MINUTES OF TOWN COMMISSION MEETING
WORKSHOP MEETING
Tuesdav, April 25, 1995 1.30 P M
Mayor Arlin G. Voress called the Workshop Meeting to order in
Commission Chambers at 1:30 P.M.
Town Clerk Doris Trinley called the roll. The Mayor, Vice Mayor
Bill Paul and Commissioners Arthur Eypel, David Augenstein and John
F. Rand were present.
Town Manager Mary Ann Mariano, Town Attorney Thomas E. Sliney and
members of the general public were also in attendance.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
The Agenda was accepted as submitted upon MOTION by COMMISSIONER
AUGENSTEIN/COMMISSIONER EYPEL.
95.1 PUBLIC COMMENTS AND RE UESTS

DEMONSTRATION OF A.E.D (AUTOMATIC ELECTRONIC DEFIBRILLATION)
EQUIPMENT BY DELRAY BEACH FIRE/RESCUE
Initiated by Commissioner John F. Rand and arranged by Delray Beach
Fire/Rescue EMS Division Chief Douglas Trawick, a demonstration of
a portable Automatic Electronic Defibrillation (A.E.D.) machine was
given by Rick Rogers, a representative of Airmedic, Inc., the
manufacturer. Commissioner Rand had previously asked for
consideration of the addition of this type of machine to the fire
engine truck now being built for the Town as an emergency back-up
to the more sophisticated monitoring equipment on the fire rescue
vehicle. It would be used in those circumstances where the
fire/rescue vehicle was not available (on another call, refueling
out of Town, etc.). However, the fire/rescue truck would still be
notified to respond.
After the demonstration, Mr. Rogers answered questions posed by the
Commission, Among his remarks, he stated that although the
technology has been available for 8-10 .years, this particular
device was relatively new on the market; the machine would require
very little training of personnel in that it is a "smart" machine
which gives step-by-step directions; its lead-acid batteries have
a life of 2-3 years and need only be swapped out and recharged once
. a month; the machine is self-diagnostic and keeps a record of the
analysis given for a particular patient, which is stored on a disk

in the unit and can be translated via computer. Mr. Rogers also
stated the unit meets American Heart Association standards and
would entail a one-time cost of $2800.
Answering questions addressed to him, Division Chief Trawick said
there were not now any of these devices on Delray's engine trucks;
however, they were looking to install the machine on all these
trucks through a budget request. He also said that a similar
machine, suitable to a marine environment, was being considered for
lifeguard use.
At the suggestion of Commissioner Rand, and with no objection, this
item will be placed on the May 02, 1995 Regular Meeting Consent
Agenda.
93.8 DISCUSSION RE ADELPHIA CABLE
Attorney Cormac Conahan's response, on behalf of the Town, to
Adelphia Cable's proposal was duly noted. However, in order to
give individual Commission members time to review and comment, Town
Attorney Tom Sliney suggested that further discussion be postponed
until the May 1995 Workshop, at which time Attorney Conahan will be
• present to receive the Commission's input.
95.2 BOARDS AND CO1~II~IITTEES
Mayor Voress noted there were no Board vacancies at this time.
He then read into the record a memorandum received from Thomas J.
Reid, Chairman of the Financial Advisory Board, relating that a
preliminary report regarding their study of reserve funds will be
forthcoming by mid-June, with a final report available by
September.
95.3 PROPOSED ORDINANCES AND RESOLUTIONS
There were no ordinances or resolutions to be considered.
94.7 DISCUSSION RE LIBRARY FOUNDATION
Substantial discussion of the proposed Library Foundation took
.place, with the Commission addressing each item listed in the Town
Attorney's letter to them regarding the information he needed to
move the documentation of the foundation forward. Among other
points, it was agreed that the purpose of the proposed foundation
was to raise funds in support of the Library only rather than a
general charitable foundation of the Town, the name agreed upon
being the Highland Beach Library Foundation, Inc. Among other
items discussed were the number of those to serve (including staff
. and residents), locale of meetings, staggered terms and term
limitations. It was further agreed that annual meetings should be

held at the beginning of the Town's fiscal year budgetary process
so any monetary considerations could be included in that process.
Mr. Sliney will draw up an initial draft of the necessary
documents, incorporating the information agreed upon.
MISCELLANEOUS - ITEMS LEFT OVER
The Status of Building Development in Town, a report supplied by
the Building Official, was accepted as information.
Four (4) sets of Meeting Minutes (March 28 Workshop and Special;
April 04 Regular and Special) were moved to the May 02 Regular
Meeting Agenda for consideration and possible approval.
REPORTS - TOWN COMMISSION
Neither Vice Mayor Bill Paul nor Commissioner David Augenstein had
a report for this meeting.
Commissioner Arthur Eypel requested an update from Town Manager
Mary Ann Mariano regarding real estate companies being advised of
the new requirements for real estate signage per the adoption of
• new Chapter 23 (Signs and Advertising) on April 4. Ms. Mariano
reported that the Building Official had sent letters to each of the
realty associations and to current permit holders advising of the
changes and including, for those now advertising in Town, that
there would be a 60-day grace period to come into compliance with
no re-permitting fee being charged.
Referring to the recent and huge quantities of tar washed up on our
beach due to an off-shore pumping of bilge oil into the ocean, the
Commissioner asked if any clean-up coordination had been started.
Ms. Mariano replied that those who had called to volunteer services
in this regard were asked to contact Jose Echeverria, who
coordinates the Town's on-going beach clean-up.
It was the consensus that a notice regarding this incident be aired
on Channel 12, advising residents that the Town is well aware of
the situation and has been in touch with county and state agencies
in an effort to coordinate clean-up; in the meantime, beachgoers
should take precaution and be prepared for tar removal.
Commissioner John F. Rand noted the Settlement of Litigation
reached on April 21 regarding the Milani property. Although it had
been emphasized during the Public Hearing/Special Meeting, and
agreed to at that time by the Milani attorney, the Commissioner
felt a letter from our Town Attorney, reiterating in writing that
the Town had no jurisdiction over any property located east of the
. Coastal Construction Control Line, be sent to the appropriate
parties.

• Mayor Arlin Voress thanked the Town Manager, Town Attorney and
Commissioner Augenstein for their efforts in bringing the Milani
suit to settlement, verifying with the Town Attorney that there is
now only one suit left against the Town. The Mayor thanked his
fellow Commission members for their efforts in bringing these
various suits to settlement and congratulated their success.
Referring to Commissioner Rand's remarks regarding the CCCL and the
Milani settlement, Mayor Voress asked Attorney Sliney to follow up
on this matter. Mr. Sliney said he would send a copy of the
Meeting Minutes, which would reflect the Town's position regarding
the CCCL, after they are approved.
REPORTS - TOWN ATTORNEY
Town Attorney Thoatas E. Sliney had no report.
REPORTS - TOWN MANAGER
Town Manager Mary Ann Mariano reported on the award she had
accepted on the Commission's behalf for the Town's "Pearls of
Survival" hurricane booklet, which she received at the National
Hurricane Conference held recently in Atlantic City. She read the
text of the plaque into the record and again thanked the Commission
for their funding and support.
Ms. Mariano said she was awaiting written quotes for the trimming
of almost 200 town trees. She advised this had not been done for
quite a few years, with the exception of the ones that were put
back in place after this past winter's severe storms, and with the
hurricane season starting soon, it was a matter of safety that
heavy winds be allowed to pass through branches.
Regarding safety deposit boxes where original ordinances and other
important documents of the Town must be stored, Ms. Mariano advised
that due to securing a better yearly rate for same, there will be
a change in banks for this purpose. She asked that this be put on
the Consent Agenda for the May Regular Meeting; there was no
objection.
Because the collection rates for garbage, trash and recyclables
must go through the ordinance process after approval for an
upcoming fiscal year budget, Ms. Mariano advised the rates as
codified in the Town Book are always necessarily a year behind. T ~~.r.
remedy this situation, she suggested that the rates be approved
Resolution, rather than Ordinance. There being no objection, s
said a draft ordinance to repeal this section (24.13 of Chapter 24
"Solid Waste") would be available for first reading at the May
Regular Meeting.
Substantial discussion followed Ms. Mariano's request for guidance
. regarding language to be used on signs reminding residents to clean
up after their animals, which was previously addressed at the March
Workshop Meeting. It was ultimately agreed to delay posting these

• signs for 2-3 months to see if stricter enforcement of the Town's
ordinance on this subject by the Police Department might bring the
situation under control.
There being no further business to come before the Board at this
time, the meeting was adjourned at 2:50 P.M.
