1992.02.25_TC_Minutes_Workshop~~ , •~ ~ x TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, February 25, 1992 1:30 p.m. The Workshop Meeting of the Town Commission of the Town of High- land Beach, Florida, was called to order by Mayor Joseph A. Boulay at 1:30 p.m. in the Commission Chambers at Town Hall. Others in attendance were Vice Mayor Bill Paul, Commissioners Arlin Voress, Arthur Eypel, and John F. Rand. Also present were Town Clerk Anne M. Kowals and members of the general public. Absent were Town Attorney Thomas E. Sliney and Town Manager Mary Ann Mariano. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA It was the consensus to delete Item 92.7 (discussion re Drexel Property) from the Agenda. Same was accepted as amended. • 92.1 PUBLIC COMMENTS AND REQUESTS Mr. Patrick Beary of Seagate of Highlands addressed the Commission noting the minutes of Commission Meetings, as prepared by the Town Clerk, should contain remarks of residents made during the Public Comments and Requests period. Noting the Minutes of Commission Meetings do in fact contain the subject of residents' comments presented during "Public Comments and Requests", the Town Clerk informed Mr. Beary he was confusing the Agenda Action Report (which is merely a summary of what transpired at a Commission Meeting and does not include the comments) with the Commission Meeting Minutes which reflect the comments . Mr. Beary proposed both candidates running for the Commission in the March 10, 1992 Municipal Election be permitted to hold an open forum in the Commission Chambers where they can present their platforms to the Town residents. Mrs. Evelyn Houck of Russell Drive, voiced objection to the boat- ing ordinance adopted on 2/4/92 prohibiting anchoring in navigable waters within town limits and requiring registration of all water craft, stated she would like to know more about ordinances before they are considered. ' e' Town Commission Workshop Meeting Minutes February 25, 1992 Page 2 of 8 It was noted that, following first reading of a proposed ordinance at a Regular Meeting, the ordinance is posted on the Town Hall Bulletin Board; it is discussed at a Workshop Meeting following its advertisement in the Boca News approximately ten days prior to its final reading which occurs at the very next Regular Town Com- mission Meeting. Mayor Boulay advised the correct procedure re- quired for processing all ordinances had been followed with regard to the ordinance under discussion. Mr. Jerry Marshall of 1088 Bel Lido Drive, President of the Bel Lido Homeowners Association, noted he, like Mr. Beary, would like the Town Commission to consider the use of the Town Hall Commis- sion Chambers for an open forum by the two Commission Candidates in the March 10, 1992 Municipal Election. Mr. Marshall, noting he suggested an ordinance to prohibit the anchoring of water craft in the town's navigable waters as he was concerned with itinerant sailors passing the word about our waters which would then add waste and polutants to our waters, stated he finds the criticism of the Town Commission unfair regarding this matter. Mr. Marshall commented that it came from love of Highland Beach; it wasn't to obstruct anything in Highland Beach. Mayor Boulay stated he would have no problem with the Town Hall being used for "Candidates' Nite"; however, he would like to dis- cuss the matter with the Town Attornery to determine if there would be any legal ramifications. Vice Mayor Paul advised that, in the past, there was a Highland Beach Civic League that would sponsor a "Candidates' Nite" in Town Hall during Municipal Elections; the Town Commission itself would not sponsor anything political. Mrs. Marie Beary of Seagate of Highlands, noting a Sun Sentinel article of this date indicated a judge would rule as to whether the referendum questions would be on the ballot, advised residents should be more informed about this matter and some meeting to this end should be arranged. Mrs. Beary further noted she would like to have information regarding the presidential primary which will be held in conjunction with the Municipal Election on March 10, 1992. Vice Mayor Paul noted the Boca Monday Paper of February 24, 1992 covers the referendum matter very well. The Mayor advised this • Town Commission Workshop Meeting Minutes February 25, 1992 Page 3 of 8 subject is also addressed in the March/April Newsletter which will be processed for mailing in advance of the March 10, 1992 Municipal Election. Said Newsletter contains the opinion of County Commissioner Mary McCarty. 92.2 BOARDS AND COMMITTEES Mayor Boulay, noting there are no existing vacancies on the Town Boards and Committees at this time, acknowledged receipt of the Financial Advisory Board Memo of 1/29/92 regarding the annual financial report as well as the F.A.B. recommendation that the town continue to participate in the State Pooled Investment Fund. Commissioner Rand stated the financial report is the finest report ever received by the town; he extended congratulations to Finance Director Michael Seaman who provided the additional information relating to the town. 92.3 PROPOSED ORDINANCES AND RESOLUTIONS None 92.4 DISCUSSION RE MARCH/APRIL NEWSLETTER The draft copy of the March/April Newsletter, including the amended "Town Commission Action" page, was reviewed by the Com- mission who directed same be processed for mailing, as amended, as soon as possible. Commissioner Rand suggested, if possible, a sentence reminding residents to bring their voter's registration card to the polls on March 10, 1992 be included in this Newsletter. Mayor Boulay advised the amendment to the Newsletter was to inform residents that South Florida Water Management District issued a ten year consumptive water permit to the Town of Highland Beach on February 13. 1992 with a February 13, 2002 expiration date. The Mayor extended thanks to Commissioner Voress who worked with the Town Engineers and South Florida Water Management District, the Town Manager, and the Town's Water Resources Advisory Board to obtain this ten year permit. • Town Commission Workshop Meeting Minutes February 25, 1992 Page 4 of 8 92.5 J. M. MONTGOMERY, TOWN'S ENGINEERS, RECOMMENDATIONS RE THE TOWN'S WATER PLANT INSTRUMENTATION SYSTEM/ANCILLARY SYSTEM Engineers Clay Blanton and Bert Bergara of J. M. Montgomery, the Town's Engineers, explained their proposal of 2/24/92, (a copy of which is attached to and made a part of these minutes) distributed to each Commissioner in advance of this meeting, regarding the up-grading and modernization of the town's water plant instru- mentation system/ancillary system. Following substantial deliber- ation, it was the consensus to move this matter to the March Workshop Meeting Agenda for further discussion. In response to a question regarding the 16" water main crossing in the Intracoastal, Mr. Blanton advised that matter has been in permitting since December, 1991 with various Government Agencies who have requested additional information; our engineers will be answering such requests for a few more months. The time table, which includes 60 days for permitting with an additional 60 days for bidding, would indicate approximately 6 months or so for the work to commence . 92.6 DISCUSSION RE SUPPLEMENTAL INTERLOCAL AGREEMENT FOR PART II OF THE ENVIRONMENTAL PROTECTION AGENCY NPDES PERMIT APPLICATION Commissioner Voress, noting the Environmental Protection Agency is looking into the run-off from storm drains that flow into lakes, streams, Intracoastal Waterway, etc., explained the Supplemental Interlocal Agreement for Part II of the Environmental Protection Agency NPDES Permit Application. The Commissioner, noting the Interlocal Agreement is to collect data to provide information for licensing, advised he discussed this matter with the Town Attorney who is comfortable with the legal aspects of the Agreement and the Commissioner is comfortable with the cost of said Agreement. It was the consensus to move approval of the document to the Consent Agenda for the March 03, 1992 Regular Town Commission Meeting. Vice Mayor Paul commented that if we do not join in the Interlocal Agreement, we would have to submit the data on our own at a tremendous cost to the town. 92.7 DISCUSSION RE DREXEL PROPERTY At the start of this meeting, it was the consensus to delete this item. . Town Commission Workshop Meeting Minutes February 25, 1992 Page 5 of 8 MISCELLANEOUS - ITEMS LEFT OVER Status of Building Development in Town Members received, as information, the "Status of Building Develop- ment in Town", a report prepared by the Building Official. Minutes for approval at March 1992 Regular Meeting lJ The Commission reviewed the January 28, 1992 Workshop Meeting Munutes and the February 4, 1992 Regular Meeting Minutes; same were moved to the March Regular Meeting Agenda for consideration. REPORTS - TOWN COMMISSION Vice Mayor Bill Paul Vice Mayor Paul had no report. Commissioner Arlin Voress Commissioner Voress reported on the ten year consumptive water permit for an annual allocation of 508 million gallons granted to the town by South Florida Water Management District providing the town complies with the limiting conditions. The Commissioner noted the Town's Water Resources Advisory Board, established by the Town Commission in 1988 to look for a long-term water solution, has completed its task. It was the consensus to move consideration of suspension of activity of this Board to the March 03, 1992, Regular Meeting Agenda. Commissioner Arthur Eypel Under his report, Commissioner Eypel discussed the 2/14/92 memo to the Town Commission from Ms. Joan Leek of the Town Clerk's Office regarding the Town Newsletter Mailing List. Following much deliberation, Members requested Commissioner Eypel readdress this matter, under his report, at the March 03, 1992 Regular Meeting. • Town Commission Workshop Meeting Minutes February 25, 1992 Page 6 of 8 Commissioner John F. Rand Commissioner Rand, under his report, noted the traffic on AlA is very heavy, suggested the town request the Florida Department of Transportation analyze the situation to see how that traffic can be alleviated. Noting we are coming into the budget season and newspapers are predicting an increase in taxes, Commissioner Rand suggested the Town Commissioners make their feelings known through our County Commissioner Mary McCarty that we expect no increase in taxes. In this regard, the Commissioner requested the Town Attorney be directed to prepare a Resolution, as well as a petition for sign- ing by residents for delivery to County Commissioner McCarty. It was the consensus to defer this matter to the March Regular Meet- ing of the Town Commission when the Town Manager and Town Attorney will be available. Commissioner Rand, noting last December he addressed the matter of Mr. Leonard Bell's concern regarding the destruction of the dune at the Holiday Inn, questioned the status of this matter. The Building Official noted the DER and DERM have been advised of the situation; however, to date, no response has been received from either agency. The Building Official advised the Commission that the Holiday Inn Manager did secure the gate to prevent anyone from trespassing on the dune. The Commissioner, citing an article in the 2/24/92 issue of the Sun Sentinel regarding coastal flood insurance, stated he believes the Town Commission should fight the pending Congressional bill. Mayor Boulay, having read the same article, noted he met with the Building Official to discuss how this matter would affect the town; the Building Official advised the Mayor the town is not in any danger and the bill will not affect the town. Vice Mayor Paul also read the article and stated he believes the bill is merely to protect the fragile coastline; they are trying to discourage building on the fragile coastline and suggest municipalities have 10/20/30 year plans regarding the rate of erosion. It was noted Palm Beach County has few areas falling into the flood zone. Mayor Boulay stated the town could go on record to oppose the pending bill and he will confer with the Town Manager and Town Attorney with regard to this issue. The Commission suggested the individual citizens write to their congressman regarding this topic. • Town Commission Workshop Meeting Minutes February 25, 1992 Page 7 of 8 When Commissioner Rand questioned how his colleagues feel with regard to the traffic on AlA, it was indicated the town would prefer to avoid contacting the DOT as, in the past, their solution was to create an additional lane whereby AlA would become a three lane highway. Mayor Joseph A. Boulay Mayor Boulay, under his report, addressed the referendum questions relating to the Countywide Planning Council and noted the county has already been planned and, as required by state law, the county prepared a comprehensive plan which has not been approved by the state. The town spent a lot of time and money on a comprehensive plan that received approval from all state agencies including the county. The Mayor noted the 37 municipalities in Palm Beach County are in agreement that a "NO" vote on each referendum question will avoid any raise in taxes. Mayor Boulay urged all residents to exercise their right to vote in the March 10, 1992 Municipal Election. Mayor Boulay noted the "Walk America Campaign" to fight birth defects involves walking 12 miles which is beyond the endurance of most people. Therefore, the Mayor is proposing a mini-walk be held in Highland Beach along the bike path. Anyone interested in participating in the mini-walk should contact Town Hall for information. REPORTS - TOWN ATTORNEY The Town Attorney was absent - no report. REPORTS - TOWN MANAGER Town Manager Mariano was absent - no report.
