MINUTES OF TOWN COMMISSION MEETING
REGULAR MEETING
Tuesday, June 3, 2014 1:30 PM
Mayor Bernard Featherman called the Regular Meeting to order in the Library's Goldstein Community
Room at 1:30 PM.
CALL TO ORDER:
Roll Call: Members present: Mayor Bernard Featherman; Vice Mayor Ron Brown; Commissioner
Dennis J. Sheridan; Commissioner Louis P. Stern; and Commissioner Carl Feldman. Also present: Town
Attorney Glen Torcivia; Town Manager Kathleen D. Weiser; Town Clerk Beverly M. Brown; Finance
Director Cale Curtis; Public Works Director Edward J. Soper; Police Chief Craig Hartmann; Assistant to
the Manager Zoie Burgess; and members of the public.
Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence.
1. ADDITIONS. DELETIONS OR ACCEPTANCE OF AGENDA:
Mayor Featherman asked for any additions or deletions.
Town Clerk Brown — Under Presentations — Please remove State Representative Hager as he will not be in
attendance today.
Town Attorney Torcivia — There are two revisions to the Agenda. Please delete Item No. 5 which is the
proposed ordinance on the landscape requirements. Since there were enough revisions to be made we will
start over again. Item No. 6 (F) on the Consent Agenda which is the agreement with Boca; we received
some revisions from Boca and this should be moved to "Miscellaneous Items Left Over" on the Regular
Agenda.
Agenda was approved as amended.
2. PUBLIC COMMENTS AND REOUESTS:
Peggy Gossett Seidman, 4312 Intracoastal Dr . — Stated she was present today to represent nine families
who had flat tires this week. We are asking for the Town to give us some help because of the construction
sites on our street. The streets need to be swept clean daily and they are not. I personally picked up a bag

of nails. We also counted twenty -four code violations in the last two months. Against Code, there is no
fence on the construction site that has ladders, cement buckets, bricks, hoses and trash throughout the
project. Comm. Feldman — When there is a problem like this, who is to be contacted first - the Police
Dept., Code Enforcement or Building Inspector? Town Manager Weiser — I have been in constant
contact with Peggy. Most of what she is talking about happens on the weekends, or night time, when
there is no Code Enforcement here. We have told the residents that they need to call the Police Dept.
when this happens on the weekends. They were allowed to take down the fence on this site because they
need a place to park to do their finishing work. The contractors are responsible for sweeping the streets
twice a day. Code Enforcement is responsible during the day and we have instructed the Police Dept. to
drive by the site in the evening. They have found no problems; so there is some discrepancy. Ms.
Seidman — We did call the police and they were very good about it, and agreed to ticket them. They had
me write out a citizen's complaint and then they wrote them a ticket. They do not sweep the road twice a
day. Comm. Feldman — I think we have to be more proactive when it comes to situations like this. Ms.
Seidman — We would be willing to have a meeting with you to see how we can resolve this. Comm.
Stern — I have to agree with Comm. Feldman. We have to be more proactive and I would like to have
copies of the citations that were given for the Commission to see. We need to be sure that citations, or
some kind of effort, is made so that these people do clean the street a minimum of twice a day and on the
weekend as well. Comm. Sheridan — In order to be proactive, we should have our Code Enforcement go
through there. It could be every day, but at different times of the day. Ms. Seidman — The biggest problem
is when they change out the dumpster, which is overflowing with debris and the small pieces fall out of
the bottom. I have never seen a dumpster company get out and sweep the road or the management
company at the site. Vice Mayor Brown — I think the police and our code enforcement do a very good job
at the construction site. It is not going to change unless we sit down weekly with the general contractor
and the supervisor at the site. It is construction and will be very difficult to police it through every single
hour of the day to make sure it meets your specs. Mayor Featherman — We have to have something done
immediately. If people are in violation of the law they should be ticketed. Chief Hartmann — We were
proactive before this builder started building that house. We had a meeting with the builder, the Code
Enforcement Officer and the Building Inspector. He was aware of the concerns of the residents and was
very responsive and had no issues. We were unaware of this until last week when we received the first
email. For a construction site, it has been very well maintained. We enforce the code on the weekend as
well as every day of the week. We have written many citations for people working on the weekends and
enforce the hours that they are allowed to work. We will have a meeting with the Building Inspector
sometime next week to review this situation. As a Police Dept., we have proactively met with the various
construction contractors and on -site managers informing them of the code and what is expected of them.
Mayor Featherman — We will ask the Town Manager to speak to the Code Enforcement Officer and the
people in charge of the construction sites. Vice Mayor Brown — I looked at the property in question and
the nails that are there are for Code Enforcement, who cannot issue a ticket. They can give a warning and
then follow up on it. They are striving to do what they can do and doing a good job. Our Police Dept.
and Code Enforcement Officer have been at these construction sites many times, as have I. There may be
some subcontractors that are not aware of the various codes. Comm. Feldman — I think this is more
serious then what is being said. There should be something more that we can do then just issue a warning.
Is there some way you can write a ticket without issuing a warning first. Chief Hartmann — This builder
has been very responsive and there has been no issue with him. People should not have to go before the
Commission to get things done if something is not going right. They can come to me or Code
Enforcement to deal with the issues in their community. Town Manager Weiser — This has been an
ongoing construction site. I will be contacting the builder and follow up on this issue.

Talent Bank Interview:
Paul Resnick — 4740 S. Ocean Blvd — I am up for a re- appointment and would like to continue
to serve on this Board. Mr. Resnick described the duties of this Board and stated that they meet
on a quarterly basis as needed.
MOTION: Commissioner Stern moved to re- appoint Paul Resnick to the Boca Raton Airport Advisory
Board. Commissioner Feldman seconded the motion. A voice vote was taken with all in favor.
• Code Enforcement Board — Two Re- Appointments for Three -Year Terms
Talent Bank Interview:
Michael Kravitt — 3200 S. Ocean Blvd. — I am an architect and have a practice
in Boca Raton. I would be happy to serve on the Board for another three year
term.
MOTION: Vice Mayor Brown moved to re- appoint Michael Kravitt to the Code Enforcement Board for
a three -year term. Commissioner Sheridan seconded the motion. A voice vote was taken with all in favor.
Paul Resnick — 4740 S. Ocean Blvd — I am presently the Chairman of the Code Enforcement
Board. I have served on this Board on and off for the past six years, and would like to continue
to do so. I would also like to have additional meetings and be more proactive. There are no
Code Enforcement Board meetings, unless there is a code enforcement issue that needs a
hearing. We would love to meet and be able to discuss certain issues in this town. Town
Attorney Torcivia — The Code Enforcement Board is a quasi-judicial. They are the judges; they
hear the case. You must be very careful not to cross the line and become legislators. A judge
in court could not change the law. They must enforce the law and interpret the law. They
could meet occasionally, but you have to remember that you are a judge and you may see
something and want to correct it; but you must also be independent and impartial when the case
comes before you.
MOTION: Commissioner Feldman moved to re- appoint Paul Resnick to the Code Enforcement Board.
Commissioner Stern seconded the motion. A voice vote was taken with all in favor.

A) ORDINANCE NO. 14 -005 O — Second Reading
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA AMENDING
CHAPTER 28 "XERISCAPE- LANDSCAPE REQUIREMENTS, INSTALLATION AND
MAINTENANCE,"OF THE TOWN CODE OF ORDINANCES BY AMENDING
SECTION 28 -10, "MAINTENANCE STANDARDS FOR CULTIVATED LANDSCAPE
AREAS ", TO CLARIFY THAT THE ADJACENT PROPERTY OWNER SHALL
MAINTAIN ANY LANDSCAPING IN THE PUBLIC RIGHT -OF -WAY; PROVIDING
FOR CODIFICATION, CONFLICTS, SEVERABILITY AND FOR AN
EFFECTIVE DATE.
Town Clerk Brown stated that this Ordinance was removed from the agenda for further revision.
B) ORDINANCE NO. 14 -006 O — First Reading
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA AMENDING
CHAPTER 23, "SIGNS AND ADVERTISING," OF THE TOWN CODE OF
ORDINANCES, TO PROVIDE FOR CLARIFICATION REGARDING THE
PERMITTING AND REGULATION OF SIGNAGE; PROVIDING FOR
CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE.
Town Clerk Brown read Ordinance No. 14 -006 O into the record.
Town Attorney Torcivia explained the changes requested and made to this ordinance since the last
meeting. The changes made had to do with the number of flags allowed on the property; from two flags
to four flags. Real Estate "open house" signs would be allowed for 72 hours on nationally recognized
holidays. Residents would be allowed to put out small flags no more than a total of 40 square inches.
Also, with regard to the valet signs noted on Page 14 of the Ordinance, they cannot be larger than 24
inches wide or 36 inches high and can only have a directional arrow and the word Valet. Four signs
would be allowed on any property.
MOTION: Vice Mayor Brown moved to accept Ordinance No. 14 -006 O on first reading and schedule
for a Public Hearing and Second Reading on July 1, 2014. Commissioner Sheridan seconded the motion.

7. NEW BUSINESS:
A) Town Commission to consider a Special Exception for the approval of the installation of a
20,000 LB. Boat Lift on property located at 4222 S. Ocean Blvd.
PUBLIC HEARING: (Quasi - Judicial Hearing)
Town Clerk Brown read the application into the record.
Mayor Featherman opened the Public Hearing.
Mayor Featherman asked if the Commissioners had any ex parte communications to disclose.
Requested that all those giving testimony, please stand and raise your hand so that the Clerk can swear
you in. Hearing none, Town Clerk Brown administered the oath to those who would be testifying during
this hearing.
Staff f, j`'Presentation:
Bradford Leary, Acting Building Official read the application into the record. The boat lift has already
been installed. It started out as a repair and the dock company determined it needed to be replaced.
This permit application is called an "after the fact permit ". The penalty for that type of permit is four
times the permit fee based on the construction cost. The Building Dept. does not have a record of the
boat lift initially being approved or permitted. Mr. Van Duren does not have any documentation to
show the existing lift was permitted and believes the lift was installed about 27 years ago. The
Planning Board has approved this application and it meets the Town of Highland Beach planning
requirements. They also have approval from the DER The Building Dept. recommends this
application be approved by the Town Commission. The Building Dept. has no objection to issuing a
permit for the boat lift after required documents, permit application and construction documents after
approval by the Town Commission of the Town of Highland Beach.
Public Comments: No Public Comments received.
Commission Discussion:
Comm. Feldman — What would the amount of the fees be? Mr. Learn — It is not known at this time; but
once that is determined, it will be four times the amount. Comm. Feldman — If someone wants a permit
and the permit costs a sum of money, how can the Building Inspector issue a permit without knowing
how much to charge? Mr. Leary — Some permits have set fees and some are based on cost of
construction. This one is on the cost of construction. The work was already completed when an
inspector visited the site and issued a stop work order. Although the lift is installed, he is not able to
use it. Comm. Feldman — Town Attorney, can we approve this before all the documentation is given.
The owner tried to evade the process by going ahead and putting in the boat lift before asking for a
permit. Town Attorney Torcivia — Today you are only asked to approve the Special Exception. If you
approve this, then the Building Official will calculate the permit fee and have it collected.

Comm. Stern — After hearing the application at the Planning Board, it seems it was done correctly after
it was stopped. I am in agreement with the Planning Board to approve this.
Comm. Sheridan — I also attended the Planning Board meeting and there were no objections from any
of the residents abutting this property.
Vice Mayor Brown — I am also recommending approval.
Mayor Featherman closed the Public Hearing.
MOTION: Commissioner Sheridan moved to approve the Special Exception for the installation of a
20,000 Lb. Boat Lift on property located at 422 S. Ocean Boulevard. Commissioner Stern seconded
the motion.

8. MISCELLANEOUS — ITEMS LEFT OVER:
A) Discussion of Town Manager Performance Evaluation and Merit Increase.
Comm. Feldman — After the last meeting when I gave my evaluation, I met with the Town Manager to
discuss my issues. We agreed on some and disagreed on others. I was not in favor of renewing the Town
Manager's contract. However, I am a team player and whatever the other four Commissioners want, I will
go along with their decision. I am also in favor of an increase in pay.
Comm. Stern — I have no problem with renewing the Town Manager's contract. We discussed the
comments I made in my evaluation and have come to an understanding. I also agree that a merit increase
is in order.
Comm. Sheridan — I have also met with Manager Weiser on several occasions and have worked out our
minor differences. She has done a great job and I am in favor of a merit raise.
Vice Mayor Brown I think she has done a great job. I believe a five percent merit raise is in order. -
Mayor Featherman — Manager Weiser has many strong points. She is professional, a capable speaker and
is pleasant to work with at times. Mayor Featherman gave a synopsis on what is expected -of the Town
Manager during her next year in Highland Beach.

Town Manager Weiser — I believe that together with my Staff we had many accomplishments this year. I
provided all the Commissioners with a long list of those accomplishments. My meeting with Comm.
Feldman was very proactive and we came up with some very good ideas to make your job and my job
easier. I enjoy working with all of you and thank you for your support.
MOTION: Comm. Feldman moved to give the Town Manager a three percent (3 %) merit increase
effective on June 30, 2014. Comm. Stem seconded the motion.

B) Commission to Authorize Contract Change Directive to Replace Tile in North
Building (Administrative Offices) in the amount of $11,968 with Funding from "Reserve for
Contingency."
Town Manager Weiser — The proposal to extend the tile into the north building is $11,968 and is
approximately 1,000 sq. ft. of tile which includes the demolition and the carpentry.
Comm. Feldman — Was not in favor of replacing the tiles. States that the existing tiles are in good shape
and I don't feel adding an additional $12,000 to the project is necessary.
Comm. Stem — Would like to see the new tile put in, because it would give the overall building a new
wonderful look and there would be continuity.
Comm. Sheridan — Was in favor of replacing the tile at this point.
Vice Mayor Brown — Was in favor of replacing the tile. It would tie together the old building and the new
construction.
Mayor Featherman — Was not in favor of replacing the tile and spending an additional $12,000 because I
don't think it is needed.
MOTION: Vice Mayor Brown moved to authorize Contract Change Directive to replace the tile in the
north building in the amount of $11,968. Commissioner Sheridan seconded the motion.

C) Commission to authorize Mayor Featherman to sign Proposed Amendment
Interconnect Agreement between Boca Raton and Highland Beach.
Town Attorney Torcivia described the revisions made to the original agreement. There is nothing
substantive to me between what you saw last week on Consent; but there are many grammatical changes,
and I didn't think it was fair for you to approve it on Consent. That is why I asked that it be put on the
regular agenda.
Comm. Feldman — Do we know what the rate is at this time? I understand we are going with Boca rather
than Delray because it was less money. Town Attorney Torcivia — It will change over the years. The
agreement is that whatever the lowest rate they are charging their customers, we will be charged.
Town Manager Weiser — This is an agreement we had with Boca from the 1980's and was purely for
emergency purposes. This agreement negotiated with Boca includes water not just for emergencies, but
anytime we would need to tap into their water. The red was what we initially negotiated with them and
had that all worked out. They came back to us this week and made these additional changes, which are
not substantial. It was much more cost effective than going with Delray.
Public Works Director Ed Soper — Boca is about one -third of the price of Delray.
Comm. Stern — How long will the water tank be out of service when it is being painted? PWD. Soper — It
is expected to take approximately three weeks. Comm. Stern — Will this affect the rate we would be
charging our residents? PWD Soper — The rate will not change.
Comm. Sheridan — Mr. Soper are you comfortable with the changes? Mr. Soper — This is a great
agreement and would recommend executing the agreement.
Mayor Featherman — I am in agreement but am just concerned that we received these changes on such
short notice.
MOTION: Commissioner Stern moved to accept the presentation of the Proposed Amendment
Interconnect Agreement with the City of Boca Raton. Commissioner Feldman seconded the motion.

9. REPORTS — TOWN COMMISSION:
A) Commissioner Carl Feldman — Some of the residents have mentioned that they were having
trouble getting these meetings on their computers. He spoke Zoie Burgess about this and set this up for
them to be able to view the meetings. My meeting with the Town Manager was a very productive meeting.
One of the things we talked about was the visibility of the Commission and the Town Manager. I asked if
we could get the Commission books on a Tuesday or Wednesday rather than the Thursday before the
Tuesday Commission meeting. Also, could we receive Ordinances and Resolutions prior to the day of the
meeting? We discussed having the Town Manager give the Commissioners a State -of -the -Town Report
every two weeks with what is happening in the Town. My question to Zoie is when they can view the
meetings. Reply — They should be ready for viewing by noon time the next day.
B) Commissioner Louis P. Stern — I have been working with the Florida Fish & Wildlife
Commission for almost seven years to get some restrictions on boating. I have been working with Dawn
Griffin and she has sent a tremendous number of materials to myself and the Town Manager. I want to
thank the Town Manager and Staff for the wonderful job they have done to assist me.
Comm. Stern read a letter into the record that was written by Attorney Brian Shutt from Glen Torcivia's
Office: "I spoke with Dawn Griffin from Florida Fish & Wildlife Conservation Commission today
regarding the Town's ability to place signs in the Intracoastal right of way. Pursuant to Florida State
Statute 327.46, municipalities have the ability to establish boating restricted areas if there are certain
structures present; such as a bridge, bridge ramp, fuel pump, etc. Unfortunately, along the entire length of
the Intracoastal adjacent to Highland Beach, there are none of these structures. So, there are no restrictive
signs that may be installed. Florida Administrative Code 68D -23 regulates markers in Florida waters.
However, it is primarily for boating safety. Section 68D - 23.101(3) provides that no boating restricted areas
be established for the purpose of noise abatement or protection of shoreline structures from vessels wake.
Ms. Griffin did not know if the Town wants to install signs on currently located on FWC signs. Our signs
could say something to the effect "you are responsible for your wake" and these signs are roughly one inch
by six inches. They cost $53.00 per sign plus the cost of installation. The Town will need a permit from
FWC to install the signs. FWC could take up to ninety days to approve the permit but she did mention that
it normally takes around thirty days. She did give me a list of sign contractors who are approved by them
that we could use to fabricate these signs. I asked Ms. Griffin if she thought that by adding the extra
signage would it reduce the amount of wake from boats and she indicated that it had only been done once

before and was in an area that was in transition between idle wake and slow wake. She was not sure if the
signs were of any help."
Comm. Stern continued: Even though we are a slow wake zone, we cannot post any signs to that effect.
We are getting closer and closer with Boca Raton's boat to patrol our waters.
C) Commissioner Dennis J. Sheridan — I want to report that 3200 S, Ocean has filed their plans with
the Town by the deadline of June 0 1 . We should see some action by September 1 I want to commend
PWD Soper for his quick action in removing the cone that was in the middle of the sidewalk in front of
Regency Highland.
D) Vice Mayor Brown — June 1 St starts hurricane season. I represented the Town at the open house at
the Red Cross. They are prepared for any emergency that will come before them.
E) Mayor Featherman — I would like to schedule a town -wide public meeting to hear the concerns of
our residents about potential climate change impacts and the ideas on how we can begin to consider how
the Town itself would want to respond. Also, I would like the Code Enforcement Officer to check into the
problems brought before us today by one of our residents.
10. REPORTS — TOWN ATTORNEY GLEN TORCIVIA:
I would like to explain why the landscaping ordinance was taken off the agenda. Historically, homeowners
have taken care of the adjacent property; the swale and the right -of -way. In 2007 the Town entered into an
agreement with FDOT where trees were planted and the Town was responsible for maintaining them. The
way we intend to rewrite this is to make it clear that the residents are responsible for the adjacent right -of-
way, unless the Town had planted that through the FDOT agreement in which case the Town would be
responsible, unless damage was caused by that adjacent homeowner. Comm. Feldman — I think you should
put something in about the maintenance of these trees if planted other than by the homeowner. It is quite
costly to maintain them. The burden should be on the Town or the State.
11. REPORTS — TOWN MANAGER KATHLEEN D. WEISER:
Thursday, June 5 th is Boca's Planning and Zoning meeting at 6:30 p.m. to consider our Boca properties. I
will be attending with a representative from our Attorney's office. Thursday, June 12 at 6:00 p.m. is the
Delray special meeting to consider what they are going to be doing with their fire service.
12. PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT
MEETING:
Tim Burnich, 4505 S. Ocean Blvd — I would like to re- enforce what Mr. Resnick said that we would like
the Code Enforcement Board to meet quarterly and review what is going on with the Code Enforcement
and the Building Dept. We can make sure we are not legislating but trying to learn -what is going on in
case there are some things we should look at.
