1992.03.11_TC_Minutes_Specialr TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission SPECIAL MEETING/CANVASSING BOARD Wednesday, March 11, 1992 1:00 p.m. Mayor Joseph A. Boulay called the Special Meeting/Canvassing Board of the Town Commission of the Town of Highland Beach, Florida to order in the Commission Chambers at Town Hall at 1:00 p.m. for the purpose of certifying the results of the Municipal Election held on Tuesday, March 10, 1992. Others in attendance were Vice Mayor Bill Paul, Commissioners Arlin Voress, Arthur Eypel, and John F. Rand. Also present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals and members of the general public. Town Clerk Anne M. Kowals read Resolution No. 604 (a copy of which is attached to and made a part of these minutes) declaring the election to have been held on the 10th day of March, 1992 for the Vice Mayor unnecessary since the qualifying candidate is unopposed. • A MOTION by COMMISSIONER RAND/COMMISSIONER VORESS to adopt the Resolution as read carried with unanimous approval. The Town Clerk administered the "Oath of Office" to Vice Mayor Bill Paul. The Vice Mayor then read a prepared statement into the record, a copy of which is attached to and made a part of these minutes. At the request of the Mayor, the Town Clerk read the results of the Commission race: Betty C. Dodd 647 votes John F. Rand 833 votes Records indicate there are 2,644 registered voters in town; 1,543 voters cast their ballots which amounts to a 58.36 percent voter turnout. COMMISSIONER VORESS/COMMISSIONER EYPEL MOVED to accept the certi- fication of the election. The MOVE carried without objection. Mayor Boulay, noting the Commission is pleased with the large turnout at the March 10, 1992 Municipal Election, extended thanks to all who attended this special meeting. Having addressed all Agenda Items, MOTION was made by COMMISSIONER VORESS/COMMISSIONER EYPEL to adjourn this meeting. Same received unanimous approval. John., Rand, Commissioner U • RESOLUTION NO. 604 DECLARING THE ELECTION TO HAVE BEEN HELD ON THE 10TH DAY OF MARCH, 1992 FOR THE VICE MAYOR UNNECESSARY SINCE THE QUALIFYING CANDI- DATE IS UNOPPOSED. WHEREAS, the Florida State Statute, Chapter 101.151(6) states: "Except for justices of the Supreme Court and judges of District Courts of Appeal, the names of unopposed candi- dates shall not appear on the general election ballot. Each unopposed candidate shall be deemed to have voted for himself."; and WHEREAS, the election was to have been held in the Town of Highland Beach on March 10, 1992 for the Vice Mayor is now unnecessary since the qualifying candidate is unop- posed and shall be deemed to have voted for himself. NOW, THEREFORE, it is hereby declared that under the laws of the State of Florida, and the Codes of the Town of Highland • Beach, WILLIAM E. PAUL is hereby elected to the office of the Vice Mayor. Kowals /Town Clerk 11 March, 92 It is a great honor to have the opportunity to serve another two years as your vice mayor. I pledge to each of you to act in the best interests of our Town of Highland Beach at all times. I first served on this Commission from 1983 to 1985. I am proud of my record during those two years. In particular, I am especially proud of my part in settling a law suit involving property in the south end of town. Not only was the town being sued, but several Community Appearance Board Members were indi- vidually named as defendants. Even though that proposed settle- ment was extremely favorable to the town, the settlement was approved by a 3-2 vote. As a result of that settlement, our town has an expanse of green space rather than two buildings as you enter Highland Beach from the south. As you may surmise, I'm leading up to the verdict last week in another court case. The present case has been pending since 1987 and was one of the main reasons I felt compelled to make my suc- cessful bid to return to this commission in 1990. For the past year, the five people now occupying this podium have worked diligently and done everthing humanly possible to effect an out of court settlement in the best interests of Highland Beach yet still be fair to the plaintiff. As you all know by now, the jury verdict last week was not favorable to our town nor was it fair to our town. This particular case could still drag on for many, many years. I have every confidence that the four people sitting up here with me now will do everything humanly possible to ameliorate our present situation and act in the best interests of everyone in Highland Beach. I am proud of our town and happy to be such an integral part of our town. The Resolution declaring me vice mayor states I am deemed to have voted for myself. Since I was unopposed, I feel that all of you supported me and I will work to the very best of my ability to represent each and everyone of you. Thank you for your confidence!
