1994.05.03_TC_Minutes_Regular TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meetinq of Town .Commission REGULAR MEETING Tuesday, May 03, 1994 1:30 p.m. Vice Mayor Bill Paul, in the absence of Mayor Arlin Voress, called the Regular Meeting of the Town Commission of the Town of Highland Beach, Florida, to order at 1:30 p.m. in the Commission Chambers at Town Hall. Also in attendance were Commissioners Arthur Eypel, John F. Rand, and David Augenstein. Others present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, and members of the general public. CALL TO ORDER Following roll call, the Pledge of Allegiance was given. ADOPTION OF AGENDA ' The Agenda was adopted, as written, upon MOTION by COMMISSIONER EYPEL/COMMISSIONER AUGENSTEIN. APPROVAL OF MINUTES The following sets of Town Commission Meeting Minutes were submitted for consideration: March 29, 1994 - Workshop Meeting April 05, 1994 - Regular Meeting April 14, 1994 - Public Hearing The above Minutes received unanimous approval, as written, upon MOTION by COMMISSIONER RAND/COMMISSIONER AUGENSTEIN. PUBLIC COMMENTS AND REQUESTS No individual addressed the Town Commission under Public Comments and Requests. REPORTS - TOWN COMMISSION Vice Mayor Bill Paul Vice Mayor Bill Paul, under his report, noted the time change for mail pick-up from the U. S. Postal boxes at the Town Hall Complex; pick-up takes place at 10:30 a.m. and 3:30 p.m. i Town Commission Regular Meeting Minutes May 03, 1994 Page 2 of 4 Commissioner Arthur Eypel Commissioner Arthur Eypel, under his report, urged all residents interested in coastal construction affairs to attend the Palm Beach Countywide Beaches and Shores Council meeting on May 09, 1994, at 1:30 p.m. at the County Engineering Building, 160 Australian Avenue, West Palm Beach. The Commissioner noted Mr. Kirby Green of the Department of Environmental Protection will give an update of the status of the Coastal Construction Control Line; and, the Coastal Permitting Delegation to the County will be discussed. Commissioner John F. Rand Commissioner John F. Rand had no report at this time. Commissioner David Augenstein Commissioner David Augenstein reported he attended a gathering on May O1, 1994, at the Sieman Campus in Boca Raton where he, on behalf of the Town of Highland Beach, presented a Proclamation in support of Israel's independence. REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney, noting the proposed ordinance to repeal Section 6.4 (f) of Chapter 30, given first reading on 04/05/94 was published on 04/15/94 and was the subject of two 5:01 p.m. Public Hearings, advised said ordinance is scheduled for second reading by title only; if adopted, this section will be deleted from the Code of Ordinances. REPORTS - TOWN MANAGER Town Manager Mary Ann Mariano, under her report, noted Lanzo Liner is working in Town to reline part of our sewer system to repair the areas that are leaking. REPORTS - BOARDS AND COMMITTEES Vice Mayor Bill Paul, citing the scheduled meetings of the various Town Advisory Boards and Committees, noted a vacancy exists on the Community Appearance Board and two vacancies exist on the Financial Advisory Board. At this point, COMMISSIONER RAND proposed a MOTION to nominate • Miriam S. Zwick to a three year term on the Community Appearance Board. COMMISSIONER AUGENSTEIN SECONDED the MOTION which received unanimous approval. • Town Commission Regular Meeting Minutes May 03, 1994 Page 3 of 4 A MOTION by COMMISSIONER RAND/COMMISSIONER EYPEL to re-appoint Victor Hadeed to a three year term on the Financial Advisory Board was favorably received by the Commission. A MOTION by COMMISSIONER RAND/COMMISSIONER AUGENSTEIN nominating John DeMarco to a three year term on the Financial Advisory Board carried unanimously. PROPOSED ORDINANCES AND RESOLUTIONS 1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, REPEALING SECTION 6.4 (f) PERTAINING TO DISCONTINUANCE OF NONRESIDENTIAL NONCONFORMING USES AS CONTAINED IN CHAPTER 30, ENTITLED "ZONING," OF THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH. The proposed ordinance repealing Section 6.4 (f) of Chapter 30 of the Town of Highland Beach Code of Ordinances, as cited earlier this date under the Town Attorney's report, received second reading • by title only. COMMISSIONER AUGENSTEIN/COMMISSIONER RAND MOVED to adopt Ordinance No. 639. A roll call resulted in an "AYE" vote cast by Commissioners Eypel, Rand, Augenstein, and Vice Mayor Paul. REGULAR BUSINESS Items Left Over None Consent Agenda 1. Authorizing Attorney Sam Daniels to file Motion for Rehearing, Motion for Rehearing En Banc, and subsequent Writ Certiorari to the U. S. Supreme Court regarding the Resolution Trust Corporation issue. 2. Approval of $200.00 contribution to the Palm Beach County Municipal League regarding "Directions 94". 3. Approval of expenditure up to $7,500.00 for printing 5,000 copies of "Hurricane Preparedness" Booklets. Vice Mayor Bill Paul noted the Consent Agenda Items. COMMISSIONER AUGENSTEIN/COMMISSIONER RAND made a MOTION to adopt the three Consent Agenda Items noted by the Vice Mayor. A roll call resulted in "AYE" votes cast by Commissioners Eypel, Rand, Augenstein, and Vice Mayor Paul. } Town Commission Workshop Meeting Minutes April 26, 1994 Page 3 of 4 Commissioner John F. Rand Commissioner John F. Rand had no report at this time. Commissioner David Auqenstein Commissioner David Auqenstein reported the condemned building on the East side of A-1-A, across from Boca Highlands, has been demolished. The Commissioner, noting plans for 44 single family homes proposed for the 'Steinhart' property were submitted to the Building Department, stated building in Town is extremely active with the Grand Bay development and the Tuscan Harvey project commencing construction. The Commissioner commented he looks forward to the successful completion of these developments and the welcoming of new resi- dents to our Town. Mayor Arlin Voress Mayor Arlin Voress was absent - no report. REPORTS - TOWN ATTORNEY Town Attorney Thomas E. Sliney read a statement into the record, a copy of which is attached to and made a part of these minutes, with regard to the Resolution Trust Corporation litigation and noted, on the advice of the Appeals Attorneys, the Town and the Town's Officials will have no comments on this matter at this time. The Town Attorney reported, pursuant to a court order to have the vacant structure removed, the condemned building across from the Boca Highlands Complex has finally been demolished. REPORTS - TOWN MANAGER Town Manager Mary Ann Mariano, noting she has been in contact with Appeals Attorney Sam Daniels regarding the RTC issue, requested the Commission authorize Attorney Daniels to proceed with the Motion for Rehearing, the Motion for Rehearing En Banc, and the Writ of Certiorari to the U. S. Supreme Court. It was the consensus to place this matter on the May 03, 1994, Regular Meeting Consent Agenda. The Town Manager stated Mr. Bob McDonald of the Palm Beach Muni- cipal League is urging all communities to get involved in the "Directions 94" project which will examine critical issues throughout the County and develop plans to address such matters. • Town Commission Regular Meeting Minutes May 03, 1994 Page 4 of 4 ADJOURNMENT With all Agenda Items being addressed, Vice Mayor Paul entertained a MOTION to adjourn.
