Vice Mayor Bill Paul, in the absence of Mayor Arlin Voress, called the Workshop Meeting of the Town Commission to order in the Com- mission Chambers at Town Hall at 1:30 p.m. Others in attendance were Commissioners Arthur Eypel, John F. Rand, and David Augenstein. Also present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, Alexandra and Joseph Bracie, David Rustine, and members of the general public. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The Agenda, amended to include two items; i.e. County Commissioner Mary McCarty's commentary regarding Palm Beach County's proposed bus route along AlA as well as Mr. David Rustine's proposal to purchase from Highland Beach a portion of property located at our wellfields in Boca Raton, was unanimously accepted as amended. 93.1 PUBLIC COMMENTS AND REQUESTS • No residents addressed the Town Commission at this time. Dedication of 'Declaration of Independence' by artist Arthur Szyk During the dedication of 'Declaration of Independence' by artist Arthur Szyk, Commissioner Augenstein, extending a welcome to Palm Beach County Commissioner Mary McCarty, invited the artist's daughter and her husband, Alexandra and Joseph Bracie to step forward to unveil the work of art. Following the unveiling, Ms. Bracie, acknowledging the presence of her neighbors, Palm Beach County Commission Chair Mary McCarty, and Florida Atlantic University Library Representatives, stated it is a pleasure to see one and all. Ms. Bracie, noting her father was a war cartoonist during World War II as well as a syndicated artist who died at the age of 57 at New Canaan, Connecticut home, advised she has been invited to exhibit his work in 1994 (on his birthday) at Florida Atlantic University Library. Vice Mayor Bill Paul, on behalf of his colleagues and the Town, extended thanks to Alexandra and Joseph Bracie for their generosity. Town Commission Workshop Meeting Minutes November 30, 1993 • Page 2 of 6 Ms. Jean Weisser, Librarian at Wimberly Library, invited all to attend the exhibit to be held at Florida Atlantic University in 1994 of Arthur Szyk's art work. Commentary by Chair Mary McCarty re Palm Beach County's proposed bus route along AlA Palm Beach County Board of County Commissioners Chair Mary McCarty advised the County, in approximately nine months, will approve a bus route system (which Mr. Irving Cure will be discussing with various home owner associations, condominiums, etc.), that will run through the 37 municipalities in Palm Beach County. It is anticipated the County will scrap the proposed plan and discuss a new system that municipalities indicate they want and need. Chair Mary McCarty suggested Mr. Cure be invited to a Town Meeting where residents and Town Officials can make their feelings known. The views of every municipality will be given consideration in the total picture. Mr. David Rustine of Tropic Investments, Inc. Proposal re purchase of Town property Mr. David Rustine of Tropic Investments, Inc., owner of property • adjacent to the Highland Beach wellfields in Boca Raton, presented a proposal to purchase a portion of the Town's parcel in order to continue a street into his property which is under consideration for development. It was the consensus to move this matter to the December Workshop Meeting to allow the Commission time to review said proposal as well as obtain more information regarding this issue. 93.2 BOARDS AND COMMITTEES Vice Mayor Paul noted Board of Adjustment Member Robert F. Selby is eligible for reappointment when his current term expires in December. Also noted was no correspondence had been received from any Boards or Committees. The following Talent Bank Applicants were interviewed by the Town Commission: John DeMarco, Theresa Colarullo, Miriam Zwick, Daniel Lowenthal, and Werner Rothenberg. Discussion re Advice and Protection Program Ad Hoc Committee Following discussion of the Advice and Protection Program Ad Hoc Committee, during which it was noted St. Lucy's Parish is initiat- ing a 'Home Visit Program' available to all (non-denominational) . Highland Beach residents, it was the consensus to place this matter on the Agenda Y Town Commission Workshop Meeting Minutes November 30, 1993 • Page 3 of 6 for the December Workshop Meeting. Mr. John Ward, Chairman of the Ad Hoc Committee, thanked Commissioner Rand for informing him of the 'Home Visit Program' and noted he recently made contact with St. Lucy's staff so both groups can meet to discuss the program. Mr. Ward stated he would report back to the Commission in due course as to the results of such meeting. 93.3 PROPOSED ORDINANCES AND RESOLUTIONS 1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, PROVIDING FOR UTILITY RATES, FEES AND/OR CHARGES, SPECI- FICALLY AMENDING HIGHLAND BEACH CODE SECTION 24-13 OF CHAPTER 24 RELATING TO SOLID WASTE (GARBAGE, TRASH, AND RECYCLING CHARGES.) The proposed ordinance, given first reading on 11/05/93 and published on 11/17/93, was read by title only. Following discus- sion, it was the consensus to move this matter to the December Regular Meeting Agenda for final reading and consideration. 2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING CHAPTER 16 ENTITLED "MOTOR VEHICLES AND TRAFFIC" SECTION 16-3 ENTITLED "PARKING ON RIGHT-OF-WAY" OF THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH. The above received first reading on 11/05/93 and was published on 11/17/93. Same was moved to the December Regular Meeting Agenda for final reading and possible approval. 3. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING RESOLUTION NO. 614 SETTING POLICE FINES AND OTHER ADMINISTRATIVE FEES, BY ADDING FINES FOR FALSE ALARMS IN EXCESS OF THREE PER MONTH PER 30 DAY PERIOD PER ADDRESS. Following consideration of the above resolution, it was the consensus to move this matter to the December Regular Meeting Agenda for possible adoption. 4. A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, REQUESTING THAT THE CLINTON ADMINISTRATION AND CONGRESS PASS MEANINGFUL LEGISLATION TO END THE PRACTICE OF UNFUNDED MANDATES, AND TO INCLUDE IN ANY FUTURE MANDATE, PROVISIONS REQUIRING LOCAL GOVERN- MENT INPUT, COST/BENEFIT ANALYSES, AND SCIENTIFICALLY SOUND ASSESSMENTS OF PURPORTED HEALTH, SAFETY OR ENVIRON- MENTAL RISK; REQUESTING OTHER MUNICIPALITIES TO ADOPT A SIMILAR RESOLUTION; PROVIDING AUTHORIZATION TO FURNISH • COPIES OF THIS RESOLUTION TO ALL OTHER MUNICIPALITIES IN Town Commission Workshop Meeting Minutes November 30, 1993 • Page 4 of 6 PALM BEACH COUNTY, THE BOARD OF COUNTY COMMISSIONERS, THE PALM BEACH COUNTY LEGISLATIVE DELEGATION, OUR U.S. CON- GRESSMEN AND SENATORS, INTERNATIONAL CITY MANAGERS' ASSOCIATION (ICMA) AND THE FLORIDA LEAGUE OF CITIES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. The Commission discussed the above resolution and moved same to the December Regular Meeting Agenda for final consideration and possible approval. 93.8 Discussion re Adelphia Cable Vice Mayor Paul noted 'Discussion re Adelphia Cable' is carried on the Workshop Meeting Agenda to allow residents to give input. The Town Manager, noting Adelphia's 90 days timeframe for submittal of a draft proposal will be up on December 08, advised Chuck Blaine, Director of Govern.~tent and Community Affairs at Adelphia Cable Communications, will be in early the week of December 06, 1993, with said draft proposal which will be reviewed by the Town Manager and Attorney Cormack Conahan, Town Attorney Thomas Sliney's Associate. MISCELLANEOUS - ITEMS LEFT OVER Status of Building Development in Town The Commission received and reviewed the 'Status of Building Development in Town', a report submitted by the Building Department. Minutes for approval at December 1993 Regular Meeting Three sets of Town Commission was the consensus to move same Agenda for consideration. Meeting Minutes were reviewed; it to the December Regular Meeting REPORTS - TOWN COMMISSION Vice Mayor Bill Paul Vice Mayor Bill Paul, under his report, urged one and all to come out on Thursday, December 02, 1993, between 10:00 a.m. and 3:00 p.m. to join in our "Government Open House" Program. The Vice Mayor extended wishes for a 'Happy and safe Holiday Season' to all. Town Commission Workshop Meeting Minutes November 30, 1993 Page 5 of 6 Commissioner Arthur Evnel Commissioner Arthur Eypel, under his report, responding to resi- dent Lucy Miller's November 09, 1993, written requests regarding the turtle and the beach cleanup programs, advised the Town sup- ports (but does not sponsor) the programs; said programs are not functions of the Town. Noting the requests involve private property, it was suggested Ms. Miller contact the individual property owners to discuss the matters outlined in her letter. Noting a meeting of the Department of Environmental Protection (DEP) staff and the Department of Environmental Resources Manage- ment (DERM) staff with beach cleaning contractors is scheduled in West Palm Beach in January (1994), Commissioner Eypel stated he would like to attend said meeting and then report back to the Town Commission. Ms. Miller, noting she is concerned with regard to the proper forum for presenting status reports as well as obtaining input relating to beach and turtle issues, was invited by Forum Group Co-Chair Victor Hadeed to attend the Focus Group Meetings where citizens' comments are always requested and encouraged. In response to a query from the audience, Town Attorney Sliney stated, in Florida, the beach is public up to the mean high water line (i.e. everything West of the mean high water line is private property that may be subject to governmental restrictions.) Commissioner John F. Rand Commissioner John F. Rand had no report at this time. Commissioner David Augenstein Commissioner David Augenstein, under his report, noting the proper place for elected officials to keep municipal records is in the Town Hall, urged all elected officials to do so.
