Minutes of Meeting of Town Commission
SPECIAL WORKSHOP MEETING
Tuesday, October 27, 1992 9:30 a.m.
Mayor Joseph A. Boulay called the Special Workshop Meeting of the
Town Commission of the Town of Highland Beach, Florida, to order
in the Commission Chambers at Town Hall at 9:30 a.m. Others in
attendance were Commissioners Arlin Voress, Arthur Eypel, and
John F. Rand. Vice Mayor Bill Paul was absent.
Also present were Town Attorney Thomas E. Sliney, Town Manager
Mary Ann Mariano, Town Clerk Anne M. Kowals, several Charter Re-
view Board Members, as well as members of the general public.
Noting this Special Workshop Meeting was called for the purpose of
reviewing the proposed amendments to the Town Charter (submitted
by the Charter Review Board) and acknowledging the presence of
Charter Review Board Chairman Ray Murphy and several other Charter
Review Board Members, the Mayor advised copies of the proposed
amendments (redlined in the old Charter) have been distributed to
Commission Members.
Town Attorney Sliney, noting the Charter has been redlined to
. reflect the proposed amendments, advised it is just a matter of
the Commission going through each proposed change. The Town
Attorney stated the Charter Review Board Members present may wish
to embellish on why changes were recommended.
Charter Review Board Chairman Ray Murphy advised Members consid-
ered English as well as compacting articles so they would not be
listed in different articles in an effort to up-date the Charter.
The Town Attorney advised he will review the State Statutes to
determine the seven catagories that would require a referendum to
effect Charter changes. He further advised most amendments may be
adopted by ordinances which he would have recorded. Noting a lot
of the changes were proposed merely for 'clean-up' or because time
has passed and certain Charter items were no longer applicable;
Attorney Sliney stated there are no substantive changes proposed.
The Commission reviewed each proposed amendment. Substantial de-
liberation ensued with regard to Section 1.06 - Sub-section (3)
regarding term limitation. It was noted the Charter Review Board
held lengthy discussion at four monthly meetings regarding this
matter. Further, it was noted that Charter Review Board Members
conducted a poll of Town citizens residing in single family homes

and condominiums to get an idea as to the feeling of the general
public regarding term limitation prior to final consideration of
the Board's recommended amendment. It was the consensus of the
Town Commission to give this matter further thought and, perhaps,
prior to the November Commission Workshop Meeting when the pro-
posed Charter amendments will be up for additional discussion, the
Commissioners will conduct individual polls to determine the wish
of the residents regarding term limitation.
Under discussion of Section 1.06 - Sub-section (4), Town Manager
Mariano cited the second sentence of the paragraph which reads
"Such person may or may not be a resident of the town." It was
the consensus to delete this second sentence therefore said
section will now read:
(4) The commission shall designate by resolution some quali-
fied person to serve as town clerk.

With regard to Section 2.01 - Sub-section (9), following brief
discussion, it was agreed to have this section amended to read as
follows:
(9) Public water. To provide the town with a supply of water
for public purposes and to sell at fees approved by ordi-
nance, by waterworks etc.
Following completion of review of the proposed Charter Amendments
by the Town Commission, it was the consensus to include this
matter on the November Workshop Meeting Agenda for further
discussion.
The Mayor, on behalf of the Town Commission, extended thanks to
all Charter Review Board Members for their efforts in conducting
and completing their review.
COMMISSIONER RAND/COMMISSIONER VORESS MOVED to adjourn the Special
Workshop Meeting of the Town Commission. Same was adjourned by
Mayor Boulay at 11:00 a.m.
