1994.03.01_TC_Minutes_Regularf` ~ ^ ~ TOWN OF HIGHLAND BEACH, FLORIDA • Minutes of Meeting of Town Commission REGULAR MEETING Tuesday, March O1, 1994 1:30 p.m. Mayor Arlin Voress called the Regular Meeting of the Town Commis- sion of the Town of Highland Beach, Florida, to order at 1:30 p.m. in the Commission Chambers at Town Hall. Others present were Vice Mayor Bill Paul, Commissioners Arthur Eypel, John F. Rand, and David Augenstein. Also in attendance were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, Mr. Chuck Haas and Ms. Wendy Douglass representing Haas, Dias & Co., the Town's Auditors, and members of the general public. Following roll call, the Pledge of Allegiance was given. ADOPTION OF AGENDA MOTION by COMMISSIONER RAND/COMMISSIONER EYPEL to adopt the Agenda as submitted received unanimous approval. • APPROVAL OF MINUTES VICE MAYOR PAUL/COMMISSIONER AUGENSTEIN proposed a MOTION to approve the January 25, 1994, Workshop and February O1, 1994, Regular Meeting Minutes of the Town Commission. The MOTION was favorable to all. PUBLIC COMMENTS AND REQUESTS Mr. Alan Teller of 4210 S. Ocean Boulevard questioned who will pay to repair the lawns and sprinklers damaged as a result of the recent Designer Showcase event that occurred in Town. Noting a letter was received from the Boca Junior League stating they will restore the affected properties to their original condition, Town Manager Mariano advised the League's President is meeting with the Building Official and an irrigation technician tomorrow, March 02, to make an inspection of the area to determine what needs to be replaced and/or repaired. ANNUAL REPORT to be presented by HAAS & DIAZ Mr. Chuch Haas and Ms. Wendy Douglass of Haas, Diaz & Co., the Town's Auditors, presented the Annual Financial Report for fiscal Town Commission Regular Meeting Minutes March O1, 1994 • Page 2 of 4 year 1992/93 to the Commission. It was noted the Commissioners can call the Auditors' Office if they have any questions concern- ing the lengthy submittal. REPORTS - TOWN COMMISSION Vice Mayor Bill Paul - No report at this time. Commissioner Arthur Eypel Commissioner Arthur Eypel, under his report, alluding to the February Workshop Meeting when the Utilities Director presented a comprehensive Annual Report, noted the Town is fortunate to have Jack Lee operating the Town's Utilities Department. The Commissioner reported he will be attending the symposium for better local government to be held in the Village of Royal Palm Beach and the Ritz-Carlton Hotel April 21-22, 1994, and urged his colleagues to participate in this program. Commissioner John F. Rand Under his report, Commissioner John F. Rand, alluding to the • Workshop Meeting where the public commented regarding the recent Designer Showcase fund raiser, noted no one anticipated the large turn-out in support of the program; property damage occurred on the swale due to the soggy weather and valet parking which was made available to ticket holders who did not wish to be trans- ported by other means to the site. Noting the Town should request some satisfactory form of protection to cover any resulting damages, the Commissioner stated approval of any future exhibits in Town should be given more thorough consideration. Commissioner David Augenstein - No report at this time. Mayor Arlin Voress Mayor Arlin Voress acknowledged receipt of the Boca Junior League's letter of apology for the inconvenience and damage that occurred during the fund raising event; the letter advised any property that was damaged during this program will be restored to its original condition. The Mayor advised Congressman Clay Shaw's staff cancelled the meeting they initially scheduled for March 05, 1994, in the Highland Beach Town Hall at which meeting the Congressman was to discuss the issue of the 'Welfare Program'. R Town Commission Regular Meeting Minutes March O1, 1004 Page 3 of 4 REPORTS - TOWN ATTORNEY Attorney Thomas E. Sliney, noting a court order has been obtained by the Town to enforce the demolition of the condemned house on the ocean at the South end of Highland Beach, advised his col- league, Attorney Michael Gora, is working with the property owner regarding this issue. With regard to the Connaught Litigation, Attorney Sliney advised it is necessary to hold an advertised public hearing/special meet- ing on this matter. It was the consensus to schedule such meeting on Monday, March 14, 1994, at 9:30 a.m. The Town Attorney noted the required documents will be submitted to the Commission for review in advance of the scheduled meeting. At this time, Commissioner John F. Rand, noting the March of Dimes Walk-a-thon is set for Saturday, April 09, 1994, urged all to support this fund raiser as they have in the past. REPORTS - TOWN MANAGER Town Manager Mary Ann Mariano extended thanks to all who met with Gee & Jenson Engineer Tom Orlowski with regard to the evaluation of the needs of the Town's Administrative Complex. A written report including sketches is forthcoming and it is anticipated this matter will be on the Agenda for either the March or April Town Commission Workshop Meeting. The Town Manager acknowledged receipt of an award from the Solid Waste Authority for our outstanding recycling program; Highland Beach is the first municipality in the County to employ condo recycling without any problems. Based ae consensus of the Town Commission Bus Route along A-1-A. The Town Manager presented an up-date of the Legislative Priori- ties Packet discussed at the February Workshop Meeting. It was noted the municipalities are against the 'Presumptive Disease Bill' which would adversely affect a city's insurance coverage. The Town Manager stated the Commission will be advised of any additions that will be included in the Packet which is to be delivered to Tallahassee. ~ e Town Commission Regular Meeting Minutes March O1, 1994 Page 4 of 4 REPORTS - BOARDS AND COMMITTEES Mayor Voress, citing the scheduled meetings of the various Advi- sory Boards and Committees, noted the expiration of Board of Adjustment Chairman Harold B. Cohen's term was discussed at the last Workshop Meeting. VICE MAYOR PAUL/COMMISSIONER AUGENSTEIN made a MOTION to reappoint Harold B. Cohen to the Board of Adjust- ment for a three-year term. The MOTION received unanimous approval. PROPOSED ORDINANCES AND RESOLUTIONS 1. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, DECLARING THE ELECTION TO HAVE BEEN HELD ON THE 08TH DAY OF MARCH, 1994, TO BE UNNECESSARY SINCE THE ONLY CANDIDATES WHO QUALIFIED ARE UNOPPOSED. • Resolution No. 644 was read in its entirety by the Town Clerk. A MOTION by COMMISSIONER EYPEL/COMMISSIONER AUGENSTEIN to adopt the resolution received all 'AYE' votes.
