response to the paper indicating the Town of Highland Beach recognizes the importance of this issue. The Commissioner, having read the editorial and his written response into the minutes, gave a copy of each item to the Town Clerk (both are attached to and made a part of the Minutes.) Commissioner David Augenstein Commissioner David Augenstein had no report. Mayor Arlin Voress Mayor Arlin Voress, noting data regarding 'Lead and Copper' in drinking water had been forwarded to all residents, advised anyone having any questions about this matter should call the Town Hall or the Water Treatment Plant. Town Commission Regular Meeting Minutes November 02, 1993 • Page 3 of 5 Noting Government Day is scheduled for Thursday, December 02, 1993, from 10:00 a.m. through 3:00 p.m., the Mayor urged all to come out on that day and visit with Town Staff. REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney, noting he proposed revisions to the Town's sign ordinance for review by the Community Appearance Board, acknowledged receipt of a CAB Memo recommending some changes which will be incorporated in the redrafted copy. The Town Commission will receive the ordinance for consideration fol- lowing the CAB's review of the redrafted document. The Town Attorney advised, with regard to the Drexel Property Settlement, plans for five single family homes on the East side are to be submitted to the Building Department for processing through the various Town Boards. REPORTS - TOWN MANAGER Town Manager Mary Ann Mariano, noting the SCADA System was a budgeted item handled by Montgomery Watson, advised the Commission needs to award the bid for implementing the telemetry system at • our Water Treatment Plant. MOTION by COMMISSIONER AUGENSTEIN/COM- MISSIONER RAND to accept the recommendation of Montgomery Watson to award the bid to Curry Controls Company in the amount of $119,928. was unanimously approved. The Town Manager advised the Palm Beach County Municipal League is sponsoring a "U.S. Congressional Delegation Forum" on Friday, November 12, 1993, from 1:30 p.m. to 5:00 p.m. at Palm Beach County Community College President's Dining Room, 4200 Congress Avenue, Lake Worth. All elected officials are invited to attend. Town Manager Mariano, noting receipt of the updated status report from Montgomery Watson, advised a copy of said report was placed on the clipboard in the Commission Office at Town Hall for review by the Commissioners. Town Manager Mariano reported the Delray Beach Fire Department received an "Award for Excellence" from the International Association of Fire Chiefs at their recent conference in Dallas, Texas. In response to a query regarding the status of the Adelphia Cable matter, Commissioner Rand was advised the Town Manager has been working with Adelphia to put together a draft proposal relating to the franchise renewal for cable service in the Town. Town Commission Regular Meeting Minutes November 02, 1993 Page 4 of 5 • In brief discussion regarding the smooth transition from Palm Beach County to Delray Beach for Fire/Rescue Services, it was noted a problem surfaced with a call to 911; a meeting has been scheduled with the Palm Beach County Sheriff's Department, Palm Beach County Fire/Rescue Staff, Delray Beach Fire/Rescue Staff and Town Manager Mariano to make certain the matter is corrected. REPORTS - BOARDS AND COMMITTEES Mayor Voress, noting the scheduled meetings for the various Town Advisory Boards, stated the vacancy listed for the Financial Advisory Board was discussed at the October Workshop Meeting. COMMISSIONER RAND/COMMISSIONER AUGENSTEIN made a MOTION to re- appoint S. Myron Browner for a three year term on the Financial Advisory Board. The MOTION passed without objection. I sincerely hope that our State Legislature, cities and municipalities and especially voters will take cognizance of the valid and cogent reasons which you outlined as to why terms of our elected officials, as well as certain County administrative officers, should be limited. However, I was somewhat disappointed that you did not mention that the Tov~m of Highland Beach(based on my recommendation) restricted the terms of its Commissioners to no more than three consecutive two year terms which, thanks in great part to your editorial sup1oort of February ltd, 1y93, was approved by over yUjo o~ our voting residents • in the 1vlarch 1893 referendum. I proposed legislation to restrict the terms of members appointed to each of various Boards to a maximum of six _._ consecutive years which our Town Commission approved. So as you can readily observe, Fnie in Highland Beach have recognized the importance and advisability of term limitations. Your above editorial deserves support and follow up, in my personal opinion.
