1994.03.29_TC_Minutes_Workshop TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, March 29, 1994 1:30 .m. The Workshop Meeting of the Town Commission of the Town of Highland Beach, Florida, was called to order at 1:30 p.m. in the Commission Chambers at Town Hall by Mayor Arlin Voress. Others in attendance were Vice Mayor Bill Paul, Commissioners Arthur Eypel, John F. Rand, and David Augenstein. Also present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, Redpath Invest- ment Corporation Representatives Stuart Wexelman, Norman Wexelman, Richard Rankin, Warren McCormick Associates' Landscape Architect Michael Sapusek, and members of the general public. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The Agenda, amended by Sites (Town Lots 2A N - following Item No. 94.1 accepted as amended. 94.1 PUBLIC COMMENTS • No individual addressed moving Item No. 94.5 "Discussion re B & C formerly Royal Cove)"to a forward position "Public Comments and Requests", was AND REQUESTS the Town Commission at this time. 94.5 Discussion re B & C Sites (Town Lots 2A N - formely Royal Cove) per request of Stuart Wexelman, President, Redpath Investment Corporation (Grand Bay Estates) At this time, the Commission addressed Item No. 94.5 regarding the Grand Bay Estates proposed for Town Lots 2A N (formerly Royal Cove) as per request submitted by Stuart Wexelman, President of Redpath Investment Corporation. Landscape Architect Michael Sapusek explained the Warren McCormick Associates (West Palm Beach) Landscaping Plans that include sign- age and placement of sales and construction trailers on the site. Town Manager Mary Ann Mariano, noting the Commission is being informed as to the proposed development of property that is under a 'Settlement Stipulation', advised the Commission will only be involved with the sales and construction trailers in the area. During lengthy discussion with regard to maintaining and preserv- ing the level of security presently enjoyed by the Boca Highland residents, it was noted Mr. Stuart Wexelman met with the Board of the Boca High Center to review the plans and address what will be • happening in the area and how security matters will be handled. Town Commission Workshop Meeting Minutes March 29, 1994 • Page 2 of 6 In the course of extensive deliberation when Mr. Wexelman stated he purchased the property, it was noted said property had been under 'foreclosure' and, inasmuch as there are many different uses involved in this matter, the Town Commission will require written, signed documentation regarding what the Center Board of Boca High- land had agreed to with Mr. Wexelman regarding access, North gate ownership, as well as copies of deeds relating to property owner- ship. Noting the Commission takes action at Regular Meetings only (no action taken at Workshop Meetings), Mr. Wexelman was advised the Commission will meet in Regular Session on Tuesday, April 05, 1994, at 1:30 p.m. Mr. Wexelman consented to submit the requested data and noted he will attend the scheduled Regular Meeting on Tuesday. 93.8 Discussion re Adelphia Cable When Mayor Voress questioned submitted by Adelphia Cable, munication was received from Cormac Conahan will write to when a response is received, accordingly. if any formal proposal had been Town Manager Mariano, noting no com- the Cable Company, stated Attorney Adelphia regarding this matter and, the Commission will be advised At this time, Commissioner David Augenstein presented his report inasmuch as it pertained to Adelphia Cable. Commissioner Augenstein noted, some months ago, the Commission was advised by Adelphia's Representative that the new head equipment acquired for Highland Beach would provide added capacity. The Commissioner, noting Adelphia's Channel Guide lists 43 channels, stated, due to several channels cloning each other, the actual total of channels available to Highland Beach subscribers is 31; cable service is the only service which allows our residents no choice. 94.2 BOARDS AND COMMITTEES Mayor Voress, noting there are no vacancies on the Town Advisory Boards and Committees, acknowledged receipt of a March 09, 1994, Planning Board memo regarding Chapter 30, Section 6.4 (f). Town Attorney Thomas E. Sliney stated an ordinance repealing the cited section will be given first reading at the April 05, 1994, Town Commission Regular Meeting at which time a public hearing will be scheduled for the purpos of further discussion and to obtain citizens' input regarding this issue. a Town Commission Workshop Meeting Agenda March 29, 1994 Page 3 of 6 Commissioner Rand, alluding to the March 09, 1994, Planning Board memo which affects the Highland Beach Holiday Inn, noted the enterprise has a low rating of two diamonds. Mr. Michael Walsh of the Holiday Inn advised the low rating, given by just one travel guide, does not reflect the level of service; it was due to the lock system presently in use at the hotel. Noting management has been renovating the hotel (i.e. new carpeting, draperies, etc.), Mr. Walsh advised they have committed to install an electronic lock system, at a cost of $200,000.00, before June O1, 1994. 94.3 PROPOSED ORDINANCES AND RESOLUTIONS There were no proposed ordinance and resolutions on the Agenda for discussion. 94.4 Discussion re 'Spring' Newsletter Mayor Voress, noting the Town Newsletter will be prepared three times a year, entertained comments regarding the draft copy of the 'Spring' Issue. Vice Mayor Bill Paul stated he hopes people pay attention to this Newsletter which includes information regarding the new, larger 'blue' recycling bins, the discontinuance on April 14 of the twice . weekly. recycling pick up, and the March of Dimes Walk-a-thon taking place in Town on April 9 which residents are encouraged to participate in and support this worthy cause. MISCELLANEOUS - ITEMS LEFT OVER Status of Building Development in Town The Status of Building Development in Town, a report submitted by the Building Department, was received and reviewed by the Commission . Minutes for approval at A ril 1994 Regular Meeting Three sets of Town Commission Meeting Minutes were reviewed and moved to the Regular Meeting Agenda for consideration. REPORTS - TOWN COMMISSION Vice Mavor Bill Paul Vice Mayor Bill Paul deferred his report to the Regular Meeting. Town Commission March 29, 1994 • Page 4 of 6 Workshop Meeting Minutes Commissioner Arthur Evpel Commissioner Arthur Eypel, noting Alternate Member Jane Raynor attended the last Palm Beach Countywide Beaches and Shores Council Meeting, advised he will present the report submitted by the Alternate Member. The Commissioner noted the Beachraker (a beach cleaning service) has received a permit from the County Environmental Resources Management, to continue working in the Town of Highland Beach; it is expected Universal Beach Cleaning will be following shortly. Commissioner Eypel reported briefly on the affects of the Port of Palm Beach 'sand transfer program' which has a great deal to do with the movement of sand towards the South. The Commissioner, citing an artificial reef project (Phase II) that successfully increases the amount of sand behind the area of the project, noted he would like to continue to monitor this program which would be of great interest to all on the coast. The Commissioner noted there are three levels of ordinances that regulate coastal areas: the State, the County ERM and DERM, and the Town. Noting the County ordinances were recently challenged • successfully, Commissioner Eypel stated he favors a system where local municipalities have a little more authority with regard to what happens within their Town and he will keep his colleagues apprised as he continues to monitor this matter. The Town Manager, alluding to a letter Mr. Richard Walesky of the Palm Beach County Environmental Resources Management submitted to Mr. Kirby Green of Florida Department of Natural Resources, Director of Beaches and Shores, requesting control over trimming of Seagrapes in coastal areas, advised the Commission Town staff has participated in a phone campaign to request all municipalities oppose such delegation of authority to Palm Beach County. Commissioner John F. Rand Commissioner John F. Rand, noting his associates have a tendency to look over papers during a meeting thereby creating sounds that interfere with the audio, requested the Commissioners not rattle papers when individuals are speaking. Commissioner David Auqenstein Commissioner David Auqenstein presented his report earlier in the meeting when a discussion regarding Adelphia Cable was in progress. Town Commission Workshop Meeting Minutes March 29, 1994 Page 5 of 6 Mayor Arlin Voress Mayor Arlin Voress, noting the March of Dimes Walk-a-thon will take place in Highland Beach on Saturday, April 09, with registra- tion commencing at 8:30 a.m., stated the event is being co-chaired by Ms. Jan Sheller and Ms. Marlis Sudbay. The Mayor reported Senator Kerry's National Flood Insurance Bill that would prevent some property owners from obtaining coverage was defeated while Senator Kennedy's bill, similar to Kerry's, was passed by the House but is expected to be opposed in the Senate. The Mayor noted it is believed this bill is now dead and the public will see a continuation of the National Flood Insurance as it is now known. Mayor Voress acknowledged a memo from Utilities Director Jack Lee regarding the need to rehabilitate the Town's Sewer System and requesting approval to engage a contractor, at an approximate cost of $63,000., to proceed with the necessary repairs. It was noted the Town's Comprehensive Plan requires the municipality to do whatever repairs and up-grades the system may require. Following discussion, it was the consensus to move this matter to the Regular Meeting Consent Agenda for consideration. • REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney reported a demolition permit was obtained for the abandoned structure at the South end of Town; the demolition will take place shortly. REPORTS - TOWN MANAGE Town Manager Mary Ann Mariano requested the Commission re-affirm its policy with regard to videotaping of its meetings and direct said policy be implemented in the manner thought most appropriate by the Town Manager. The Commission voiced unanimous approval to direct the Town Manager to implement their policy for this procedure. The Town Manager reported Gee & Jenson representatives will present their draft renderings regarding the evaluation of the Town Hall Administrative Complex to the Commission at the April Workshop Meeting. Town Manager Mariano reported on the 1994 Hurricane Conference, which included the FEMA Conference, Mayor Vorees, Chief Cecere and she attended and noted a draft document of hurricane preparedness procedures will be drafted for review by the Commission prior to printing a little 'booklet' for distribution to residents. n U Town Commission Workshop Meeting Minutes March 29, 1994 Page 6 of 6 Town Manager Mariano further reported she personally delivered the Town's Legislative Package to Members of the Palm Beach County Legislative Delegation in Tallahassee last week and noted it appears, from discussions of issues with legislators or their aides, we are in for some rough roads with regard to some of the major bills (i.e the presumptive disease bill which will wreck havoc with workmen's compensation and disability insurance). The Town Manager noted she will continue to update the Commission with regard to other bills of concern.
