Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, February 22, 1994 1:30 p.m. Mayor Arlin Voress called the Workshop Meeting of the Town Commis- sion of the Town of Highland Beach, Florida, to order at 1:30 p.m. in the Commission Chambers at Town Hall. Also present were Vice Mayor Bill Paul, Commissioners Arthur Eypel, John F. Rand, and David Augenstein. Others in attendance were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, and members of the general public. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The Agenda, amended by moving the ANNUAL REPORT by Utilities Director Jack Lee to a position preceeding Agenda Item 94.1 (Public Comments and Requests), was unanimously approved as amended. ANNUAL REPORT to be presented by Utilities Director Jack Lee Mayor Voress, noting the Highland Beach Utility Department (manned • by certified operators 24 hours a day, seven days a week) runs the water treatment plant, the sewer system, does work relating to our engineers, our wellfields, meter reading, etc., requested Jack Lee make his presentation at this time. Utilities Director Jack Lee presented the Annual Report outlining the accomplishments of the Utilities Department during 1993 which included the rebuilding of well #7; installation of a new transfer pump at the water treatment plant; removal of Australian Pine trees that, as a result of Hurricane Andrew, were resting on the hydro-tank at the plant; the water lines received free-chlorine twice in 1993, a lime slaker was purchased for the water plant as was a motor boat to cross the Intracoastal Waterway if the depart- ment's staff has to get to the island to operate the emergency generator for the high service pumps during a natural disaster (i.e. hurricane); the lead and copper samples taken from 20 residences were tested with follow-up samplings required of a few participants having been taken; all generators have been serviced; a new electrical panel was installed at lift station #4; a 14" clamp for the existing Intracoastal Waterway pipeline was obtained for use if a repair is necessary; a pre-construction meeting was held with Curry Control regarding the telemetry system for the water plant. During the presentation, it was noted the Town had provided water to Boca Raton by way of the emergency interconnect when that City experienced a break in its water line. Mr. Lee stated the break was quickly repaired. Town Commission Workshop Meeting Minutes February 22, 1994 • Page 2 of 5 94.1 Public Comments and Requests Mr. Steve Bell of 4318 South Ocean Boulevard, noting the Boca Junior League Designer Showcase runs through February 27 and cit- ing numerous problems resulting from this much too lengthy (17 days) charitable fund raising event in Town, stated he does not want the Town deciding what charity he will be contributing to. Mr. Bell, further noted an existing problem regarding the public not being informed of the Town Ordinance requiring owners to 'pick-up' after their pets, suggested the Town educate citizens relative to this matter. During discussion, it was noted a code enforcement officer has to witness a violation of an ordinance in order to enforce the law. Commissioner Rand, alluding to Mr. Bell's comments, stated the Designer Showcase was too long, the Town is too small to handle such an event and, in the future, the Commission will weigh such requests more carefully. Relative to the pet problem, the Commis- sioner, noting the ordinance on the books should be enforced or repealed, stated it is not merely a matter of education--it is a matter of pet owners' having consideration for their neighbors. . The Mayor, noting the proceeds from the Designer Showcase will benefit an outreach program dealing with underprivileged children, juvenile delinquency, drug programs, etc., advised the Town will see to it that areas damaged by the valet parking will be restored to their original condition and requested residents be patient until the event is over. Noting much money is going to a good cause, the Mayor stated, should there be a next time, he would consider such request carefully. Regarding the problem with dog walkers failing to clean up the waste of their pets, Mayor Voress stated information concerning this matter will be placed on the government channel. At this time, Commissioner John F. Rand left the Workshop Meeting to keep a medical appointment. 93.8 Discussion re Adelphia Cable During brief discussion of this matter, it was the consensus to carry this item to the March Workshop Meeting. The Town Manager advised no written draft proposal was received from Adelphia. 94.2 Boards and Committee Mayor Voress, noting Board of Adjustment Chairman Harold B. Cohen is eligible for reappointment when his term expires this month, stated the Chairman advised he would like to be considered for reappointment. It was the consensus to place this matter on the March O1 Regular Meeting Agenda for consideration. Town Commission Workshop Meeting Minutes February 22, 1994 • Page 3 of 5 It was noted no correspondence was received from any Town Advisory Boards or Committees. 94.3 Proposed Ordinances and Resolutions 1. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, DECLARING THE ELECTION TO HAVE BEEN HELD ON THE 08TH DAY OF MARCH, 1994, TO BE UNNECESSARY SINCE THE ONLY CANDIDATES WHO QUALIFIED ARE UNOPPOSED. The resolution, read by title only by the Town Clerk, was briefly discussed and moved to the March O1 Regular Meeting for approval. 94.4 Discussion re Newsletter The Commission reviewed the Town Manager's Memorandum suggesting the Town Newsletter be prepared and distributed following the March, July, and November Workshop Commission Meetings. Following acceptance of the Town Manager's suggestion, the Commission noted this does not preclude the Town from sending out an additional newsletter when necessary. MISCELLANEOUS - ITEMS LEFT OVER • Status of Building Development in Town Members received and reviewed the 'Status of Building Development in Town' and the 'Year end Building Department Activity Report for 1993' submitted by the Building Department. Minutes for approval at March 1994 Regular Meeting It was the consensus to move the two sets of Town Commission Meeting Minutes to the March O1 Regular Meeting for consideration. REPORTS - TOWN COMMISSION Vice Mayor Bill Paul Vice Mayor Bill Paul had no report this date. Commissioner Arthur Eypel Commissioner Arthur Eypel reported, at the recent Palm Beach Countywide Beaches and Shores Meeting, there is an on-going debate regarding replenishing of public beaches; the Commissioner will transmit any additional information regarding this issue, as it is received, to his associates. n l_J Town Commission Workshop Meeting Minutes February 22, 1994 Page 4 of 5 n LJ Commissioner John F. Rand Commissioner John F. Rand was not present during the latter part of the Workshop Meeting. Commissioner David Augenstein Commissioner David Augenstein reported the bicycle 'warning sign' posted in the Boca Highland area has, once again, been knocked down. The Commissioner was pleased to report a survey has commenced to determine if computer system up-grading in Town Hall is necessary; and, up-grading of the phone system as well as the fax system be considered. With regard to the B & C sites at Boca Highland, Commissioner Augenstein advised the Williams residence is nearing final stages; the two remaining lots have been sold and buildout should follow soon. Mayor Arlin Voress Mayor Arlin Voress, noting resident Steve Bell discussed issues he planned to address, reported the Florida Supreme Court issued a decision that does not allow the County Board of Commissioners to dictate what municipalities are permitted to do (i.e. cutting of seagrapes, etc.). REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney reported U. S. Senator Bond and U. S. Congressman Backus are sponsoring a new bill with regard to flood insurance; said bill is much friendlier to property owners in the reported flood zone. REPORTS - TOWN MANAGER 1. Legislative Priorities Packet Town Manager Mariano's memorandum of February 18, 1994, regarding the Legislative Action Day on March 23, 1994, in Tallahassee was discussed; the Commission approved the proposed action in terms of opposition or support for each item listed in the Town Manager's Legislative Priorities Packet. ~ } Town Commission Workshop Meeting Minutes February 22, 1994 • Page 5 of 5 Following the completion of all agenda items, Mr. Leonard Bell of 2727 South Ocean Boulevard, noting he has been thinking about resident Steven Bell's comments presented under Public Comments and Requests regarding the Designer Showcase Program in progress in our Town until Sunday, February 27, 1994, urged the Commission to "dimensionalize" their thinking when a similar request is proposed.
