1992.09.29_TC_Minutes_Workshopa ~ --~.~ r TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, September 29, 1992 1:30 p.m. Mayor Joseph A. Boulay called the Workshop Meeting of the Town Commission of the Town of Highland Beach, Florida, to order in the Commission Chambers at Town Hall at 1:30 p.m. Others present were Vice Mayor Bill Paul, Commissioners Arthur Eypel, and John F. Rand. Commissioner Arlin Voress was absent. Also in attendance were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals and members of the general public. ADOPTION OF AGENDA The Agenda was accepted as written. 92.1 PUBLIC COMMENTS AND REQUESTS As Jose Echeverria of Russell Turtle Program approached the Commissioner Rand, noting our identifying the leader of the Mr. Echeverria with a 'turtle may be more readily recognize Drive, head of the Highland Beach podium to address the Commission, turtles are having difficulty Town's Turtle Program, presented hat' which he is to wear so that he 3 as the head of said program. Mr. Jose Echeverria stated he and his family members went to South Perrine following Hurricane Andrew where they observed the heavy devastation/damage to trees (in particular the Australian Pines that were sheared off), suggested the Town consider trimming the Australian Pines in Town to avoid such problems, in the future, in our area. Mr. Echeverria extended thanks to Commissioner Rand for his kind gesture with the 'turtle hat'. Mr. Michael Dent of the Casuarina stated he received a notice from Adelphia Cable that included a bill for an in-put selector switch for certain channels, an option service he had not subscribed to. Mr. Dent advised the way Adelphia handled the mailing makes it appear more like a marketing scam which he thinks confused a lot of people. Commissioner Rand, noting he received a similar notice in the mail, advised he is confused as to the significance of that ad- vertisement; he requested the Town Manager inquire of Adelphia Cable as to the significance of said notice. e Town Commission Workshop Meeting Minutes • September 29, 1992 Page 2 of 6 92.2 BOARDS AND COMMITTEES Mayor Boulay, noting Board of Adjustment Member Jane Rayner is eligible for reappointment when her term expires this October, requested the Commission give consideration to the reappointment at the October 06, 1992 Regular Meeting. At the request of Com- missioner Rand, copies of Ms. Rayner's resume will be distributed to the Commission prior to the October Regular Meeting. The Mayor noted no correspondence was received from Town Boards and Committees. 92.3 PROPOSED ORDINANCES AND RESOLUTIONS 1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, PRO- VIDING FOR UTILITY RATES, FEES AND/OR CHARGES, SPECIFIC- ALLY AMENDING HIGHLAND BEACH CODE SECTION 11-13 OF CHAPTER 11, RELATING TO GARBAGE, TRASH AND RECYCLING CHARGES. During discussion of the ordinance, it was noted the increase is a result of several things: an increase in the base contract rate; an additional recycling pick-up in season; and, the new vegetation • recycling requirement. With regard to the new vegetation recycling requirement, Vice Mayor Paul stated "tree trimmings will not be picked up on Mon- day". Town Manager Mariano advised a notice was mailed to advise all residents/condos 'vegetation' will be picked up on Thursday. The Vice Mayor, noting people should be aware that tree trimmings will only be picked up on Thursday, advised if such vegetation is placed for pick up too far in advance of Thursday, residents will be in violation of the Town Ordinance. Following deliberation, it was the consensus to move this ordi- nance to the October Regular Meeting Agenda for first reading. MISCELLANEOUS - ITEMS LEFT OVER Members reviewed the Status of Building Development in Town, a report submitted by the Building Department. Six sets of Town Commission Meeting Minutes were reviewed and moved to the October Regular Meeting Agenda for possible approval. . , Town Commission Workshop Meeting Minutes • September 29, 1992 Page 3 of 6 REPORTS - TOWN COMMISSION Vice Mayor Bill Paul When Vice Mayor Paul was called upon to give his report, he indi- cated his comments made during discussion under "Proposed Ordi- nances and Resolutions" constituted his report. Commissioner Arlin Voress Absent - no report. Commissioner Arthur Eypel No report. Commissioner John F. Rand Commissioner Rand urged residents to attend the Focus Group Meet- ing scheduled for Wednesday, September 30, 1992. at 9:30 a.m. at Town Hall. In response to Commissioner Rand's inquiry regarding how one may reach the Police Department for non-emergency matters that occur after business hours, it was noted one would dial the Palm Beach County Sheriff's Department non-emergency number (276-2458); the Sheriff's staff will then radio the information to our officers. Alluding to Mr. Dent's comments regarding Adelphia Cable's notice, Commissioner Rand noted he received a smimilar notice in the mail and was confused as to the significance of the information. Per the Commissioner's request, the Town Manager will inquire of Adelphia Cable as to the significance of said notice. When Com- missioner Rand questioned how Town residents returning from their Northern homes will be advised as to how they go about exchanging their converter boxes, it was noted the Town requested Adelphia schedule a second session to affect the converter box exchange. It was further noted Condo Managers have received information regarding this matter as Adelphia may, in fact, try to leave a supply of new converter boxes with the Managers prior to the residents return to Town. When the Commissioner inquired if arrangements were made to have representatives from J. M. Montgomery, the Town's Engineers, to appear before the Town Commission to give a status report regard- ing the Intracoastal Waterway Pipeline, he was advised this matter will be an agenda item for the October Regular Meeting. Town Commission Workshop Meeting Minutes • September 29, 1992 Page 4 of 6 With regard to a Special Town Commission Workshop Meeting to be scheduled for the purpose of reviewing the proposed Charter Re- view Board Amendments, Commissioner Rand was advised that when Commissioner Voress returns to Town and we have a full Commission, a Special Workshop Meeting will be arranged. It was noted each Member of the Commission received a complete copy of the Charter in which the proposed changes have been highlighted. The Town Manager advised that after the Commission determines what changes to the Charter are necessary, the Town Attorney will then deter- mine if any changes require a referendum or just an ordinance to effect the changes. Commissioner Rand, citing an article on September 16, 1992 in the Sun Sentinel with regard to the cap on property tax evaluation, advised the information in said article is sheer nonsense as this constitutional amendment has nothing to do with the homestead ex- emption. With regard to the September 18, 1992 Sun Sentinel article concerning Boynton Beach toughening their leash law, the Commissioner advised he would like to have our Town ordinance re- garding this matter enforced or repealed. Mayor Joseph A. Boulay Mayor Boulay, under his report, urged those eligible to vote in the October O1, 1992 run-off election to exercise their right by casting their ballot. The Mayor noted the Palm Beach County Municipal League is forming a Countywide Intergovernmental Coordination Task Force to supple- ment the works of the former Planning Council which was sunsetted by action of the majority of the Palm Beach County Municipalities. Noting the Task Force will consist of nominees whose names are to be submitted by the Palm Beach County Municipalities, the Mayor read the list of candidates and requested the Commissioners give consideration to selecting two people whom the Mayor will nominate to the new Task Force before October 16; from our two nominees, one will be selected for the Task Force. The Mayor requested the Members keep this matter in mind and be prepared to make their selection of the two nominees at the October Regular Meeting. REPORTS - TOWN ATTORNEY 1. Combined Mutual Aid Agreement between Boca Raton Police Department and Highland Beach Police Department. n U i i Town Commission Workshop Meeting Minutes September 29, 1992 Page 5 of 6 Following substantial discussion during which the Town Attorney explained the 'Combined Mutual Aid Agreement between Boca Raton and the Highland Beach Police Departments' it was noted that such agreement, entered into often between communities, is used only in an emergency. The existing Mutual Aid Agreement between Boca Raton and Highland Beach Police Departments is merely being up- dated with the signing of this document. It was the consensus to prepare a Resolution approving said Mutual Aid Agreement for con- sideration at the October Regular Meeting. Town Attorney Sliney advised he has prepared a counter-proposal regarding the Drexel Investments matter. Commissioners are requested to review said counter-proposal and contact the Town Attorney if they have any questions. When all Commissioners feel comfortable with the document, same will be submitted to Drexel. The Town Attorney further advised the Commission all the attorneys for Highland Beach have been working on the first brief to be submitted with regard to the Broadview/RTC appeal. The Town Attorney noted he is working with the new Building Offi- cial on a few matters (i.e. she is looking into permit jurisdic- tion involving the Department of Environmental Regulation, Army Corps of Engineers, etc.). REPORTS - TOWN MANAGER The Town Manager advised that, regarding the Drexel matter discus- sed under the Town Attorney's Report, the Commission will have to take action at the October Regular Meeting to direct the counter- proposal be submitted to Drexel Investments. Town Manager Mariano, giving an up-date on the Fire/Rescue Advi- sory Board Meeting regarding the assessment method, noted they have been working on the ERU. It is felt that, when everything is settled, a favorable response will be received with regard to changing the assessment method. A concensus was reached to write to the County Board of Commissioners as to the Town's dissatis- faction in the budgeted amount this year as well as to urge the continuance of their support in amending the assessment methodology. The Town Manager noted "Making Strides Walk" for the American Cancer Society is scheduled for October 17, 1992; it is a five mile walk for the purpose of raising funds for cancer research. The Town will be walking in honor of our Police Officer Frank Mencik who is recovering from cancer surgery. r'1 U s .. .~ -.
