TOWN OF HIGHLAND BEACH, FLORIDA
Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesday, May 26, 1992 1:30 p.m.
Mayor Joseph A. Boulay called the Workshop Meeting of the Town
Commission of the Town of Highland Beach, Florida, to order in the
Commission Chambers at Town Hall at 1:30 p.m. Others present were
Vice Mayor Bill Paul, Commissioners Arlin Voress, Arthur Eypel,
and John F. Rand.
Also in attendance were Town Attorney Thomas E. Sliney, Town
Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, and members
of the general public.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
The agenda, amended to include a draft resolution, under Item
92.3, opposing the CCCL changes as well as adding three items
under the Town Manager's Report (amendment to the disposal
contract with Delray Beach re water and sewer; voter control of
city taxes supported by Florida League of Cities; and, a proposal
opposing SB 1650 called "National Flood Insurance, Mitigation, and
Erosion Act of 1991"), was accepted as amended.
92.1 PUBLIC COMMENTS AND REQUESTS
Mr. Leonard Bell of 2727 South Ocean Boulevard thanked the Town
Commission for their help in protecting the dunes in the area of
the Holiday Inn. It was noted that, following a meeting with the
Holiday Inn Manager and Town representatives, a 6' fence has been
erected in the area where individuals were walking on and destroy-
ing the dunes.
Mr. Bell, noting Holiday Inn guests were using jet skis close to
the shore creating a hazard for bathers and making a lot of noise,
questioned if anything can be done about such nuisances. Staff
will contact municipalities in the area to inquire if they have
any ordinances pertaining to jet skis.
Mr. Philip Colman of 2727 South Ocean Boulevard, agreed with Mr.
Bell's comments regarding problems caused by individuals using jet
skis.
Alluding to the proposed reestablishment of the CCCL by the DNR,
Mr. Colman questioned the position of the Town should a structure

suffer extensive damage in excess of the 50 percent figure whereby
a new building would be required; what would the Town allow to be
rebuilt on the affected property?
Attorney Sliney advised that the Comprehensive Plan and the Town's
Zoning Code would have to be readdressed with the movement of the
CCCL. Mr. Colman, noting insurance companies question the posi-
tion of the Town as they have to know what the future will hold if
they are faced with a catastrophic situation, stated the Town must
have some kind of a position on this matter.
Town Manager Mariano commented that each case will have to be
considered individually with much depending on the situation; the
Town is interested in protecting all residents.
Commissioner Eypel questioned if buildings along the coast are
insured up to replacement costs at today's prices.
Ms. Annette Amaral of 3114 South Ocean Boulevard, noting she is an
insurance agent, stated the condominiums should be insured for
replacement value. There will be some lapses without value for
land and foundation; however, there is 'building ordinance cover-
, age' condominiums can purchase. Ms. Amaral advised there is no
way for insurance agents to establish a value with regard to what
the building loss will be.
Mr. Philip Colman, noting Adelphia Cable has included the AMC
channel in the Highland Beach lineup, stated the City of Palm
Beach receives an additional 6/7 channels compared to the Highland
Beach channel allotment. It was noted that the Adelphia repre-
sentatives are scheduled to attend the June 02, 1992 Regular
Meeting to address cable television concerns.
PRESENTATION BY WALK AMERICA COMMITTEE
Walk America Committee representatives Janice Carlin, Jean King,
and Carol DeLuca presented awards to the following individuals who
participated in the April 04, 1992 March of Dimes Walk-a-thon:
Betty Graham, Fire/Rescue Station 44, Highland Beach Police
Department, Boy Scout Leader Matthew Cienfolo, Co-chairman
Victor Hadeed, Annette Amaral, Jerry Marshall for Bel Lido
Homeowners' Association, Irene Augenstein for Braemer Isles,
Harvey Sheller for Trafalgar. Also recognized by Mayor
Boulay were Dave Augenstein and Jan Sheller who worked on the
Committee.

The Walk America Committee presented jackets to the five top
walkers: Leonard Bell, Harvey Sheller, Laura Becker, Victor
Hadeed, and Mayor Joseph Boulay.
Mayor Boulay noted Victor Hadeed and Dottie Boulay co-chaired the
Walk-a-thon. Mr. Hadeed, extending thanks to all who participated
and supported this project, noted Beach Walk East Condo Manager
Jere Smingler was very helpful in this fund raising event.
92.2 BOARDS AND COMMITTEES
Mayor Boulay, noting there are 7 active Talent Bank Applications
on file, stated there are no existing vacancies on any Town Ad-
visory Boards. The Mayor urged residents interested in appoint-
ments to Town Advisory Boards to submit Talent Bank Applications
to the Town Clerk's Office. It was noted no correspondence was
received from Town Boards or Committees.
92.3 PROPOSED ORDINANCES AND RESOLUTIONS
1. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA
OPPOSING ANY CHANGE IN THE COASTAL CONSTRUCTION CONTROL
LINE.
The resolution, included in today's amended agenda, was discussed
by Members; it was the consensus to move this item to the June 02,
1992 Regular Meeting Agenda for consideration with the inclusion
of the following statement recommended by Commissioner Voress:
3. That the Town Commission will request the Department of
Natural Resources to hold another public hearing in the
winter of 1992 to receive public comment from the over
50 percent of the town's beachfront property owners who
are seasonal residents and are thus denied the
opportunity to comment on this important issue.
The original number 3 of the proposed resolution becomes number 4.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
The Commissioners reviewed the 'Status of Building Development in
Town', a report prepared by the Building Official.

Minutes for approval at June 1992 Regular Meeting
Following the review of three sets of Town Commission Meeting
Minutes, it was the consensus to move this matter to the Regular
Meeting Agenda for consideration.
REPORTS - TOWN COMMISSION
Vice Mayor Bill Paul
Vice Mayor Bill Paul urged all to attend the public hearing with
regard to the reestablishment of the CCCL scheduled for 7:00 p.m.
on Thursday, May 28, at the Boca Raton City Hall.
The Vice Mayor extended congratulations to Jose Echeverria on the
Sun Sentinel Metro Section article citing him for his work on the
"Turtle Program".
Commissioner Arlin Voress
Commissioner Arlin Voress strongly urged all to review the DNR
submittal regarding the westward movement of the CCCL on display
in the Town Hall Lobby. The Commissioner stressed the importance
of all residents attending the public hearing on Thursday evening
at 7:00 p.m. in Boca Raton City Hall. It was noted that both
Commissioners Voress and Eypel will speak in opposition of the
proposed change of the CCCL.
Commissioner Voress noted he asked the Utilities Director to
invite all Commissioners to inspect the new emergency generator
system which is in excellent condition to handle the sewer and
water systems should a hurricane occur.
Commissioner Arthur Eypel
Commissioner Arthur Eypel, under his report, noted he is very
encouraged with residents showing an interest in serving the Town
by submitting their Talent Bank Applications.
The Commissioner, alluding to the proposed movement of the CCCL,
advised he will speak personally at Thursday's public hearing with
regard to the facts and will impart to the board things he
observed, since 1952 when his family moved to Highland Beach, with
his eyes: the beauty of the shoreline, the lovely beach with the
elevation of the dunes where one could enjoy the sea breezes. The

Commissioner stated he feels we will succeed in this matter if we
overcome apathy and stir people to the point where they will all
attend the scheduled public hearing at the Boca Raton City Hall on
Thursday, May 28, at 7:00 p.m.
Commissioner John F. Rand
Commissioner Rand, upon questioning the status of the Attorney
Rosenbaum matter, was advised that a copy of the response to a
follow-up letter was placed on the clipboard in the Commission
Office; the pertinent documents with regard to this issue have
been received and are available for his inspection.
The Commissioner noted he requested the Finance Department to look
into the possibility of refinancing the Town's last bond issue; it
was found that it would not be economically prudent to refinance
that particular bond issue unless it were incorporated into any
future bond issues. The Commissioner advised that he will again
request the Town Manager and the Financial Advisory Board to
consider the Town's participation in the State Pooled Fund as he
feels the Town may realize a higher return by utilizing other
methods of investment.
• Mayor Joseph A. Boulay
Mayor Boulay, the last Member of the Commission to give his
report, noted by the time he is called upon for said report, his
associates have already addressed whatever he intended to comment
on. The Mayor, once again, extended thanks to all who partici-
pated in the March of Dimes Fund Raiser and noted there is much
cooperation amongst the Town's residents.
REPORTS - TOWN ATTORNEY
Town Attorney Thomas E. Sliney had no report.
REPORTS - TOWN MANAGER
Town Manager Mary Ann Mariano reported staff is working on the
1992/93 f.y. budget. Following substantial discussion of this
matter, it was the consensus of the Commission that the 1991/92
appropriation of $150,000. for the installation of an additional
pipeline across the Intracoastal Waterway be carried forward into
the 1992/93 f.y. budget.

Mr. Leonard Bell of 2727 South Ocean Boulevard, noting all are
concerned about the CCCL reestablishment and therefore got in-
volved in condo meetings conducted by Commissioners regarding this
important issue, stated "with a little imagination, we proved a
little Town Hall works". Mr. Bell, urging the Commission to con-
sider continuing such practice, thanked the Members for their time
and effort.
Residents Jose Echeverria, and Leon Canova spoke to urge the Town
Commission to move the money forward in favor of the additional
pipeline across the Intracoastal Waterway.
Following discussion of the Town Manager's Agenda Report Form of
May 26, 1992 regarding amendment to the disposal contract with
Delray Beach relating to sewer and water, it was the consensus
that a resolution be prepared for possible consideration at the
June 02, 1992 Regular Meeting of the Town Commission.
Town Manager Mariano reported the Florida League of Cities is
supporting the "Voter Control of City Taxes" which is a proposed
constitutional amendment that will allow citizens to take back the
authority to tax themselves by giving each city an innovative way
• to create its own tax structure. The Florida League of Cities is
urging the Legislature to put this matter on the November 1992
ballot. A resolution relating to this matter will be prepared for
consideration at the June 02, 1992 Regular Meeting.
Town Manager Mariano reported the U. S. Senate is considering a
bill (SB-1650) called 'National Flood Insurance, Mitigation and
Erosion Act of 1991'. Noting this could cause serious problems by
denying flood insurance and mortgage money to all new construction
within a hypthetical "30 year erosion line" and all construction
over four units within a "60 year erosion line", the Town Manager
recommended the Town adopt a resolution to support opposition to
this Senate Bill. It was the consensus to consider adoption of
said resolution at the June 02, 1992 Regular Commission Meeting.
Mayor Boulay acknowledged the presence of former Commissioner
Peter Genovese and his wife at this Workshop Meeting. The Mayor
noted the videotape of this session will be replayed on Friday,
May 29, 1992 at 1:30 p.m. on Channel 12.
There being no further business to come before the Town Commission
at this time, Mayor Boulay adjourned the Workshop Meeting at 3:40
p.m.
