Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesdav, June 28, 1994 1.30 p m
Mayor Arlin Voress called the Workshop Meeting of the Town Commis-
sion of the Town of Highland Beach, Florida, to order at 1:30 p.m.
in the Commission Chambers at Town Hall. Also in attendance were
Vice Mayor Bill Paul, Commissioners Arthur Eypel, John F. Rand, and
David Augenstein.
Others present were Attorney Cormac Conahan, Town Manager Mary Ann
Mariano, Town Clerk Anne M. Kowals, CMC, and Members of the general
public.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
At the Mayor's request, the Agenda was amended to include discus-
sion of 'Employment Agreement' for the Town Manager under her
report. The Agenda was unanimously approved as amended.
• At this time, Mayor Voress, extending a welcome to the new Delray
Beach Fire Chief, introduced Robert Rehr to the Town Commission,
the home viewing audience, and the residents attending this
meeting.
Fire Chief Rehr noted he is thrilled to be in Delray Beach and to
have the opportunity to serve the Town of Highland Beach. Noting
he has been in this profession for many years, Chief Rehr stated he
will continue with the quality of high-level service provided to
the Town by the City of Delray Beach Fire Department. It was noted
Chief Rehr and members of his staff attended the June 21, 1994,
Condo Managers' Meeting where they addressed issues raised by the
Managers.
94.1 PUBLIC COMMENTS AND REQUESTS
Mr. Jose Echeverria of Russell Drive, noting his wife DJ and he are
the holders of the permit for the Highland Beach Turtle Program,
gave a status report with regard to this year's nesting period
which resulted in 153 nests and 162 false crawls which represents
an approximate increase of 150 over last year. Mr. Echeverria
stated they are pleased with the program as well as the cooperation
regarding 'lights out' on the beach during the turtle nesting
season. Mr. Echeverria further noted the on-going beach clean-up
. program in Highland Beach is continuing very nicely.

93.8 DISCUSSION RE ADELPHIA CABLE
Attorney Cormac Conahan, in the absence of Town Attorney Thomas
Sliney, reported a conversation with Chuck Blaine approximately one
month ago regarding the submittal of a cable franchise renewal
proposal revealed confusion on Mr. Blaine's end as to which party
was to submit said proposal. When advised it was Adelphia's
responsibility to submit the proposal, Mr. Blaine indicated same
would be forthcoming. To date, no proposal or word from Adelphia
has been received.
Following brief discussion, it was the consensus to submit a letter
advising that, inasmuch as Adelphia has not been timely with their
response, the Town will be looking at other available options (i.e.
Leadership, Comcast, etc.).
94.2 BOARDS AND COMMITTEES
Mayor Voress, noting he spoke with members (V. Gordon and L. Bell)
whose terms on Advisory Boards will expire this month, advised said
members stated they would like to be considered for reappointment
to the respective Boards.
• At this point, Commissioner Rand stated a vacancy exists on the
Financial Advisory Board due to the absence of Frank Magarace from
three consecutive meetings. It was noted the Town Commission will
consider appointments at the July 05, 1994, Regular Meeting to fill
the three vacancies.
It was noted no correspondence was received from any Town Advisory
Boards and Committees.
94.3 PROPOSED ORDINANCES AND RESOLUTIONS
There were no proposed ordinances and resolutions on the Agenda for
discussion.
94.6 Discussion re request submitted by Attornev R. Eisen for
Developer H. Frank Lahage for release of Unity of Title
re Lot 129 East.
This matter was deferred to the July Workshop Meeting per Attorney
Robert Eisen's second request for postponement.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
. The Commission received and reviewed the 'Status of Building
Development in Town' a report submitted by the Building Department.

Minutes for approval at Julv 1994 Regular Meeting
Three sets of Town Commission Meeting Minutes (May 31, 1994, Arbor
Day Program, May 31, 1994, Workshop, and June 07, 1994) were
reviewed and moved to the July Regular Meeting Agenda for
consideration.
REPORTS - TOWN COMMISSION
Vice Mayor Bill Paul
Vice Mayor Bill Paul had no report at this time.
Commissioner Arthur Eypel
Commissioner Arthur Eypel complemented those responsible for the
preparation of the 'Pearls of Survival', the Hurricane Preparedness
Booklet, recently compiled and made available to Town residents.
Commissioner John F. Rand
Commissioner John F. Rand had no report today.

Commissioner David Augenstein had no report this date.
Mayor Arlin Voress
Mayor Voress reported the Town's water 'free chlorine' treatment
program has been completed; we have reverted back to our regular
chloroamines treatment process.
REPORTS - TOWN ATTORNEY
In the absence of Town Attorney Thomas E. Sliney, Attorney Cormac
Conahan had no report to present to the Commission at this time.
REPORTS - TOWN MANAGER
Agenda Report Form re Solid Waste Interlocal Agreement
The Commission received and reviewed the Town Manager's Agenda
Report Form regarding the Solid Waste Interlocal Agreement. Town
Manager Mariano noted the proposed Solid Waste Authority Interlocal
Agreement will incorporate the two existing agreements (Recycling
and Education Grant Program Agreement and the Municipal Recycling
Agreement), the Town had entered into with the Solid Waste
Authority some years ago. At the Town Manager's recommendation,
the Commission moved this matter to the July 05, 1994, Regular

Agenda Report Form re Proposed Amendments to Chapter 30
Section 5.
Following review of the Town Manager's Agenda Report Form regarding
walls inside private property lines, the Town Commission issued a
directive to have the Town Manager transmit this matter to the
Community Appearance Board for their review and subsequent recom-
mendations to the Town Commission.
Agenda Report Form re Proposed Amendments to Chapter 16,
Sections 4 and 36
Members reviewed the Town Manager's Agenda Report Form relating to
amendments of Chapter 16, Sections 4 (d) and 36 concerning the
parking of recreational vehicles at the municipal complex and pro-
hibiting the detaching and parking of any motor or auto trailer
within the corporate limits of Town and not only on 'public
streets'. Following brief discussion, it was the consensus to have
a proposed ordinance regarding this matter drafted for first read-
ing at the July 05, 1994, Regular Meeting.
Town Manager Mariano read into the record a memorandum regarding
the Florida Department of Transportation's publication entitled
"Corridor Designation Report" which reflects that State Road AlA
throughout Palm Beach County has been removed from a future
"Widening Hit List" by the State.
The Town Manager extended thanks to the Mayor, Chief Cecere, and
Condo Manager Jere Smingler who assisted her in preparing the
'Pearls of Survival' (Hurricane Preparedness) Booklet as well as
the Town Commission for funding this worthwhile endeavor. It was
noted copies of the booklet are being forwarded to coastal commu-
nities with an offer of assistance to help anyone wishing to
prepare and adapt such manual to their particular needs.
At this time, Commissioners reviewed the memorandum which included
the proposed "Employment Agreement" for the Town Manager. Said
Agreement reflected the amendments suggested by Commissioner Rand.
It was the consensus to prepare a Resolution adopting said
agreement for placement on the July Regular Meeting Consent Agenda
for consideration.
ADJOURNMENT
There being no further business to come before the Town Commission
at this time, upon unanimous approval of MOTION by COMMISSIONER
AUGENSTEIN/COMMISSIONER RAND, Mayor Voress adjourned the Workshop
Meeting at 2:10 p.m.
