Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesday, January 25, 1994 1:30 .m.
The Workshop Meeting of the .Town Commission of the Town of
Highland Beach, Florida, was called to order in the Commission
Chambers at Town Hall at 1:30 p.m. by Mayor Arlin Voress. Others
present were Vice Mayor Bill Paul, Commissioners Arthur Eypel,
John F. Rand, and David Augenstein.
Also in attendance were Town Attorneys Thomas E. Sliney and Cormac
C. Conahan, Town Manager Mary Ann Mariano, Town Clerk Anne M.
Kowals, CMC, Adelphia Cable's Director of Government and Community
Affairs Chuck Blaine, Adelphia Cable Representative Doug Bennett,
Ms. Marina Chaney of the Boca Junior League, Mr. Michael Walsh and
Attorney Margaret Cooper representing Ocean Properties, and inter-
ested members of the general public.

No individual addressed the Town Commission under Public Comments
and Requests.
93.8 Discussion re Adelphia Cable
Mayor Voress requested Attorney Cormac Conahan lead the discussion
regarding Adelphia Cable.
Town Attorney Conahan, acknowledging receipt of a draft document
submitted by Adelphia Cable late last week, briefed the Commission
with regard to the status of the cable renewal procedure, request-
ed by Adelphia Cable, which resulted in the advertised public
hearing of August 31, 1993. During discussion, Adelphia Repre-
sentative Chuck Blaine touched on additional channel capacity,
franchise fees, gross revenues, customer service standards,
franchise term, etc. Noting the Commission did not have the
opportunity to review the draft document, it was the consensus to
schedule this matter for the next Workshop Meeting to allow
Members to study Adelphia's submittal and offer their personal
comments/responses, as well as obtain input from residents, which
information will then be transmitted to Adelphia. Town staff and
Adelphia will negotiate the issues; Adelphia will then prepare a

draft proposal for consideration by the Commission. Attorney
Conahan advised the Commission has at least a four month window to
iron out their concerns relating to the cable franchise. This
matter will be an agenda item for the Town Commission Workshop
Meeting set for February 22, 1994.
Discussion re Boca Junior League sign request
Ms. Marina Chaney of the Boca Junior League was advised their
request for a temporary sign at the Designer Showhouse should
identify the property as a Junior League project and the size of
said sign requires modification. It was the consensus to place
this matter on the February O1, 1994, Regular Meeting Agenda for
further discussion and possible approval.

BOARDS AND COMMITTEES
Mayor Voress, noting the resignation of Daniel C. Stump effective
02/01/94 creates a vacancy on the Board of Adjustment, requested
Members review the current Talent Bank Applications on file and
give consideration to filling said vacancy at the February Regular
Meeting.
. It was noted no correspondence was received from any Town Advisory
Boards or Committees.
94.3 PROPOSED ORDINANCES AND RESOLUTIONS
No proposed ordinances/resolutions were on the agenda for
consideration.
94.4 Discussion re Newsletter
During lengthy discussion regarding the frequency of the Town
Newsletter, noted were the facts that a minimum of three issues
per year is important and there are certain times of the year when
everyone is interested in what is going on in Town at which time
an additional Newsletter may be necessary. It was requested the
Town Manager review an annual calendar of events and submit a
proposal for frequency of the Newsletter for consideration by the
Town Commission.
94.5 Discussion re Gee & Jenson Scope of Services
The Commission reviewed the Town Manager's Agenda Report Form
regarding the Gee & Jenson proposed scope of services to profes-
sionally evaluate the present and future needs of the Town's
Administrative Complex, Public Safety, Maintenance, and Library

fiscal year budget. Following discussion, it was the consensus to
move this matter to the February Regular Meeting Consent Agenda to
approve scope of services 1 through 6 only at a cost not to exceed
$10,000.00 and to nominate the Town Manager as the designee for
this matter.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
The Commission reviewed the Status of Building Development in
Town, a report submitted by the Building Department.
Minutes for approval at February 1994 Regular Meeting
Minutes of the December 28, 1993, Workshop Meeting and January 04,
1994, Regular Meeting were reviewed and moved to the February
Regular Meeting Agenda for possible approval.
REPORTS - TOWN COMMISSION
Vice Mayor Bill Paul
• Vice Mayor Bill Paul had no report today.
Commissioner Arthur Eypel
Commissioner Arthur Eypel had no report this date.
Commissioner John F. Rand
Commissioner John F. Rand, a volunteer for the tax form prepara-
tion program sponsored by AARP, urged residents to use this free
service to file their tax forms. The Commissioner advised a
listing of the time schedules and locations will be given to those
interested in taking advantage of this no cost service which is
available from February O1 through April 15.
The Commissioner reported, as a member, he attended a meeting of
the Medicare, Part B, Beneficiary Advisory Council, sponsored by
Blue Cross Blue Shield of Florida where a videotape alerting
persons to the many Medicare scams was viewed. Stressing the
need for all to guard their medicare number/data, Commissioner
Rand suggested arrangements be made to run said videotape on the
Town's Government Channel 12 for benefit of our residents; the
date and time will be announced when the 30 minute videotape is
made available to the Town.

Commissioner David Augenstein
Commissioner David Augenstein cited an article in the City of
Delray Beach Publication advising that Delray Beach received its
second improved fire protection classification in less than a year
for continued improvements to its fire defense system. The Com-
missioner noted he requested the article be posted on the bulletin
board in his condominium and suggested other condominiums do
likewise.
Mayor Arlin Voress
Mayor Arlin Voress reported the Town filed a formal notice with
the Lake Worth Drainage District requesting an economic impact
statement for Highland Beach resulting from the sugar industry's
contamination of the ponds which have been classified as water
treatment ponds.
The Mayor, noting the completion of a review of the wells in our
wellfield to determine how the chlorine is running, stated the
Commission will continue to be advised regarding this issue.
REPORTS - TOWN ATTORNEY
• Town Attorney Thomas E. Sliney, acknowledging receipt of a letter
from Ocean Properties' Attorney Margaret Cooper regarding the
Highland Beach Holiday Inn concerning Chapter 30, Section 6.4 (f)
of the Town Code relating to nonconforming uses of land, suggested
the Planning Board review this matter and transmit their recom-
mendations to the Town Commission where appropriate action will
then be taken.
It was noted Attorney Cooper and Ocean Properties will be notified
of any meetings/public hearings, etc., scheduled to address this
issue. During discussion, when Mr. Michael Walsh of Ocean
Properties stated their 'lenders' expressed concern regarding the
above cited section of the Town Code, Town Attorney Sliney stated,
for the record, "nobody ever tried to enforce anything on your
property"; the Town Attorney advised Mr. Walsh can represent to
the 'lenders' the Town is in the process of addressing the matter.
REPORTS - TOWN MANAGER
Alluding to Commissioner Augenstein's report, the Town Manager
noted only commercial properties will realize a financial gain as
a result of the second improved fire protection classification
awarded to the Delray Beach Fire Defense System.
• Town Manager Mary Ann Mariano reported Lift Station No. 1 was
renovated and the chlorine room received a face-lift.

Town Manager Mariano noted 'candidate qualifying' for the March
08, 1994, Municipal Election, commenced this date at noon and runs
through Tuesday, February 08, 1994, at noon.
The Town Manager advised she will attend a meeting tonight at Boca
Del Mar where Mr. Irving Cure, County Commissioners McCarty and
Aaronson will discuss a 'smaller' bus service for that area.
Noting it is 18 months since Hurricane Andrew hit South Florida,
Town Manager Mariano requested approval for Police Chief Cecere,
Mayor Voress and the Town Manager to attend a hurricane prepared-
ness seminar scheduled for March 08 thru 11; the Town's hurricane
preparedness plan will then be amended accordingly.
ADJOURNMENT
There being no further business to come before the Town Commission
at this time, Mayor Voress, upon proper MOTION, adjourned the
Workshop Meeting at 2:50 p.m.
