Minutes of Meeting of Town Commission
WORKSHOP MEETING
Tuesday, July 26, 1994 1.30 p m
Vice Mayor Bill Paul, in the absence of Mayor Arlin Voress, called
the Workshop Meeting of the Town Commission of the Town of Highland
Beach, Florida, to order in the Commission Chambers at Town Hall at
1:30 p.m. Others present were Commissioners Arthur Eypel, John F.
Rand, and David Augenstein.
Also in attendance were Town Attorney Thomas E. Sliney, Town
Manager Mary Ann Mariano, Town Clerk Anne M. Kowals, CMC, and
members of the general public.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
The Agenda received unanimous approval as submitted.
94.1 PUBLIC COI~IENTS AND REQUESTS
Mr. Jose Echeverria of Russell Drive, noting his wife D.J. and he
• head the Highland Beach Turtle Program which consists of five
zones, stated there were 408 nests and 401 false crawls at the end
of June; this reflects a slight increase over last year's figures.
It was noted the ocean front residents and condo managers are co-
operating with regard to the light restrictions during the turtle
nesting season.
As to the on-going beach clean-up program in Town, Mr. Echeverria
stated they appreciate the people who are calling with regard to
beach clean-up duties as well as the many condo residents who are
walking with plastic bags to collect debris. It was noted the Town
looks after and, when necessary, empties the trash receptacles that
are in place on the beach.
When Mr. Echeverria noted there is some concern regarding the
Town's proposed budget, Vice Mayor Paul stated a Public Hearing for
the purpose of soliciting citizen's input in this matter is
scheduled for September 02, at 5:01 p.m. with a Special Meeting to
adopt the budget set for September 13, at 5:01 p.m. at Town Hall.
93.8 Discussion re Adelphia Cable
During discussion of this matter, Town Manager Mariano informed the
Commission that Attorney Cormac Conahan forwarded a letter stating
the Town is awaiting Adelphia's franchise proposal and it is the
Town's position that Adelphia is not protected under the Cable Act
. inasmuch as they did not respond to the Town in a timely manner.

94.2 BOARDS AND COMMITTEES
Vice Mayor Paul, noting there are no vacancies on any Town Advisory
Boards and Committees, acknowledged the presence in the audience of
Talent Bank Applicants Plous, Futernick, and Kane. Each Applicant,
during the Commission interview, presented a brief biography of his
education and business experience.
It was noted, in an attempt to contact Talent Bank Applicant
Bresnahan, the Town Clerk was informed said Applicant is a part-
time resident at the Seagate Condominium where he resides from
October to May/June.
94.3 PROPOSED ORDINANCES AND RESOLUTIONS
1. MENDING THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND
BEACH, FLORIDA, BY AMENDING CHAPTER 16 ENTITLED "MOTOR
VEHICLES AND TRAFFIC", SECTION 16-4 ENTITLED "RECREA-
TIONAL VEHICLE PARKING", SUBSECTION (d) BY THE REPEAL
THEREOF, AND SECTION 16-36 ENTITLED "DETACHING, PARKING
ON STREETS" BY AN AMENDMENT THERETO.
• The proposed ordinance received first reading on July 05, 1994, and
was published on July 18, 1994. Brief discussion ensued and it was
the consensus to move this matter to the August 02, 1994, Regular
Meeting Agenda for final reading and possible adoption.
94.6 Discussion re request submitted by Attornev R. Eisen for
Develover H. Frank Lahage for release of Unity of Title
re Lot 129 East
The above agenda item, upon third request from Attorney Eisen, was
postponed to the August Workshop Meeting of the Town Commission.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Buildinv Development in Town
The Commission reviewed the 'Status of Building Development in
Town', a report submitted by the Building Department.
Minutes for approval at August 1994 Regular Meeting
It was the consensus of the Town Commission to move the June 28,
1994, Workshop Meeting and July 05, 1994, Regular Meeting Minutes
to the August 02, 1994, Regular Meeting Agenda for consideration.

Commissioner Arthur Eypel had no report at this time.
Commissioner John F. Rand
Commissioner John F. Rand, noting the elected officials have com-
plied with the Town Attorney's request to refrain from commenting
on the Town's pending litigation, stated he cannot be silent with
regard to the Palm Beach Post's article on July 22, 1994, which
implies the Town's involvement in two lawsuits is the cause of a
tax increase in the proposed budget. Noting the intention of the
article was to discredit the Town Commission and its efforts to
appeal the 11th Circuit Court of Appeals decision regarding the RTC
litigation, Commissioner Rand questioned just how many residents
were contacted in the so called 'survey' conducted by the Palm
Beach Post for said article. Further noting the Town has held
numerous public hearings regarding this issue and has done its
utmost to acquaint the residents with this problem, the Commis-
sioner stated the elected officials owe it to the residents to
protect them, therefore, the Commission is fighting 'tooth and
nail' to have the injustice reversed.
Commissioner David Auaenstein
Commissioner David Augenstein, alluding to a previous report he
presented several months ago concerning the various technological
changes occurring within the cable television service field, noted
a new service "Primestar" (a type of mini satellite dish) is being
made available in Dade County. The Commissioner advised cost of
installation is $700 to $750 and a fee of one dollar per day is
applicable.

1. Discussion re Town's Wellfield/Environmental Sensitive
Lands (Nina Seibert, Property Specialist for the City of
Boca Raton)
Town Manager Mary Ann Mariano, under her report, acknowledging
Boca's Property Specialist Nina Seibert, noted Ms. Seibert is in
attendance to discuss Boca's original proposal of several months
ago to fence in, at their expense if the Town agrees to a 'First
Right of Refusal Option', our wellfield (which is part of Environ-
mental Sensitive Lands) located at the end of 70th Street in the
City of Boca Raton. Town Attorney Thomas E. Sliney noted he will
coordinate with Boca's Attorney to review and revise said proposal
and the 'First Right of Refusal Option' agreement. Following sub-
stantial deliberation, it was the consensus to place this matter on
the August Workshop Meeting Agenda for further clarification and
discussion.
The Town Manager, noting the Town is hosting the Palm Beach County
Municipal League Meeting on Wednesday, July 27, 1994, at 10:30 a.m.

the Commissioners to attend the luncheon (11:30 a.m./12:00 noon)
immediately following the meeting.
2. Submission of 1994/95 Fiscal Year Budget Packet
Town Manager Mariano, in briefly explaining her 1994/95 fiscal year
budget memo, noted that following the Financial Advisory Board's
budget review and transmittal of their recommendations to the Com-
mission, the budget packet is moved to the Town Commission. The
Commission schedules public hearings to solicit citizens' in-put
and makes amendments, if required, prior to adoption of the budget
which is set to take place on September 13, 1994, at 5:01 p.m. in
the Commission Chambers at Town Hall.
