1994.04.28_TC_Minutes_Special~P' ~ C~ TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission PUBLIC HEARING Thursday, April 28, 1994 5:01 p.m. Vice Mayor Bill Paul, in the absence of Mayor Arlin Voress, called to order the advertised Public Hearing of the Town Commission of the Town of Highland Beach, Florida, in the Commission Chambers at Town Hall at 5:01 p.m. Also in attendance were Commissioners Arthur Eypel, John F. Rand, and David Augenstein. Others present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, and members of the general public. Vice Mayor Paul noted this advertised Public Hearing was called for the purpose of obtaining citizens' input regarding the following • proposed ordinance: AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, REPEALING SECTION 6.4 (f) PERTAINING TO DISCONTINUANCE OF NONRESIDENTIAL NONCONFORMING USES AS CONTAINED IN CHAPTER 30 ENTITLED ZONING, OF THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH. The Vice Mayor stated the proposed ordinance received first reading by title only on 04/05 with the legal ad published on 04/15/94 in the Boca News. A Notice of Public Hearing of "Permitted Use Change and Change of Regulations affecting the Use of Land" was published in the Boca News on 04/08 and 04/22/94. It was noted the first public hearing regarding this ordinance was held on April 14, 1994, at 5:01 p.m. At this point, Vice Mayor Paul requested comments from the public. Mr. Jim Kelly of 2565 South Ocean Boulevard addressed the Town Commission to voice his objection to the proposed ordinance. During substantial discussion, the Town Attorney, noting all properties must be treated alike, stated this proposal will allow the nonresidential nonconforming properties to implement improve- ments--it will not allow such properties to expand. The Town Attorney advised the next step will be for the Town Commission to address this matter at the May 03, 1994, Regular Meeting where consideration will be given to adopt the proposed ordinance. 1 I"' , Town Commission Public Hearing Minutes April 28, 1994 Page 2 of 2 As there were no additional comments from the public, Vice Mayor Paul entertained a Motion to Adjourn.
