Minutes of Meeting of Town Commission
REGULAR MEETING
Wednesday, November 04, 1992 1:30 p.m.
The Regular Meeting of the Town Commission of the Town of Highland
Beach, Florida, was called to order at 1:30 p.m. in the Commission
Chambers at Town Hall by Mayor Joseph A. Boulay. Others present
were Vice Mayor Bill Paul, Commissioners Arlin Voress, Arthur
Eypel, and John F. Rand.
Also in attendance were Town Attorney Thomas E. Sliney, Town
Manager Mary Ann Mariano, Town-Clerk Anne M. Kowals, and members
of the general public.
Following the Pledge of Allegiance, the roll was call.
ADOPTION OF AGENDA
The Commissioners adopted the agenda as written.
APPROVAL OF MINUTES
The following Town Commission Meeting Minutes were submitted for
approval:
September 29, 1992 - Workshop Meeting
October 06, 1992 - Regular Meeting
The MOTION by COMMISSIONER RAND/COMMISSIONER VORESS to adopt the
above Minutes as submitted carried without objection.
PUBLIC COMMENTS AND REQUESTS
No individual addressed the Town Commission at this time.
REPORTS - TOWN COMMISSION
Vice Mayor Bill Paul
No report.
Commissioner Arlin Voress
Commissioner Arlin Voress congratulated the residents who came out
to vote in the General Election on November 03, 1992. It was
noted the Town had a better than 90$ voter turn-out.

Commissioner Voress reported Town Manager Mary Ann Mariano, Utili-
ties Director Jack Lee, and he reviewed a report submitted by the
Town's Engineers, J. M. Montgomery, regarding the Wastewater Col-
lection System Study relating to the sewer and collection systems
for the Town. Some changes of the draft copy were made; however,
it was noted that our system is in pretty good shape with few
areas requiring attention (i.e manholes were low). Also noted was
the fact that there is some indication down-spouts (which are not
permitted to drain into the sewer system) are in fact draining
into our sewer system; therefore, the Town's Utilities Department,
along with our outside Utilities Contractor Earl Harvel, will look
into this concern.
Commissioner Voress further reported that South Florida Water
Management District served notice to the Boca Teeca Country Club
to shut well no. 4 which is adjacent to our wellfield (used for
irrigation purposes only) located west of the railroad tracks in
Boca Raton. Said well will be shut down soon; that will put less
of a load on that cone of water and will stop the movement of salt
water towards our wellfield.
Commissioner Arthur Eypel
• Commissioner Arthur Eypel, under his report, proposed a Resolution
(copies of which he distributed to the Commissioners) authorizing
the Chief of Police to initiate the rank of Technical Sergeant and
to elevate Officer Frank Mencik to that position in appreciation
of his endeavors to provide the best possible Police Services for
our Town. Following reading of said Resolution by Commissioner
Eypel, COMMISSIONER VORESS MOVED to adopt the Resolution as pro-
posed by Commissioner Eypel. VICE MAYOR PAUL SECONDED the MOVE.
which received unanimous approval.
Officer Mencik addressed the Commission noting this honor came as
a surprise; he extended thanks to all involved and stated he could
not have accomplished a thing without the help of Chief Cecere and
Town Manager Mariano. Noting the Chief is the best, Officer
Mencik, once again, thanked the Commission. At this point, Com-
missioner Eypel presented Officer Mencik with a badge designating
his new rank.
Commissioner John F. Rand
Commissioner John F. Rand, commenting with regard to the General
Election on November 03, stated we should support President Bush's

appeal to support our new President and give our cooperation and
assistance.
Commissioner Rand reported an invitation was extended to him by
the Sun Sentinel to attend an 'Editorial Board Meeting' this past
Monday. The Commissioner accepted the invitation and noted said
meeting was very informative, intersting, and fascinating; it
explained how topics are brought up and placed as an editorial
item.
Mayor Joseph A. Boulay
Mayor Joseph A. Boulay, alluding to his report at the October
Workshop Meeting regarding a request for permission to conduct a
survey concerning a means of providing transportation to shopping
malls for residents at no cost to the Town, advised approximately
500 signatures supporting this effort were collected. The Mayor
stated he would like to go forward, pursue this matter, and
approach bus services to provide such transportation in Town. It
was noted this will not cost the Town money nor will it cause any
traffic problems in Town. The Mayor advise the company providing
transportation will be invited to Government Day where they will
have an exhibit explaining their full service to the general
S public. It was noted such service would prevent residents from
falling prey to unscrupulous providers of transportation who are
not fully insured.
Noting the great turn-out of voters for the General Election, the
Mayor thanked the Police Department for a job well done in handl-
ing the parking situation.
REPORTS - TOWN ATTORNEY
Town Attorney Thomas E. Sliney had no report.
REPORTS - TOWN MANAGER
Town Manager Mary Ann Mariano, citing a prepared statement read
into the record by Mr. Victor Hadeed at the October Workshop Meet-
ing, advised it would be appropriate for the Commission to direct
the Planning Board to look into the matter regarding the zoning
code. Noting the Planning Board will be provided with necessary
expertise through our Land Planning Engineers, the Town Manager
advised the Planning Board would, following their complete review,
submit their recommendations to the Town Commission for considera-
tion. It was the consensus to direct the Planning Board to review
this matter.

Town Manager Mariano reported she appeared before the County Board
of Commissioners at their October 27, 1992 meeting with regard to
the matter of Fire/Rescue Service Fees; said matter is a continu-
ous discussion. The Fire/Rescue Advisory Board which the Town
Manager Chairs, will again look at the matter and reassess the
situation before they go back to the County Board of Commissioners
with their recommendation regarding the method of assessing Fire/
Rescue Fees.
REPORTS - BOARDS AND COMMITTEES
Mayor Boulay noted the scheduled meeting of the various Town
Boards and Committees as well as the vacancy that will occur on
the Board of Adjustment as of December O1. COMMISSIONER RAND
MOVED to nominate Mr. Neil Burd to a three year term on the Board
of Adjustment as of December O1, 1992. The MOVE was SECONDED by
COMMISSIONER VORESS who noted he spoke with Board of Adjustment
Chairman Harold B. Cohen who stated he would welcome this nominee
to the Board of Adjustment. Said MOVE received all "AYE" votes.
Mr. Neil Burd, in the audience, addressed the Commission to accept
the nomination and noted his gratification regarding the Commis-
sioners' confidence.
PROPOSED ORDINANCES AND RESOLUTIONS
1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
PROVIDING FOR UNTILITY RATES, FEES AND/OR CHARGES,
SPECIFICALLY AMENDING HIGHLAND BEACH CODE SECTION 11-13
OF CHAPTER 11, RELATING TO GARBAGE, TRASH AND RECYCLING
CHARGES.
The ordinance, given first reading on 10/06/92 and published on
10/16/92, was read by title by Mayor Boulay. Following brief
deliberation, MOTION by COMMISSIONER RAND/VICE MAYOR PAUL to adopt
the ordinance as proposed received unanimous approval with each
Member casting an "AYE" vote.

During brief discussion regarding pick up of 'vegetative waste',
which is to be kept separate from garbage, Commissioner Voress
noted there is a problem with the 'vegetative waste' if it is
placed in plastic bags. The Commissioner suggested a warning
regarding the need to keep the 'vegetative waste' separate be
included in the next Town Newsletter.
2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
AMENDING CHAPTER 9, ENTITLED "FIRE PREVENTION AND
PROTECTION" TO INCLUDE FEE REQUIREMENTS THEREIN;
PROVIDING FOR CODIFICATION.
